Reinckens PROPERTY LOCATION: 955 & 1065 Hummel Avenue Southold,NY. .SCTM#'s=1000-63-2-25 & 26 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 17, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. i LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. i PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a two story single family dwelling with j accessory framed garage. It is located in the R-40 zone district and has 110.00 feet of frontage on Hummel Avenue, 200.00 feet along the western property line, 110.00 feet on the north property line and 200.00 feet on the eastern property line as shown on the survey dated June 22, 2005 prepared by John T.Metzger,LLS. ' BASIS OF APPLICATION: Request for Variances under Article IV Section 280-18 and the Building Inspector's j August 27, 2012 Notice of Disapproval based on an application for building permit for a subdivision, at: Proposed f Lot 1; 1) less than the code required minimum lot size of 40,000 sq. ft., 2) less than the code required lot width of 150 linear ft., and Proposed Lot 2; 1) at less than the code required minimum lot size of 40,000 sq. ft., 2) less than the code required lot width of 150 linear ft. RELIEF REQUESTED: The applicant proposes to subdivide their existing lot into the two original lots that were merged when purchased by the applicant in 1997. ADDITIONAL INFORMATION: The applicants had a prior application (#6573 dated August 7, 2012)before this Board requesting a waiver of lot merger that was denied. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: i � I Page 2 of 3—October 18,2012 ZBA File#6598-Reinckens CTM: 1000-63-2-25&26 i 1. Town Law&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although it is zoned R-40 under the Zoning Ordinance, all of the lots fronting on Hummel Avenue are undersized in this zone. Presently there are 16 lots from Youngs Avenue on the west to Boisseau Avenue on the east. Of these 16 lots, 7 have road frontage on Hummel Avenue of 60 feet or less making them the same size or smaller than the applicant's tax lot 25. Tax lot 25,which is the subject of this application, is vacant and contains an area of 12,000 sq. ft. This lot, as well as the applicant's home lot(tax lot 26), are comparable with the size of the majority of the lots in this neighborhood on the northerly side of Hummel Avenue.The southern side of Hummel Avenue consists of commercial properties. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The only alternative to an area variance to create the two j lots is a waiver of lot merger which was previously denied by this Board because the applicants do not meet the balancing criteria set forth in 280-11(B). 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial for proposed lot 25, representing 70% relief and proposed lot 26 represents 75% relief from the code for lot area. The request for lot width for proposed lot 25 represents 60% relief and proposed lot 26 represents 67% relief from the code for. lot width. However, these are described parcels which have been in existence since prior to zoning and conform substantially to the current neighborhood. Parcel 26 is the last unimproved lot on this block. i 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(30)(5). The difficulty has been self-created. The applicants purchased the properties with one deed in the same names. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a subdivision while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. I RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Dinizio, and duly carried,to GRANT, the variances as applied for, and shown on the survey dated June 22, 2005 prepared by John T. Metzger, LLS. C Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 5, 2012, at which time written and oral evidence were presented. Pursuant to §280-11(A) an applicant must provide documentation that the lot proposed to be recognized has not been transferred to an unrelated person since the time the merger was effected. The applicant submitted documentation that these lots were merged subsequent to the death of the prior owners. A title search, conducted by Chicago Title Insurance Services; LLC, indicates that both lots were owned by the same two related people (The Dickerson's and their heirs) at the time of the sale.
