Dear Merl:
As a follow-up to our conversation today, please let this
confirm that you have agreed to send five prints of the
following concerning the above applications pending with our
office for a proposed principal boat-storage building:
(a) Five prints of a survey or site plan maps showing
all buildings, including the proposed. {If possible,
it would be helpful to show the outside areas presently
used for boat storage that will remain. If no
outside storage of boats are shown, we will
assume that those boats will then be stored inside
and those areas will no longer be used for outside
boat storage. }
(b) Five prints of the elevation plan of the building
showing the total height, especially the distance from
ground level to the peak.
Also acknowledged is the fact that we have as of last
Thursday received the SEQRA coordination letter from the
Planning Board, as lead agency, and our Department would
coordinate comments (i€ any) within the next 25+- days.
As you know, the premises has been re-designated on the
newly adopted Master Plan Zoning Maps. As you are aware, when
the applications were filed with our office, the previous zoning
code regulations were applicable. Since all files must be
updated under the new zoning plan, the following provisions

(see Article XII, Section 100-121, which lists under
'Permitted Uses," Subparagraph ( 5) - "Boatyards for
building, storing. . . subject to site plan approval
from the Planning Board."
Please check one of the following two choices, sign and
return a copy of this letter as early as p ssible:

by our office staff in order to update the same and apply the
above-noted provisions of law for this proposed principal

In response to your May 17, 1989 Lead Agency coordination
request, the following comments are furnished for your
consideration:
1. This Board, by its letter dated September 26, 1988,
reiterates its position recommending that the Planning Board
take lead agency status (copy of letter attached citing reasons) ;
2. This Board, under SEQRA, has limited jurisdiction under
Section 617.13 for Type II Actions, however, wishes to provide
the following concerns and comments:
a. Stormwater runoff - a description and evaluation of
methods proposed for retaining all stormwater runoff, without
leakage or drainage into the waterways, should be filed for
consideration
b. Activities and uses - a description of activities to be
conducted relative to the proposed building should be described
in specific detail, and sufficiently evaluated to determine
possible effects on the environment, including coordination for
vehicles and pedestrians at the site.

c. Drainage basins - location should be shown, including
those inside of the proposed building, for evaluation of
suitability and types of activities demanding its necessity.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition,many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly,comprehensive in nature,yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.
DETERMINATION OF SIGNIFICANCE—Type 1 and Unlisted Actions

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT. FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition,many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly,comprehensive in nature,yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly,comprehensive in nature,yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

FULL ENVIRONMENTAL ASSESSMENT FORM
Puipose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition,many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly,comprehensive in nature,yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

Cappa and Ann Hocking, Main Road, Southold, New York, for a variance
to the Zoning Ordinance, Article VIII , Stction 100-81 and Bulk Parking
Schedule for permission to construct an addition to an existing building
with insufficient rear yard setback. Location of property: Old Main
Road, Southold, New York, bounded on the north by Old Main .Road; east
by Reiter; south by Budd's Pond; west by Port of Egypt Enterprises.
The Acting Chairman opened the hearing by reading the application
. for a variance to the Zoning Ordinance, legal notice of hearing, affi-
davit attesting to its publication .in the official newspapers, and dis-
approval from the Building Inspector. The Acting Chairman also read a
letter from the Town Clerk that notification by certified mail had been
made to: Joan Reiter and Port of Egypt Enterprises. Fee paid $15. 00.
MR. DOUGLASS : They have a sketch here for us of the existing
building and the . proposed addition, and we also have a section of the
County Tax Map . showing the surrounding neighborhood. If you look at it
it is deceiving. When we went out there it shows the proposed addition
would be about .equal in size to the existing building. This is misleadir
because where the proposed addition will go it will replace part of the
existing building there now. The part to be replaced is on a lower level
and floods now in a heavy rain. That part will be removed and rebuilt
at the same time the addition is erected. All they are requiring is
15 feet instead of an area the size of the existing building. Is therr

ANN HOCKING: No, I think the application states everything,

MR. DOUGLASS: Is there anyone present who wishes to speak against
this application?
HELEN REITER: I would like to speak, but not .really for or against
it. I just want to air a couple of points on this. On this property
there are two very active places of business plus a rental, and really
there is hardly enough parking for one business much less two. This
parking situation results in flooding over to our property for parking,
as well as disabled boats and things. It causes bad relationships
and expense for :us to remove. This is all I wanted to say.

MRS. REITER: We have already spoken on this.
.'.MR._:. DOUGLASS: ` Maybe you could control that. We measured the
area and the neighboring businesses are within 32 feet and less of
their bulkheads, their structures are. The proposal that she desires
would bring her only to 35 feet of the bulkhead and we would definitely
make that a restriction that she could not go closer than the 35 :feet.
There is certainly plenty of parking available if properly controlled.
MRS. HOCKING: I don't know of any of my customers parking there.
Helen, could it be from the Barge?
MRS.' REITER: No.
MR. TUTHILL: This is not going to effect the -parking.
MR. DOUGLASS: What she is actually asking for is a 15 foot
extension.
MRS. REITER: I have no objection to this, I just wanted to bring
out some problems and the number of buildings.
MR. DOUGLASS: This addition will not change the existing businesses.
It will be the same business, it is just going to improve the existing
building she has there. •Is there anyone else present who wishes to speak
on this application?
After investigation and inspection the Board finds that the
applicants wish to construct an addition to an existing business building.
Part of the present. building will be removed and rebuilt at the time the
addition is built. The other businesses along the water are all about
the same setback from the bulkhead. The Board agrees with the reasoning
�, of the applicant.

This is an amended application , modified from Appeal No . 3349
which was initially a request for six multiple dwellings with eight
units per building , total : 46 dwellings .units , filed on 4-18-85 .
At a Regular Meeting of the ZBA held on May 2 , 1985 , a Draft Environ-
mental Impact Statement was requested in accordance with a Positive
SEQRA Declaration . Also requested in the interim was that an
application be filed by the applicant with the N .Y . S . Department
of Environmental Conservation (Section 661 . 5 (b ) [46] and that their
reviews be coordinated accordingly . On May 21 , 1985 , Richard
Pellicane asked for an update concerning this .-proposed multiple-
dwelling complex , and a response was returned on May 22 , 1985
indicating the above . On 10-17-85 , the ZBA , ( Planning Board , et al . )
were served with a Summons and Complaint .

RESOLVED , that the application under Appeal No . 3542 as
Amended for CLIFFSIDE ASSOCIATES be dnd hereby is deemed incomplete
at this time pending receipt of the following : C

rip-rap along the water ' s edge at its closest point from the
outside containment wall , and 23 feet to the first fuel tank ,
as amended .
4. Article XI , Section 100-119. 2 (B ) of the Zoning Code
requires all buildings and structures located on lots adjacent
to tidal water bodies other than the Long Island Sound to be
set back not .less than seventy-five (75 ) feet from the ordinary
highwater mark of such tidal water ' body , or not less than
seventy-five (75 ) feet from the landward edge of the tidal
wetland , whichever is greater . Relocation and installation of
fuel tanks are required by Article 12 of the Suffolk County
Health Code , which limits the distances between the dispensing
pumps and fuel tanks , etc . , and must be installed in compliance
with the provisions of the National. Fire Protection Association
(NFPA) regulations and Tidal Wetlands Land Use Regulations ,
6 NYCRR.
5. It is noted for the record that actions have been
taken under Applications No . 3494 and 3495 by this board con-
cerning similar relief, as noted therein .
6 . It is the opinion of the board members that it would
be within the best interests and protection of the public ,
customers , employees , etc . , if the fuel - storage tanks were
located in area more distant than the area chosen , as further
noted below .
In considering this appeal , the board finds and deter-
mines that by locating the proposed fuel tanks with containment
enclosure and fencing at a distance , noted below : (a) the
variance will be the minimum necessary ; (b ) the circumstances
are unique ; (c ) the practical difficulties are sufficient to
warrant a granting of . this variance ; (d) there will be no sub-
stantial change in the character of the district ; (e ) the
relief as granted is not substantial ; ( f) the circumstances
are not shared by other properties generally existing in the
neighborhood ; (g ) that in view of the manner in which the
difficulty arose and in consideration of all the above factors ,
the interests of justice will best be served by allowing the
variance , as conditionally noted below .

prevent the orderly and reasonable use of adjacent properties or
of prperties in adjacent use districts ; (b) the use will not ad-
versely affect the safety , welfare , comfort , convenience or order
of the town ; (c ) the use is in harmony with and will promote the
general purposes and intent of zoning . The board has also
considered subsections [a] through [1 ] of Article XII , Section
100-121 (C) [2] of the Zoning Code .

of fuel in the "C-Light" Industrial Zoning Districts and subject to
site plan approval from the Southold Town Planning Board in accord-
ance with Article XIII of the Zoning Code . By action taken March 24 ,
1986 , the Southold Town Planning Board referred the site plan
to the Building Department for certification in accordance with
Section 100-133 (C) .
6 . It is noted for the record that simultaneously herewith
