(631)765-1809-Fax(631)765-9064 FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF JULY 5,2012 ZBA FILE No.: 6566 NAME OF APPLICANT: Edward J. Conner PROPERTY LOCATION: 1200 Gillette Rd. East Marion,NY SCTM#1000-38-2-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk, County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 27, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a one story framed house with attached garage and accessory shed on a 10,000 square foot lot in the R-40 zone. It has 100.00 feet of frontage on Gillette Drive, 100.00 feet along the southern property line, 100.00 along the western property line and 100.00 feet along the northern property line as shown on the survey prepared by John Metzger, Peconic Surveyors dated April 17, 2012. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's March 20, 2012, amended June 12, 2012, Notice of Disapproval based on an application for building permit to construct a deck addition to existing single family dwelling: 1) less than the code required minimum rear yard setback of 35 feet, 2) lot coverage at more than the code permitted 20%. RELIEF REQUESTED: The applicant is proposing to construct a deck addition on the rear of the dwelling requiring a variance for a rear yard setback of 19.5 feet where the code requires 35 feet and lot coverage of 26.8% where the code permits-20%maximum lot coverage. AMENDED APPLICATION: The applicant's agent was asked at the public hearing to reduce the size of the deck to make it more conforming to code by reducing the size to 15'X14', instead.of the requested 15'X16'. The agent did not see any issue with meeting this request. ADDITIONAL INFORMATION: The applicant is requesting to deck over his existing ground level patio,with a raised wood deck that is even with the floor level of the home to allow him to access it from the rear of the home, without using any stairs .There were no objections raised by neighbors to the proposed deck. After the close of the Page 2 of 3—July 5,2012 ZBA File#6566-Conner CTM: 1000-38-2-13 first hearing, it was discovered that the applicant submitted a survey to the Zoning Board that differed from the one submitted to the Building Department. The survey submitted to the Building Department did not note the excess lot coverage, so the increased lot coverage was not noted on the original Notice of Disapproval. At the Special Meeting of the Board of Appeals held June 21, 2012, a resolution to re-open this hearing to address the additional lot coverage variance was passed by a unanimous vote. The existing lot coverage is 24.4%,which was allowable at the time the dwelling was constructed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on June 7,2012 and July 5,2012 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This area of Gillette Drive is a subdivision of quarter acre lots. Most additions and alterations into the rear yard area would require relief from the present zoning code. The. rear yards of all of the lots on the easterly side of Gillette Drive in this subdivision are adjacent to tillable farmland which will remain in the Suffolk County agricultural land bank, which renders the farmland unbuildable. The proposed deck is not visible from the street. 2. Town Law �267-b(3)(b)(2). The benefit sought by the applicant for the setback can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could create a 6.7 foot deep deck along the portion of the dwelling that is 41.7 feet from the rear property line. However, the placement of a raised deck in that location is not logical or convenient to the layout of the interior of the house and an outside cellar entrance in that area makes it an impractical location. Because the applicant's house is 35.7 feet from the rear of the property line where the raised deck is proposed, a variance is required. The applicant must obtain a variance for excessive lot coverage because the existing lot coverage is already beyond what the code permits, so any addition to the subject dwelling will require a variance. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 39% relief from the code in regards to the rear yard setback. However, the variance is mitigated by the small size of the lot, the existing location and interior layout of the dwelling, and the adjacency of the rear yard to property that will remain in agricultural use in perpetuity. The variance granted herein for the lot coverage is mathematically substantial, representing 33% relief from the code. However, a review of the immediate area indicates that this Board has granted variances for lot coverage on several improved properties. The excessive lot coverage is based upon the non-conforming size of most of the lots in this subdivision,which average 10,000 square feet in size. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All run off will be retained on site per Chapter 236 of the code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. 1 f' Page 3 of 3—July 5,2012 ZBA File#6566-Conner CTM: 1000-38-2-13 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to DENY, as applied for, and GRANT ALTERNATIVE RELIEF, as follows: 1. the proposed deck shall be reduced to 14'X15', 2. the rear yard setback shall be 21.5' 3. the lot coverage shall be no more than 26.5% Subject to the following condition: 1. The deck shall remain open to the sky. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final architectural drawings conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
