PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T'E" S SOUTHOLD TOWN PLANNING BOARD September 17, 1963 A regular meeting of the Southold Town: Planning Board was held 7:30 P.M. , Tuesday, September 17, 1963 at the Town Office, Main Road, Southold, New York. There were present: Messrs. John Wickham, Chairman,. Henry Moisa, Alfred Grebe,. Archibald Young, and William Unkelbach. Also present: Messrs. Otto'W. . Van Tuyl, Consultant and Howard Terry, Building Inspector. PUBLIC HEARING: On the question of approval of the follow- ing plat: Plat of property owned by-Costas' Stars, entitled . "Stars Manor, " consisting of' a parcel of land of 17.50 acres, situated at East Marion,_ Town of Southold, Suffolk County, New York, and bD unded and described as follows: Beginning at a concrete monument on the northerly line of'Main Road at the southeasterly corner of land of Costas - Stars and running thence along said northerly line of Main Road,. Young opened the hearing and the legal notice of the hearing and affidavit of publication by the official newspaper were read. Mr. Young read the letter from the Superintendent of Highways which stated he had inspected the proposed roads at Stars Manor, East Marion, New York, and found them suitable as to layout and reasonable access. MR. YOUNG: Is there anyone present who wishes to speak in opposition to this development? MR. THEODORE SCHROEDER: I am not here to oppose this. There is just one question. He bounds us on the west, does this road abut us or is there any property left between us and the road? STANLEY CORWIN, ESQ. : There is no buffer zone. The easterly line of the road is now the westerly line of your property. MR. SCHRODER: what about the jog at the beginning of the road. Before there was a strip left there between us and the road. MR. CORWIN: That is no longer that way. That is all public property and it is not reserved to the owner. Southold Town Planning Board -3- September 17, 1963 MR. YOUNG: Is there anyone else here who has anything in opposition to this subdivision? (There' was no response. ) MR. YOUNG: I's there anyone here who wishes to speak in favor of this subdivision? (There was no response. ) MR. CORWIN:' I represent Mr. Stars. I do not have anything I wish to say for the recordr other than the application speaking for itself. I havenothing to add. MR. YOUNG: If there is no further discussion we will declare the hearing closed. On motion of Mr. Unkelbach, seconded by Mr. Grebe, it was RESOLVED: WHEREAS Costas Stars has petitioned the Southold Town Planning Board for final approval of his plat known as "Stars Manor" at- East Marion, New York; and WHEREAS the Town Superintendent of Highways has inspected the road layout and found them suitable for reasonable access and his repott is hereby approved by the Planning Board; and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard; and WHEREAS the Southold Town Planning Board waives the provisions in the rules and regulations for the subdivision of land requiring park and playground or cash equivalent; and WHEREAS the highways in this subdivision will not be dedicated to the Town of Southold at this time, the highways must meet the specifications of the Highway Superintendent when they are offered for dedication, and the requirement for a performance bond is waived; Southold Town Planning Board -4- September 17, 1963 NOW TBEREFORE BE IT' RESOLVED that the subdivision to be known as "Stars Manor", East Marion, New York, consisting of 17. 50 acres and owned by Costas Stars be approved. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. Mr. George Schrodder discussed withfhe Planning Board and Mr. Stanley Corwin the dedication procedure for Stars Road in the newly approved, subdivision. On motion of Mr. Moisa, seconded by Mr. Young, it was RESOLVED that the minutes of the Southold Town Planning Board of August 14, 1963 be approved as submitted. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. Southold Town Planning Board -5- September 17, 1963 The Chairman reported that several members of the Planning Board met with Monsignor Brennan and discussed widening Griffing Street and he was most cooperative. The' Chairman thereafter met with Stanley Case and he feels that School Street Extension and North Street should be widened at the same time. Mr. Case would be willing to dedicate 10 feet to his barn and 5 feet to the highway. The Chairman then talked to William Baxter, Sr. and his attorney- William Wickham, and since he owns both sides of Griffing. Street he does not see how it would hurt hire.. William Baxter, Jr. and Sr. both said they were going to give 20 feet . along the rectory to Monsignor' Brennan but they have not done this as yet. The Chairman feels there is no reason this block cannot be 60 feet to Stanley Case' s house lot and 55 feet from there to the street and the Board is agreeable to that. On motion of Mr. Moisa, seconded by: Mr. Grebe, it- was RESOLVED that a letter be forwarded to the Town Board advising that the Planning Board has been working on the, petitions of (1) William J. Baxter, Jr. and (2) William J. Baxter, Jr. , Patricia Baxter, Robert A. Goeller, Jr. , Jane P. Goeller and William J. Baxter, Sr. and feel they are making some progress toward widening Griffing Street, School Street Extension and North Street. All parties concerned in the widening have been most cooperative, they are Monsignor Brennan, William J. Baxter, Sr. and his attorney William Wickham, Stanley Case and John Wickham. At this time they are attempting to get final agreement and an offer of dedication. vote of the Board: Ayes:- Mr. Grebe, Mr. Wickham, Mr. Moisa, Mr. Young, and Mr. Unkelbach. Mr. Young wished the record to show that the Planning Board is very much in favor of 70 ft. roads in any future business areas and the Planning Board concurred with this and is fully in agreements Notification was received from the Suffolk County Depart ment of. Health, Riverhead, stating that effective October 1, 1963 a filing fee of $3. 50 per lot will be required for all realty subdivisions approved by their office. Southold Town Planning Board -6- September 17, 1963 On motion of Mr. Grebe, seconded by Mr. Young, it was RESOLVED that the following Annual Estimate be submitted to the Southold Town Board for the fiscal year beginning January 1, 1964: Expenditures: Stationery, postage, printing Advertising legal notices, etc. $300. 00 Telephone (Chairman) and Office 30. 00 Association of Towns Mtg. - New York 350. 00 Office Equipment 150. 00 Transportation (Fishers Island Member) 800. 00 Car Expenses C $ . 10 75. 00 Member Remuneration } Chairman $1050. 00 Fishers Island Member 1050. 00 Others 950. 00 4950. 00 TOTAL EXPENDITI]RES $ 6655. 00 Revenues: (Estimated) Income from Subdivision Applications $ 350. 00. Dated September 17, 1963. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and .Mr. Unkelbach. It was FURTHER RESOLVED that a letter be forwarded to the Southold Town Board stating that the Planning Board is progressing rapidly toward a Master Plan and it is our belief that there will be some real expense in that connection. We think the Town Board should be prepared for it with a separate budget item either specifically for a Master Plan, under Town Engineering, or some other way. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Chairman informed the Board that in,.late August he attended a hearing in Riverhead held by the Water Resources Commission relative to classifying all surface waters, bays Southold TownPlanning Board -7- September 17, 1963 and creeks in Southold, Riverhead, Shelter Island and other townships and he discovered that in classifying quite a few of the creeks in Southold Town they were designated as unfit for shellfishing either commercial or otherwise. They were given 90 days in which to file recommendations. The Chairman wrote a letter to Supervisor Albertson apprising him of the situation and suggested that it be determined who in the Town should make the study. Supervisor Albertson suggested that the Planning Board do it and call on the Town Trustees to approve it. However the Planning Board has received no official communication from the Supervisor on this. The Chairman suggested that the Planning Board set aside some time at their next meeting to study this matter. A letter was directed to the Town Trustees apprising them of the situation and enclosing a copy of the Chairman's letter to Supervisor' Albertson relative to this. A letter was also forwarded to Supervisor' Evans K. Griffing of' Shelter Island advising him of the classification stating that this Town is taking steps to rectify the situation and hope his Town Board will do the same. A letter was also forwarded to Colonel A. F. Dappert of the NewYork- State' Department of Health, Albany requesting six copies of the report: "Suffolk- County Survey Series No. 5, Surface Waters of Eastern Suffolk County. " Also requesting the name of the engineer or technician responsible for locating test points as the Chairman's study of the aforementioned report seems to indicate that some of the creeks we are interested in had no tests in the salt area. The next meeting of the Southold Town Planning Board will be held 7: 30 P.M. , Tuesday, October 1, 1963 at the Town Office, Main Road, Southold, New York. Meeting adjourned at 9: 30 P.M.
