July 27, 1964
A regular__.meeting of the Southold Town .Planning Board was
held at 7:30 P.M. , Monday, July 27, 1964,. at.- the Town .Office.,
Main Road, Southold, New York.
There were present: Messrs: John Wickham; Chairman, Henry Moisa,
Alfred Grebe, Archibald Young, ,William Unkelbach.
Also present: Mr. Howard Terry, Building Inspector.
Absent: Mr. . Otto Van Tuyl, :Consultant.
The Board and Mr. Terry held a lenghty discussion on changes
-for the Ordinance. Howard Terry read the proposed changes as he had
wrote them. The idea of a swimming pool .Ordinance was also brought
up for discussion. The Board stated what they felt -should be added
and what -should be taken out of the proposed amendment. The change
in the Ordiance will deal with apartment houses and shopping centers.
The Board is looking into the future when shopping centers will be
in Southold Town, and they want -to be sure the Ordinance will make
provisions for such a development.

On motion by Mr. Wickham, seconded by Mr. Grebe, it -was
RESOLVED that the following amendments to the Zoning Ordinance
be recommended to the Town Board for their consideration:
I. By amending Article ILIA, Section 350, Subsection 4, by
adding thereto a new part to be 4a.
4a- Apartment houses of :any type, (garden .apartments, regular
renting apartments, cooperative apartments, condominium apartments,
etc.);, by special exception of the Board of Appeals as hereinafter
provided. Such apartment._:houses shall not be:
1. Over two and one-half (2%)f stories or 'thirty-five (35);
feet-in height.
2. .No residential occupancy other :than main (1st) floor
units,. and second floor.
3. Not -more than ten (10) families or apartment units
per building.
4. . Each building housing more than four (4) families, or
apartment units, must be set on a lot having a mininum frontage
of 200 feet on a 50 foot mininum width road. • Side yards of
at least .25 feet on each side, a mininum setback of 35 'feet
.or --the average setback of principle buildings on -that -side of the
street or block, a mininum rear yard of 100 feet, 50 feet
mininum between the project buildings, if there are more than
one building.
5. .Maximum_ building area, including accessory buildings
twenty percent (20/) of lot .area.
6. .Mininum dwelling unit area, six -.hundred (:600). square
feet within wall of each single apartment unit.
. 7. Not any other provisions. of this
Ordinance, each apartment house �of, _over four (4) living
units shall have one and one-half -,(11%) parking spaces
per unit for off street parking of tenants. Such parking
spaces shall be properly drained and maintained, dust
free at all times. For this- purpose each parking space shall
be three hundred thirty-four (334) square feet of area,
mininum per vehicle.

8. .All accessory- buildings must,be inthe rear yard
not .closer than five ;(5): feet to side of rear property
lines, and the area of such shall be included in computing
the total _building area of each lot.
9. SIGNS - One sign not larger than 4' high by .6' long,
single or double faced, at least .3 feet to bottom edge and
not more than .12' to top edge, setback at least .10 feet from
all property line, permit required.
10. No building permit shall be issued until approval of
Board of .Appeals received in writing by the Building Inspector.
Such approval shall cover all items on the plot -plan, buildings,
parking area, accessory buildings, access roads, drainage,
plantings, lighting, fencing, etc. , and written approval of the
health department of water supply, sewage disposal, garbage and
refuse disposal, etc.
II. By repealing Article IV, - Section 207, which reads:
SECTION 407- "B" DENSITY .OF POPULATION- In the "B"
Business District, no . building shall hereafter be erected
or altered to. accommodate or .make. provisions for more
than twenty (20) families on one (1) acre of ground or
more than a proportional number of families on a fractional
part -of any acre of land, based on the requirements as
outlined above.
III.--::By amending Article IV, Section 400, Subsection 1, by
adding thereto a new part to be la.
la- To read the same as Article IIIA, Section 350,
Subsection 4a.
IV. By amending Article IV, by adding thereto a new part -to be
Section 411.
SECTION 411- Any building or .combination .of buildings
specifically erected for retail business, offices,, merchantile
establishments, professional buildings,- etc. , erected or
altered on a..lot of .one acre or larger shall meet the following
requirements:

1. At least twenty-five percent (251) of the area of
the lot shall be landscaped with grass and plantings.
. 2. .Parking shall be provided in .paved areas. at.=the rate
of one parking space three. hundred thirty-four (334) square
feet -for each one hundred (100) square feet -of .floor sales
area or office space in each bui]J.ng.
3. : 13; xaarifa].l .aid :storm water accumulated on each and
every lot shall''be returned to the ground within. the bounds
of said lot..
4. SETBACKS- Side yard setback of 25 feet, rear y and
setback of .25 feet, front yard setback as .in Section .404, and
405, mininum.
Vote of the Board: Ayes: Mr. - Wickham, Mr. .Moisa, . Mr. Young,
Mr. Grebe, Mr.. Unkelbach.
Supervisor Lester :Albertson. attendtd the meeting to review
the proposed amendments with the Board.
The planning Board received from the .Town Board a petition for
a change of .zone from "A" Residential .and Agricultural District
to "B" Business District by Vina Baker and .George M. -Van Buren
with the instructions to prepare an official report defining the
conditions described in the petition and determine the area so
effected with the recommendation of the Planning Board. This
property is to be used for a motel, restaurant, slips for boats
and a marine dock. The property is bounded and described as
follows:
Beginning at a point where the westerly line of Wickham
Avenue is intersected by ordinary high watermark of .Mattituck
Creek, said point being S. 28 degrees 48 minutes, -40 seconds,
E. 130 feet, more or less, southerly from a concrete monument
marking the northerly extremity of said westerly line of -Wickham
Avenue which runs S. 28 degrees, 48 minutes 40 seconds E.; running
thence westerly and southwesterly along high water mark of :Mattituck
Creek to a point, the tie line, from said point to a point on
the westerly line of Wickham Avenue 90 feet .So 28 degrees 48 minutes
40 seconds E. from said monument above mentioned, being 69 degrees

28 minutes 10 seconds';W. 479.16 feet; thence along said ordinary
high watermark of''Mattituck :Creek southwesterly and northwesterly
to a point, the tie line being S. 63 degrees 23 minutes 00 seconds
W. 300.79 feet; thence northwesterly along ordinary high water mark
of Mattituck Creek to a point, the tie line being N. . 15 degrees
19 minutes 40 seconds W. 393.76 ' feet; thence northeasterly along
ordinary high water-,mark of Mattituck Creek to a point, the tie line
being N. 34 degrees 48 minutes 40 seconds- E. 412.04 feet; thence
along other-land of 'said Baker and Van .Buren, - the following two
courses and distances as follows: ,(1) S. 58 degrees 36 minutes
10 seconds -E. 245.0 feet; thence (2) N. . 65 degrees 05 minutes 40
seconds E. 215.03 feet to the westerly line of Wickham Avenue;
thence along the westerly line of Wickham Avenue two courses and
distances as follows: (1) S. . 24 degrees 54 minutes 20 seconds E.
330.00 feet -to a monument, thence (,2) S. 28 degrees 48 minutes
40 seconds -E. 130 feet more, or . less, to the point .or place of,be-
ginning.
On motion by Mr. Grebe, seconded by Mr. Unkelbach, it was
RESOLVED that the Planning Board does favorably recommend to
the Town Board the change of zone from -"All Residential and
Agricultural District -to "B" Business District on the property
of Vina 'Baker and George Van Buren, as described above.
The property is presently a non-conforming use, having been
a hotel and picnic area for many years. This is located on the
deep water channel, Mattituck Creek, opposite an existing :"B"
Business District. Due to an increase in the use of said Mattituck
Creek by pleasure boats, both 'large and small, facilities. in
Mattituck .Park .District are inadequate to accomodate visiting
yachts and yachtsmen.
- The Planning Board feels that -this is an .ideal -location. The
'proposed layout of the motel, restaurant, and docking facilities will
be an asset' to the Mattituck area and to the -Town of Southold.
The Town Trustees have given their approvi of the propesed docks
and mooring facilities.
The proposed use will be in .line with the waterfront .development
consistently advocated by the Planning ,Board.
Vote of the Board: Ayes: -Mr. Wickham, Mr. Moisa, Mr. Young,
Mr. Grebe, Mr. Unkelbach.

The Planning Board received from the Town Board a petition for
- a change of zone from ."A" Residential and Agricultural .-District-to
"M" Multiple Residence. District by Bernard Kaplan with the instructions
to prepare an official report defining the conditions described
in the petition and determine the area so effected with the
recommendation of 'the Planning Board. . This change is requested so
that the property may be used' asmultiple dwelling. This property
is bounded and described asfollows:
.Beginning at a point on the ordinary high .water :mark of
Gardiners Bay where said high water mark is intersected bythe
westerly line of Shipyard lane; from said point -of .beginning
running westerly along said high watermark, 1915 feet, more or
less, to the easterl y. line of -land shown as "Reserved for Beach
Area" on "Map of :Section .2, --Cleaves Point", filed in the- Suffolk
.County Clerk`s Office as map ,#k2752; thence along said easterly
line,north 44 degrees, 03 minutes 30 'seconds west, 190 feet,more
or less; thence along a 15 foot xight of way as shown on said map,
north .12 degrees 53 minutes 10 seconds east, 131.27 feet; thence
along lot 6, north 8 degree's 13 minutes 10 seconds east, 121.02
feet; : thence along lot 5, north 0 degrees 22 minutes 40 seconds
east, 124.15 feet; thence along lot -4, north '16 degrees 08 .minutes
20 seconds. west, 131.56 feet; thence along lot .1, two courses as
follows:. _(1) north 56 degrees 37 minutes 10 seconds east, . 75 feet
thence 1(2) north 33 degrees 22 minutes 50 seconds west, 150 feet;
thence across the southerly end of a 50 foot -private road known as
Maple .Lane, north 56 degrees 37 minutes 10 seconds east, . 38 feet
thence along the easterly line of said' Maple ,Lane, : north 33 degrees
22' minutes 50 seconds west, 80 feet; thence north 56 degrees
37' minutes 10 seconds east, 195 feet to land of .Rutkowski-;_ thence .

On motion by Mr. Unkelbach, seconded by Mr. . Moisa, it .was
RESOLVED that the Planning 'Board does not favorably recommend
to the Town Board .the change of zone from "A" Residential and
Agricultural District to "M"' Multiple Residence Diatrict .on the
property of Bernard Kaplan, as described above.

The Planning Board has never recommended twenty-five (25)
acres for a "M" Multiple Residence District, and they see no
reason to depart from that -.policy-. The, Board feels that this is an
excessive amount .of land for the purpose specified.'
-Vote of the Board: Ayes:-.Mr.-Wickham, Mr. , Moisa, Mr. Young,
Mr. Grebe,Mr. Unkelbach.
'On motion by Mr. Unkelbach, seconded by Mr. . Young, it was
RESOLVED that .the minutes of the Southold Town .Planning
Board dated June 30, 1964 and July 13, 1964, be approved
as submitted.
Vote of -the Board: Ayes:- Mr.. Wickham, Mr. Moisa, Mr. Young,
Mr. Grebe, Mr. Unkelbach.
'A letter was sent to the Shelter I'sland .Planning .Board, inviting
them to attend the next -meeting of `the Southold Town .Planning
Board, which is to be held 7:30 'P.M.!, Monday, August .l7, 1964, at
-the Town Office, Main .Road, Southold, New York .
