There were present: Messrs: John Wickham..Chairman ;(present at 8: 00 P.M.) . Archibald Young,, Henry Moisa,, Alfred Grebet. William Unkelbach. Also present: Messrs: Otto Van Tuytt consultants Howard Terry, Building Inspector. PUBLIC HEARING: Notice is hereby given that pursuant to Article 16 of Town Law a public hearing will be held by the Planning Board of the Town of Southold. Suffolk County, New York., at the Southold Town Office., Main Road.. Southold. Archibald Young, Acting' Chairmans opened the hearing by reading the legal notice of hearings and the affidavits attesting to its publication in the' Long Island Traveler— Mattituck-Watchmans and the' Suffolk-Weekly Times. Copies of the amendment to the Rules and Regulations for the Subdivision of-Land were distributed at the hearing. All present were given an opportunity to look them over and ask any questions. ACTING CHAIRMAN: Is there anyone present who wishes to speak against this amendment? (There was no response.) ACTING(=CHAIRMAN: is there anyone present who wants to ask' any questions about the amendments? (There. was no response.) ACTING' CHAIRMAN: Is there anyone present who wishes to speak for these amendments? •(There was no response.) On motion by- Mr. Urikelbach,- seconded by Mr. Grebes it was RESOLVED that the hearing on the amendments to the Rules and Regulations for the Subdivision of Lands Town of Southolds be and hereby is closed. Esq. appeared before the Board in regard to the subdivision. to be known as "Salt Aire 'Estates":. located at Mattituckt owned and developed by Casbort Inc, Mr, Alden Young stated that- tY e;%±final `maps h`ave;;,;not yet been signed by the County HealthvDeparWitantt however there is .no problem with the Health -Department and,'Rthenaps will be -signed, WILLIAM WICKEIAMeESQ.: We 'talked to the County Clerk about putting on the map the lot number with possible dedication to the Town of Southold, and we got a negative answer on that. Would you want us to turn over the one lots to be held in escrow until such time as a decision is made about a park. and playground fund. - We can't turn it over by lot numbers but we can turn it over by description. THE CHAIRMAN: I don't want to say yes without talking to the .Town Attorneys As far ' as I can see it doesn't make any difference if the Town accepts cash or a l.bt. WILLI.AM WICKHAM-ZESQ.: We will go on record as being willing to do everything as you require. THE CHAIRMAN: I don't like the idea of this lot being a numbered lot.-,a negotiable lot. This is the same thing as cash. WILLIAM WICKHAM,.ESQ. : When we deed it to your we would deed it to be used for park purposes. THE CHAIRMAN: Eranklyt this problem has never been presented in this way. MR. 'UNKELBACH: I don't .see any reason why it can't.be done. WILLIAM WICKRAM.ESQ.: Do you want to hold both of the lots? THE CHAIIR[MAN: Not, one lot will be sufficient. Either lot number 31 or lot number 32.r both are next to the leaching basin. We would be willing to make any statement .or agreement you would want us. to make for the record. I THE- CHAIRMAN:' I see no reason not to handle it that way. j We would have until the hearing to check -. on this with the Town Attorney,, and' see what he says,0, I see no objection to itt but I want to clear it with him. MR. ARCHIBALD YOUNG: Wasn't Mr. Tasker looking into the possibility of getting some legislation through so that we might. be able to require cash. HOWARD TERRY: He is- waiting for a case to be settled on this. THE CHAIRMAN: I don't see any -reason why we can't, set this up for a hearing at our next meeting. There ds. no real problem with the Board of Health. ARCHIBALD YOUNG: It- seems to'.me that we should have some intention in writing from .the attorney of what- the setup is so that our records will be clear tight up to the time of calling the hearing. We should have some thing from the attorney to file with- our records. It' seems to me that we are- setting a precedent. WILLIAM.WICKHAMJ-PESQ.: I would be .glad to .supply3pu a letter of intent2. conveying over to you one of these lots, . . if it is determined that the Town won't accept cash. MR. Southo.;.d Town Planning. 'Board -6- April' 5,v, 1966 THE CHAIRMAN: Where does this Charles Gagen Road Extension go? HOWARD 2ERRY: They are going to connect this right th;Vough to Oaklawn' Avenue. THE CHAIRMAN: This road is called South Street on the map. WILLIAM SMITH: This road has never been dedicated but it goes right across to Custer Avenue, THE 'CHAIRMAN: Is this road 50 feet wide? WILLIAM SMITH: Yes. THE CHAIRMAN: I think that the record should show that the road -referred to in the letter of the Superintendent of Highways dated March 29,, 1966,E as 'Charles Gagen Road Extension is the same road named° South Street on, the map submittede and this will proceed across to oaklawn Avenue. The Board and those present concerning this subdivision discussed the city water situation as it 'regards this subdivision. This subdivision will not- have city water. The Board and those present also discussed the problem .of drainage in the subdivision. THE CHAIRMAN: The. only. thing to be settled before the- night of the hearing is the park and playground provision. I wish this court case would be settled so that welmow what we are doing. There are. 29 lots in , this. subdivision. The record should show that this "Fairview' Park" referred to .by the Superintendent of Highways in his letter of .approval of the highway layout is just :a temporaryidentification for this subdivision. WILLIAM"SMITH: Mr. Terry, went over this and we looked it up. Fairview" Park original owners were a corporation. . We would have to get permission, from,'Southold Development Corp. to call this Fairview Park., Section II. cA discussion was -- held on what name would be given 'to this subdivision.) UNKELBACH: Was the map that was filed,. filed as "Fairview% Parkr- Section I"? j `DANIEL SMITH: .No. I Mr. UNKELBACH: Then you couldn=t call this Section 'II. THE CHAIRMAN: The subdivision map shows,, a subdivision . plan for 'Daniel T., Smith.,_ George Herbert Smith and William .`B. Smith.. and -the date March 23-, 1966,. by Alden Young. The Only pr*bJem we have is the park and .playgro.und,. and I don=t know how to handle this. I wish we .could come to some sort of determination on park and playground provisions. . We dorintlmow what to do. Bob Tasker, the Town Attorneyr.. canit give us a determination. on what-we -should require and we feel we can't waive the provisions,,, which we have done on occassion in the past for small developments without waterfront. We can't in fairness to other developers with waterfront ask. 100 feet of the waterfront., then the next day allow ' some fellow without waterfront get by without any contribution to the Town park- and playground. . We just donzt know what to do. DANIEL -SMITH: Who- would maintain. this park and.pla ' round? THE CHAIRMAN: That would be dedicated to the Town. . This is in a sense .out of our hands. In some cases where there are several sections of a developement., we will not require 100 feet out of each section, - We will settle for 200 or 300 feet for four or five sections. . Then the -Town has .enough waterfrontage inone .place to do something with. What-we have just done with the last application we asked if they would be willing to give up one lot, adjacent to a leaching area. This will _be.::held in escrow untUl some. determination .is made about a park and playground fund. DANIEL SMITH: I- would say that we would alSk for some assurance from the- Town that they would take care of it and don=t let it grow up in a weed patch. I can .see their point with waterfront property. THE CHAIRMAN: It=s best to have it next to the drainage area which is already taken care of by the Town. ARCHIBALD YOUNG: This is a policy that has. been thought up and adopted amoung ourselves., and we want- to treat everyone the same. Southold Town Planning Board -8-- April 5.e 1966 I . THE CHAIRMAN: Well•r. we are not going to settle this tonight,, and I don't know how to settle it. ,ARCHIBALD YOUNG: I think that. all of these questions have got to .be straighten out as we go. along. If we adopt i a policy that is good for the Town,I all well and good. , We are going to -make some .mistakes. It's just .a thing of how long have we had subdivisions- here in- Southold Town, I am very much opposed -to cutting this land up into small parcels Ilike in Mineola.. They had lots 25z by 100 i. I would be. Very.,much opposed to any of this down here. I-have had the experience '- and that isnst good,.,planning. We got to' take the water and drainage,,, -and all of these things into consideration. THE CHAIRMAN: If you want to have a hearing.,,. and get this going•$ - you .can do what -Bill Wickham did in this other case. He will send us a letterof intent- and after the subdivision is filed .with the-,County- Clerk,, he will convey or dedicate .to the Town a lot which .if and when the court- case is settled might-be released-.so that the -Town can accept cash for a park and playground fund. . WILLIAM SMITH-. .Would it have to be on this property?' What about 'a .better area? THE CHAIRMAN: If you have a better - area,?. .I don:t see why the Board can't accept it, Another area that you have- developed. . We will waive the provision under the condition that you -agree to give a better parcel atlanother time. If you have some property that you will. develope at a future time we are interested. The Board briefly viewed and discussed this proposal. Mr. Alden Young stated that this was all very preliminary and may never become a reality. The Southold Town Planning Board received from the Southold Town Board the following -resolution: a..meeting of the Town Board of the Town of Southold,,. WHEREAS, this Board believes it in the public interest that the Building Zone' Ordinance of theTown of Southold be amended to provide requirements for the erection of shopping centers to provide that building permits be required for the erection or addition of all buildings and that a minimum lot' area be required for 'each family occupying a dwelling unit. NOWT THEREFORE, BE IT RESOLVED, that the Building Zone Ordinance of the Town of- Southold, Suffolk'County.. New York, be and the same hereby is amended as follows: I. ARTICLE IV B of said Ordinance is heregy amended by adding a new section thereto to be' Section 442s, to read as follows: SECTION. 442- Notwithstanding any other provisions of this Article, abuilding or a combinatinn of buildings containing retail stores.,, mercantile establishmentss offices.$, banks and financial institutionsz commonly known as shopping centersr may be erected or altered in the "B--2" Business Districts subject, howeverr to the following requirements: Southold Town' Planning Board -12- April 5t 1966 1. The lot' area shall be not less than one '(1) acres; 2. At least twenty--five (25%) per cent of the lot area shall be landscaped with grass and plantings. 3. The required. front yard shall be not less than twenty-- five (25) feet except that where the property in the vicinity' is partly built- up with permanent buildings and an average setback line has .been established, no buildings shall project beyond the .line of the average setback- so established. 4. The required .side yards shall be not less than twenty- five ,(25) feet. 5. The 3equired rear yard shall be not less than twenty- five (25) feet. 6. Parking shall be provided for one -(1) parking space, three hundred thirty-four' 'x334) square feet in areal. for each one hundred (1.00) square feet of sales floor '.area or office floor area in each building. 7. All rainfall and storm water accumulated on the premises shall be returned to the ground within the boundaries of the premises. II. ARTICLE VIIp' Section 703... •f ' said Ordinance is hereby amended to read as follows: SECTION 703 . -- No building shall be erected or, added to until a permit therefor has been issued by the Building Inspector. III. ARTICLE X of said Ordinance is hereby amended to by adding thereto a new section to be' Section 1008r.. to read as follows: SECTION 1008 - Notwithstanding any other provisions of this Ordinance=, no multiple dwelling shall be erectedt, altered . or used which does no provide a lot area of at least twelve thousand five hundred ,(12z,500) square feet for each family or dwelling unit. On motion by Mr. Moisat. . seconded by Mr. Grebe., it was RESOLVED that the` Southold Town Planning Board recommend to the Southold Town-Board the above proposed amendments. Southold Town PlanningBoard -13- April 5,; 1966 It is the, opinion of the Planning' Board that these amendments are in the best .interest of Southold Town. Vote of the Board: Ayes:- Mr. Wickham.- Mr, Moisa,?. Mr. Grebe., Mr. Youngs and Mr. Unkelbach. On motion by Mr.- Moisa., seconded by-Mr. Grebe.a, it was RESOLVED that the minutes of the' Southold Toww Planning Board dated March 1•,v,. 1966... be approved as submitted. On motion by-Mr. Moisa,, seconded by Mr. Grebe,,. it was RESOLVED; WHEREAS the` Southold Town Planning Board has petitioned to amend the Rules and Regulations for the Subdivision of Land,,, Town of Southold=, and WHEREAS a hearing was held on•.said amendmentb. at which time all interested persons was - given an opportunity to be heard; NOW THEREFORE BE IT 'RESOLVED that the' Southold TownPlanning Board adopt the following amendment- to. the- Rules and Regulations for. the' Subdivision of Landa, Town of Southold: 1. SECTION 5 "IMPROVEMENTS"r;- SUBSECTION 2z is hereby amended to read as follows: a SECTION 5z- SUBSECTION `2: All streets shall conform to the Highway' Specifications of the Town of- Southold. Vote of.-the Board: Ayes:--Mr.. Wickham_.- Mr.. Moisai Mr. Grebes, Mr. Young, and Mr. Unkelbach. A letter was written to Robert W. Taskere Town Attorneye. in regard to the Subdivision.= Cleaves Point,.- Section 111. The letter explained the actions of' the Board in-.regard to this subdivision. On motinn by Mr. Moisa.r .seconded by Mr. Young.. it was RESOLVED that the' Southold TownPlanning Board recommended, to tlie' Southold Town Board an estimated performance bond, of $19,,,000. 00 for the completion of the roads and watermains in the subdixzbion 'to be known as. "Willow- Point"r located at Southold.., and owned and developed .by Bleecker• Construction Company=. Inc. t Southold Town Planning Board -14- April 5r 1966 Vote of the Board: Ayes:- Mr. Wickham,, Mr, Moisat- Mr. Grebe.- Mr. Young.., and Mr. Unkelbach. On motion by Mr. Grebes seconded by'Mr. Moisa, it was RESOLVED that the' Southold Town Planning' Board recommend to the Southold Town Board an estimated .performance bond of $12.,000.00 for the completion of the roads in the subdivision to be developed and owned by Daniel T.
