SOUTHOLD TOWN 'PLANNING BOARD
October 15,.1964
A regular meeting of the Southold Town Planning Board was
held October 15,. 1964,. at '7:30 P®M ,. at-:the Town Office,, Main
Road, Southold: New York.
There were present: Messrs: John Wickham,' Chairman,; Henry;Moiaa,.
Alfred Grebe,,,- Archibalc Young, William Unkelbach.
Also present: Howard Terryt, Building Inspectors,- Otto Van Tuyl,
- Consultant.
Mr. Young, acting 'Chairman for this hearing read the legal
notice of'hearing.

MR® YOUNG: I-will declare this hearing closed at this time
and the Board will discuss it later.
Harbor•Lights was again put before the Board.
THE CHAIRMAN: In view of the fact that this legal notice ;
and description has been read and we adjourned the hearing to '
obtain approval of County Health Departments we will dispense
with preliminaries.
This subdivision has not received the approval of the
'County Health Department yet.
On motion by Mr. Grebe,, seconded by Mr.. Moisar. it was
RESOLVED that the hearing for the subdivision "Harbor
'Lights",_ located at Bayview in Southold,, be recessed until
the next regular -meeting of 'the Planning IBoard.

Mr. Young, and Mr. Unkelbach.
Mr. Reese was also -present at this meeting to express to
the Board that-he was in favor, of the change of zone proposed,
by .the Town Board on his property located at Bayview in Southold.
He stated that he wanted this property residential and thanked
the- Board for their consideration in the matter.
The" Chairman read the following resolution that was passed
by the Southold Town Board:

"At a meeting of the Town Board of the Town of'Southold,
held on: the 29th day of` September,,, 1964s, at the' Supervisorss
Office,' 16 South. Streets, Greenports, New York.
"WHEREAS,_ this Board deems it .in the public .interest and in
the promotion of the health,,, safety ,_ morals or general welfare
of. the Town of' Southold that certain premises. at.-East.Marion, in
the Town. of:Southold,.- Suffolk County, New Yorke_ hereinafter more fully
described, be rezoned from "B" Business:District to "A" ` Residential
and Agricultural-District.
"NOW,- THEREFORE-8 BE IT-RESOLVED, that the Building 'Zone
Ordinance of the Town of Southold,,. including the Building Zone
Map forming a part thereof'. be amended by the Town Board on its
own motion by changing from "B" Business' District to "A" Residential
and Agricultural District the following described premises:
"All those certain plots`, pieces or parcels of land situate=
lying and being at-East Maion in the Town of:Southold,- Suffolk

901 of 'the Building Zone, Ordinance of the Town of Southold, the
Town clerk be and he hereby is authorized and directed to transmit
a copy of this resolution to the' Planning Board of the Town of
'Southold with a written request instructing said Planning Board to
prepare an official. report:concerning the same, together with
their recommendationse "
The Board viewed the map of the property in question. Mr.
Howard Uhl and his associate Mr. Frank Russell were present to
discuss this proposed change with the' Planning Board.

Mr.• Uhl stated that he wished to be heard on this matter :
because he felt- that the Planning Board should know first-Viand what
the plans are regarding this property. He said that they -are
actively engaged in trying to get a motel set up on this property.
He brought along a scale model of their layout of plans for
the property. He said their plan was to start out by putting
up 20 motel units,,. then gradually adding more. When it was
completed there would be 100 units. Mr. Uhl pointed out on
the scale model the location of the motel units,' .restaurant,
tennis courts convenience store,, golfcourse, and other facilities.
He stated that this would be a self-containedr: self-supporting
tape of an operation. . The people willnot have to go out of the
area to .find recreation.
Mr. Uhl stated that the reason a scale model of this proposed
plan was made was because they had no success in raising funds
to finance this plan. He said that-they tried banks on the North
Fork- and banks in .the' City without success. They next-turned to
the Small Business Administration, however,,, this did not work
out either. Ths,'scale model was made for the purpose of im-
pression banks. Because they could not get- started_on this
project by themselvesr they contacted resort operations. In
appealing to them . for aid,,', it was specifically pointed out that
this property was zoned for business for the type of:operation
they had inmind. If the Business° Zone is taken away, their
idea will be harder to put across.
The' Chairman recommended that this property be upzoned to
a "M" Multiple Residence-District. However, Howard Terry-pointed
out that-with a "M" ' Zone, a restaurant and gift shop, etc. , could
.not be operated. The -Chairman stated that they wanted to assure
all -their cooperation. He stated that this , is the ,oAly large
area that was ever zoned for business and it-'bothers the Board
.a little that it is not being used for business. The Chairman
stated that he has taked to the' Supervisor, and he- feels the
same way on this matter. He stated that- the Board did not want
to cut-him off, however they didn't-want to be in the position
of- having a large area zoned for business when a "M" District
would .suit the purpose just as well. - Mr. Uhl stated that an
I'M" District--would handicap theme with the "M" Zone they
couldn'-t have a sign as large as they could in the "B" Zones.

He stated that they went to alot- of trouble to get this "B"
zone, that it was given to them in goon faith -and they have
used it in good faith.

Mr. Unkelbach asked if they have been actively engaged
in trying to put this plan -through since 1957. - Mr. Uhl stated that
theyhad .and this whole operation will take time. Mr. Unkelbach
pointed out that he should see the reluctance of the Town Board
to keep this property zoned .for 'business. If they ,,.:-.Were forced
to sell this land, any sort of business that is provided for in
the ordinance,, could be located on this property. . The. Town
Board did not. want-any type of 'business in this location that
might=be harmful to the area. Mr.- Russell stated that they
were approached this summer' by a gentleman from- orient who
wanted to run the ferryboat from this location. He said that
they would not make such a proposition. It would .-not be
advantageous to their operation or to the Town of� Southold. He
said he thinks this points out that they do have the community
interest .at heart- and that they will not jump at the first
chance to sell this property. Mr. Unkelbach pointed ._out that
there was always the possibility that they. could no longer

afford to keep the property.
The Chairman explained that the Town Board has made the
motion on this particular change of 'zone and that- they ask the
planning Board's recommendations however, they don't-have to
take it. The= Chairman pointed out that there can be mulch pressure
from carry a large parcel of land without receiving any income
from it. It is -with this thought in mind that the Town Board
does not want this . large prcel of land zoned business. - Cove Beach
Estates may at- some time be forced to dispose of this land.
The Board and Mr. Uhl and Mr. Russell discussed the possibility
of spliting this into different zones, - The golf .course could be
in a "A" zone with a: special exception from the Board of-Appeals.
the -motel units could be in a "M" Districts' and the rest of' the
property could remain business. zoned for the convenience store,
restaurant,, etc.
The Board decided to set this matter aside until later in
the evening when the supervisor could be present to further
discuss the matter with them.
`Mr.- Clement Botth appeared before the Board next. He has
property on Tuckers Lane which he plans to subdivide. He has
already been selling -lots out- of ' this area. Mr. Van T4NII
made a map of the proposed layout, and Mr. Booth wanted the
Board's permission to construct a road.

The Chairman advised that after' Janua-ry ls, 1965, the -County
Health- Department was requiring municipal sewers,,, therefore, Mr.
Booth should try to file before the first of the year. Mr. Booth
said he would like to file the final map before January 1, 1965.
He presented :h.the map layout of the property. The Chairman
advised -that he would need- County -approval to have access come
out .on the County Road. Mr. Booth is only planning to file one
section of this land,,.. and rent the remainder for farm land for
a few more years.. The- Chairman advised him that he should file
the whole. parcel of land now. He advised that . the. expense would
not be that- much greater,,. and he could submit--a performance bond
for the roads.
On motion by Mr. Grebe,.. seconded by Mr. Moisar, it was
' RESOLVED that the' Southold Town Planning Board give preliminary
approval to Clement Booth for the cut through of roads on Lhe _land
located on .Tuckers Lane and the North Road, Southoldt New- York.
Vote of the Board: Ayes:-Mr.- Wickham=; Mr. Moisa, Mr. Grebes
Mr. Young, and Mr. Unkelbach.
The Board again took up the matter_ of-Cove Beach Estates.
Su� ervisor' Albertson was present and the=Chairman advised him
of the plan to have three different .zones in this propertyr so
that-Mr. Uhl could continue with his original plan. The' Super-
visor thought- this was a good idea. - A lenghty discussion was
held as to where each zone would be,. and how large. It-was
determined that--a very_specific legal description. would be
necessary. _ Mr. Uhl should submit his final plans to Otto Van
Tuyl,, who will make a new map, and submit it to the Planning
Board at' their next-meeting.
The Planning Board received from the Town Board a resolution
.for a change •of zone from. "C" Industrial District to 'W' Residential
and Agricultural- District on property located at-Bayview in
Southold, with the instructions to prepare an official report
defining the conditions described in the petition and determine the
area so effected .with the recommendation of the Planning Board.

On motion by Mr. Grebe, seconded by Mr. Unkelbach, it was
RESOLVED that the' Planning Board favorably recommends to
the Town Board the change of zone. from : "C" Industrial -District
to "A" Residential and Agricultural--Distr�,,ct on the property
described_above.
Mr. Young has personally inspected this property and
he feels that it should be changed to-, "A" Residential and
Agricultural- District. Mr. Reese appeared before the
Board to -state- that the was in favor of such a change. This
piece of.:property is surrounded by residential property and
Town property*

On motion by Mr. Grebe,, seconded by Mr. Unkelbach, it was
RESOLVED that the minutes of the Southold Town Planning
Board,, dated -:,:+September 21,, 1964, be approved as submitted*
vote of the Board: Ayes:-Mr.- Wickham., Mr.- Moisa, Mr. Grebe,
Mr. Young, Mr. Unkelbach.

- The Board next discussed "Blue Horizons".. Peconic, New
York.. - A letter was written to the subdivider requesting. an
affidavit of the disposition of the right-of-way shown on
the map. The. subdivider-was also advised that he should file
a formal application with the` Planning Board as soon as possible.
On motion by Mr. Grebe, seconded by Mr.. Young, it was
RESOLVED that the Southold Town 'Planning Board.authorize
Mr.-Lawrence Tuthill, Professl6nal Engineer., to make an
estimate for a performance bond -for the roads in "Blue Horizons",
Peconic, New York.
Vote of the Board: Ayes:Mr. Wickham: Mr. Moisa, Mr. Grebe.
Mr. Young, and Mr. Unkelbach.
On motion by Mr. Grebe, seconded by Mr.. Unkelbacbt'. it was
RESOLVED that the-' Planning Board recommend a bond of
$12:000.00 for' performance bond .for the roads in Eastwood
Estate, - Section II, located at Fleet's Neck in' Cut-chouge..
Vote of the Board: Ayes:Mr.. Moisa, Mr. Young, Mr. Grebe,
mr. . Unkelbach.
On motion by Mr.- Moisa,. seconded by Mr. Unkelbach.., it was
RESOLVED that the subdivision known as Eastwood Estates.
Section II, owned by Kathryn Fleet and others be approved,
subject to the approval of the layout of the roads by
Harold Price.
Vote of the Board: Ayes:-Mr. Young, Mr, Moisa, Mr. Grebe.
and Mr. Unkelbach.
. (Mr. Wickham abstained from any participation in the
matter fof Eastwood Estates... Section II because of a conflict
of .interest. )

The, Chairman read a letter from Albert"W. Richmond, Town
Clerk, stating that the Town Board accepted' $13,000.00 cash
in excrow from Henry. Smithr Peconic, .New York, for the security
of completion of, raods in the subdivision known as "Peconic
Homes" in Peconic, New York.
The Chairman also read a letter from'Albert W. Richmond,
stating that the Town Board resolved that Northwest-Loop
Road, Nassau Point, Cutchogue+, New York, . shall hereafter'be
known as.West- Cove Road.
The Chairman next- read a letter from Frederick P. Rich
stat•A4g 1ihis disapproval of any change in 'the' Zoning Ordinance
regarding apartment houses.
The Board .discussed raising the fee for applications for.
subdivisions. It was unanimously agreed that the Southold Town
Planning Board recommend as. a fee for all subdivisions the
following: Fifty dollars for the first 16 acres .in the sub-
division, and vfive dollars for each additional acre over
10 acres.
On motion .by Mr. Grebe, seconded by Mr. Moisa, it was
RESOLVED that the' Southold Town Pinning Board recommend
to the Town Board that- Lawrence Tuthill,. professional engineer,
be paid for his services on the following basis: Making estimates
for bonds for roads, he shall receive- $25.00 for the first 10
acres in the subdivision, and $1.00 for each additional acre over
10 acres.
Based on the past few cases he has made estimate this would
be the same as a two per cent, which he feels and we feel is very
reasonable for this work.
Vote of the Board: Ayes: Mr. Wickham,, Mr. Moisar Mr. Grebe,
Mr. Young, and Mr. Unkelbach.

Mr. Grebe felt -that the' Planning Board should start work
on making rules and regulations for' Swimming pools. The- Chair-
'man felt that this should wait- until after January 1,,1965, -in
view of the fact that the Planning Board wants to give approval
an as many subdivisions as possible before that. date.
A letter was written to Mr. Manning in regard to Race' Point
- Corp. He was advised that every effort should be made to complete
this subdivision and have the final approval of it before the
first day of January,, 1965.
The next meeting of the--Southold Town Planning Board will
be held '7:30 P.M. Wednesday, November 4, 1964, at the Town office,
Main Road, Southold, New York.
