S SOUTHOLD TOWN PLANNING BOARD March 19, 1963 A regular meeting of the Southold Town Planning Board was held 7:30 P.M. , Tuesday, March 19, 1963 at the Town Office, Main Road, Southold,. New York. There were present: Messrs. John Wickham, Chairman, Henry Moisat Alfred Grebe, Archibald Young and William Unkelbach. . Also present: Mr. Otto W.' Van Tuyl, Consultant and Mr. Howard Terryt Building Inspectcr . Mr.- Walter Kapp, attorney for Paradise Point. Corporation appeared before the Planning Board with regard to the public hearing scheduled for this meeting. He stated that they have been having difficulty securing approval from the Suffolk County Health Department for the water supply and wished to ask for a modification of the map. which would include the lots previously contained in an'Open' Development Area and lots 1,2,3,4, and possibly lot 5 on the new proposed map. The Chairman advised that the hearing would be held and approval given for the lots Mr. Kapp indicated he wished included. However, if he should not be able to secure permission from the Health- Department he Southold Town Planning Board -2- March 19, 1963 would have to refile a new layout and start again with another hearing. PUBLIC HEARING: On the question of approval of the following plat: 1. Plat of property owned by Paradise Point Corporation, entitled Paradise Point at Bayview, consisting of a parcel of land of approximately 19.70 acres, situated at Southold, in the Town of Southold, Suffolk County, New York, and bounded and described as follows: Beginning at a monument at the southwesterly corner of land of Paradise Point Corporation and on the easterly line of land of Shelter Island Oyster Company and at the northerly end of the west- erly line of Paradise Point Road; running thence along said land of Shelter Island Oyster Company two courses as follows: (1) N. 19- 151 20" E. 519. 03 feet; thence (2) N. 180 291 20" E. 258. 31 feet, thence along other land of Paradise Point Corporation four courses as follows: (1) S. 66' 131 0011 E. 100 feet; thence (2) S. 18' 291 20" W. 49. 79 feet; thence (3) S. 660 131 00" E. 340.29 feet; thence (4) N. 57- 541 30" E. 103 feet more or less to a dredged canal; thence easterly across said canal about 75 feet; thence northerly along the easterly shore of said canal about 205 feet to Town Harbor; thence easterly along said Town Harbor about 800 feet to land of Sinning; thence along said land of Sinning, S. 40 151 20" W. 229. 00 feet to a 50 foot private road; thence across said private road, S. 159� 381 10" W. 50.76 feet; thence along the southeasterly line of said private road S. 370 081 E. 46. 56 feet to the northwesterly line of a second private road known as "Robinson Road" ; thence along the boundary of said. "Robinson Road" eight courses as follows: (1) S. 520 221 50" W. 527. 99 feet; thence (2) On a curve to the right having a .radius of 127. 00 feet a distance of 103. 54 feet; thence (3) N. 800 541 20" W. 120.75 feet; thence (4) On a curve to the left having a radius of 177 feet a distance of 161.21 feet; thence (5) S. 460 551 50" W. 96.80 feet; thence (6) On a curve to the right having a radius of 150 feet a distance of 175. 08 feet; thence (7) N. 660 131 001, W. 393.70 feet; thence (8) On a curve to the left having a radius of 175 feet a distance of 274.89 feet to the point of beginning. The Chairman opened the hearing by reading notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak in opposition to this proposed subdivision? Southold Town Planning Board -3- , March 19, 1963 (There was no response. ) THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this proposed subdivision? MR. WALTER KAPP: I represent Paradise Point Corporation. THE CHAIRMAN: Do you have the approval of the Highway Superintendent? MR. KAPP: Not as yet. THE CHAIRMAN: I suggest that we adjourn this hearing until April 2. 1963, the date of the next Planning Board meeting, at which time you may supply the highway superintendents report and a new map with health department approval of same. On motion of Mr. Moisa, seconded by Mr. Young it was RESOLVED that the hearing upon the question of approval of plat entitled Paradise Point at Bayview be adjourned to 7:30 P.M. , April 2, 1963. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. A representative of Frederick and Harold Reese appeared before the Board for an informal discussion relative to Southold Shores at Arshamomaque. Mr. Van Tuyl presented a revised preliminary plan of the layout. In the new layout drainage easements are provided. After examining the map the Board advised that they would require a 100 ft. by 100 ft. turnaround where the road ends at the canal on the wester- ly side of the development. They advised that this turnaround could be retained as private property reserved for the interior lots with the provision that it be dedication to the Town for highway purposes, when the roads are dedicated. The Board also advised that the road and drainage layout should be approved by the Highway Superintendent before a final map is drawn and water tests should be made and approval from the Health Department secured. - Map by Otto W. Southold Town Planning Board -4- March 19, 1963 Mr. Henry Smith with his attorney Lefferts Edson appeared before the Planning Board requesting tentative approval of his proposed subdivision to be known as "Peconic Homes, at Peconic" located on the north side North Road. Mr. Smith was granted preliminary approval of his map in February. Mr. Smith advised that he ,has spoken with Mr. Price and he is in favor of the road layout and the connection with Miami Avenue at the northerly end of the development. He will next obtain approval from the Health Department for the water. On motion of Mr. Unkelbach, seconded by Mr. Grebe, it was RESOLVED that Henry-J. Smith be grantedtentative approval of his layout of "Peconic Homes, " Peconic, New York. Map by Otto W. Van Tuyl & Son dated January 24, 1963. It was further RESOLVED that a letter be forwarded to Mr. Lefferts Edson on behalf of Mr. Henry Smith advising that he may now instruct his engineer or surveyor to proceed with computing the map, prepare the finished print, submit cloth prints to the Health Department for approval, and proceed with other matters necessary prior to submitting them to the Planning Board for final consideration. These prints must be submitted at least 15 days prior to a regular meeting of the Planning Board. Vote of the Board: .Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. Mr. Lefferts Edson also appeared before the Planning Board with his client-Mr. Ellis Terry and presented the final approval application to the Town for the laying out of a Town highway. This highway is to be known as Jockey Creek Drive and is located on the east side of Main (State) Road, Southold. In February the Planning Board approved the layout with the provision that a 50 ft. drainage easement to the creek be provided on the southerly side of the property with at least a 100 ft. turnaround at the end. They also requested a 100 ft. turnaround at the easterly end of the road where it abutts the Leicht property. .A-,',:new map by Otto W. Terry, who. consent. to the laying out of the highway. _ Southold Town Planning Board -6- March 19, 1963 On motion of Mr. Unkelbach, seconded by Mr. Moisa, it was RESOLVED that the Planning Board grant approval of the layout of Jockey-Creek Drive to Edith M. Terry, Ellis M. Terry, Raymond W. Terry, Jr. , and Susan H. Terry, and recommend approval of same to the Southold Town Board. Map of Jockey/Drive by Otto W. Van Tuyl & Son revised February 12, 1963. Creek Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. On motion of Mr. Grebe, seconded by Mr. Unkelbach it was RESOLVED that the minutes of the Southold Town Plannin g Board dated February 11: 1963 be approved as submitted. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board received from the Town Board a petition for a change of zone from "A" Residential and Agricultural District to "B" Business District by Joseph Riccardo and Jack Driscoll with instructions to prepare an official report defining the conditions described in the petition and determine the area so effected with the recommendation of the Planning Board. The request for this change of zone is made because the property is in a predominantly business section. This property is bounded and described as follows: Beginning at a monument set on the corner formed by the inter- section of the northerly line of .Main Road New York State Route 25, 0 with the easterly line of Factory Avenue; running thence North 20 22.' 40" West along the easterly line of Factory Avenue 663.35 feet to a monument set in the southerly line of land formerly of John Husing, later of Lee O. Karp; thence North 640 471 50" :;: East along said last mentioned land 664.36 feet to a monument set in the westerly line of Mattituck Cemetery; thence South 370 203 30" East along said Cemetery 440.26 feet to a monument set in the northerly line of said Main Road; and thence South 480 57 ' 30" West along the northerly line of said Main Road 844.83 feet to the point or place of beginning. The Board discussed this proposal and on motion of Mr. Grebe, seconded by Mr. Moisa, it was i Southold Town Planning Board -7- March 19, 1963 . . RESOLVED that Mr. Unkelbach be appointed to contact- the trustees of the Mattituck:Cemetery to ascertain if they have any objections to a business zone abutting- their property. It was further: RESOLVED that this petition be held' for further discussion at the next-.Planning Board meeting. Vote of the Board: Ayes: Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. ; . The- Planning Board received notification from the Riverhead Town Board and Suffolk.Courity ,Department of 'Planning that the Riverhead Zoning Ordinance was being amended to: 1. change the definition of a building; 2. add anew definition of living area.; : 3. add a section which states 800 sq. ft. shall be ,the minimum living area for any new main building to be erected, reconstructed,. altered -or occupied; 4. and by. changing the. designation. of.'a paragraph and deleting certain words in another paragraph. The Planning Board noted in a recent bulletin from the New York State Federation of:Official Planning Organizations that on page 3 the. Federation is opposed to an amendment introduced into the= Senate- by'Senator ' Barrett and into the Assembly by-Assemblyman Duryea extending the -powers of the Town Board to include regulating of house trailers, instead of only when used or occupied as living or sleeping quarters. On motion of Mr. Moisa, seconded by_ Mr. Grebe it was RESOLVED that' a .letter' be .forwarded to the New York State - Federation -of official Planning Organizations advising that the Plannin-g Board is in favor'. of this proposed amendment and cannot ; understand why, the Federation would oppose such an amendment without. consulting the sponsors of the bill whohappen to be the . Town Board of the Town � of :Southold. Vote of .the'Board Ayes:- Mr. Wickham,. Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. :. Supervisor. Alberton •and Town Attorney Tasker appeared before the' Planning Board and formally presented a proposed amendment to - the Building zone-,ordinance as proposed by the Town Board. . 'This ' ' proposed amendment reads as follows: Southold Town Planning Board -8- March 19, 1963 I. By amending' Article III,,. Section 300, Subdivision 11 of the Building Zone Ordinance of the Town of Southold to read as. follows: 11. When authorized as a special exception by the Board of Appeals as hereinafter provided, one (1) sign, single or double- faced, not more than four (4) feet in height and eight (8) feet in width, the lower edge of which shall be not less than two (2) feet above the ground and the upper edge of which shall not extend more than six (6) feet above the ground, provided, however, that such sign shall be set back not less than thirty-five (35) feet from all street lines except that where a set-back line has been established in the vicinity with permanent buildings of more or less than thirty- five (35) feet, such sign shall not project beyond the set-back line so established, and provided further that such sign shall be setback not less than fifteen (15) feet from all property lines. II. By amending ArticlelV, Section 408, Subdivision (b) of the Building Zone Ordinance of the Town of Southold to read as follows: (b) WALL SIGNS -- One (1) sign attached to or incorporated in each building wall and advertising only the business conducted in such building, provided such sign does not: 1. Exceed two (2) square feet in total area for each horizontal foot of such wall, and 2. Exceed in width one hundred (100) percent of the horizontal measurement of such wall, and 3. Exceed ten (10) feet in height, and 4. Exceed fifteen (15) feet six (6) inches from ground level to the upper edge of sign, and 5. project more than one (1) foot from such wall. III. By repealing Article X, Section 1002, of the Building Zone Ordinance of the Town of Southold. The Board members discussed each section of the proposed amendments with the Supervisor and Attorney Tasker. On motion of Mr. Grebe, seconded by Mr. Moisa it was Southold Town Planning Board -9- March 19, 1963 RESOLVED that the Planning Board recommend to the Town Board the proposed amendments to the Building Zone Ordinance as setforth heretofore. The Planning Board is of the opinion this is the only solution to the sign problem which presently exists. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Board briefly and informally discussed with Supervisor Albertson and Attorney Tasker the proposed dredging projects in the Town, land owned by the Commoners, and proposed comprehensive plan. On motion of Mr. Young, seconded by Mr. Grebe, it was RESOLVED that the Planning Board set April 2, 1963, Town Office, Main Road, Southold, New York as time and place for the next' Planning Board meeting. It was further RESOLVED that the members of the Greenport Planning Board' be invited to this meeting to further discuss a comprehensive plan for Southold Town.
