SOUTHOLD TOWN 'PLANNING BOARD
June 9, 1964
A regular meeting of the Southold Town Planning Board was
held at 7:30:P.M. , Tuesday, June 9, 1964, at�..the Town Office,
Main Road, Southold, New York.
There were present: Messrs: John Wickham, - Chairman, Henry Moisa,
_ Alfred Grebe, . Archibald Young, and William Unkelbach.
Also present: Mr. Otto Van Tuyl, Consultant, and Mr. Howard
Terry, Building Inspector.
PUBLIC HEARING: On the question of approval of the following
plat: Plat of property owned by Christ Stratakis, entitled Sterling
Homes' at Greenport, consisting of a parcel of 'land of 5.738 acres,
situated at Greenport, in the Town of, Southold, . Suffolk County,
New York, and bounded and described as follows:
Beginning at the intersection of the easterly line of Beach
Road with the southerly line of Manhanset -Avenue; from said point
of beginning running along said southerly line of Manhanset Avenue,
. S. - 680 353 50" .E.-462.27 feet to a monument and land of Bumble;
thence along said land of Bumble and along the several lands of

LaVeglia, Renner, Case, Getches, . Capuano, Trillcott, &-Olsen,
S. 20 559 0011 'W.-638.54 feet to a monument on the northerly line
of said Beach. Road; thence along siad. northerly line of 'Beach Road
N. 830 15' 10" W.-26.35 feet; thence northwesterly along the
northeasterly line_ of said Beach Road on a curve to the right
having a radius of 386. 0 feet, . a distance of 533.25 feet; thence
along said easterly line of 'Beach Road, N.' 40 06' 00" W.-448.76
feet to the point of beginning.
The'.Chairman read the legal notice of 'hearing, and' the affidavit
attesting to its publication in the official -newspaper.
The Chairman stated that he had the final maps signed by
the Board of Health, and a letter of. appr-oval for the roads from
the- Superintendent -of Highways.
THE 'CHAIRMAN: ' Everything seems to be in -Order. Is there anyone
who would like to speak in opposition to this subdivision?
(There was no response. )%
THE 'CHAIRMAN: Hearing none, does anyone wish to speak in favor
of this subdivision, - Sterling Homes, in Greenport?
CHRIST 'STRATAKIS: We own the- property. - We have engaged Mr.
Van Tuyl°s 'services to draw. up the subdivision and we -required
the approval of the Board on the preliminary drawing by Mr. Van
Tuyl.
THE' CHAIRMAN: As I said everything seems to be in order. There
seems to be no problem. We will close the hearing,, than latter
this evening take action on it. As things seems to be in order
and there are none opposing it,,, I don'tt think it will be any problem.
one of the problems that has arisen.,t,. and -this goes for all- sub-
divisions.,, is some times the Planning Board has accepted the roads,
and highways but the Town has not when these subdivisions are. _
ready to dedicate to the Town. The Town has recently changed the
specifications for dedication and, it -now . takes a year'and a half
for 'approval., therefore, it is not possible oto dedicate now. Under
the circumstances.:: we have to require all bonds upon the completetion
of the highways.
CHRIST 'STRATAKIS: As Mr. Van Tuyl knowsz. we do have a contract
-with Latham-Sand and Gravel Company. We have spoke to Mr. Smith

and requested that he .undertake the running of the plumbing and
he :said he woul& be happy to do so. I think the only .problem
we may have would be the drainage of the roads.
THE CHAIRMAN: . The Town Attorney on this says once this map is
filed and registered with the County Clerk's `Office?. our hads are
tied. We are suppose to make all arrangements prior to the filing
of the map and again we have done this a few times ain the past.,
but .we haven't done it often enough. I do know that -the Town
Attorney says you -have to file a bond for this. Now just how
we sare going to work this out,. I don't know. We haven't done it
- often enough so that we can very well take a week or 10 days.
CHRIST STRATAKIS: Who does the work fob: the final.?
THE' CHAIRMAN: We have `our own engineer who does this work
for us.
CHRIST STRATAKIS: The signing of- the contract would be setting
the proformance bond
THE' CHAIRMAN: Inyq�r sew of the fact- we sign on this,, I feel
that from now on we have to approve this more carefully than we
have in the past. -We swill start immediately on this, assuming
that it- gets the approval of the Town Board. Is .there any reason
that you couldn't put up. a proformance bond?
CHRIST. STRATAKIS: No.
THE CHAIRMAN: We had hoped to profit by having all our high-
ways dedicated. . We will get the Town Board to look at -this on the
16th_, of June.
CHRIST STRATAKIS: We will have to set the amount. -of th.e
proformance bond?
THE CHAIRMAN: Yes.
. CHRIST STRATAKIS: Do we submit this tothe Town Board or to
the Planning Board?

THE CHAIRMAN: Highways are in contract having to comly to
laws set down by the 'State. The Town has to move in after the
proformance ,bond is forfeited.
CHRIST STRATAKIS: That is quite all right.
THE CHAIRMAN: . Is there anyone who would like to say anything
further in connection, with this subdivision?
(There was no response. )
THE CHAIRMAN: If 'there is northing else to be presented at this
hearing,, I will declare it -closed.
Lefferts 'P. Edson,, Esq. .. appeared before the Board with Mr.
Henry Smith to discuss proposed subdivision at Peconic,, New York,,.
entitled "Peconic' Shores". Mr. Nelson Axiens. an adjoining property
owner 'appeared to express his concern about his access. He now
has a right-of-way and wants to know if he will still -have access
to the public road after the subdivision is constructed. There
was some question about the :boundries and the location of the
proposed right-of-way. Mr. Wickham suggested that .Mr. Smith and
Mr. Axien confer together with their lawyers and decide on the
location ofthe right-of-way. Mr. Axien also wanted to know if
all the highways in the subdivision had to be dedicated, or if just
some of them could be dedicated. He was informed that if the. .
roads were dedicated tothe Town,, they would all be dedicated and
not just some of them.
Mr. Alfred Teeves appeared before the Board to discuss the
possibility of constructing a subdivision at Boisseau Avenue,,
Southold, New York. Mr. Wickham informed him it would -be better
'if 'he filed it in two sections. The Chairman also explained ,
to Mr. Teeves the problems with the highways .and the requirements
they must meet to be dedicated tothe Town. Mr. Teeves _said he
was going to keep all the trees offfthe front- of the property
and the wires off the roads for estatic reasons. Mr. Teeves
also brought up the question of an . entrance gate. The Board
informed him that .all entrance gates must be 35 feet from the -
highway,, and that he should discuss this with Harold Price,,
Superintendent of Highways. Mr. Wickham advised Mr. Teeves

that he should make a preliminary application for= a subdivision.
Mr. Teeves said that nnothing was definite and that he was
also considering putting in apartment houses. Mr, Wickham
said that personally he did not approve of this type of thing
in Southold Town,
Robert Trumanbach appeared before the Board to discuss
putting in a numbering system . in the Town of 'Southolds, whereby
lots., blocks., and houses would be numbered for clearer and
acurate idenification. This numbering system would be caraied
through when land is developed. This idea is something for
. the Board to look further into.
- -Mr. and Mrs. Leroy Brown., Greenport-s, New York., appeared
before the Board in reference' to the Island's `End Golf and
Country Club's application for a change of 'zone. They,
wanted
to know the size of the property that was in question fora
change. Mr. - Wickham read the legal notice tothems, however'.,
he explained that he would not discuss it -at lenght with them:
Mr. and Mrs. Brown felt that the parking vlot-which is adjoining
their property would be a noise hazard and hence affect their
business.
The Planning Board then went back to the application of
Christ- Stratakis's subdivisions; Sterling Homes and discussed
it.
On- motion by Mr. Moisa,, seconded by Mr. Youngs: it was
RESOLVED that approval be given to the subdivision entitled
"Sterling Homes"., subject to the signing of "proformance bonds,
and the approval of the Town Board.

RESOLVED that the 'PlanningBoard set 7:30 P.M. , Tuesday,
June 30, 1964, Town Office,_ Main Rpad, Southold,' New York, as ,
time and place for hearing on the question of .approval of the
following plat:
Plat of property owned by Henry Smith,, entitled Peconic
Shores at -Peconic, consisting of, a parcel of land of approximately
21.62 acres, situated at :Peconic,, in the Town of Southold, Suffolk
County, New York,, and bounded and described as follows:
Beginning-at a point on the northerly side of North Road'
where the. same is intdtedected by the westerly side of land now

The Planning Board received from the Town Board a petition for
a change of zone from "A" Residential and Agricultural District
to "B" Business District by Island's End Gold and- Country ,Cluld
with the instructions to prepare an official report defining the
conditions described in the petition and determine-the area so
effected with the recommendation of the Planning Board. The
request- for 'this change of zone is made for 'the purpose of
operating the Golf and-country club on a public basis instead
of -on a membership.basis. This property is bounded and described
as follows:
Beginning at a concrete monument on the northerly line of the
Main Road at the southeasterly corner of land of Ernest Wiggins and
the southwesterly corner of. land of Floyd- King; from said point :of
beginning running along said land of'Wiggins, north 360 04' M'
west, 300 feet; thence along said land of Floyd. King, north 660 .391
50" east,. 190.61 feet to landof Wayland Brown; thence along said land
of Wayland Brown,, south ,360 031 40" east,. 106.84 feet; thence along

On motion by Mr.'-Moisa, seconded by. Mr. Grebe,., it was
RESOLVED that the Planning Board- is not going to take an
immediate action on- this application. They are going to hold
it for 'fur.ther investigation and study.

The Planning Board received from the Town Board a resolution
containing proposed amendments to the Building -Zone Ordinance
with instruction to prepare an official report thereon.
The amendments proposed read as follows:
I. By amending Article III,,- Section 300, of said Ordinance by
adding a new subdivision,. to be subdivision 4A,. to Lead as follows:
4A. Stables and riding academies, when authorized
- as a special exception by the Board of' Appeals as
hereinafter provided.

II. By amending .Article III,, Section 300, subdivision 5-of
said Ordinance to read as follows:
5. Clubs,, fraternity houses and golf courses, when
authorized as a special exception by the Board of Appeals
as hereinafter provided.
III. By amending Article IVO Section 400, subdivision 5 of
said Ordinance to read as follows:
5. Offices,, banks..., and financial institutions.
IV. By amending Article IV,, Section 400.., subdivision 10 of
said- ordinance to read as follows:
10.- Storage houses.. express carting or hauling offices
or stations,, . ice manufacturing,, yards for storage and sale of
coal and building materials.
V. By amending Article X* of said Ordinance by adding thereto
a new section to be' Section 1000B,, to read as follows:
Section 1000B - No dwelling shall be hereafter be
erected or altered in any district- unless provisions .shall
be made therein for not less than %eight hundred and fifty
(850) square feet -of space within the exterior of the
foundation walls at ground level exclusive -of 'a garage,
carport,. carpark,, open porch.. or 'terraces,, or other
'extensions outside the body of the house. Provided,
however,, that fifty (50%) percent of the habitable area
of the second story may be used and applied to the areaa
requirement of the first floor.
Notwithstanding anything hereinabove to the contrary
the area of the second floor shall be included in computing
the .-.area of the total habitable area when the finished floor
of the second story has a clear -headroom -of not less than
seven and one-half (732-) feet -with knee walls of not less
than five (5) feet and when the second floor 'is serviced
by a permanently placed stairway.
The provisions of this section shall not apply to
dwellings located within a tourist -camp as defined in
the 'Southold Town Ordinance, providing for .the regulation
of tourist camps, house trailer camps-,, house trailers

or 'similar establishments when a permit for such
tourist camp has been issued by the Town Board
pursuant to the provisions of said Ordinance.
On motion by Mr. Moisat seconded by Mr. Young., it was
RESOLVED that the Southold Town Planning Board favorably
recommends tothe Town Board the above amendments to the
Southold Town Zoning Ordinance.
The Planning Board finds that the changind- of the . times and
demands .on the Town have increased to the point where we feel that
the proposed changes in the Ordinance are necessary. The Planning
Board feels that these changes are in the public interest of the
Town of Southold..
Vote of. the Board: Ayes: Mr. Wickham, Mr. Moisaa. Mr. Grebe..,
Mr. Young, Mr. Unke lbach.
Mr. Howard Terry, Building Inspector attended the Riverhead
Town's Master' Plan preliminary meeting.., and gave a brief report
on it to' the Planning- Board. The biggest --objection tothe Plan
was the apartment houses and green belt., which is open farm land.
The term "green belt" was not looked -upon favorably.
LAwrence. Tuthill came to the meeting tolobtain information
of "Peconic' Shores" and"Sterling Homes"to make an estimate for
proformance bonds.
on motion by Mr. Moisa.., seconded by Mr. Unkelbach,, it was
RESOLVED that the Planning Board minutes dated May 5, 1964,,
be approved as 'submitted.

The subdivision,,. "Eastwood Estates".t_. Section Ihe. was
discussed briefly by the Board.
, On motion by Mr. Moisa,, seconded by Mr. Grebe,, it was
RESOLVED that tentative approval be given to the maps
of Eastwood Estates,, Section II.
Vote of the Board:. Ayes: Mr. Moisa,, Mr. Grebe, Mr. Young
Mr. Unkelbach.
Mr..- Wickham did not vote.
The Planning Board received an application from Race 'Point
Corp. ,, Fishers Island,, New York, for a subdivision. The Board
held a lenghty discussion on this proposed subdivision. The
application was> not in complete form to meet the requirements
of the Planning Board. A letter was forward to Mr. James
Manning, with carbon copies of said letter to Chandler&- Palmer,
Alfred. Grebe,, Supervisor-Albertson,, Otto Van Tuyl,, and James
E, Plymire,- Esq. ,, recommending ways in which the application
for 'the subdivision could be improved.
The Planning Board received from Ernest W... Whitlocke. Malcolm
Pirnie-'Engineers the proposals for the study of ground water in
the Town of Southold. The Board discussed them.
On motion by Mr. Unkelback, seconded by Mr.. Wickham,,it was
RESOLVED that the 'Planning Board recommend that the Town
Board also approve the proposals for the study of ground water
in the Town of Southold.

Mr. Unkelbach,, Mr. Young.

The Chairman dictated three letters to the Secretary.
(1) . To Mr. Ernest�W. Whitlock,. Malcolm, Pirnie Engineers.,
informing him that the 'Planning Board met and approved the
proposals,, and submitted them to the Town Board with the
recommendation that they approve them. (2) To the Town.
Board informing them that the Planning Board accepted the
proposals of 'Malcolm'Pirnie 'Engineers and recommend that
the Town Board also approve them. . (3) To Mr. John Diffigos,r,
Department of Commerce. informing him that the proposals
of Malcolm Pirnie 'Engineers had been accepted by the
Planning Board and that copies of the proposals were sent
with the letter in hopes that work will commence as soon
as possible on this ,pooject.
The next.meeting of the 'Southold Town Planning Board
will be held 7:30 P.M. ., Tuesday,,, June 30., 1964., aththe Town
Office... Main Road.; Southold,, New York.
