PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T-E S SOUTHOLD TOWN PLANNING BOARD February 11, 1963 A regular meeting. of the Southold Town' Planning BDard was held 7:30 P.M. (E.S.T. ) , Monday, February 11, 1963 at the Town Office, Main R7ad, Southold, New York. There were present: Messrs.- Archibald Young, Acting Chairman, Henry Moisa, Alfred Grebe and William Unkelbach. Absent: Mr. John-Wickham. Also present: Messrs. Otto W. Van Tuy1, Consultant, and Howard Terryt Building Inspector. Mr. Walter: Kapp, presented to the Planning Board a revised preliminary plan of Paradise Point at Bayview, Southold. This proposed subdivision will contain 19.70 acres, with 28 lots. There was a brief discussion relative to the turnaround at the end of Basin Road where it. meets the proposed canal. The Board stated that they would require this 100 ft. turnaround to be 100 ft. in depth as well as width. On motion of Mr. Moisa, seconded by; Mr. G:ebe, it was. Southold Town Planning Board -2- February 11, 1963 RESOLVED that the Planning Board grant Paradise Point- Corp. tentative approval of their proposed subdivision to be known as Paradise Point at Bayview, Southold. This tentative approval is subject to the approval of the Board of Health and subject to the turnaround at the end of Basin Road being widened to 100 ft. by 100 ft. A letter was to be forwarded to Mr. Kapp, on behalf of Paradise Point Corp. advising that he may now instruct the engineer or survey or to proceed with computing the map, preparing the finished print, submit cloth prints to the Health Department for approval, and proceed with other matters necessary prior to submitting them to the Planning Board for final consideration. Theseprints must be submitted at least 15 days prior to a regular meeting of the Planning Board. Vote of the Board: Ayes:- Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Hnkelbach. On motion of Mr. Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the Planning Board set 7: 30 P.M. (E.S.T. ) , Tuesday, March 19, 1963, Town Office, Main Road, Southold, New York, as time and place for hearing upon the question of approval of the following plat: Plat of property owned by Paradise Point Corp. , entitled "Paradise Point at Bayview", consisting of a parcel of land of 19.70 acres, situated at Southold, Town of Southold, Suffolk County, New York, and bounded and described as follows: Beginning at a monument at the southwesterly corner of land of Paradise Point Corporation and on the easterly line of land of. Shelter Island Oyster Company and at the northerly end of the westerly line of Paradise Point Road; running thence along said land of Shelter Island Oyster' Company two courses as follows: (1) NW 19' 15' 20" E. 519. 03 feet; thence , (2) N. 180 29' 20" E. 258.31 feet, thence along other land of Paradise Point Corporation four courses as follows: (1) S. 66' 133 00" E. 100 feet; thence (2) S. 18' 29' 20" W. 49. 79 feet; thence . On motion of Mr. Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the next meeting of the Southold Town Planning Board will be. he ld 7:30 P.M. , Tuesday, March 19, 1963, Town Office, Main Road, Southold, New York. Vote of the Board: Ayes: - Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. Mr. Walter Kapp, attorney fcr Ruth F. Wells, appeared before the Planning Board with regard to the application of Ruth F. Wells for a change of zone from "A" Residential and Agricultural District to "M" Multiple Residence on property at Bayview, Southold, New York. . Mr. Kapp presented an amended description to the Board stating that the original description covered the entire parcel owned by Ruth Wells. The new description includes only the portion under request for an "M" zone. The amended description is as follows: - Beginning at a point which is the northwesterly corner of the land hereinafter described and which point is South 460 08t 50" West 738. 18 feet from a point on Main Bayview Road which is the point of intersection of the easterly side of a private road (which road leads southerly from said Main Bayview Road over lands now or formerly of Richard L. Hammel) with the southerly side of Main Bayview Road; running thence in a generally easterly direction and in a straight line along other land of Ruth F. Wells to a point on the westerly boundary of a private lane and land now or formerly of Mary L. Dayton, which said point is South 380 421 40" West 775. 0 feet Southold Town Planning Board -4- February 11, 1963 from the intersection of said westerly boundary of said private. lane with the southerly side-of Main Bayview Road; thence along the westerly boundary of said private lane South 380 42 ' 40" West 1124. 63 feet to lands now or formerly of Mayer and Dickerson; thence along. said lands the following two courses and distances: (1) North 510 17 ' 20" West 87. 50 feet; (2) South 380 421. 4011 West..200 feet to a point on the ordinary high water line of Little Peconic Bay; thence along the ordinary high water line of Little Peconic Bay North 65" 16' 30" West 560. 15 feet to the easterly boundary of land now or formerly of Giraud C. Campbell; thence North 370 58' 50" East along said land and private road 1053. 68 feet to a point; thence North 340 53_' 10" Rest ,35 feet to Corey Creek; thence along the ordinary high water mark of Corey Creek :on a tie line bearing North 380 57 ' East 250.55 feet to a point on the easterly line of land now or formerly of Richard L. Hammel; thence along said land and the east- erly line of a private road first above mentioned North 46- 08' 50" East 411.82 feet to the point or place of beginning. There were approximately 15 persons present at this meeting to speak in opposition to this proposed change of zone. The Planning Board also received letters of opposition from the following: Lillie and Arthur Jacobson, Lot 5, Bay Haven; Helen B. Pospisil, Bay Haven; A. M. Van Nostrand, Bay Haven; Ann E. and Arch Davis, Bay View Road; Alfred W. Bitz, President, Laughing Water Property Owners Assoc. , Inc. ; Millie Vaskelis, Lot *37, Terry- Waters; Elsie and Harry Johnson, Lot 59, Terry Waters; Robert Bettinardi, Bay Haven. A copy of a letter from Bill and Ruth Wells to property owners in Bay Haven explaining Mr.and Mrs. Wells' intentions in this change of zone matter was alsD presented to the Board by one of the persons in opposition. Hazel Mack spoke, stating that she is an attorney and represents a group of property owners in the Bay Haven development. Mrs. Mack is also a property owner on Bayview Road. She first asked for an adjournment so that she might gather more information on this matter since she was first advised of the proposed change only three days prior. Mr. Young explained to Mrs. Mack that the Planning Board would be willing to listen to the objectors as everyone is welcome at the Planning Board meetings, however, this matter was postponed from the last- Planning Board meeting in January and the Board would probably make their recommendation to the Town Board at this time. The Town Board would then set a date for a public hearing at which time' all persons would be given an opportunity to be heard. Southold Town Planning Board -5- February 11, 1963 The general feeling of those in opposition was that the change to "M" would permit Ruth Wells to do anything specified in the "M" Multiple Residence Zone, including hotels, motels, boarding and tourist houses and tourist cottages. Mr. Kapp explained that Mrs. Wells was sincere in her proposal to erect garden type apartments. After eveyone had expressed themselves the Planning Board closed that portion of the meeting for further deliberation. On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that the Planning Board does not recommend to the Town Board the change of zone from "A" Residential and Agricultural District to "M" Multiple <Residence 'District on the property of Ruth F. Wells as described heretofore. The Planning Board unanimously feels this change of zone would be spot zoning and would devaluate the existing single family residences in the area in view of the fact the "M" Multiple Residence Zone as written in the Building Zone Ordinance leaves too much latitude to the (w ner of "M" zone property. It is further pointed out that the Planning Board does not feel this "M° Multiple Residence District would lend itself to the development of the area in which it is requested. Vote of the Board: Ayes: - Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. Mr. Lefferts P. Edson and Mr. Henry J. Smith appeared before the Planning Board to present a proposed subdivision map of property being developed by Mr. Smith on the north side of the North Road, Peconic. This proposed subdivision contains 21. 162 acres with a total of 35 lots. The road through the center of this proposed subdivision will connect with "Miami Avenue" at the northeast corner of the property. Mr. Smith advised the Planning Board that he intends dedicating the roads to the Town. On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was Southold Town Planning Board -6- February 11, 1963 RESOLVED that the Planning Board grant Henry J. Smith preliminary approval of his proposed subdivision at North Road, Peconic, New York. Map by Otto W. Van Tuyl & Son dated January 24, 1963. Vote of the Board: Ayes:- Mr. Young, Mr. Moisa, Mr. Grebe,, and Mr. Unkelbach. Mr. Lefferts P. Edson and Mr. Raymond Terry and Mr® Ellis Terry appeared before the Planning Board to present a map of proposed highway to be known as Jockey Creek Drive, located on the east side Main Road, Southold in the Open Development Area established by Susan H. and Raymond W. Terry. The Board was in favor of the layout of the proposed road with the proposed easement to Jockey-Creek. This easement will be for; the use of the Town for drainage and access purposes. It is 50 ft. wide with a 106 ft. turnaround at the creek. If this road is extended in the future across the property of Leicht it will end at Oaklawn Avenue opposite Wells Avenue. There is now proposed a 100 ft. turnaround where it ends at the Leicht property. . On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that the Planning Board approves the laying out of Jockey Creek Drive with an easement to the creek as proposed by Raymond and Ellis Terry. This easement will be turned over to the Town for drainage and access purposes. The turnaround at the end of Jockey Creek Drive where it abutts the Leicht property will be turned back to the owners of the road if this road is ever extended to Oaklawn Avenue. Map by, Otto W. On motion of Mr. Unkelbach, . seconded by Mr. Moisa, it was RESOLVED that the minutes of the meeting of January 15, 1963 be approved as submitted. Vote of the Board: Ayes:- Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. Southold Town Planning Board -7- February 11, 1963 The Board informally discussed a proposed change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District to be presented by Mr. A.
