A regular meeting of the Southold Town' Planning Board
was held at 7:30 P.M. ,. Tuesday..,, February 15,a, 1966.., at the
Town'Office.: Main Road, Southold,,. New York.
There were present: Messrs: John Wickham,: Chairman;
Henry Moisa.,a, Alfred Grebe.,,,- Archibald Young.
Absent: Mr. William Unkelbach. (sickness)
Also present: Messrs: Otto Van Tuy1.. Consultant;, Lawrence
Tuthill.. Professional Engineer; Howard Terry,, Building Inspector;
Raymond Dean.,.- Superintendent of Highways.
William Wickham,: Esq. and Franklyn Born appeared before
the Board to discuss the proposed subdivision to be known as
"Salt Aire Estates",. located at Mattituck... Town of Southold,..
- Suffolk- County, New York. This property is question is 26.223
acres and will contain 45 lots. This property is owned and
developed by' Casbor.. Inc.

WILLIAM"WICKHAMZ ESQ.: The last time we were here we
did .not show the right ,of way... it is now shown on the map.
. We have changed Wavecrest Lane to run all the way east and
west. There was a question of the turn-around. You said
it should be 100 feet. I think-Mr. Dean has consented to
have it that way.
MR. BORN: It will be paved all the way.- There will be
no problems. We will surface 50 feet by 100 feet.
Mr. Born stated that he. had been down to inspect the
property and there was no water accumulation from. the heavy
rainfall. The Chairman stated that if this subdivision met
with the approval of the Board.. they could give preliminary
approval and then work out the park and playground provisions.
The Chairman pointed out there was a plot 100 feet by 200
feet right next to the drainage area and inquired if this
was being saved for some special reason. Mr. Born advised
that said parcel was not being saved for any specific reason.
Mr. Young pointed out1hat steps should be taken to clarify
the status of the right of way leading to the Sound. William
,Wickhaml.. Esq. stated that all the lot owners will have a
right of way over this right of way. This will be stated in
the deeds to the lot owners.
Mr. Young stated that Mr. Uhkelbach had spoke with Mr.
McNulty and ,this property .in question is the only property
left of the McNulty farm. That is why the property is an
irregular shape.:, and why the right of way was included with
this property.
On motion by Mr. Moisar, seconded by Mr. Grebe... it was
RESOLVED that preliminary approval be given to the sub-
division to be known as "Salt Aire 'Estates"r located at
Mattituck.., consisting of a parcel of land 26.223 acres=. owned
and developed by'Casbor.r_ Inc.... map by'Alden,W. Young..,.. dated
February 71, 1966. This preliminary approval is granted
subject to an. agreement on the park and playground provisions.

go .back. on what is in the descriptions, but you cani't add to
it. Is that corrects. Howard?

THE CHAIRMAN: Wouldnst it be possible to give this
lot an" "A" number?
.MR.`' an TUYL: Th6 County Clerk requires, that the lots be
numbered consecutively with no "a" or' "b" numbers.
FRANK STURM: We can- leave it out and sell ,it- by description,
THE' CHAIRMAN: Can we ask you. twos., Mr. Van;..,Tuyl and Mr.. Edson:a.
to, get together and make a revised description.

THE' CHAIRMAN: There has been some discussion about .the road
at- the west end. At that point it is a difficult position if
anyone else wants to at some -future time try to connect to
it. I have talked to several people about .this:r. .including some
members .of the Town Board... and we are not-hap about it. I
don't know what the solution isr, but the . faci sou might destroy
value of .the property. The Planning Board has got to look
into the future. Somenne may want to connect tothis road and
we want to make it, not as easy as possiblea.]bt at least-possible
to connect,f and there is a real gully through there. It is
appropriate for the' Planning Board in a case like this. to require
this road to terminate at reasonable condition so that attachment
can be made without undo cost or problems.

STURM: Attachment can be made. {Mr. Sturm pointed
.to the map showing.'where- attachment to' Sound Drive could be
-made!. - As. I told you before,,. there are other plans that will
make possible access for down here now at the beach. Down
here 1,pointing to mapj there is no problem.
THE CHAIRMAN: It seems unnatural to run the road down
along the beach because this destroys the value. I am talking
about continiUng this road further west.
FRANK STURM: That is 'a natural curve right down. You
still have to. go down on' a hill basis.
RAYMOND' DEAN: Where will this road leads, nowhere?
THE CHAIRMAN: At the present time it-.leads .nowhere.
{A discussion was: held..on the grade of the road and fill
for the area by 'the. end of the road by- Inlet Pond, Mr.- Sturm
stated. that no plans for bulldoting were .shown on the map. The
Chairman. stated that the Board should ask :for a corrected profile
map. Mr. Van' Tuyji, stated that he could show an alteration on
the old profile maps, and have the revised:map filed.
THE CHAIRMAN: Now:;, the park and playground provisions have
been met for the subdivision.
The record shall show:.we are asking them to surface the whole
50 feet opposite lot 121. This will.be the whole 50 feet of
Sound Drive.
At this time is there anyone present who wishes to be
heard in opposition to this subdivision?
(There was no response.)
THE CHAIRMAN: Is there anyone present who wishes to be
heard. in favor of this subdivision?
LEFFERTS P. EDSON.,r ESQ.: We ask: for the approval of this
subdivision subject to the modificatione. amendment- of-the
profile map, and this including the 5.0 feet surfacing of the
road= and for 'the setting of the bond.
' It was stated that the estimate for'the bond would be
submitted as soon as Mr. Lawrence Tuthill- arrived.)

for' Mr.. .Tuthill.
'.THE, CHAIRMAN: If you prefer to waits, if there is no
objections I will recess the .hearing until Mr. Tuthill
arrives with the estimate for the performance bond, and we
will reconveine after the next case.
The' Planning Board received from the Town Board the
original petition of Frederick Rich,. Southoldr .New York
relative to an Open' Developement Area under the provisions
of Section 280 A of the Town` Law of the State of New York.
The Planning Board is instruc.te:d.to prepare an official
report .defining the conditions described in the petition
and determine the .area .so- affected .and make a recommendation
to the .Town Board.
..This- property in question is located west- of. the property
of- Southold Fire'District on. the• north side of the Main' Road
Southold., extending north to the` Long Island Railroad and east
to Boisseau-Avenue.i. approximately 6 acres. of land having the
metes -and- bounds set forth in survey map by Otto W.-Van Tuyl
& Son... which is attached to, application.
The. Chairman. read the application for the open development
area. He then inquired what the status was of the proposed new
amendments regarding apartment houses. Mr. Terry informed him
. that' no action had been taken on these proposed amendments.
WALTER KAPP,ES¢.: There are three units, one is still
under .construction. One of them has four units.e. two have
7 units each. They 'are smalls, frankly- they are quite- similar
to a motel on the outside. They are mostly occupied by one
individual. Has any one .on the Board -.been down• to see this?
I- think that you are familiar-with . it.i,. but- go down there and
look' at it. Just sitting down here and talking doesn't bring
out the true picture.
THE CHAIRMAN: I don't recall that we have ever approved
access. for 20 feet.. I would say that right now ,this is the
main problem.

WALTER KAPP.4ESQ.: Let me say this as far as your objection
is concerned.., there is 6 acres of land and 56 unitsz, if we
widen-the roads people are going to go. faster. Your state
law requires a. 20 foot- access. , We are going by the: State Law
and, .it _says in the law that. 20 feet-will be presumptive means ,
of access... or- words to that affect. There is a reason for
these things... this is not a subdivision_ or a development.
THE. CHAIRMAN: Everyone aluays .says . that- wider roads will '
make people go faster. . This is an old story. However,.. we are
also-'concerned with population density here. We have this new
. amendment which controls ,population density and we can rely on
that. ..
. . WALTER KAPP4ESQ.: This man has 56 units on 6 acres- of land.
What are7g oag
.n to do with motels? These units are on .the. same
.sdea except they are used all . year around.
THE, CHAIRMAN: I'll tell you what the difference is.. these
.buildings are j amed right in there. We 1iV.'e in the country..,
we have broad lawns. Accross the street from these buildings,
are. houses with broad lawns.., and here these buildings are
j amed in.
.WALTER?KAPP,zESQ.: What do you mean by j amed in ?
MR. YOUNG: They are jamed in with narrow roads. .. We have
so many narrow roads we can't do anything about. We won't be
called a very good Planning Board if we allow more narrow roads.
THE CHAIRMAN: The first thing we have to do is go over
our records and see if we have ever approved a 20 .foot access.
WALTER KAPP,6ESQ.: This is not a request for a filed map.
This . is a request for an, Open' Development Area..,. .there is a big
difference.
THE CHAIRMAN: Well... wevill go down and look at .this.
WALTER KAPP,ZESQ.:. I think that's one answer.

THE' CHAIRMAN: I think we will also have to go over our
records. .. We have-- a beautiful. village. There isn't anything
I can do about this, but there are some certain rules that
wet. the- Planning Board have to go by; is it .an' asset, does
it interfere with healthz safety and welfare of the Town?
Right- off' the bat, the thing that hits us is the 20 :;_foot
access. We want to look at this.
WALTER KAPP.OESQ.: Take a look at it an see what's there
and what is being done. I can't see any difference between
this"and a motel unit:
THE CHAIRMAN: Motels don=t= come to uscfor' 20 foot access.
I agree that there is a need for a thing like this, but we want
to look at it and we will report back to you.
,(The Board agreed to look the property and buildings in
question over and .give a report at their next- regular- meeting.
Mr., Kapp will be notified of the next-. regular meeting of the
Planning Board.)
THE CHAIRMAN: I :,:will reconviene the hearing on Eastern
Shores at Greenport.,,,- Section' IV, at this time. I will read
the estimate for the bond presented by our engineer.

Frank STURM: I mentioned to you last time that we have
given out the o Lei act for the water. HaLf of it has been
completed: the a f will be completed in the Spring.. I was
wondering if we could omit that from the bond since we already
have the contract for the. installation of the water.
(Mr. Sturm went,ion .tip explain that two hydrants have been
put in and the works:'°for:,-the--"other two have .been installed.
However, the actual hydrant will not be installed until the
population increases. The Chairman advised Mr. Strum that it
wouldba, better to post a bond for both the water and the roads.
Mr. Sturm agreed to do this.)
On motion by Mr. Grebe, seconded by'Mr. Young.. it was
RESOLVED that the 'Southold Town Planning Board recommend
to the Southold Town Board a performance bond of $18l000.00
for the completion of the roads and the watermains in the
subdivision "Eastern Shores at Greenport.- Section IV%, located
at Greenport. New York.., owned and developed by H.J.S. Land &
Developement- Corp.
Vote of the- Board: Ayes: - Mr. Wickham, Mr. M6isa,
Mr. Grebes and Mr. Young.
THE CHAIRMAN: Is there anything else to come :lffrefore this
hearing?
There was no response.)
THE CHAIRMAN: we are asking you for an amended profile map,
corrected legal description of the property,. and the bond will
have to be posted and approved.
If there is nothing further on this hearing on Eastern
Shores at Greenport, Section IV. I will declare the hearing
closed.
Mr. Bleeker appeared before the Board with a revised
preliminary map of a subdivision to be known as "willow Point"
located at Arshamomaque, Town of Southold, Suffolk County,
New York. The proposed subdivision will be approximately
21acres and will contain 31 lots. There is a proposed man-
made canal shown on the preliminary map. This proposed
canal will run in from Budd's Pond.

Mr. Bleeker pointed out that he had changed the location
of the 30 •foot right of way. shown on .the preliminary map.
MR. BLEEKER: I would like to "mention one thing 'in regard
to bringing this Town road all the way down to the -beach. The
people are not in favor of it at all. ' Wheir experience has
been that people come down, get on the beach and leave trash.
We were hoping that the Town wouldnst insist on running this
road all the way to the beach.
THE CHAIRMAN: I'll tell you what happens sometimes.., the Town
Board requires it often. The highway Superintendent can recommend
n against opening it up right to, the beach.

Mr. Bleeker stated that =:there presently was a building on
the property that would have to be removed or- added- to because
itzs not in keeping Ath what Mr. .Meeker intends to do with the
property. The' Chairman. inquired of Mr. Bleeker, whether he
anticipated any problems with the County. Board of Health on
elevation. Mr. Bleeker stated there appeared to be no problems.
He said he has talked to the Board of .Health.

RESOLVED that the Southold Town Planning Board. grant
preliminary approval to the subdivision to be .known" .as "Willow

Suffolkz, New York;.- containing 31 acres.. owned .and developed by
Bleeker ,Construction- Companyt. Inc.,, map by'Alden, W. Young,,,.
February 10.,E 1966. This preliminary approval shall include
approval of the -location and construction of the proposed canal
shown cn- said map.

R. Terry..- Jr. s.- Esq. appeared before the Board in regard to
a preliminary map of a subdivision to -be known as "Fairview Park?-
Section II"a- owned and developed by"Daniel- T. Smith.- George H.
Smith.z. and William B.- Smith. The total acreage of this parcel
is 19.4 acres and it will contain 31 .lots. There was no profile
map submitted with the preliminary map,,, and the preliminary map
did not show anything in regard to drainage. - It was felt that
the contour ,of the land is such that it could drain. naturally.

The Chairman stated that preliminary approval could be
given to this subdivision subject to working out the park and
playgpund area provisions and possible drainage easements. The
Chairman' also stated-that the Town Attorney was presently
-looking into, the pos`sibfLity of having a park and playground .fund.
R.. Terry Esq. felt that .the. location of this subdivision near
the .high'. school where there are recreational facilities'-would
prehaps be sufficient so. that' a park' and playground area would
:not be. required in this subdivision. However.. the Chairman
advised that all subdividers must be treated equally.. and they
must all .fullfIll the necessary requirements.
.On. motion by`Mr. Moisa. seconded by. Mr. Young.. it, was
RESOLVED that the Southold Town -Planning Board grant
preliniinary' approval on the subdivision to be known as "Fairview
Parka:- Section ZI" �. located at Southold .in the Town of Southold=
Suffolk County.. New. York.... containing 19.4 acres,z owned and
developed.by'' Daniel T. Smith,#, George 'Z. Smithr, and William B.
Smith... map by'Alden W. Young. dated January 14.- - 1966. This
preliminary approval is. .subject to profile maps being submitted
tothe Planning Boardt possible provisions for drainages and
possible provisions for: the park and playground area. requirements.

RESOLVED that the-minutes on the joint meeting between
Southold Town Planning' Board and the Riverhead 'Town Planning
Board dated January. 27,r -1966r .be approved as submitted.

The, Chairman read the following resolution duly-adopted
by the Riverhead Town.' Planning Board:
"WHEREAS? the Planning Boards of the Town of Southold and
of the Town of' Riverhead did .meet on November 23,,r 1965r at the
Town Hall in' Southoldt New York., and discussed the inadequacies
of- the present highways. as to width and aligment to care for the
existing traffic between Mattituck- and Riverhead and that cer-
tainly would not be adquate for any increase which 'is expected
with the growth of these two towns and further 'discussed ,the
approving of realty subdivisions which might lie in the route
of any-new highways and came to the conclusion that the Planning
Boards .should be aware of proposed routes of highways so that
in'- approving a- realty subdivision land might be reserved for
them.c.r. and
"WHEREAS.= the members of the Planning' Boards of the Town
of Southold and Riverhead at this meeting agreed to request
representatives of the New York State Department of' Public, Works
and the Suffolk County Department of Public'Works to meet jointly
with the Planning- Boards of the Towns of Southold and -Riverhead
to effectuate the ideas set forthr, and
"WHEREASr the representatives of the New York State' Department
of' Public,Works and the Suffolk' County Department of Public -Works
did meet on January 27r 1966,,; with these Boards and the Supervisors
of the- Towns of Southold -and Riverhead,, and
"WHEREAS: The representatives of the Suffolk" County' Department
of Public` Works XMCUPM dial present the proposed route of.-County
Road No. 105- which would start at the' Quogue Road, State Highway
Route 113r about one half mile southerly of Ludlam Avenues. and
.run northerly to' State Highway Route No. 25r at a location
approximately one half mile easterly of the easterly terminus
of Coutny Road No. 58r and this County Road No. 105 would continue
northerly to the' Long Island Lighting Company high tension liner
and then run easterly generally adjacent to the Long island
Lighting Company high. tension liner terminating at County Road
No. 27 at Mattituck in the Town of Southoldr andr

"WHEREAS, those present did„concur in, the, route of this
proposed County Road No. .105 and recognized that it would relieve
congestion in the Town of Riverhead for persons traveling between
the .north and south forks, of the island and would provide another
needed highway between' Mattituck and Riverhead= and
1111 EREAS.,r, the representatives of the New York ,State department
of Public' Works did state that the terminus of the Long Island
Expressway would be at Old Country"Roads County Route No. 58, at
a point of approximately one half mile easterly- of the junction
of State Highway Route No. 25 and County 'Road No. 58 and further
that consideration was being given to the widening of County Road
No. 58 from-the terminus of the Long Island Expressway easterly
to the terminus of County Road No. 58, and
"WHEREAS= those present did point out that in recent months
additional utility lines have been installed in County 'Road No. 58
and. many buildings have been erected and building permits have
been obtained. for new buildings which. new: construction did make
it more difficult and expensive to widen County Road No. 58s, and
did point out that the terminus of the Long Island .Expressway
would syphon off traffic only on, State Highway Route No. 25 and
County'Road No. 58, and
"WHEREAS,,, it was pointed out that if the Long Island Express-
way were continured northeasterly- and eaderly to the proposed
highways.-- County Road No.. 105z where this highway turned easterly
at the Long Island Lighting Company high tension line that
traffic from the Long Island Expressway could be .syphoned off
at two other major county and town .highways, namely Roanoke Avenue
and Northville Turnpike., and the through traffic could continue
from this proposed terminus of the Long Island Expressway along
the proposed County'Road No. 105.
"NOWZ, THEREFORE,, BE IT RESOLVED that this Board does request
the New York State- Department of Public'Works to give due
consideration ' and do• all things- necessary to have the Long Is3mnd
Expressway. continued easterly: to the proposed County Road No. 105
and that the route of- the, Long Island Expressway be northerly
and approximately parallel to' County Road No. 58t, and

"BE. .IT FURTHER RESOLVED that a copy of this resolution
be . forward to Mr.. Austin Sarr.. District' Engineer.t New York State

RESOLVED that the Southold Town' Planning Board approves .
of the- above rEm)lution duly adopted by the Riverhead Town' Planning
Board.. and
It is further RESOLVED that the Southold Town' Planning
Board adopt a resolution similar to the resolution- of the .
Riverhead Town Planning Board .

Lawrence Tuthill presented a revised estimate for the
roads and watermains to be .completed in .the . s.ubdivision to
be known as "Fordham -Acres,r-. Section II".
On: motion by' Mr. Moisar- seconded by-Mr. Grebe,, it was
RESOLVED that the. Southold Town Planning Board recommend
to the.-Southold Town Board a revised estimated.perforna nce bond
of $2,400.00 for the completion of the roads and the water' mains
in the subdivision to be known-as "FOrdham Acres... Section II,r"
located: at Greenportr in the Town of Southold:- Suffolk- County]
New. York, owned and developed by Ruth Preston and Others.

- The Southold Town ' Planning Board viewed and discussed the
map of the proposed annexation of the Village of Greenportr map
by" Otto Van Tuyl and Sonrdated October 27.,E 1965. The Greenport
Village Planning Board was invited to this meeting to discuss
this proposed annexation,, however,, they did .not attend. The ,
Chairman felt - that in view of the fact that the Village of
Greenport owned all the property to be annexed that this proposal

should be favorably recommended. Howevers he felt that the
property lines should be straightened out and the annexed
property should run all the may to the North Road and Chapel
Lane. Mr. Young felt that they should not take any definite
action on this .matter until they have had a chance to discuss
it with the Greenport Village Planning'Board, Mr. Young also
felt that a letter should be written to the Southold Town
Board stating that no definite action was taken on this matter
in view of the fact that Greenport -V;lllage Planning 'Board did'
not attend the meeting. it was agreed by all that no action
would be taken on the proposed annexation to the Village of
Greenport. It was further agreed that Greenport-Village Planning
Board be invited to attend the next meeting of' the- Southold Town
Planning Board so that this matter may be discussed.
The Planning Board again took up the matter of "Eastern
Shores at Greenports Section IV".
On motion by Mr. Moisa: seconded by Mr. Youngs it was
RESOLVED: WHEREAS H.J.S. Land & Development Corp. .has
petitioned the Southold Town' Planning Board for final approval
of their plat known as "Eastern Shores at Greenport , Section IV"e.
at Greenports New Yorke and;
WHEREAS the Superintendent of Highways of the- Town of
Southold has inspected themap and approves the highway layout
of the roads to be constructedi and his report is hereby accepted
by the Planning Board, and;
WHEREAS the Park and Playground area requirements have been
met for this subdivision, and;
WHEREAS the signing of the final maps by the Chairman of
the Southold Town' Planning Board is waived until such time as.
a performance bond is posted for the raods and the watermains
and all other improvements in the subdivision: and said bond
is accepted by the Southold Town Boards
NOW THEREFORE BE IT RESOLVED that- the subdivision to be
known as Eastern Shores at Greenport,, Section IV,. at Greenportz
New York, consisting of a .parcel of land 12 acres more or less:,
owned and developed by HeJ..S. Land and Development' Corp., be
and hereby is approved,, subject to the Board receiving an
amended profile maps and a corrected legal description of the
property.

It .was agreed that the' Chairman of the Southold Town Planning
Board be authorized to sign the final subdivision maps on
"Eastern, Shores-:.at Greenportt- Section W",,"Cleaves Point,. Section III"t.
and"Fordham Acresa.- Section II",r, after the develope3S of the above
mentioned subdivisions have posted the necessary performance bonds,
and said bonds are accepted by the Southold Town Board.
A 1eter was received from 'George J. Garbe in regard to
the -roads in. "Cleaves Point,, Section I". - Said letter was
acknowledgedand placed. on file.
A letter was received from'Louis K. McClean, P.E. in regard
to regulations foreman mande canals in the Town of Brookhaven.
Said letter was acknowledgedand p&aced on file.
