There .were present: Messrs: John Wickham, Chairman; Henry Moisa, Alfred Grebe, William Unkelbach. PUBLIC HEARING: Upon the question of approval of the following plat: Plat of.property owned by South Forg Development- Corp. , entitled Corey Creep Estates, consisting of a parcel of land of 19.65 acres, situated at Southold, in the Town of Southold, Suffolk County, New York, and bounded and described as follows: BEGINNING at a monument on the southwesterly line of Main Bayview Road, 1090.46 feet southeasterly 'along said southwesterly line from Freeman' s Lane; from said point of beginning running along said southwesterly line of Main :Bayview Road, S. 500 59, 30" E.-662. 72 feet; thence along the several .lands of Conrad, Sundquist, Caplan, Johnson, Fitzpatrick, Caccavo, Burkhardt, O'Sullivan, Darnell, and Kdyer, four courses: (1) S. 80 05 ' 30" E.-17 0. 02 feet to a monument; thence (2) S. 6° 45' 40" E.-162. 95 feet; thence :(3) S. 80 29' 30" E.-195.32 feet to a monuments thence .(4) S. 80 37' 10" E.-708.36 feet to a monument; thence Southold Town Planning Board -2- November 15, 1966 along said land of Kolyer, two courses: (1) N. 800 19' 20" E.-161. 02 feet to a monument; thence (2) S. 100 32 ' 20" W.- 249.20 feet to Corey'Creek; thence westerly along said Corey : Creek about 200 feet w measured by a tie-line, N. 890 30' 30" W.- 182.77 feet; thence along a proposed dredged canal, two courses: (1X N. 610 001- W. 239.47 feet; thence (2) S. 81 27' W.- 215. 0 feet; thence along land of St. Patrick's R.C. Church, six courses: (1) N. 82 33' 00" W.- 990.0 feet to a monument; thence (2) N. 70 20' 40" W.-112.42 feet; thence (3) N. 70 30' 00" W.-305.01 feet; thence (4) N. 60 17' 40" W.-111.38 feet to a monument; thence (5) N. 110 10' 50" W.-152.13 feet to a monument; thence -(6) N. 19' 06' 40" E.- 127.21 feet to the point of the beginning. The Chairman .read the legal notice of hearing, and the affidavit attesting to its publication in the official newspaper of the Town. THE 'CHAIRMAN: I am going to open the hearing to those washing to be heard in opposition to this subdivision. (There was no response. ) THE' CHAIRMAN: Hearing no one speaking in opposition to this subdivision known as Corey Creek-Estates in Southold, I will call on those wishing to be heard in favor of this. KURT'HAMBSCH: We are in favor of it. THE CHAIRMAN: At this time we will go into some of the other discussion. KURT _HAMBSCH: We spoke to Laughing Waters association. There isn't any way* we can get together with them on the whole deal. I don't think the channel that we intend to dredge will connect with the basin they intend to dredge. MR. UNKELBACK: ilt won't bbck this entrance? KURT HAMBSCH: No. We are going to give the job to Mr. Latham. There was a lenghty discussion held on. the dredging of' the proposed canl. Also discussed was the feasibility of doing the dredging in conjunction with Laughing Waters Association. Mr. Hambsch stated that he understood. that- Laughing Waters Association had only so much money appropriated and they weren't sure exactly what they weve going to do. Howard Terry Southold Town- Planning Board -3. November 15, 1966 stated that Laughing Waters Association had not yet made an application to the Town Trustees for any dredging. There were some plans for abridge mentioned. The islands across the way from the proposed carpi were discussed. The chairman R a .sed. these would give alot of fill. Mr. Hambsch stated they had.,a surplus of land onthe waterfront. Most of- the waterfront lots have 350 feet in depth. The aesthetic value of the island was also discussed. The Chairman advised that the applican.th should make the canal wider than 50 feet. The Chairman stated that �it- wouldnl�t take long for the canal to fill in and the applicants would be left with a 10 foot channel. The Chairman suggested digging a 70 foot channel and this would probably last three times ax , long as a 50 foot channel. The Chairman read. the estimate for a performance bond submitted by Lawrence Tuthill. The cost of leaching basins was briefly discussed. THE' CHAIRMAN: If there is nothing further we will close the hearing at- this time. On motion by Mr. Unkelbach, seconded by Mr. Moisa, ,it was South Fork-Develo ment' Corp. RESOLVED: WHEREAS/GeLzey' GLaeek Estates, has petitioned the Southold Town Planning Board for final approval of their plat known as Corey`Creek' Estates, at- Southold, New York, and WHEREAS, The Superintendent of' Hghways of the Town of Southold has inspected the map and approves the highway layout of the roads to be constructed, and his report is hereby accepted by the Planning Board, and WHEREAS, the park and playground area requirement is waived in view of the fact the subdivider plant to dedicate' Corey Creek Lane to the Town of Southold, and that it has a 100 foot turnaround at Corey`Creek, and. also that immediately adjoining to it there is approximately one -half acre of land for park area for residents, and, WHEREAS the signing of the final maps by the Chairman of the Southold Town Planning Board is waived until such time as a performance bond is posted for the roads; and other improvements in the Subdivision, and siad bond is accepted the the Southold Town Board, Southold .Town Board of Appeals -4- November 15, 1966 NOW THEREFORE, BE IT- RESOLVED, that the subdivision to be known as--Corey Creek Estates, at' Southold, New York, consisting of 19. 65 acres, owned and developed by'South Fork' Developmentl Corp, be approved; and BE IT' FURTHER RESOLVED that the Chairman of the Southold Town Planning Board be authorized to sign the final subdivision maps when said bond has been ,hosted and accepted by the Southold Town Board. Vote of the .Board: .Ayes:- Mr. Wickham, Mr. Moira, Mr. Grebe, Mr. Unkelbach: On motion by Mr. Uneklbach, seconded by Mr. Moisa, it was RESDLVED that the Southold Town Planning Board recommend to the- Southold Town Board an estimated performance bond of $18,000. 00 for the completion of the roads and other improvements in the subdivision to be known as "Corey`Creek Estates", ' Southold, New York, owned and developed by South Fork-Development Corp. Vote of the Board: Ayes:- Mr.. Wickham, Mr. Moisa, Mr. CJebe, Mr. Unkelba ch. The Planning Board took- up, a discussion on the applica tion of Harold Reese, 855' Sunrise Highway,. Lynbrook, New York, relative to a change of zone from "A" Reddential and Agricultural District to "B"' Business" District on certain real property situated at Southold, in theTown of Southold, Suffolk County, New York-, bounded and described as follows: Beginning at a point -on the southerly line of the Main Road 145.82 feet-westerly along said southerly line from "Dolphin Drive", said point of beginninig -being the northwesterly corner ' of lot 14,. as shown on "Map of Southold Shores", filed in the Suffolk' County'Clerk's Office, as map #3853; from said point of 'beginning running along said lot 14, S. 13° 15' 00" E.-55.11 feet; thence along a proposed canal as shown on said map, two courses: (1) S. 76° 45" 00" W.- 40. 0 feet;-thence ;(2) S. 130 151 00" E.- 700 feet, more or less, to ordinary high water mark of peconic Bay; thence, westerly along said high water- mark. 250 feet, more or less, to land of Sledjeski; thence along said -land of Sledoeski, N. 13° 15 ' 00" W.- 630 feet more or, less, to said southerly line of the Main Road; thence along .said southerly line, (1) N. 69° 078 20" E.- 151. 91 feet; Southold Towm, Planning Board -5- November 15.s. 1966 thence ;(2) N. 5.1 C , 3,7' 2 0" E.- 154.Q1 feet- to the point of beginning. ;The Planning Board and Mr. Reese discussed the dredging of the proposed canal. Once again the' Chairman suggested digging a --;larger canal than proposed by Mr. Reese. Mr. Reese stated that-he planned to parallel the .boats along the canal. . The Chairman suggested digging a 70 foot canal. Mr. Reese felt that a 50 foot canal was sufficient for what he had in mind. Further discussion was held on the width and shape of the. proposed. canal. . Mr. Reese stated that he would very probably follow the Chairman=s suggestions.,,, however.,,. the canal plans were not for the immediate future and that' at the present time all he wanted was the change of zone. On motion by' Mr. Unkelbach.,r, seconded by Mr., Moisaaf it was RESOLVED that the Southold Town .Planning Board recommend favorably to the' Southold. Town Board the change of zone from "A" Residential and Agricultural District- to "B" Business District bn .the property described herein. .This change of zone would be an extension of the- existing business zone in the immediate area. Vote. of the Board: Ayes:- Mr. Wickham-l. Mr. Moisa . Mr. Grebe,,, Mr. Unkelbach. The Southold Town' Planning Board received .a letter-. from. the Southold Town Board of Town Trustees asking the Planning Boardzs advice and consideration on the application of Steve and-Daniel Mitacchione for dredging a canal leading to Broadwaters Cove. A copy of the application was attached to the letter. On motion by' Mr._ Moisar,, seconded, by Mr.'N= Grebe, it- was RESOLVED that the Planning Board does not approve the applicationW)of Steve and Daniel Mitacchione for dredging a canal leading to' Broadwaters Cove. This would bring salt- water into this area by deepening the natural drain. It will result in salt intrusion problems for the homes in the immediate vicinity. In adc�tions this proposed canal would make .it possible to sell nine lots of 12.s,500 square feet each. 'All of them on existing highways, and each one of them almost certain& water problems. "Dear Mr. .Wickham: "I hasten to reply to your letter of 21 October 1966 with respect to our prior communication of 15 August 19661, "Our records disclose that at- that time we wrote a letter to the Planning Board advising that our .client,, Mr. Daniel- S, Wood,,,, Jr.:, Immediately -theretofore contacted a Mrs.- Long., who is the: owner. of one of the residences on the westerly side of Maiden Laae. . and who was the reluctant owner with respect to the prospect of dedication to theTown for-widening Maiden Lane. "Our client advised us that- Mrs.- Long indicated her con- currence with respect to joining in such a dedication. 'Very truly yours.,,. s/s William I. Niles. " On motion by Mr. Moisa.,, seconded by mr. Unkelbach, it was RESOLVED that the Southold Town' Planning Board favorable recommend to the' Southold Town Board the change of, zone. from "A" Residential and Agricultural District to "B=2" Business District-on the above described property. The Planning Board has followed this application rather carefully. There is correspondence showing _that- Maiden Lane, can be widened to a 50 foot or 60 foot road and dedicated to the Town. In view of the fact there has been several attempts in the past to bring Maiden' Lane up to standard width,, we feel. that this package might be a real benefit- to the Town.
