PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T 'E' S SOUTHOLD TOWN PLANNING BOARD April 4, 1963 A regular meeting of the Southold Town Planning Board was held 7: 30' P.M. , Thursday, April 4, 1963, Town- Office, Main Road,. Southold, New York. There were present: Messrs., Archibald Young,- Acting Chairman, Alfred Grebe and William Unkelbach. Absent: Mr. John Wickham (attending another meeting) , and Henry Koisa (fire department elections) . Also present: Mr. Otto W. Van Tuyl, Consultant, Lester M.- Albertson, - Supervisor. Mr. Walter Kapp spoke to the Planning Board with reference to the property of Julius Zebroski at Bayview,- Southold. Mr. Kapp wished- to know if the Board would reconsider an Open Development-.Area- on Mr. Zebroski's property since the cost of filing a map is great and also there are other problems which they cannot seem to resolve. The Board advised Mr. Kapp that the matter had been before them as an Open.' Development- Area and they had not recommended it favorably to the Town Board. Supervisor Albertson advised Mr. Kapp . to refile for an Open Development--Area. Southold Town Planning Board -2- April 4, 1963 PUBLIC HEARZ.NNG: The public hearing upon the question of approval of the following plat was reopened: Plat of property owned by Paradise Point- Corporation, entitled Paradise Point at Bayview, consisting of a parcel of land of approximately 19. 70 acres, situated at Southold, in the Town of Southold, Suffolk- County, New York. MR. YOUNG: We have the report of the Highway Superintendent which reads as follows: "I have inspected the proposed roads at Paradise Point at Bay View, Southold, New York, and found them suitable as to layout and reasonable access. " MR. WALTER KAPP: We have the final map with the Health Department Approval. MR. YOUNG: We seem to have everything in order now. Is there anyone present who wishes to speak in opposition to this proposed subdivision? (There was no response. ) MR. YOUNG: Is there anyone else present who wishes to speak in favor? (There was no respcn se. X MR. YOUNG: Since there is nothing further I will declare the hearing closed. On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED: WHEREAS Paradise Point Corporation has petitioned the Southold Town Planning Board for final approval of their plat known as "Paradise Point at Bayview"i. Southold, New York, and WHEREAS the Superintendent of Highways of the Town of Southold has inspected the map and property and approves the highway layout, and his report is hereby approved by the Planning Board, and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval Southold Town Planning Board -3- April 4r 1963 of the plat- at which time all interested persons were given an opportunity, to be heard,. and WHEREAS the Southold Town Planning Board waives the provisions in the Rules and Regulations for the Subdivision of: Land requiring Park and Playground area or cash equivalent; and WHEREAS the applicant does not intend to dedicate the highways to the Town of Southold. at this time, the highways must meet the specifications of the Highway-. Superinteadefttwhen they are offered for dedication to the Town. The requirement for a performance bond is waived; NOW, THEREFORE, BE IT RESOLVED that the subdivision to be. known as "Paradise Point at Bayview" at Southold, New York, consist- ing of 19.70 acres and owned by Paradise ' Point Corporation be approved. This plat: is bounded and described as follows: Beginning, at a monument. at_ the southwesterly corner of land of Paradise Point ._Corporation and on the easterly -line of land of Shelter Island Oyster Company and at the northerly end of the westerly line of Paradise Point .Road; running thence along said land of: Shelter' Island Oyster Company two courses as follows: (1) N. 19 151 20" E. 519. 03 feet; thence (2) N. Vote of the Board: Ayes: - Mr. Young, Mr. Grebe, and Mr. Unkelbach. in Mr. Unkelbach reported that/the matter of the application for a change of zone from "A" Residential and Agricultural District to "B" Business District by Joseph Riccardo and Jack Driscoll, he 'spoke with Lawrence Reeve of the Mattituck Cemetery and Mr. Reeve planned on calling a special meeting of the Trustees. On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that the minutes of the Planning Board meeting of March 19, 1963 be approved as submitted. Vote .of the Board: Ayes: - Mr. Young, Mr. Grebe, and Mr. Unkelbach. Mr. John Rath and his attorney appeared before the Planning Board for an informal discussion relative to property Mr. Rath has purchased on the North Road, Greenport. This property is known as the Sinuta farm. Mr. Rath plans to develop this property as a subdivision with approximately 76 lots and he expects to have the dwellings:-built himself. There was some discussion relative to cutting down the bank, which the Planning .Board approves and the possibility of extending the village water and possibly the village sewerage system. - Mr. Rath intends dedicating the roads to the Town of Southold and will provide parking and beach area at the bluff. The Board advised they are in favor of the proposed layout. regular The next/meetin g of the Southold Town Planning Board will be held 7: 30 P.M. , Tuesday, May 7, 1963 at the Town Office, Main Road, Southold, New York. The Board received the map of West- Creek Estates at Southold being developed by Ernest and Harold Wilsberg. They requested that a date be set for the public hearing and they anticipate securing Health Department approval of the map before that time. Southold Town Planning Board -5- April 4, 1963 On motion of Mr. Unkelbach, seconded by Mr. Young, it was RESOLVED that Ernest and Harold Wilsberg be granted tentative approval of their proposed subdivision to be known as "West- Creek Estates", Southold, New York. This tentative approval is subject to the approval of the Board of Health. Vote of the Board: Ayes:- Mr. Young, Mr. Grebe, and Mr. Unkelbach. On motion of Mr. Young, seconded by Mr. Grebe, it was RESOLVED that the Planning Board set 7: 30 P.M. (E.D.S.T. ) Tuesday, May 7, 1963, Town Office, Main Road, Southold, New York, as time and place for hearing upon the question of approval of the following plat: Plat of property onned by-Ernest and Harold Wilsberg, entitled "West Creek Estates", consisting of a parcel of land of 33. 2 acres, situated at Southold, Town of Southold, Suffolk County, New York, and bounded and described as follows: Beginning at a monument on the easterly line of Main Bayview Road at the southwesterly corner of land of Polywoda; runnin g thence along said land of Polywoda two courses as follows: (1) S. 69' 19' 10" E. 200. 90 feet to a monument; thence (2) N. 260 06' 30" E. 421. 66 feet to land of Dart; thence along said land of Dart, three courses as follows: (1) S. 72' 59' 30" E. 590.23 feet to a monument; thence (2) S. 750 09' 30" E. 727. 64 feet; thence (3) N. 14' 54' 00" E. 55.86 feet; thence along land of Wilsberg, N. 740 00' 00" E. 386.83 feet; thence along other land of said Dart two courses as follows: (1) S. 71 42' 20" E. 345. 95 feet to a monument; thence (2) S. 260 17 ' 40" E. 415. 97 feet to the ordinary high water line of West Creek; thence in a general southwesterly direction along said ordinary high water mark about 1500 feet to the center of a gutter; thence along land of an unknown owner and the center of said gutter, S. 780-0514OF W. about 330 feet; thence along lands of McAslan, Frederickson, Foster and Hanff, N. 620 45 ' 40" W. 775 feet more or less; thence along land of said Hanff two courses as follows: (1) S. 180 ,31' 00" W. 165. 00 feet to a monument; thence (2) N. 650 29' 00" W. 228.63 feet to a monument on said easterly line of Main Bayview Road; thence along said easterly line, N. 260'-006'1 30" E. 407.49 feet to the point of beginning.
