Wednesday,. August 14, 1963 at the Town Office,. Main Road, Southold, New York. There were present: Messrs.. John Wickham, Chairman, Henry Moisa,.. Alfred Grebe,- Archibald Young,. and William Unkelbach. . Also present: Messrs. Howard Terry, Building Inspector and Rod Van Tuyl appearing for Otto W. Van Tuyl,. Consultant. PUBLIC HEARING: On the question of approval of- the following plat: Plat of property owned by Harold and Frederick-Reese, entitled °Southold Shores at Arshamomaque,," consisting of a parcel of land of 34 acres, situated at Greenport, Town of: Southold, Suffolk County, New York., and bounded and described as follows: Beginning at a point on the southeasterly line of Main (state) Road, N. 690 07' 20" E. 151. 91 feet,. thence N. 510 37= 2011 E. 154. 01 feet along said line from the northwesterly corner of land. of Harold& Frederick Reese; running thence along the c Southold Town Planning Board -2- August 14.,. 1963 southeasterly line of the Main (State) Road three courses as follows: - (1) N. 5.1' 373 20" E. 419.45 feet; thence (2) N. 480 043 50" E. 230.47 feet; thence (3) N. 270 461 00" E. 200. 00 feet to land of Sage; thence along said land of Sager . The Chairman opened the hearing by reading notice of hearing,. affidavit attesting to its publication in the official newspaper and letter from the Highway Superintendent. THE CHAIRMAN: Is there anyone present who wishes to speak in opposition to the proposed subdivision'? (There was no response. ) THE CHAIRMAN: Is there anyone present who wishes to speak in favor of the proposal? MR.. HAROID REESE appeared in favor of the application. (The Board discussed the final map and found it to be in order. ) THE CHAIRMAN: If there is nothing further to come before this hearing and in view of the fact the applicant has met all of the requirements I will declare thehearing closed. Southold Town Planning Board -3- August 14i 1963 On motion of Mr. Unkelbach,, seconded by- Mr. Moisa.,. it was RESOLVED: WHEREAS Harold and Frederick Reese have petitioned the ,Southold Town 'Planning Board for final approval of their plat known as "Southold Shores at Arshamomaque.,," at Greenport,, New York; and WHEREAS The Superintendent- of Highways of the Town of Southold has inspected the road layout and found them suitable for reasonable access and his report is hereby approved by -the Planning Board; and WHEREAS... the Southold Town Planning .Board,, pursuant to due notice thereof held a public hearing ,on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard; and WHEREAS,. the Southold Town Planning Board waives the provisions in the rules and regulations for the subdivision of land requiring park and playground or cash equivalent; and WHEREAS., the highways in this subdivision will not-. be dedicated to the Town of 'Southold at this time= the highways must meet-- the specifications of the Highway Superintendent when they are offered for dedication=. and the requirement. for a performance bond is waived; NOW THEREFORE BE IT RESOLVED that the subdivision to be known as "SoutholdShores at Arshamomaque".,. Besch of Mattituck, New York relative to a change of zone from "A" Residential and Agricultural District to "B" Business District on certain property situated in Mattituck, New York,. with instructions to prepare an official report defining the conditions described in the petition and determine the area so effected with the recommendation of the Board. This property is bounded and described as follows: Beginning at a point on the northerly side of Main Road as widened at the southwest corner of the premises herein described adjoining the easterly side of premises now or formerly of William Maston; running thence along the easterly side of land now or formerly of William Maston North 34 degrees 15 minutes 00 seconds West 182.36 feet to land of the Long Island Railroad Co. ; running thence along the land of the Long Island Railroad Co. the following three courses and distances: (1) North 47 degrees 06 minutes 40 seconds 'East 302. 96 feet (2) North 26 degrees 38 minutes 30 seconds West 12 feet (3) North 45 degrees 27 minutes 30 seconds East 478. 09 feet to the westerly line of land now or formerly of C. Southold Town Planning Board -5- August 14',. 1963 The• applicants state the reason for the requested change isil for the purpose of operating a riding academy on the premises. The Board examined the map by- Otto W. Van Tuyl &' Son dated -October 19,, 1962 which appeared in the file and discussed the character of the area. OnImotion of. Mr. Grebe,. seconded by Mr. Moisa,, i t was RESOLVED that the Planning Board recommends favorably to the Town Board the the property of Carl Henry Besch and Ethel R. Besch beychanged from "A" Residential and Agricultural District to "B" , Business District. . It is further -RESOLVED that the Planning Board recommends that . the Town Board on its own motion zone "B" Business the property on the north side of Main Road from the westerly side of property, of C. A. Price & Co..,, Inc..,, presently zoned "B" Business,. to the westerly side of the property of William Maston adjoining a private right-of- way. This property should be -zoned the full depth to 'the property of the Long Island Railroad Company. In view of the fact- Henry Kersnowski has requested that he be included in this change of zone, and he presently operates a non- conforming farm stand on his propertyt it is the opinion of the Plan- ning Board this entire area should be zoned 'B" Business. This area on the northerly side of Main Road,. Laurel,, is fast becoming a commercial area and should be zoned correctly for that use. Vote of the Board: Ayes:- Mr. Wickham,. Mr. Moisa,. Mr. Grebe.:, Mr. Young.;, and Mr. Unkelbach. On motion of Mr. Mcasa,, seconded by Mr. Young,, it was RESOLVED that the minutes of July 16, 1963 be approved as submitted. Vote of :the Board: Ayes:- Mr. Wickham,. .Mr. Moisa, Mr. Grebe,, Mr. Young, and Mr. Unkelbach. Planning Southold Town/Board -6- Au§ust 14, 1963 Mr. Van Tuyl presented to the Board the final map of "Stars Manor" at East Marion,, New York,. and advised that the map is now ready for the final hearing. The last detail is the report of the Highway Superintendent which will be secured by ' Mr. Costas Stars' attorney. On motion of Mr. Moisa, seconded by Mr. Young, it was RESOLVED that the Planning Board set 7:30 P.M. ,. Tuesday, September 17,. 1963,. Town Office,- Main Road, Southold, New York, as time and place for hearing upon the question of approval of the following plat: Plat of, property owned by, Costas Stars,.. entitled "Stars Manor, " consisting of a parcel of land of 17.50 acres, situated at East Marion, Town of Southold, Suffolk- County,. New York, and bounded and described as follows: (See page 9 for legal description. ) Vote of the Board: Ayes:- Mr.- Wickham, Mr. Moisa, Mr. Grebe,, Mr. Young,. and Mr. Unkelbach. Mr. Young brought up the point before the Board that he felt all future proposed businessstreets should be 70 ft. in width to allow for parking on either side and sufficient room for two cars to pass. The Board was inclined to agree with Mr. Young and kept that point in mind in connection with the next application. The Board received from the Town Board the original petitions of (1) William J. Baxter, Jr. , and (2) ' William J. Baxter, Jr. , . Patricia Baxter, Robert A. Goeller, Jr. , Jane P:. Goeller and William J. Baxter, Sr. requesting a change of zone from "A" Residential and Agricultural District to "B" Business` District with the instructions to prepare an official report defining the conditions described in the petitions and determine the area so affected with the recommendation of the Board. The property of William J. Baxter,. Sr. is situated in Cutchogue, New York, and more particularly bounded and described as follows: Beginning at the intersection of the north- westerly line of School House Road with the southwesterly line of Griffing Street and running along said southwesterly line of Griffing Streets two courses as follows: (1) S. 380 052 40" E. 635.81 feet; thence (2) S. 490 341 40" E. 122. 98 feet; thence along land of the Roman- Catholic- Diocese of' Rockville Centre three courses and distances as follows: (1) S. 70' 282 40" W. 23.67 feet; thence (2) S. 39' 519 40" W. 185.55 feet; thence (3) N. 370 13' 30" W. 790.57 feet; thence along other land of the petitioners herein on the direct extension southwesterly of said northwesterly line of School House Road, N. 520 553 20" E. 167.39 feet to the point of beginning. After reviewing the aforementioned petitions the Board,,, on motion of Mr. Moisa, seconded by Mr. Young RESOLVED that the matter, be held for the next meeting of' the, Planning Board and in the meantime the Board would meet with Monsignor Brennan and William J. Baxter relative to widening and straightening Griffing Street. The Board feels the road should be 60 ft. or 70 ft. wide. The Chairman advised that he owns property in the area and he would also be willing to give up 10 ft. additional to widen the road. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr.Unkelbach. Southold Town Planning Board -8- August 14, 1963 A letter was forwarded to the Southold Town Board advising that the matter is being held for the September 17th meeting so that the Board may meet with Monsignor Brennan,. and Mr. Baxter. The next meeting of the Southold Town Planning Board will be held 7:30 P.M. ,, Tuesday, September 17, 1963 at the Town Office, Main, Road, Southold,, New York. The Board received a bulletin from the Suffolk- County Health Department- which states in part -that after January 1,. 1965 public sewage facilities will be required for all realty subdivisions. The Chairman stated that he had received a letter from Malcolm Pirnie giving a report on the ground water resources in the Town cf Southold by the State Water Resources Commission which he found. very interesting. They plan to have Mr. Whitlock meet with the Board in the near future to discuss this subject further. Correspond- ence was also had ;.:by.:; the Chairman and Dr. Olaf Larson, Head of the Department of Rural Sociology at-.Cornell. Dr. Larson and Mr. Howard Conklin propose to visit with the Planning Board in early October to get a first- hand understanding of the situation. In• September ' Mr. Wickham will meet with the Director of Cornell University, W. K. Kennedy. The dates of October 15th or 22nd were suggested for meeting with Dr. Larson and Mr. Conklin. The Board briefly discussed the forthcoming budget for 1964. It was felt an increase in the salaries of the Planning Board would be in order since a great- deal of work lies ahead in the formulating of the Master Plan. It was further felt .Mr. Grebe should be compensated slightly higher than the others because of his difficulty in traveling to and from Fishers Island for the Planning Board meetings. There was considerable discussion relative to the highway specifications. Mr. Young stated that he feels the .specifications should be revised because dedication cannot be accomplished wi-. the regulations the way they are now. Further, construction methods should be revised and standardized for all subdivisions. The proposed sand pit ordinance was briefly discussed. r' Southold Town Planning Board -9- August 14, 1963 The following is the legal description of the proposed subdivision of- Costas Stars to be known as "Stars Manor" at .
