SOUTHOLD TOWN PLANNING BOARD
December 9, 1968
A regular meeting of the Southold Town Planning Board was held at
7:30 P.M. , December 9, 1968, at the Town Off ice, MainRoad, Southold, New
York.
There were present : Henry Moisa, Acting Chairman(Late) , William
Unkelbach, Alfred Grebe, Frank Coyle.
Absent: Mr. Jbhn Wickham, Chairman
PUBLIC HEARING: Upon the question of approval of .the f olbwing plat:
Plat of property .entitled Rosewood Estates, situated lying and being at
Mattituck, Town of Southold, Suffolk County, New York, bounded and described
as follows:
BEGINNING at a monument set at the intersection of the northerly line
of Bergen Avenue and the westerly line of Cox Neck Road and from said point
of beginning running thence along the northerly line of Bergen Avenue, S. 75°
36' 30" W. 440.55 feet to a monument and lands of Charles Murphy; formerly
of William Lindsay; running thence along said lands of Murphy the following
eight courses and distances: (1) N. 220 57' 30" .W. - 684.47 feet; (2) N. 23°
03' 40" W. 200.05 feet; (3) N. 18° 36' .30" W.- 100.15 feet; (4) N. 22°
28' 40" W.- 200.40 feet; (5) N. 19* 45' 20" W.- 100.06 feet; (6) N. 21 '
45' 40" W. - 99.79 feet (7) N. 20° 30' 20" w. 100.06 feet; and (8) N. 22°
17' 50" W. - 59.64 feet to a monument and lands of J. Sledjeski; running
thence along said lands of Sledjeski the following four courses and distances'.'
(1) N. 741D 42' 10" R. - 373.56 feet to a point; (2) S. 23° 23' 30" E.- 727.52
feet to a.monuement; (3) S. 23' 16' 30" E.- 179.70 feet to a monument; and

(4) S. 16° 16' 30tL E.- 142.30 feet to a monument and lands of Pause ti=yang;
running thence along said lands of Pausewang the following two courses
and distances; (1) S. 10°11" 20" E. 189.08 feet to a monument; and (2) S. 850
15' 00" E.- 206.55 feet to a monument set on the westerly line of Cox Neck
Road; running thence along the westerly line of Cox Neck Road, S. 20' 13t
30" W.- 28.28 fett to an angle point in said road; continuing thence along
the westerly line of Cox Neck Road, S. 41 56' 30" E.- 224.50 feet to the
monument set at the point or place of beginning.
MR. UNEELBACH: Is there anyone present who wishes to speak in favor
of this subdivision/
RICRU,D LARK, ESQ. : I don't have anything further to offer. Mr. Kart,
the surveyor has met all the requirements of the Board and the highway
department. The highway has been given tentative. approval, the Board of
Health has given their okay. We have complied with every-hing to date.
(A discussion was held on the amount of the performance bond. The
applicants felt that the bond could be reduced. The inttallati.on of
curbs was discussed. Bair. Larry Tuthill reproted the mcst the bond could
be reduced would be by about $2,000.00. It was agreed that the
Planning Board would recommend to the Town Board that the bond for
Rosewood Estates, be reset for $22,000.00. )
MR. UNICILBACH: It there anyone present who wishes to speak against
this subdivision?
(There was no response. )
MR. UNMLBACH: Hearing none, I will close the hearing at this time
and we will make our decision later this evening.
Dominic T. Aurichio, Esc. appeared before the Planning Board in
regard to a change of zone for Stephen J. Dororski, and Prances Doroski.
The Board and Mr. Aurichio discussed this application at some le nght.
The Board referred to their minutes of June 30, 1967, at which time
thej advised Mr. Doroski what type of business zone and how much of a
business zone they would be inclined to go along with. The property
involves] is located at Southold, in theTownof Southold, and more
particularly bounded and described as follows:
PARCEL I - Beginning at the intersection of the northwesterly line of
Middle Road (CR 27) as relocated with the southwesterly line of land of
MUdd, and southeasterly boundary line of land ofDoroskij from said point
of beginning running -southwesterly along said northweste ly line of M&Ule
Road (CR 27) as relocated, 4.00 feet; thence along land of Doroski three
courses: (1) Northwesterly parallel to said boundary line of land of
Mudd, 300 feet; thence (2) northeasterly parallel to said northwesterly
line of Middle Road (CR 27) , 400 feet, more or less to land of Mudd; thence
(3) southeasterly along said land of Mudd, 300 feet, more or less to the
point of beginning.

PARCEL II - Beginning at the intersection of the northwesterly line
of original Middle Road, with the southwesterly boundary of land of
Suffolk County and the southeasterly boundary of land of Doroski; from
said point of beginning running southwesterly along said northwesterly
line of original Middle Road, 400 feet; thence at right angle to last
described course northwesterly along other landaf Doroski, 315 feet, more
or less, to the southeasterly line of Middle Road (CR 27) as relocated;
thence northeasterly along said southeasterly line of Middle Road (CR 27)
as relocated 375 feet more or less, thence along the westerly side-of land
of Suffolk County, two courses, (1) easterly 27 feet, more or less, thence
(2) x southeasterly 283 feet more or less, to the point of beginning
excepting whatever part of the above described Parcel II which is already
inthe "B" zone.
On motion by Mr. Unkelbaach, seconded by Mr. Coyle, it was
RESOLVED the Southold Town Planning Board favorably recommend to
the Southold Town Board the change of zone from "A" Residential and
Agricultural District to "B" Business District on the property of-
Doroski as described above.
The Planning Board dexk= discussed this change of zone with Mr.
Doroski on June 30, 1967, and has record of this discussion in their
minutes. This changeof zone is requested in view of the relocating of
Middle Road.
Vote of the Board: Ayes:- Mr. Koisa, Mr. Unkelbach, IdIr. GrebeiR
Mr. Coyle.
Mr. Dennis Hurley appeared before the Planning Board in regard to
the subdivision to be known as Jacksons Landing, located on the easterly
side of Mill Road, at Mattituck, in the Town of Southold, County of Suffolk
add State of New York. Mr. Hurley stated that every-ling was in order for
a/public hearing. It was pointed out that curbing would be required.
The Board advised Mr. Hurley they would set the next regular meeting as
the date for a public hearing on this subdivision and he would be notified
of this date.

Messrs: Robert W. Gil lispie, Jr. , Robert Bergen, Fred H31sle, Jr. ,
and Charles Grigonis, Jr. , members of the Southold Town Board of Appeals
met with the Planning Board inregard to the Mattituck Shopping Center and,
their request for a reduction in thelandscaped area so that they could
have more parking. The Board of Appeals wanted the Planning Board views,",
on this before the heard the application. It was generally agreed that
it would be acceptable to reduce the landscape area and make more
parking area.

The Planning Board regeived from theTown Board the original petition
of LeRoy Brown for. a change of zone from "A" Residential and Agricultural
District to "B-2" Business district on the following described property:
All that certain real property situated at East Marion, Town of Southold,
County of Suffolk, and State of New York, bounded and deseribed as follows:
BIIGINNING at a monument on the northerly line of Main IState)Road, at the
intersection between thepremises herein described and land of Village of Green-
port, running thence along the northerly line of Main (State) Road the following
four courses and distances: (1) westerly along a cmrve bearing to the right,
having a radius of 1009.0 feet, a distance along said curveof 50.76 feet toa
point, thence (2) south 69 degrees 18 minutes 40 seconds west 164.00
feet to a pipe; (3) south 77 degrees 18 minutes 40 seconds west 164.00
feet to a pipe; (4) south 66 degrees 4$ minutes 40 seconds west 8.53 feet
to a pipe at the division line between the premises herein described and
land now or formerly of Floyd F. King; thence north 34 degrees 05 minutes
30 seconds west along the last mentioned land 193.16 feet to an iron bar
and the land now or formerly of Wayland C. Brown; thence north 60 degrees
O1 minutes 30 seconds east along the last mentioned land 286.44 feet to
a monument and land of the Village of Greenport first above mentioned; thence
south 33 degrees 17 minutes 00 seconds east along the last mentioned land
EK- 265.80 feet to the northerly line of Main (State) Road at the point or
place of beginning.
On motion by Mr. Coyle, secondedby Mr. Grebe, it was
RESOLVED tha t the Southold Town Planning Board recommend to the
Southold Town Board the change of zone from "A" Residentialand Agricultural
District to "B-217 Business district on the above described property.
The Planning Board points out that the property herein described has
been used for business for many years as a non-confiormmng use.
Vote of the Board: Ayes:- Mr. Moisa, Mr. Unkelbach, Mr. Moisa., Mr. Grebe.
The Planning Board received from the Town Board the original petition
of David Mudd, Middle Road, Southold, New York, for a change of zone from
"All Residential and Agricultural District to "Bf Business District oncertain
real property situatedat Southold, in the Town of Southold,County of Suffolk,
and State of New York, and more particularly bounded and described as
follows:
PARCEL I - Beginning at the intersection of the extension northwesterly
of thenortheasterly line of Ackerly Pong Lane with the southeasterly
line of Middle Road (CR27) as relocated; from said point of beginning running
northeasterly along said southeasterly line 334 feet, more or less, to lan
of Suffolk County; thence southeasterly along said land of Suff of k Coutny
185 feet, more or less, to the northwesterly line of Middle Road! thence
southwesterly along said northwesterly line, 285 feet, more or less,. to said
extension of Ackerly Pond Lane; thence along said extension three courses:
(1) westerly 39 feet, more or less, thence (2) northwesterly, 244 feet, more
or less, thence (3) northerly, 34 feet, more or less to the point of beginning.

PARCEL II - Beginning at the intersection of the northwesterly line of-
Middle Road (CR 27) as relocated, with the northeasterly boundarly &f land
of Doroski and the southwesterly boundary of land of Mudd; from said point
of beginning running northwesterly along said land of Doroski, 300 feet;
thence along said land of Mudd, two courses: (1) northeasterly parallel to
said northwesterly line of Middle Road, 400 feet, thence (2) southeasterly
parallel to said boundary line of Doroski, 300 feet to said northwesterly
line of Middle Roads thence southwesterly along said northwesterly line,
400 feet to the point of beginnig, excepting whateverpartof the above
described Parcel II which is already in the "B" zone.
On motion by Mr. Coyle, seconded by Mr. Grebe, it was R
RESOLVED that the Southold Town Planning Board recommend favorably
to the Southold Town Board the change of zone from "A" Residential and
Agricultural District. to "B" Business District on the property described
herein. The Board finds that this property is conducive to business to
conform with the dnaaracter of the adjoining property owned by Doroski.
Vote of the Board: Ayes :- Mr. Moisa, Mr. Unkelbach, Mr. Coyle, Mr. Grebe.

On motion by Mir.. Grebe, seconded by r. Moisa, it was

RESOLVED 'that the Southold Town Planning Board grant final approval
to the subdivision to be known as Rosewood Estates, subject to the
subdivider posting a bond and said bond being accepted by the Southold
Town Board.
Vote of the Board: Ayes:- Mr. Moisa, Mr. Unkelbach,. Mr. Grebe, Mr. Coyle.
The next regular meeting of the Southold Town Planning Board will
be held at 7:30 P.M., Rhxx Monday, January 13, 1969, at the Town Office,
Main Road, Southold, New York.
The meeting was adjourned at 10:30 P.M.
