Mr. Franklyn Bo= appeared in favor of the application., however. he had nothing further to say about it. THE-CHAIRMAN As far' as this particular letter from your attorneye .I would like to suggest that we hold this in abeyance. The Towd-Supervisor has told me- that the Town Board is thinking about c=.changing some of their requirements and it.may be that we would want- you to put this in for the Towne but maintain it yourself as a park and playground area. - Apparent7.y we are going, to have at least a couple of weeks before your bond is presented and before the subdivision map can-be filed. I am - reasonably sure that you can come to an agreement. MR. BORN: Then it would be up to a property owners association to keep this - up? THE CHAIRMAN: That is one way to handle it. In the meantime you could hold it until such time as the association was formed. I am rnly suggesting this. THE CHAIRMAN: For the record,- the name of this subdivision is .not • "Fairview Park.,.- Section II* as stated in the letter from -the highway'Superintendent. I believe this letter from the' Superintendent of Highways is meant to cover- the subdivision of Daniel T. ... George Herbert and William B. Smith. I also have a letter- here from the Superintendent- of Highways approving the layout of' Charles Gagen Road extension. This is shown on the subdivision map as ,-South -Street and Clearview Avenue. I would like to clear away the preliminarys. There has been some talk of park and playground .provisions. I would like -at this time tohold this for later this evening. So far as I can determine everything meets all the requirements for a subdivision. The following letter is hereby made part of the record: ?April 26,.. 19661., Mr. John Wickhamr; Chairman,- Southold Town' Planning Board,, Cutchogue,,.- Long Island, New York. "Dear'Mr.- Wickham: "Regarding the property owned by Daniel,. George and William'.Smith,. formerly the Breitstadt property--for which a public hearing -Is scheduled for May 3. 1966-- "This letter is written by* Lilliam M. Howell of Southold, owner of the meadow adjacent to the Smith .property and her nephews George Wells of Glen Head and South Harbors Southold-- "We suppose that the- meeting concerns the granting of the permit for the layout of roadsz. etc. for the development of the property into .building plots. The reason for, thi.s letter is to biing ,three things to the. attention to. the Planning Board. "THE RIGHT OF' WAY 1. The old legal right .of. way, from .the Pine Neck Road to the Howell Meadow runs along the west side of the old Breitstadt . property. This right of way has been overgrown but was used and kept .in order- by John Howell as long as he was able-- and by his father before him. It is. not 'marked on the survey map of the area made by V-an Tuyl and Son.r, dated December- 22., 1960. We do not know what the traditional width was of' such rights of ways, for access to meadow land. J Southold Town Planning 'Board -9- May 3r, 1966 1 "THE BOUNDRY "2. John Howell was certain that the edge of the woodland up to the' level land was also .part of .the Howell property--and' cut the trees there that had blown down in the hurricane. - We ; have not seen- a map to .show just where the present line has- been .set. . • The property is so old that there may be no accurate way of placing the boundary. "3. The Meadow- (Approximately 6 acres + or- - between the 'Dart and Smith properties--boardering Goose Greek on the East end extending 981 feet along the new Smith property.j "We have been interested -in ha-Vng the meadow become part of the permanent .public wild land belonging to Southold Town and its people and this is the thing we wish the planning board would give consideration to. "When Fair View Park was laid out, Mr. William Smith ' asked if Miss Howell would sell the Meadow so that. they could dredge a canal and sell 3water front* lots. The sand from the canal was to be used as fill either side of the canal and that would have. been the end of one more meadow and natural creek. Be-- lieving that the town should keep .some parts of our creeks in their -natural state Miss Howell did not :sell the meadow.- "At that time we made .a suggestion to' Mr. Smith that they lay out the road along the edge of the wood strip with building lots only on one side. Then the entire area would have access to the Meadow. This is the way the City of Minneapolis is laid out--Roads go around every lake in. the city but the lake side of every road is public and the other side of the roads private. This wonderful plan,,. of course.,. increased the property values in the entire region around every lake. It gives people room-without crowding them into 1.00 foot strips at the endscf roads. "If this could be done on.-the property. under consideration,v. Miss Howell would deed the entire Meadow to the Town and give up any claim to the right of way which gives access to the property. At same timer the gutter could be extended west in a natural way .so that it was a small extension of the creek thru a meadow--where the people could have access to the creek=, keep their rowboats ,stakeds. etc. Southold Town Planning Board - 30- May 3,,. 1966 "This is needed,, for with only 100z.r, just the people in Fairview alone would only have 22 feet each to keep a rowboat. . if the Smiths and the Town would consider this idea.t, the road which was originally laid out as a straight extension from Clearview Avenue to Fairview Park could curve in along the edge of the fringe of woods for' the length of the meadow which is nearly 1,c.000 feet. "Without changing the entire layout of the proposed develop- ment the extra land worth of such a road could be added to the plots on the .north side of the road making them larger and more valuable. "it is probably a ce?Ctainty that all the property in the area would become more valuable if this were done, although at the momentz it may seem like a financial loss to the Smiths., "If the planning board .and the Town thought the plan of owning the meadow with public access along its entire worth edge worthwhile and there was a blocade because of supposed financial loss to the developers=. Ij George J.- Wells,,, would be willing- 'to contribute up to $10,000. 00 to the Town to use as compensation to the owners of the property to make it all possible. I had arranged. -in my-will to give such a sum in trust for the Southold Park' District in memory of my father, with the .hope that it,would- be used to buy water front property but perhaps it would serve its purposed well if it is needed now.. "one- more thing -about the value of the lots along the meadow. Neither' Miss Howell nor ,' I,,, the heir to the property,,.' have any intention of selling the meadow so that it can be dredged, and filled and the plots becomezwater front= plots. "This winter the New York State' Conservation 'Department has said they are interested in the meadow for- the- Wetlands .. Wild Life Program so the property will probably. be transferred to the Stater if the town cannot see its way clear to making use of it., "Respectfully submitted_.. /s/ Lillian M. R.G. TERRY ESQ.: On behalf of the' Smith's I urge your' favorable consideration. It is_,my understanding that because of this matter you anticipate,�,A-,re.cess or holding this matter, in abeyance. I might just" say'"`fo'r the record there is same doubt in my mind as far as br`o09? f title s, or the location of the right of way or proof •of •right- of •way. It is a matter that can be worked out. MR. UNKELBACH: Has the right of way been in existence in recent years? R.G. TERRYoESQ.: I don't know. WILLIAM .SMITH: Ths=e is no right of way there as. such. .. We are- not contesting- ita we know that there is a right of way there. R.G. TERRY®ESQ:.: There may have been some sort of right of ways. we have m proof of any right of way granted in any deeds. The fact that we don't have proof doesn't mean that °the right of way doesn't exist. I -think that the question of the boundary l"ine -could be .settled by a boundary agreement. I_think it's .nice this talk about turning this land over, and' •becoming a public parks but I don't know whay they waited.until we made this application to do something .about it. We need public parks and this could be .benefi.cal to the developer. I don=t.- like to delay the application indefinitely. THE CHAIRMAN: At this time I think it would be well to recess this hearing. I have talked to the attorneys for both sides. and I have talked .to both the" ownerst Mr. Bill Smith.. and Mr. G. Wells. it is obvious that some of these things can't be straighted out tonight. I would like to if it is agreeable to recess this hearing -andtry to- work: some of these things "out. ARCHIBALD YOUNG: There hasn't been anything said about water. THE CHAIRMAN: .T%Ley• are not-have public water here. Southold Town Planning Board -12- May 3 . 1966 THE' CHAIRMAN: I,will at this time recess- this hearing for one month until the June meeting of the Planning Board. I would like to say in discussion that I have considered -myselfl some what of an authority. on meadow. I probably have more meadow property that anyone else in the -Town of' Southold. I feel that your deeds are extremely general and . in talking with the parties: from both,,side there is a boundary dispute that goes back about 70 years. If it .has been that- long,, .we are not going to settle it right here. Furthers,, because I think all the members of the Planning 'Board.have red this letter- I don't know if it states a copy -was sent- to the Supervisor who was very much interested and is coming, in latter this evening _ and the Town Board will have something to say about it. It still seems to me that with a little cooperation on both .sides there isn'-t any reason why it can't be settled before the- next- meetings, and. that is no great hardship to you. They are interested in having the-road skirt the meadow. How far it -skirts the meadow is the imps tant point. If you could drop a loop down thereto the meadow, - you wouldbave fairly -longer highway distance. You would have to loose another lot. , but if for that you- could get• the right of way distinguished and the boundary, line agreement., it might be worth it. You would have to make substantialN-changes on the map. ALDEN YOUNG: The only thing that would bother me.,.- you wait until June meeting. How' am I going to have something for the next meeting. This will have to go irit-6 July. THE CHAIRMAN: If ' they are going to give this property to the Town, it- isn't going to change the outline. The thing you would have to change is the highway layout. WILLIAM SMITH: I have a deed from 1866. The right of way will be in that deed if Howell had it recorded. - R. G. TERRYI ESQ.: There maybe a question of Mrs. Howell's competence to give or sign over this land to the Town of Southold. WILLIAM'SMITH: This. has been a whim- of-Mrs.. Howell's for several years to put a road along that meadow. I have said to here many J= times that, I am not -going to put a road along the water front. It doesn't- make sence to make changes in the road to comply with a whim of here. If we gave it to the Town and we get some sort of ' right of way to the meadow, that's okay with us. Planning Southold. Town/Board -13- May 32. 1966 THE CHAIRMAN: I want: to .say for: the-record .that.: I told Mr. Smith last-,night the Planning'Board has amended their.. Rules and Regulations. No permission for man made canals will be given .without the approval.. of. the Planning,Board. The' Planning Board is. going to be extremely careful how.. they grant such permits from now on. - Anything we have up to now we are- committed. to. These canals carry in too much salt water,, and the Town Boardis with us on this .. since the report of the Town' Engineer. WILLIAM SMITH: I. think that when you get into dis:cus.sion with Mrs. Howell,. what part: of the .property-, she is-turning over to the Town- will be on her terms. THE CHAIRMAN: We don z.t-know how much is- involved An transferring a right- of way. R.G:. TERRYoESQ.: All she would have to do is .sign over the right of way, but she may put all sorts of restrictions on. it. MR. UNKELBACH: How many.`people are involved in this right of way? R.G. TERRY,ES¢.: One as far as I know. THE_ CHAIRMAN: What is involved in relocating.. the lots? ALDEN 'YOUNG:_ It's a preliminary plan again. WILLIAM SMITH: I don't know what-the cost is to dater but. everything you. have .done to date is wasted. THE CHAIRMAN: I think you . could give up ,three- or, four of these lota and change the location of the road. SUPERVISOR ALBERTSON: I think if you .put a 50, foot. road._- ,. inthere you wonst have much-. meadow left. You would, have to put it on up land and take some of the' Smith property. THE CHAIRMAN: You could put the road in- front- of some of these lots. . My contention is what do you want: to do, and how do you,want to do it.. 4 M Southold Town Planning Board -14- May 3, 1966 WILLIAM SMITH: I will tell. you this, we are. not going to relinquish our. claim_to the wood land or.upiand. -(The Hearing was .recessed untilthe. June meeting of the Planning Board and negotiations will be made with all parties involved. ) Mr. George Axi;ene, and Mr. .and Mrs.• DeHaan appeared before the. Board to discuss their meadow property located. - in the Cedar Beach area which is full of -sewage.; -.Where the sewageis coming from, -or what is causing it, they. do not know. They also wanted to discuss with the Board the possibility. of putting in a fresh water pond. _ They presented to the Board a bag of sd.l which was affected by this sewage. The. Chairman advised Mr. & Mrs. DeHaan that they should contact the soil conservationist in Riverhead and ask them to look into the ,situation. - They will also be helpful in the- Planning of a fresh water pond. Mr. Rogers appeared before the Board with a"preliminary subdivision .plan of the Duvall Property, located in Ortnt. This subdivision would have some 110 lots,all . over one acre in size. The subdivision wouldhave its own water supply system. The preliminary plans also' shows..a- canal cut into the subdivision . from To", Brown's' Creek. No action was taken on this preliminary plan. The- Planning Board held a discussion with Supervisor .: Albertson.,: Councilman Valentine and Demarest, and Robert Tasker,, Town• Attorney. Increasing the size of lots was discussed. Mr. Tasker advised that in order to increase the size of lots 'for subdivision there would have to be a change in the- Zoning Ordinance. How to slow up subdivision applications and approvals was also discussed. - Some suggestions were to make the process of filing longer and more drawn out. The thought of requiring curbs and gutters was also discussed. - The' Supervisor advs-ied the Planning Board that the Town Board is not as intent on requiring read ends at the water as they use to be.
