January 16, 1968
A regular meeting of the' Southold Town Planning Board
was held at.'7:30 P.M. , Tuesday, January 16, 1968, at the Town
Office, Main Road, Southold, New York.
There were present: Messrs: Herny Moisa, Vice"Chairman;
William Unkelbach, Frank' Coyle, Alfred Grebe; John .Wickham,
Chairman.
Also present: Howard Terry, Building Inspector;' Otto
Van Tuyl, Consultant.
Mr. Robert McCarthy appeared before the Planning Board with
a map of land surveyed for' Robert' J. & Mona R. McCarthy for property '
at Bayview. The property in question is located west side North
Road to Bayview and south side North Bayview Road. Mr. McCarthy
has divided this property into four lots and seeks the' Planning
Board' s approval of the layout. - All lots have frontage on
existing highways.

On motion by Mr. Grebe, seconded by Mr. Coyle, it was
RESOLVED that the' Southold Town Planning Board grant approval
of the layout of the lots on. the map of land surveyed for' Robert
J and Mona R. McCarthy at Bayview, Southold, New York,map by
Otto W. Van' Tuyl &- Son, map dated September 16, 1959, copy of
said map being on file in the office ofthe Planning Board.
Vote of the Board: Ayes:- Mr. Moisa, Mr.- Coyle, Mr. Unkelbach, -
Mr. Grebe:
Mr.. Lee appeared before the Board with a layout of property
located north side' Laurel Lake. This property has unsuitable .
access to the -lots proposed by' Mr.- Lee. It- was felt this .la yout
should be .handled as a minor subdivision. The' Planning Board!
agreed, to hold this until later in the evening when John Wickham
would be present,. in view of the fact- he-had some conversation on
it and the Planning' Board would like to hear his views on the'
proposal.
The Planning Board took up the matter of Vista Bluff. Mr.
Moisa read the following letters from the town- Superintendent'
of Highways:
"January 16,- 1968, The Planning Board, Town of Southold,
Southold, New York,
"Gentlemen: In order for the Town of Southold to accept
Glen Court Road in Birch Hills, the grade will:. have to meet with
Glen 'Court Road in Vista Bluff.

"January 16., 1968, The' Planning Board, Town of= Southold,
Southold, New York.
"Gentlemen: -In order for the Town. of Southold to accept ,Glen

The following letter from the Southold Town Clerk was read:
"December. 15,. 1967, Mr. John Wickham, Chairman, Planning
Board, Cutchouge, New York.
. "Dear Mr. Wickham: At a meeting of the' Southold Town Board
held at the Office of' the' Supervisor, Lester Albertson, on Tuesday,
December 12, 1967, the following resolution was adopted by. the
Board:
"RESOLVED: That the Southold Town Board hereby accepts a
Bank' Deposit" Book of- Southold Savings Bank presented 'to Super-
visor' Lester M.- Albertson contia ning deposits of`#7,000. 00 as
recommended by the Southold Town; Planning Board for the completion
of roads anal other improvements in the subdivision known as
VISTA BLUFF, Cutchouge, N.Y. owned and develpped by Rene Gendron.

Mr. Gendron was present and requested this be set up for a
public hearing. He was advised that it: could be set for a hearing
at the next regular meeting -of the- Planning 'Board and the date would
be determined .later. in the evening.
Lefferts- P.- Edson, Esq. , and Henry Smith- appeared before
the Planning Board seeking preliminary appoval. o.f ' the- subdivisi.on
to be known as' Laughing, Water,. Section II, located at Southold,
New York. Mr.- Edson presented three copies of the plan. to the
' Planning Board, and stated that all the suggested changes had
been made. The question was raised about the status of fresh
water supply to this subdivision. . Mr. Edson stated he has worked
with -the' Suffolk County Health Department' on this and there is no
problem.with- the up land lots;. and the low land lots will be subject
to an agreement that they will not be conveyed until such. time as
public water has been brought into this subdivision. Mr. Edson
stated that- the health department is aware of the situation and
they would seek- their,written approval after the..
Planning Board has granted preliminary. It was pointed out that
the lYghway superintendent had not yet given written approval of
the layout of the roads. The question of park and playground
requirement was also raised and this will have to be discussed
fur ther .

Southold Town' Planning Board -4- January. 16, 1968
On motion by Mr. Coyle, seconded by' Mr. Grebe, it was
RESOLVED that- the Southold Town Planning Board grant
preliminary approval to the subdivision to be known as' Laughing
Water, Section -II, Southold, N.Y., owned and developed by'Henry
J.- Smith, Peconic, N.Y,-, map by Otto Van Tuyl &- Son, map dated
September 13, 1967; revised September 19, 1967.
*Vote of the Board: Ayes:- Mr. Moisa, Mr.. Coyle, Mr. Unkelbach
Mr. Grebe.
Lefferts` P. Edson, Esq. , appeared before the-, Planning Board
with preliminary plan ,of subdivision to be known as .Highwood,
located at Bayview, .Southold. This subdivision has '10 lots, all
20,666 square feet or more. Mr.. Edson stated he corresponded with -
Mr. Isserman, adjoining property owner, to discuss the possibility
of connecting the two property with a U-shape road; and that- Mr.
Isserman refused to join roads. The- Board -viewed the' Plan pre-
sented by Mr.- Edson and it was discussed.
On motion by'Mr. Unkelbach, seconded by Mr. Grebe, it was
RESOLVED that- the Southold Town Plannij Board grant
preliminary approval to the subdivision to be known as Highwood,
located at Bayview, .Southold, New York, owned by' Lefferts' P.
Edson, map by Otto -W.. Van Tuyl, and Son, map dated June 4, 1957,
and marked for preliminary plan of' subdivision March 10, .1966.
Vote of the Board: Ayes:- Mr. Moisa, Mr.- Coyle, Mr.
Unkelbach, Mr. Grebe.
Mr.: Donald Tuthill appeared before the'.]Planning Board to;
seek approval of the highway layout of the roads in his subdivision
to be known . as Yennecott' Park, Southold, New York. .The letter
from the- Superintendent- of Highway was - read approving the high-
way. layout of the roads. All the lots in this subdivision have
125 feet frontage, except for a few; and there are no lots
with less than 20,000 square feet. Most of the lots are 22,.000
square feet.

On motion by Mr. Grebe, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board grant approval
to the layout of the highways in the subditision to be known as
Yennecott- Park, located 'at Southold, owned by Donald E. Tuthill
and' Lorna E. Tuthill, map by Otto�.;W Van Tuyl &- Son, map dated
September 20, 196.7.
Vote of the Board: Ayes:- Mr. Moisa, Mr.- Coyle, Mr.
Unkelbach, Mr. Grebe, Mr. Wickham.
The Board took up the matter for Mr.• Lee's property located
at- Laurel Lake, Laurel,N.Y It- was again agreed this should be
handled as a minor subdivision. There is unsuitable access fo'r
this property. The -access should be increased to. a 50 foot road.
It was discussed making Mr. Jazombek.. give, more land to make a
suitable access or the' Planning Board can say there will be no
building permits issued to anyone who may buy that property in
the future wit1rout suitable access. It was agreed that- Mr.
Jazombek should be approached on the subject.
Mr.- Lee was advised that all lots would have to have 20,000
.square feet of area. Mr.- Lee presented a map showing a layout
of the property with increase lot sizes. The' Planning Board
agreed. to withold any action on this layout until the possibility
of increasing the width of the right of way has been explored.
The next regular meeting of the' Southold Town Planning
Board was. set for 7:30 PM. , .Thursday, February 1, 1968, at
the Town, Office, Main Road, Southold, New York.
The letter. to Lois Johnson Thorp, President, Gardners Bay
Company-was- read regarding a parcel of. land still in the name
of Gardners Bay"Company which was suppose to have been conveyed
to another party.
The following letter from' Lois Johnson Thorp was read:

"December 18, 1967
"Gentlemen: Replying to your letter of December 13, 1967
concerning. the parcel of land totbe- northwest of- the proposed '
development, still. owned by the Gardners Bay` Company,- wehave
an oral agreement with the owner of the adjacent land, Miss
Jean- Schnieder, for- the sale of said land to her. We have been
waiting for the final approval by the' Planning Board of our
application before consummating the sab.
-Trusting this meets with the' Planning Board's approval
and.-answers 3pur question.

On motion by Mr. Wickham,. seconded by Mr. Grebe, it was
RESOLVED that- the° Southold Town Planning Board grant
preliminary approval .to the subdivision to be known .as
Garters Bay' Estates, Section III, located at- East Marion,
owned by Gardners Bay'Company, Inc. , map by.'Otto W. Van
Tuyl & Son, map dated December 1, 1967.
It-was further RESOLVED that the applicant .be notified
that they should pay their required fee;. and geta-approval from
the' Suffolk" County Board of Health. When this is done, the
subdivision can' be, set- up for a hearing.
Vote of the Board: Ayes:- Mr. Moisa, Mr.- Coyle, Mr.
Unkelbach, Mr. Grebe, Mr. Wickham.
The Board took- up the matter of setting up Vista Bluff
for: a hearing. It was determined that the fee has not- been
paid and there was some question as to whether ornot the final :
maps- had been' signed by the' Department of Health.. It- was-
agreed that at the next regular meeting,, if all requirements
are met, this can be set- up for a hearing.
Southold' Town Planning Board -.7- January 16, 1968
The following letter- from- William B." May Company was
read:
"January 4, 1968
"Mr, Lester' Albertson, Supervisor, Township_ of Southold, -
Southold, New York -11971
"Dear" Mr.- Albertson:
"Following up on our earlier conversta Lions, I am enclosing
a copy of the latest subdivision plan made up by Mr." Palmer of
.Norwich, Connecticut. As you can see, we have provided a, 50
foot= right" - of: - way to include land on either side of the
existing. 22 foot paved road. I also include a circular turn
around with a diameter of 100 feet., From this road and from this
turn around, each lot will have well over 100 feet of frontage.
Mr. Palmer can supply linens of this when required.
"I has been suggested that I engage Mr. Gada to move in with
. a bull dozer and clear the brush and debris out of this right- of '
way. I am, quite willing to do this if you consider it necessary
but in our last conversation, you suggested I riot do anything
without talking to you so I await your advice.
"Once again, I assure you that my wife and" I and Mr. .and
Mrs.- Conant- who are the only ones -interested in this project
at the moment will do nothing to in any way downgrade the property.
If you would .like me to go out to the meeting, I will" be most.
happy to do so. - Additionally, I would be pleased to meet with
you in' Southold prior to the meeting if you consic7der this
advantageous. In-fact, I wish to cooperate with you and the
' Planning'Board in every way' I can to create something which
will result in a- positive improvement- for the Town and for' Rishers
Island.

The Planning Board viewed the plan of the property and
discussed the layout. The following letter was written to
Mr. May:

Dear Mr.- May:
Your letter of January 4,. ..1968 to' Supervisor' Lester
Albertson has been referred to us for our consideration.
. The Planning Board will require you to file for ;h minor
subdivision. You. will find applications enclosed. You will
b9i-equired to remove the foundation, sidewalk, and curbing "
from Reservoir Road and replace with blacktop to a minimum of
the present paved portion of the highway, in view of the fact
that you own the road to Winthrop Drive. This will have -to be
made a. 50 foot highway back- to Winthrop Drive. In addition, we
would suggest- that instead- of the round turn-around, that the .
turnaround.be .made. square or rectangular.
The, Planning. Board took up the matter of Beebe Drive
Extension, East'. Cutchogue, New York. The Board.v.iewed the layout
of the lots involved along Beebe Drive- Extension. The, Planniu
agreed the applicant- should file for a subdivision on this
property. The possibility of a road next to Moeller's property
was discussed. It Was agreed the applicant be notified he
should apply, for a subdivision and that all the lots be made
at least 20,000 square feet to comply.-vdth the- Suffolk- County
Board of .Health regulations.
The Planning Board vidwed a plan of- property for' Peter J.
Warren, located south side Great' Peconic° Bay' Blvd. ,. Laurel.
The plan shows six lots, all under 20,000 square feet in area.
It was also pointed out all lots must have 100 foot frontage.
No action was taken on the matter.
The' Planriing' Board .r.eceived from the Town Board the
original petition of Bernard.Kaplan, relative to a change of
zone from "A" Residential and Agricultural District to "M" -
Multiple• Residence' District on certain- real property situated
at' East' Marion, with the instructions to prepare an official
report defining. the• conditions described therein. This property
is situated at Eakt- Marion, in the Town of Southold, County -
of' Suffolk. and State of- New York, and more particularly bounded
and described as follows:

A discussion was held on the proposed changer%of zone.
On motion by Mr. Wickham, seconded by Mr. Grebe,, it .was
RESOLVED that the- Southold Town' Planning Board does not
. . favorably recommend to the' Southold Town Board the change of
zone from % "' Residential and Agricultural-District to "M"
Multiple Residence' District on. the' above described property.
The, Planning' Board refused to recommed a change of zone on
this property twice before, .and the' Planning Board sees- no reason
that-would change our assessment of the affect such change would
have, on the area. It is the opinion of the Planning Board, that
any such. change would be detrimental to the area.
Vote of the Board: Ayes:- Mr. Moisa, Mr.- Coyle, Mr.
Uneklbach, Mr. Grebe, Mr.. Wickham.
The Planning Board received the following letter from
Lefferts P. Edson, Esq. ;
"December 27, 1967

"Re: Map of Peconic' Homes, Section 2
"Dear Mr. Wickham:
"We enclose herein a copy of an easement grant by Hehn
to Smith in the above matter, which is presently being- recorded
in the' Suffolk' County Clerk's Office.
"With this, we are now assured of our ability to re-grant,
this easement to the persons who have the right to use the right
of way through the Hehn property.
"When Mr. William-Wickham's' Office has supplied us with the
release from the users of that part of the right of way which will
be abandoned, we 'will' have the. identity of the parties to whom
Henry �T.- Smith and wife will grant this new easement.

On motion by'Mr. Grebe, seconded by Mr. Coale, it was
RESOLVED that the minutes of'the° Southold Town Planning
Board dated December 12-, 1967, be approved as sent out.

Unkelbach, Mr.- Grebe, Mr. Wickham.
On motion by Mr. Wickham, seconded by Mr. Grebe, it was
RESOLVED that discussion on a .local law creating the Board
of Waterways and Natural-Resources. providing for -the apointment
of members to serve on said Board and providing for the duties
of said Board, be tabled for consideration at' a joint meeting
with the' Southold Town Board.
Vote of the Board: Ayes:- Mr. Moisa,. Mr.. Coyle, Mr.
Unkelbach, Mr. Grebe, Mr. Wickham.

The' Planning Board received' the following letter from
Mary' M. Getoff:
Vaterview Drive, Southold, New York 11971, January 11, 1'968
"Mr. Wic kham, Southold Town' Planning Board, Southold, New York
"Ddar, Mr.. Wickham:
"I am' submitting the enclosed information for consideration
by the' Planning Board at their next meeting which I understand
will be on January 16.
"I am planning to. sell a lot 100 by 150. -feet out of a lot
measuring.' at- present 100 by` 200 ft, as shown on the enclosed
diagram� 2.
".The other sketch, Diagram 1, -shown our property, of about
7 acres, before the purchase of the 100 by 200 lot- on Waterview
Drive. - As you- can see from the diagrams, the lot- on Waterview
Drive adjoins the rest of the property.
. . "This lot- was originally purchased, about 8 years ago, to
give us access to Waterview Drive, in order to have a more level
driveway. - We are now planning to retain 50- feet for this purpose,
and to sell. the remianing 150 feet along Waterview Drive.
"We have no other purpose for- this -parcel of 100 by 50 that
we are keeping other than' as access to our property which -As
residential..
"T assume that this request for approval of the division '
of the above mentioned lot will be considered at the January 16th
meeting and that I will hear from you regarding it shortly there-
after. We are anxious to go ahead with selling this lot as
quickly as possible and will appreciate your cooperation in
handling this request' at. the next board meeting. Thank you.

Southold Town Planning Board -12- January 16, 1968
The Planning' Board viewed the sketches and discussed the
request. The Board disapproves the proposed- 50 foot strip
reserved between property of Wilkinson and the proposed-lot
to be sold. It was the opinion of the Board that the entrance
to the property should be at the westerly end of the .lot proposed
to be sold, from the existing "stub-end" of Waterview Drive where
it makes the right angle turn from east-west- to north-south.
.The Board approves of retaining 25. feet of the westerly end of
the proposed lot to be sold to be dedicated to the Town- for the
purpose of widening the existing "stub-end" of'waterfiew Drive.
The frontage of the lot to be sold must begin at- Wilkinson's
property line. It was agreed that a letter be written to Mrs.
Getoff advising her of the Board's opinions.
The meeting was adjourned at 10:30 P.M.-
