A regular meeting of the 'Southold Town Planning Board
was held at, 7:30 P M _, Mondays. December 14. . 1964s. at .the
Town Offices; Main Roads- Southold& New York. .

PUBLIC HEARING: On the question of -approval of the following
plat: Plat of property owned by Frank Zaleskis,. entitled "Deep Hole
Creek -Estates"s. consisting of a parcel of land of 39.40 acres&,
situated at Mattitucks, in the Town of-'Southolds; Suffolk,-County.-
New Yorks and bounded and described as follows:

nothing more to offer, unless someone would like to ask questions.

William "Wickham,. Esq..r, stated that"bond .had not yet been.
posted for the roads 'in the subdivision. The chairman-advised
that he would waive the signing of the final .map ,until a per-
formance bond was posted.
THE CHAIRMAN: if there in no one else. to be heard on this.
subdivision, I will close the hearing at -this - time.
Lefferts P.- Edson.' Esq. , appeared before the Board with
Benjamin and Ira Selvin to further discuss the subdivision,
"Village Gardens, ' -located in Southold. At the last meeting
of the Planning Board on November 24,, 1964, this subdivision
was given preliminary approval.
The turnarounds at the end of the roads were again discussed
with the applicants.' The -Chairman again advised that the super-
intendent- of highways would not be willing to accept alot of
dead end streets. The possibility of securing land from the
property owner on the north,, George Braun,, was also discussedi
if this land was purchased it-would allow "access to the Middle
Road from. the subdivision. The Board feels that this would be
sensible "and in the best interest of the subdivider. The Chair-
man advised the applicants that- it was possible to buy this land
on the north,, the owner is willing to sell.

The Chairman next- advised hthe subdividers of the requirement
for park and playgrounds area in the subdivision. However, the
applicants have their land maped out so they can get the maximum
number of lots possible. . The Chairman advised them of the lack
of water- supply :in the Town of Southold,, and that the Board does
not -want-.to approve maximun density. - if they do, this will tend
to increase the lack of water supply. The Chairman advised Mr.

Benjamir./Sana fr Ira Selvin that they should layout their sub-
division with lots of 20,000 square feet. Then, if they cannot
obtain city water they will not be faced with a great problem.
Individual" wells and cesspools could be put- on each lot, if they
are 20,000 square feet. The Chairman advised that this would
be better for the. subdivider as well as for the Town of-Southold.. The Chairman also advised that he would like to see the lots made
larger and forego the park and playground requirement.

Very lenghty discussion was held on the size of the lots.
The Planning Board strongly advised and recommended lots of
20r000 square feet, while the subdividers felt they should try
to get- as many lots as possible from the land. The possibility
of- eliminating one road and moving.-another over was discussed.
Mr. Edson also brought up the idea of keeping the roads private
and dedicating a particular corner to the Town. The Chairman
felt it would be better to show them on the map as "Reserved
for possible dedication. "
The Chairman advised Messrs. Benjamin and Ira' Selvin_ that
they- would need the approval of the' County Health Departments.
Contract- with the Village of Greenport for water,"and .'approval
of 'the superintendent of. highways of the layout of the roads,
before this subdivision "Village Gardens"s, could be scheduled
for a hearing.
Lefferts P. Edson.. Esq. s, appeared before the Board to again
discuss the subdivision, Eastern'Shores at Green' port.e, Section II.
The Chairman read the letter written to Mr.. Edson in regard to
setting aside an. area for park and playground purposes.. The` Chairman
advised that this subdivision could not.-be discussed any further
until .a more precise map was presented.
The Planning Board received from the Town 'Board the original
petition of Martin' D,; Schluensen of Mattituck,. New York, requesting
a change of zone from."A" Residential and Agricultural District to
"B" Business District on property located on the north side of
the Main-Road, Southold, New York, with instructions to prepare
i, an official- report- defining the conditions desribed in the petition
and.determine the area so affected with the recommendation -'of the
Board.
This property is bounded and described as follows:
Beginning at a point on the northwesterly line of the Main
Road .about 1,000 feet southwesterly along said northwesterly line
of Ackerly Pond Lane, said point- of beginning being the southerly
corner of Willow Hill Cemetery; from said point. of beginning
running along said northwesterly line of the 'Main Road S. 39°
031 00" W.-207.46 feet to an iron pipe and land of Goldsmith;

Albert Goldsmith was present to advise the Board that. he
was interested in this application and in favor 'of this change
of zone..: The Chairman advised that as a courtesy. the Cemetery
Association should be notified of this proposed change of zone.
. in case the cemetery association is interested inbuying this
property. It-was pointed out that the Cemetery--Association would
like to buy this property,,,*but they haven't the sufficient funds.
. Mr.. Young said he would speak to some person that are Gahead of
the' Cemetery Association.
Bernard Kaplan - and Theodore 'Kaplan next appeared before'
the Board to discuss the roads in the subdivision,: Cleaves
Point., Section I,, and Section II, The Chairman read the letter
written to Bernard Kaplan in . regard to- these roads_% The Chairman
advised that the Planning Board wants to see all the ' roads in,
all the subdivisions brought up to town specifications. Bernard
Kaplan stated that the roads in.-'Cleaves Point are in poor condition
and that no progress has been made toward dedication to the Town.
They were under the impression that these roads were private.
Bernard Kaplan advised that they -would like to dedicate the roads
to the Town.. and that they would like to mbxke some kind .of,
arrangements for dedication. The Chairman advised that the
present town specifications for roads will have to be met for
dedication. Mr.- Kaplan said that-Maple Lane is a lovely road
with trees on both sides. If they were to make it- widers, they
would have to destroy many beautiful trees. Mr. Kaplanfelt that
perhaps some of the specifications for dedication could be waived.
The Chairman advised that Mr. Kaplan should contact Town Attorney
or the Superintendent of Highways in regard to waiving certain
requirements. Mr. Kaplan stated that he would be willing to
'dedicate- the roads to the Towns, but he cannot meet .all the present
requirements for dedication .of the roads.

On motion by Mr.. Moisa, seconded by Mr. Young, it was
RESOLVED: WHEREAS Frank- Zaleski has petitioned the "Southold
Town Planning.Board for final approval of his plat known as
"Deep Hole Creek--Estates",. at Mattituck, New York, and
- WHEREAS the Superintendent of Highways of the Town of
Southold has inspected the map- and approves the highway layout
of the roads to be constructed, and his report is hereby approved
by the' Planning Board,, and
WHEREAS the Southold Town Planning Board, pursuant to due
notice thereof, held a public hearing on the matter of approval
of the .plat- at-which time all interested persons were given an
opportunity to be heard,, and
WHEREAS the Southold Town Planning Board waives the provisions
in the Rules and Regulations for the subdivision of:Land requiring
park and playground area or cash equivalent;
WHEREAS the signing of the final maps by the Chairman of
the 'Southold Town Planning Board is waived until such time as
a performance bond is posted for the roads and drainage in
the subdivision, and such bond is accepted by the Southold Town
Board;
NOW THEREFORE BE IT RESOLVED that the subdivision to be
known as "Deep Hole" Creek -Estates" at Mattituck,, New York,
consisting of 39.4.0 acres and owned by Frank' Zaleski,. be
approved.

Board of Health states their approval.

The'Chairman read a letter from the County 'Planning Board in
regard. to "Blue' Horizons",. assubdivision on the North Road,
(CR 27)s, Peconic, .New York. The' County: Planning ,Board will
approve access coming out on the North Road under certain
conditions. - One of these conditions. were that .a certain
amount- of land be dedicated for the future expansion of the
North Road. A letter was written to Department- of Public
Works requesting information on plans for expansion for the
north side of the North Road I`(CR' 27),," Peconic,, New York.
The. Planning Board took up the matter of the change of
zone from-"A" Residential and Agricultural District to "Ba'
Business'District on property located in' Cutchogue 'and owned
by William J. Baxter,, Jr. This property is bounded and
described as follows:

RESOLVED that: the.' Southold Town Planning Board recommend
the widening of Griffing *Street, and School House,Road in
-Cutchogue as hhown on the map by Otto Van Tuyl & Son,, dkted
November 23,, 1964i, map no 1934-6.
Vote of the Board: Ayes: Mr.. Young, Mr.- Moisa," and Mr. Grebe.
Mr. ,Wickham abstained from voting because of conflidtodf'
interest.
The Planning Board received from the Town Board a petition
fora change of zone from "A" Residential and Agricultural District
to "M" NMULtiPI!e"Res';�'Ldendeby Margaret J. and A. John Gada,, with the
instructions, to..-prepare an official. -report defining the conditions
described in the petition and determine the area so effected
with the recommendation of the Planning Board. This property is
bounded and described as follows:

The Planning Board has a large number- of-protest in its
file, including telephone calls, telegrams, and letters. The
Planning Board has been over this property repeatedly and feels
it should remain "A" Residential and'Agricultural District.
Vote of the Board: Ayes: Mr. Wickham„ Mr. Moisa,. Mr. Young.
Mr.. Grebe abstained from voting because of a conflict of
interest.

Letters were received from the following named,, in regard
to the condition of the roads in their subdivision:

6. Harold Reeser, "Southold SIb res"
A letter was wxitten to Christ- Stratakis in. regard to the
roads in, "Stratmors Estates% He was advised that if the roads
were not brought up to Town- Specification and proper access is
not-providedt; then it-will be necessary to instrmct the -Building
Inspector to deny all building permits for this area.
Mr. Arnold-Larsen appeared before the Board to discuss the
change of zone petition by Martin-D.. Schluensen of Mattituck. Mr.
. Larsen. was advised that. the Board did not make a recommendation on
this application; they- .hre.holding. it until the cemetery -association
is contacted and .they have gi$en their thoughts on this change of
zone,
On motion by Mr. Greber;. seconded -by Mr. Young, it was
RESOLVED that the minutes of the Southold Town Planning
Board dated November -24r, 1964r; be approved as submitted.
Vote of the Board: Ayes: Mr, Wickham,: Mr, Moisag, Mr. Grebes,
and Mr. Young.
The next meeting of the' Southold Town Planning Board will
be held at '7:30 P_.M ,. Monday, December 28,, 1964r, at the Town
Office=, Main Road,, Southold,, :New York.
