SOUTHOLD TOWN PLANNING BOARD
May 7, 1963
A regular meeting of the Southold Town Planning Board was
held 7: 30 P.M. , Tuesday, May, 7, 1.963 at the Town Office, Main
Road,.- Southold, New York.
There were present: Messrs. John Wickham, - Chairman, : Alfred
Grebe,. Archibald Young, and William Unkelbach.
Absent: Mr. Henry Moisa, Attending a School Board meeting.
Also present: Mr.. Otto W. Van Tuyl, Consultant and Mr. Howard
Terry, Building Inspector.
Mr. Frank-Zaleski,. Mattituck, appeared before the Planning Board
to present a preliminary map of a proposed subdivision to be, located
on the south- side New- Suffolk Avenue, Mattituck. Mr. Zaleski proposes
to develop the westerly and easterly side of Zaleski Drive, a proposed
new road. There will be. a total of approximately 31 lots on either
side of this road and it will be known as Section I. The remainder
of Mr.. Zaleski's farm will be developed as Section II in the future.
There will be approximately 36 lots remaining in Section II. The
lots shown in proposed Section I all contain over 20,000 sq. ft.

On motion of Mr. Young, seconded by Mr. Grebe, it was
RESOLVED that Frank Zaleski be granted preliminary approval
of Section I of his proposed subdivision map of property located
on the south side New Suffolk Avenue, Mattituck, New York. Map by
Otto W. Van Tuyl & Son, revised March 15, 1963.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
PUBLIC FEARING: On the question of approval of the following
Plat: Plat of property owned by Ernest and Harold Wilsberg, entitled
West Creek Estates, consisting of a parcel of land of 33.2 acres, situated
at- Southold,. in the Town of Southold, . Suffolk. County, New York, and
bounded and described as follows:
Beginning at a monument on the easterly line of Main Bayview
Road at the southwesterly corner of land of� polywoda; running thence
along said land of polywoda two courses as follows: (1) S. 690 19'
10" E. 200. 90 feet to a monument; thence (2) N. 26° 06' 30" E. 421. 66
feet to land of Dart; thence along said land of Dart; three courses
as follows: (1) S. 72° 59' 30" E. 590. 23feet to a monument; -thence
(2) S. 75° 09' 30" E. 727. 64 feet; thence (3) N. 140 54' 00" E.
55.86 feet; thence along land of Wilsberg, N. 740 00' 00" E. 386.83
feet; thence along other land of said Dart two courses as follows:
(1) S. 710 42 ' 20" E. 345. 95 feet- to a monument; thence (2) S. 260

Foster and Hanff, N. 62° 45 ' 40" W. 775 feet more or less; thence
along land of said Hanff two courses as follows: (1) S. 18° 31' 00:
W. 165. 00 feet to a monument; thence (2) N. 650 29' 00" W. 228. 63
feet to a monument on said easterly line of Main Bayview Road; thence
along said easterly line, N. 260 06' 30" E. 407.49 feet-. to the point
of beginning.
(There was an error by the newspaper in the. last course. The
legal notice should read: "N. 260 06' 30" E. 407.49 feet to the point
of beginning.. " The paper had"407.46 feet.")
The Chairman. opened the hearing by reading notice of hearing
and affidavit attesting to its publication in the official newspaper.

THE CHAIRMAN: Is there anyone present who wishes to speak
in opposition?
(There was no response. )
THE CHAIRMAN: Is there anyone present who wishes to speak in
favor?
Mr. Ernest Wilsberg and Mr. Harold Wilsberg spoke in favor of
the proposed subdivision.
Mr. Van Tuyl stated that there was a delay on the part of the
Health Department and they wished more test wells. They have now
approved the wells at a depth of 35 feet but there was not time to
make the final cloth prints and get the stamp of the Health Department
on them. They will be prepared promptly now that approval has been
secured.
THE CHAIRMAN: Do you have a letter from the Superintendent of
Highways giving his report of the road layout?
MR. WILSBERG: No we don=t.
THE CHAIRMAN: We will adjourn this hearing to 7: 00 P.M. ,
Tuesday, May 21st at which time you can submit the final cloth
prints and letter from the Superintendent of Highways.
On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was
RESOLVED that the public hearing on the question of approval
of plat of property to be known as West Creek Estates be adjourned
to 7: 00 P.M. , Tuesday, May 21, 1963.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
On motion of Mr. Young, seconded by Mr. Unkelbach, it was
RESOLVED that a letter be forwarded to the Town Board stating
that at a meeting of the Planning Board on May 7, 1963 a public
hearing was held for final approval of West Creek Estates, property of
Ernest and Harold Wilsberg at Southold, on which the Town paid for
construction of a considerable length of highway as a .pilot project

to establish the cost of such a highway. The Planning Board would
appreciate very much having a copy of the figures showing the cost
of this job for future reference.
Vote of the Board: .Ayes:- -Mr. Wickham, Mr. Grebe,, Mr. Young, ,
and Mr. Unkelbach.
Mr. Julius Zebroski appeared before the Planning Board with his
attorney--Walter: Kapp to discuss his proposed Open' Development-.Area
application on property at Bayview Road,- Southold. The Board asked '
Mr. Kapp why a subdivision map was not- being filed and he replied that
, there are several reasons involved, namely, the cost of filing a map,
. and the right-of-way cannot be counted in the size of the lots. The
Board stated that they were under the impression Mr. Joseph Giordano,
attorney for the present owners of the lots in the proposed ODA was
in the process of filing a subdivision map, . in fact he had been i
touch with the Health Department on several occasions. Mr.. Kapp. still
insisted that this should be handled as an O.D.A. and asked the Boards
favorable recommendation to the Town Board. , The Board stated that they
would be unwilling to recommend it to the Town Board as an O.D.A. and
still wished a subdivision map filed as per a previous agreement several
months ago. Mr.. Kapp was advised that he should consult with Mr.
Giordano relative to his progress in the matter.
Gn motion of Mr. Grebe, seconded by Mr. Unkelbach, it was
RESOLVED that the Planning Board is not willing to recommend to
the Town Board this application for an Open Development Area by Julius
Zebroski on property at Baygiew Road, Southold, in view of the fact there
is a subdivision application being formulated on this matter at the
present. time. Mr. Joseph Giordano called the Board on May 7th and ;
assured the Board he is working on this but has a slight problem with
the Board of. Health.
We can find nothing new in this application for an Open Develop-
ment Area from the previous application. This isBa selfrd created

hardship. . As much as two years ago the Planning
if the Board ofAppeals was willing we would make some concessions,
and when this failed the Board suggested that the problem would be
solved by filing for a subdivision.

and Mr. Unkelbach.

Mr. Harold Reese appeared before the Board to make application
for tentative approval of his subdivision to be known as Southold
Shores at- Arshamomaque. The Board reviewed the .map which indicates
51 lots, all over 20, 000 sq. ft. in most cases, and most of them
fronting on Peconic Bay or proposed canals. There was a question
relative to drainage being run into the canals but it was found this
would be the most favorable solution. There was a further question
relative to the 100 ft. turn-around at the road ending at the westerly
most canal. This road end is shown as tapering to 100 ft. at the canal
and the Board requested that it be shown as a 100 ft. by 150 ft. turn-
around.
On motion of 'Mr. Grebe, seconded by Mr. Young, it was .
RESOLVED that Harold Reese be granted tentative approval of his
subdivision layout to be known as Southold Shores at Arshamomaque,
map by Otto W. Van Tuyl & Son Revised April 29, 1963.
It was further RESOLVED that a letter be forwarded to Mr. Reese
advising that he may now instruct his engineer or surveyor to proceed
with computing the map, proceed with the finished print, submit cloth
prints to the Health Department for approval, and proceed with other
matters necessary prior to submitting them to the Planning Board for
final consideration. These prints must be submitted at least 15 days
prior to a regular meeting of the Planning Board.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
The Board received from the Town Board the original petition of
A. John Gada and Margaret J. Gada, his wife, for an application for a
change of zone from "A" Residential and Agricultural District to "B"
Business District on certain property described as follows: All those
certain lots, pieces or parcels of land situate, lying and being on
Fishers Island, Town of Southold, County of 'Suffolk, and State of New
York, known and designated as Lots "C", "D" , "Eli , "Flit "G° . "H" , "I" ,
"J", and "K" on a certain map entitled- "Plan of Property on: Fishers
Island, New York, formerly owned by Mrs. Martha F. Hoffort, now belong-
ing to Southold Savings Bank, July ,1914" and filed in the office of
the County Clerk of the County of Suffolk on January 2, 1915 as map
number 242, together with the driveway shown and delineated on said
map, the same being bounded on .the south by the said lots C, D, E an d
F , and on the northby the said lots G, H, I, J and K.
On the tax map this property is bounded as follows: North by
West Harbor, East by M. Murphy, W, Torrance, S. Doyen, Jr. and L.
Middelton, South by Montauk-Avenue and West by Dawson.

Mr. Gada appeared before the Board to discuss his application
for a change of zone. He stated that all of the buildings on the
property within the requested area have been used for commercial
purposes in one way or another and they are all non-conforming uses.
There are other business zones in the area. There is one building,
a large dwelling building which has been used for summer rental
purposes and there is one room which cannot be used for dwelling
purposes which was erected some years ago. Mr. Gada has owned this
particular building for five years and one summer had it occupied by
two families.
The property is broken down into lots known as "C" , "D" ,
"Gil "Hill "I" , "J" and "K". On lot "C" is the large dwelling mentioned
heretofore. On lot "D" is a building containing four rental apartments;
on lots "E" and "F" is a large building containing two rental apartments
and a barber shop on the ground floor; on lot "Gil and part of lot "H"
is a building for the storage of materials; on the remainder of lot "H"
and lots "I" , "JF and "K" is a gasoline filling station.
After consideration of the property and review of the map,
including an aerial map submitted by Mr. Gada for the Board's perusal,
On motion of Mr. Unkelbach, seconded by Mr. Young, it was
RESOLVED that the application fora change of zone on the
property of- A. John Gada and Margaret J. Gada be tabled until the
next meeting of the Planning Board on May 21, 1963. In the meantime
the Board will endeavor to have a member look at the property on
Fishers Island.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
Stanley Corwin, Esq. appeared before the Planning Board and
presented a tentative map of "Stars Manor" property owned by Costas
Stars on the north side of Route 25, East Marion. The revised plan
of this property contains 17.50 acres with 26 lots, all containing
over 20, 000 sq. ft. Only one through-road is contemplated and that
will be called Stars Boulevard and it will run from the Main Road
(Route 25) northerly to the end of the subdivision and connect up '
with Cedar Drive. This is a revised layout and is dated May 6, 1963
by Otto W. Van Tuyl & Son.

On motion of Mr. Young, seconded by Mr. Unkelbach, it was
RESOLVED that Costas Stars be grantedtentative approval of his
proposed subdivision to be known as" "Stars Manor" at East Marion,
Map by Otto W. Van Tuyl & Son dated May 6, 1963.
It was further RESOLVED that a letter be forwarded to Mr.
Stanley Corwin, attorney for 'Mr. Stars confirming the action of
the Board and advising that he may now instruct his engineer or
surveyor to proceed with computing the map, preparing the finished
print, submit cloth prints to the Health Department for approval, and
proceed with other matters necessary prior to submitting them to the
Planning Board for final consideration. These prints must be submitted
at least 15 days prior to a regular meeting of the Planning Board.
Vote of the Board: Ayes: - Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
On motion of'Mr. Grebe, seconded by Mr. Young, it was
RESOLVED that the minutes of the Planning Board of April 4, 1963
be approved as submitted.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unkelbach.
The next meeting of the Planning Board will be held 7: 00 P.M. ,
Tuesday, May 21, 1963 at the Town Office, Main Road, Southold, New
Yo3k prior to the joint meeting of the Southold Town Planning Board
and Greenport Village Planning Board to be held that same date at
7:30 P.M.
The next regular meeting of the Southold Town Planning Board
will be held 7: 30 P.M. , Tuesday, June 11, 1963 at the Town Office,
Main Road, Southold, New York.
The petition of Joseph Riccardo and Jack- Driscoll for a change
of zone from "A" Residential and Agricultural District to "B" Business
District on certain property located on the northeasterly side of Route
25, and Factory Avenue, Mattituck again came before the Planning Board.
Mr. Unkelbach reported that he had discussed this with the cemetery
trustees and they asked that the matter be postponed further until
May 21st.

On motion of Mr. Grebe, seconded by Mr. Unkelbach, it was
RESOLVED that the recommendation on the petition of Joseph
Riccardo and Jack Driscoll be postponed to May 21, 1963.
Vote of,,the Board: Ayes:= Mr. Wickham, Mr. Grebe, Mr. Young,
and Mr. Unk:elbach.
The Planning Board received from Brown and Anthony, New York,
a letter stating that three representatives of their firm, Messrs.
Robert Carlson, David Rodetsky and Adam Krivatsky will be at the
Town Office, . Southold, at 7: 30 P.M. , May 21st to speak of the
qualifications of Brown and Anthony with regard to the contemplated
master plan.
A letter was received from the Suffolk County Department of
Health enclosing a resolution of the Board indicating that the
Suffolk County Department of Health, after thorough investigation
and evaluation of present methods of disposing of sewage in realty
subdivisions, believes individual discharge of sewage into the ground
water ' is contributing to existing and future public health problems
through ground water polution, therefore the Board of Health establi6h
the policy for the Department of Health that disposal of sewage for
realty subdivisions be accomplished through the construction of communal
sewage treatment and collection systems. They further state that
where the number of ultimate homes is less than 1001 economic
feasibility would be questionable.
