Duryea Jr. State Office Building, 250 Veterans Memorial Highway, Hauppauge, New York, on February 21, 2013 and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an addition and alterations to an existing industrial building of a mixed B business and F-1 factory occupancy, two stories in height of Type IIB, noncombustible construction, approximately 16,489 square feet in,gross area, located at 8595 Cox Lane, Cutchogue, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 19 NYCRR 1221, The 2010 Building Code of New York State, Section 1104.4,which requires that a least one accessible route shall connect each accessible level, including mezzanines, in multilevel buildings and facilities. [The petitioner requests relief to allow approximately 4,464 square feet of a combination of second story and mezzanines to not have an accessible route.] FINDINGS OF FACT 1. The building that is the subject of this petition is properly classified as a mixed B and F-1 occupancy of Type IIB construction and two stories in height. 2. Five of the tenants in the building have mezzanines that to approximately 1,141 square feet. One tenant has a second story of approximately 31232 square feet although,up until this time, an area was sealed off so that the square footage for the second story was under 3,000 square feet. 3. Exception 1 of Section 1104.4 in the Building Code of New York State, 2010, states, in part, that an WVVW.DOS.NY.GOV E-MAIL:INFO@DOS.NY.GOV Petition No. 2012-0544 Page 2 accessible route is not required to stories and mezzanines above and below accessible levels that have an aggri-gate area of not more than 3,000 square feet. The petitioner has pointed out that with the exception of the two-story area, the other tenant spaces with mezzanines would be compliant. 5. The petitioner has listed in the petition that the additional second story and mezzanine square footage over the 3,000 square feet permitted would entail a change so.slight as to produce a negligible additional benefit consonant with the purpose of the Code. 6. The petitioner has stated that the estimated cost to install a lift is$45,000, which is 25 percent of the total cost of the alteration. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulty or.unnecessary hardship, and would create an excessive and unreasonable economic burden, and would entail a change so slight as to produce a negligible additional benefit consonant with the purpose of the Code, and the granting of this variance will not substantially adversely affect the Uniform Code's provision for health, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR 1221, The Building Code of New York State, Section 1104.4, be, and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. The petitioner is Martin Sendlewski . 23 Public notice of the petition was published in the 24 February 13, 2013 edition of the New York State 25 Register. MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 4 1 The petition pertains to an addition and 2 alterations to an existing industrial building of a 3 mixed B business and F-1 factory occupancy, two 4 stories in height of Type 2B, noncombustible 5 construction, approximately 16, 489 square feet in 6 gross area, located at 8595 Cox Lane, Cutchogue, Town 7 of Southold, County of Suffolk, State of New York. 8 The petitioner is seeking relief from 19NYCRR, 9 Part 1221 of the Building Code of New York State, 10 Section -- 11 MR. SMITH: 2010 . I'm sorry, I didn' t put that 12 in there. 13 MR. MAGEE: 2010 version, Section 1104 . 4, which 14 requires that at least one accessible route shall 15 connect each accessible level, including mezzanines, 16 in multilevel buildings and facilities . 17 The petitioner requests relief to allow 18 approximately 4, 464 square feet of a combination of 19 second story and mezzanines to not have an accessible 20 route. 21 Please state your name and present your case. 22 MR. SENDLEWSKI,: My name is Martin Sendlewski, 23 215 Roanoke Avenue, Riverhead. I'm the architect for 24 the current owner of this particular facility. The 25 owner had purchased the building in 2012 . Prior to MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 5 1 the purchase in 2012, the previous owner had to obtain 2 a C.O. for the building. 3 I'm not sure of the date of the original 4 construction of the facility. However, there was no 5 C.O. for the facility, which was required to be 6 obtained prior to the closing. The previous owner had 7 retained an engineering group who had provided 8 documentation to the local building official for 9 occupancy and C.O. ' s for the facility. 10 Based on the review of the local building 11 official, a permit was issued in 2011, September, 12 2011, based on the plans submitted with some notations 13 and modifications . After some improvements, which I 14 believe had to do with some fire separations and a few 15 other issues within the building, a C.O. was issued in 16 February, 2012 . 17 One of the conditions of the permit and C.O. was 18 that there was a second floor area which was built 19 within the shell of the building. It' s a prefab 20 industrial building. When that second floor area was 21 constructed, it exceeded 3, 000 square feet and does 22 not have handicapped accessibility. 23 One of the requirements of the local building 24 official was that the owner basically block off and 25 create a dead space, approximately 300 square feet, to MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 6 1 allow the building to comply without an elevator, 2 which they did do. I have a copy of the C.O. and 3 permit approved sketches of the Town, if you would 4 like me to produce those to you also. [HANDING] 5 Subsequent to the purchase of the facility, we 6 were hired by the current owner to do some 7 improvements to the facility, basically a renovation 8 of the second floor office area in question. He, not 9 understanding the Code, had looked at the facility and 10 was wondering why this area of about 300 square feet 11 was blocked off, and not accessible. We explained to 12 him what the situation was, and submitted a revision 13 set of documents for revision of the second floor, 14 which also included that same requirement where the 15 area was blocked off, and a permit was issued by the 16 Town of Southold for the revisions. 17 That work has been completed. We have the area 18 blocked off. The owner asked if there was any 19 alternatives to having a small area within an existing 20 office not accessible, and I said that the area 21 alternative that we had was to come before the Board 22 of Review, and that is what brings us here today. 23 When I looked at the paperwork, we had a chance 24 of 361 square feet, which was the area that the second 25 floor office is over the requirement to remain without MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 7 1 an elevator. It was pointed out at that time that the 2 aggregate area of mezzanines, which are in other 3 separate locations, may apply to that number. I'm not 4 really sure if this does or doesn' t because they' re in 5 separate areas. 6 That being the case, we noted 1, 141 square foot 7 as the relief that we are looking for. If you looked 8 at your Attachment A, which is the existing plan to 9 the facility prior to our doing the work, the green 10 and pink area is the area in question, the pink area 11 being the unaccessible area, and the blue areas are 12 the additional mezzanines which are separate 13 individual tenant locations within the facility. 14 That basically is really the total content of our 15 appeal at this time. 16 MR. MAGEE: I' ll mark this as Exhibit 1, a copy 17 of the C.O. from the Building Department, which is 18 from the Town of Southold. 19 [WHEREUPON COPY OF C.O. WAS MARKED EXHIBIT 1 IN 20 EVIDENCE. ] 21 MR. SENDLEWSKI : I also have a full set of 22 documents . These are not the permitted set . It' s a 23 set I had gotten from the owner. It' s a little bit 24 clearer than those. 25 MR. MAGEE: No, it' s okay. MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 8 1 MR. HAIMES : The green area, is this all one 2 tenant? 3 MR. SENDLEWSKI : Yes . Basically, it' s a second 4 floor area. What we have done, the owner is occupying 5 the majority of the second floor, based on our second 6 plan Attachment B. He' s occupying a large portion of 7 it, and he has two small additional tenant areas, 8 which are small for leased offices . 9 MR. HAIMES: On the second floor? 10 MR. SENDLEWSKI : Correct . 11 MR. HAIMES: That would be this area? 12 [INDICATING] 13 MR. SENDLEWSKI : That would be the green -- well, 14 actually, his tenancy is located within the outlying 15 of the green area, the whole thing. 16 MR. SMITH: He has portions of the first floor, 17 also. 18 MR. SENDLEWSKI : Correct. 19 MR. HAIMES: But a separate tenant would be this 20 one area. 21 MR. SENDLEWSKI : Actually, separate tenants would 22 be on the top of the sheet here. If you look right 23 here in the middle of the top, it says "Tenant area 24 B. " That would be the one small tenant area. Then, 25 to the left of that tenant area C, the pink area, that MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 9 1 would be another leased tenant area. 2 Above the area would be the owner' s space, and 3 included within that green area is actually one 4 bathroom, which is accessible from the location in the 5 lobby, and he has a bathroom within his own space. 6 MR. MAGEE: Are you proposing to take away the 7 pink dead space? 8 MR. SENDLEWSKI : Take away that wall and allow 9 that to remain an unoccupied office without 10 accessibility. 11 MR. MAGEE: Blocking it off doesn' t help, anyway. 12 MR. SMITH: He' s a separate tenant. 13 MR. MAGEE: What type of business is that? 14 MR. SENDLEWSKI : The owner of the facility, he 15 does have a couple of occupancies in the industrial 16 area. One is a potato chip factory, and his office -- 17 what he' s looking to do, he occupies this office for 18 himself. He lives in Cutchogue, has another office in 19 Riverhead. This building is part of a larger parcel 20 that he' s going to subdivide. 21 He has a concept. It' s called farm to factory to 22 family. What he' s looking to do is encourage his 23 tenants to have properties that he can expand on, so 24 that he' s going to subdivide and allow them to 25 purchase. While they' re developing their products, he MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 10 1 built this office so if they wanted to bring in people 2 to have a presentation or a meeting, they can utilize 3 his conference room, and there is a small kitchenette 4 area that basically anybody that leases from him in 5 the building, or even if he built other buildings, if 6 they wanted to use it as a meeting space, they could 7 come in and use that. 8 He maintains that other area for his own personal 9 office. 10 MR. HAIMES: What about the first floor? 11 MR. SENDLEWSKI : Below the office area there are 12 a couple of vacant offices that he' s going to look to 13 rent. To the side of that, the other areas that are 14 hatched in mostly on Attachment A are really more 15 industrial areas. That is the way they' re going to be 16 maintained. I think originally the entire facility 17 was that type of layout. 18 I would imagine that what happened is the 19 previous owner, at some point, built space above, and 20 had to get that all legalized prior to selling the 21 property. 22 MR. MAGEE: Any fire protection in the building? 23 MR. SENDLEWSKI : Yes . It is not a sprinklered 24 building. There is a fire alarm system, and they meet 25 all the exit and egress requirements for the property. MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 11 1 MR. MAGEE: It meets Code, other than the 2 accessibility? 3 MR. SENDLEWSKI : Yes . Now, I didn' t do the plans 4 for the C.O. and permit for the overall building. 5 That was done by another group, and issued, permitted, 6 C.O. ' d by the Town. I'm assuming that does meet all 7 of the requirements since the C.O. ' s were issued. 8 The only area that we are involved with is the 9 area on the second floor. 10 MR. PETERSON: The tenant on the second floor, as 11 far as toilet facilities are concerned, what 12 facilities do they use? 13 MR. . SENDLEWSKI : There is a facility, as you come 14 up the stair from the lobby, there is a facility off 15 of that existing upper lobby. That is the bathroom 16 that the two additional tenants would have use of. 17 MR. PETERSON: , The existing upper lobby? 18 MR. SENDLEWSKI : Correct. There is a bathroom 19 off the existing upper lobby, and he also has a 20 bathroom for his facility, and if need be, he can 21 access the other toilet from the lobby. The lower 22 level has their own. 23 MR. PETERSON: You' re not proposing a second 24 floor facility that is accessible? 25 MR. SENDLEWSKI : At this point, without the MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 12 1 accessibility, we have the main toilet off the lobby 2 that meets the dimensional criteria. I don' t think we 3 installed grab bars at this point. 4 MR. PETERSON: But it' s new construction. You 5 are building out the bathrooms . 6 MR. SENDLEWSKI : The bathrooms will be built out, 7 correct. 8 MR. SMITH: I think they' re both physically big 9 enough. 10 MR. PETERSON: They' re close. I'm just, for the 11 record, there is a grab bar requirement. 12 MR. HAIMES: What would you do if we did not 13 grant the variance? Would you consider putting in a 14 lift? 15 MR. SENDLEWSKI : We looked at it. There is 16 really no convenient area for us to do that . I think 17 that the owner would -- at this point, he would look 18 into that as an option. If not, prior to that, he 19 would close off the area and get that signed off by 20 the Town to obtain the C.O. for the alteration. 21 They' re ready to issue a C.O. now, but they held off 22 until the hearing because they said if after this 23 hearing, if we were granted the relief, the C.O. would 24 encompass that space. And if not, it would not 25 encompass that space, and we would block it off, and MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 13 1 have it as a void until such time as the owner asked 2 me to do an additional analysis, as to whether or not 3 it would be feasible to install a lift at some 4 location, and he would have to see if economically 5 it' s viable. 6 MR. SMITH: Do you have any idea how much it 7 would cost to put in a lift? 8 MR. SENDLEWSKI : Probably, for a vertical lift, 9 in the neighborhood, I would think, of around 45, 000, 10 including the additional alteration work. 11 MR. SMITH: How much was the alteration work that 12 you did on the second story, dollarwise? 13 MR. SENDLEWSKI : Two hundred thousand dollars . 14 MR. SMITH: That would be roughly about 25 15 percent. 16 MR. SENDLEWSKI : Right. 17 MR. MAGEE: If we granted that, how would you 18 accommodate for -- would they have a space on the 19 first floor? 20 MR. SENDLEWSKI : That could be something that 21 could be accommodated. They have space on the first 22 floor that is unoccupied. 23 MR. SMITH: It' s part of the same facility? 24 MR. SENDLEWSKI : Yes. 25 MR. SMITH: Downstairs has an accessible MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 14 1 bathroom? 2 MR. SENDLEWSKI : Yes. 3 MR. SMITH: They could have meetings down there? 4 MR. SENDLEWSKI : On the larger set of plans, 5 which I have from the previous engineer, it shows the 6 first floor with the handicapped facilities on the 7 first floor, if you would like me to give you a copy 8 of that. Basically, this area here, that is the lower 9 lobby, and the stair going up, and the office area is 10 directly below that location. 11 MR. MAGEE: We have that already. 12 MR. SENDLEWSKI : Correct . That is the plan on 13 Attachment A. One requirement that we could look at 14 is what they have down is they do have a lower foyer 15 area. From that foyer area, you come into a small 16 alcove where that first lower office is . If we wanted 17 to, we would make that lower fire area an exclusive 18 area that allows us -- or actually, from the first 19 floor, we could provide access to the lower level 20 toilet from the foyer, if need be. 21 MR. SMITH: Can' t you get to that, anyway? 22 MR. SENDLEWSKI : You can get to that regardless . 23 He basically has that first floor space open at this 24 point. He' s remaining the occupancy open at this 25 point himself. MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 15 1 MR. SMITH: It might be important that whoever is 2 going to be upstairs has the ability to use something 3 downstairs if they needed to meet somebody, if you 4 didn' t have the vertical accessibility. 5 MR. HAIMES: It' s all one tenancy? 6 MR. SENDLEWSKI : Yes, it' s all interconnected. 7 He will be certainly looking for tenants to occupy the 8 area. If we were to carve out an access or office 9 room for handicapped access on the first floor, that 10 is something that we would have to coordinate with the 11 Town Building Inspector, if that was a condition of 12 the C.O. 13 MR. HAIMES: My concern is if he has other 14 tenants on the first floor, if there is access from 15 the foyer, that means if it' s a separate tenant on the 16 second floor, that means that the second tenant would 17 have accessible facilities . 18 MR. SMITH: Keep in mind, you can have a totally 19 separate business office on the second floor. If that 20 was less than 3, 000 square feet, that would not need 21 to be accessible. It' s a strange thing about the 22 Code, but that is how it is . 23 MR. MAGEE: Any other questions? MAGEE: Back on the record. 2 With respect to the petition of Marvin 3 Sendlewski, Petition Number 2012-0544, the petition 4 pertains to an addition and alterations to an existing 5 industrial building of a mixed B business and F=1 6 factory occupancy, two stories in height, of Type 2B, 7 noncombustible construction, approximately 16, 489 8 square feet in gross area, located at 8595 Cox Lane, 9 Cutchogue, Town of Southold, County of Suffolk, State 10 of New York. 11 The petitioner is seeking relief, requesting a 12 variance with respect to 19NYCRR, Part 1221 of the 13 Building Code of New York State, 2010, Section 1104 . 4, 14 which requires that at least one accessible route 15 shall connect each accessible level, including 16 mezzanines, in multilevel buildings and facilities. 17 The Board makes the following findings : 18 1. The building that is the subject of this 19 petition is properly classified as a mixed B and F-1 20 occupancy of Type 2B construction and two stories in 21 height. 22 2 . Five of the tenants in the building have 23 mezzanines that total to approximately 1, 141 square 24 feet. One tenant has a second story of approximately 25 3, 323 square feet although, up until this time, an MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 17 1 area was sealed off so that the square footage for the 2 second story was under 3, 000 square feet. 3 3 . Exception 1 of Section 1104 . 4 in the Building 4 Code of New York State, 2010, states, in part, that an 5 accessible route is not required to stories and 6 mezzanines above and below accessible levels that have 7 an aggregate area of not more than 3, 000 square feet. 8 In this case, there is an aggregate area of 4, 464 9 square feet above the accessible level, which 10 represents an approximately 49 percent deviation from 11 the maximum 3, 000 square feet permitted. 12 4 . The petitioner has pointed out that with the 13 exception of the two-story area, the other tenant 14 spaces with mezzanines would be compliant . 15 S. The petitioner has listed in the petition 16 that the additional second story and mezzanine square 17 footage over the 3, 000 square feet permitted would 18 entail a change so slight as to produce a negligible 19 additional benefit consonant with the purpose of the 20 Code. 21 6. The petitioner has stated that the estimated 22 cost to install a lift is $45, 000, which is 25 percent 23 of the total cost of the alteration. 24 With respect to 19NYCRR, Part 1221, Section 25 1104 . 4, the Board finds that strict compliance with MODERN SHORTHAND REPORTING AGENCY (631) 421-1602 18 1 the provisions of the Uniform Fire Prevention and 2 Building Code would entail practical difficulty or 3 unnecessary hardship, and would create an excessive 4 and unreasonable economic burden, and would entail a 5 change so slight as to produce a negligible additional 6 benefit consonant with the purposes of the Code, and 7 the granting of this variance will not substantially 8 adversely affect the Uniform Code' s provisions for 9 health, safety and security. 10 Wherefore, it is determined that the application 11 for a variance from the provisions of 19NYCRR, Part 12 1221 of the 2010 Building Code of New York State, . 13 Section 1104 . 4, be and is hereby proposed to be 14 granted with the following conditions : 15 1 . That the second story and mezzanine shall not 16 be further expanded. 17 2 . That any tenants of the second floor shall 18 have access to a usable office space, and toilet room 19 accessible on the first floor. 20 3 . That the toilet rooms on the second floor 21 shall be made adaptable, as per 1109. 2, Exception 1 of 22 the 2010 Building Code of New York State. 23 4 .
