Y. 0.l A PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T E 'S SOUTHOLD TOWN PLANNING BOARD January 15, 1963 A regular meeting of the Southold Town Planning Board was held 7: 30' P.M. , Tuesday, January 15, 1963 at the Town Office,. Main Road, Southold, New York. There were present: Messrs.- Archibald Young, Acting Chairman, Henry Moisa, Alfred Grebe, and William .Unkelbach. Absent: Mr. John:Wickham,- Chairman Also present: Mr. Otto-W. Van Tuyl, Consultant, and Mr. Howard Terry, Building Inspector. Mr. Joseph Giordano and Mr.- Walter Kapp appeared before the Planning Board to present a preliminary map of property at Bayview,. Southold, now owned by 10 individuals. Mr. Giordano advised that these 10 individuals are going to. reconvey their lots back to the former- owner- Mr. Julius Zebroski and Mr.. Zebroski will make an application. for a subdivision on the basis of the preliminary map submitted. The revised map contains 9 lots, and after the map is approved and filed Mr. Zebroski .will deed the lots back to 9 of the present owners. Southold Town Planning Board -2- January .15, 1963 On motion of Mr. Unkelbach, seconded by Mr. Grebe, it was RESOLVED that Julius Zebroski be granted preliminary approval of his proposed subdivision map dated January 10, 1963 by-Otto W. Van Tuyl. Vote of the Board: Ayes: - Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. PUBLIC HEARING: On the question of approval of the following plat: 1. Acting Chairman Mr. Young opened the hear.in g by reading legal notice of hearing, and affidavit attesting to its publication in the official newspaper. ACTING CHAIRMAN: Is there anyone who wishes to speak in opposition to this proposed subdivision? (Therewas no response. ) ACTING CHAIRMAN: Is there anyone who wishes to speak . in favor of this proposed subdivision ? Southold Town Planning Board -3- January 15, 1963 MR. CHRIST STRATAKIS: I am one of the owners. We have requested your Board with the assistance of Mr. Van Tuyl to permit this subdivision because we the owners would like to take some of this property for our own person use. We have been out here several years and we like the area and we would like to build houses and spend some time here. In addition we request the Board to permit the subdivision of the balance of the property since we do have some friends who are respectable citizens who are interested in buying some of this property. We have sold five lots to relatives or good friends. If this subdivision is approved we will not discredit the community and we will be careful of the persons we are selling the property to. . The fact we are keeping some of the property for our own use is one of the safeguards. ACTING' CHAIRMAN: Do yuu have approval of the water? MR. VAN TUYL: The water test had been made but the analysis was made for one thing and not another, but that has been cleared up and the Health Department stamp is on the final map. ACTING CHAIRMAN: This Stratmors Road will dead-end up against the Rosenberg line? MR. STRATAKIS: Yes. It has a 50 ft. width, the same as Rocky Point- Road. About a year ago I asked Mr. Rosenberg' s attorney, Mr. Corwin, if Mr. Rosenberg might want to extend the road and he did not at the time, I have heard nothing further. ACTING CHAIRMAN: Therefore, the road will be private until such time as Mr. Rosenberg develops his property and it can be carried through. Is there anything further? (There was no response. ) .ACTING CHAIRMAN: Since there is nothing further I will declare the hearing closed. On motion of Mr. Grebe, seconded by Mr. Moisa, it was Southold Town. Planning Board -4- January 15, 1963 RESOLVED: WHEREAS Christ- Stratakis, Steve Moraitis and Emanuel Moraitis have petitioned the Southold Town Planning Board for. final approval of their plat known as "Stratmors Estates" at - East Marion, . New York, and WHEREAS the Superintendent of Highways of the Town of Southold has inspected the map and approves the highway layout of roads to be constructed,.. and his report is hereby approved by the Planning Board, and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard, and WHEREAS the Southold Town Planning Board waives the provisions in the Rules and Regulations for the Subdivision of Land requiring park and playground area or cash equivalent; WHEREAS the applicants to not intend to dedicate the highway to the Town of Southold at this time, the highway in this subdivision must meet the specifications of the Highway Superintendent before being approved for dedication by,the Planning Board; NOW THEREFORE BE IT RESOLVED that the subdivision to be known as "Stratmors Estates" at East Marion, New York, consisting of 5. 0 acres and owned by Christ Stratakis, . ABELSON: There is an error in the legal description. It includes Mr. Horton's property. I bought the Horton property and simultaneously deeded it back to Mr. Horton. THE CHAIRMAN: We will show the corrected description in the minutes and that will be the description used if this sub- division is approved. Abelson has petitioned the Southold Town Planning Board for final approval of his plat known as "Arrowhead Cove" at Indian Neck, Peconic, New York, and WHEREAS the Superintendent of Highways of the Town of Southold has inspected the map and approves the highway layout of roads to be constructed, and his report is hereby approved by the Planning Board, and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard, and WHEREAS the Southold Town Planning Board waives the provisions in the Rules and Regulations for the Subdivision of Land requiring park and playground area or cash equivalent; WHEREAS the applicant does not intend to dedicate the highways to the Town of Southold at this time, the highways in this sub- division must meet the specifications of the Highway Superintendent before being approved for dedication by the Planning Board and the requirement for a performance bond is waived; NOW THEREFORE BE IT RESOLVED that the subdivision to be known as ".Arrowhead Cove" at Indian Neck, Peconic, New York, consisting of 31. 1 acres and owned by Nathaniel 0. The applicant requests this change of zone from "A" To "M" for the purpose of erecting garden type apartments. „ Mr. Walter Kapp, attorney for the applicant, and Mr. William Wells, appeared before the Board to answer questions, and to present an artists conception of the proposed garden--type apartments. Mr. Wells also presente a photograph of an tae-rial view of the property. They stated that there would be at least a 50 ft. road serving these proposed apartments and they have provided a buffer zone. at Main Bayview Road of approximately 738 feet. Southold. Town .Planning Board 10 January 15, 1963 { Since only two members of the Board had viewed this property, it was proposed that the matter be held over to the next meeting so that the remainder of the Board might visit the property and become familiar with it. Mr. Kapp also presented to the Board a preliminary plan for a proposed subdivision to be. known as Paradise Point at Bayview, Southold, New York. This proposed subdivision will contain approx- imately 32 lots. , Lots 33 through 37 are to be omitted from the proposed plan because they have been sold. _ On motion. of Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that Paradise Point Corporation.- be granted preliminary approval of their 'proposed. s.ubdivisi:on to ..be. known as Paradise Point at 'Bayview, . Board :to present ,a .revised preliminary plan of West Creek Estates at Southold, New ..York. This proposed plan contains '33.2 acres, with ,52 lots. After reviewing the layout and finding it satisfactory, on motion of Mr. Moisa, seconded,by Mr. Grebe,. it was RESOLVED that Ernest-' and Harold'.Wilsberg .be granted -preliminary approval of their revieed preliminary plan of`West Creek Estates, Southold, New. York. Map by-Otto W. Van Tuyl & :Son dated March 26, 1962' and revised November 30, 1962. Vote ' of the Board: Ayes: Mr. ' Young, Mr. Moisa, Mr. Grebe,.'and Mr. Unkelbach. On motion of Mr. Unkelbach, seconded by Mr. Grebe,_, it was. RESOLVED that. the ,minutes of December 18, 1962 be approved as submitted. Vote of the. Board: Ayes: Mr. Young., Mr. Moisa, Mr. Grebe, .,an d Mr. Unkelbach. Southold Town Planning .Board 711- JanUar, -15, 1963 . Mr. _Howard Terry presented to the Board for an informal discussion and approval a map: of. property owned by Edwin H. King at Greenport. Mr. King proposes to subdivide this property and . there is, proposed a 50 ft. road running from' -old Main South Roads , into the property to be subdivided. This property is bounded south. by Main Road; west by .Chapel Lane and north by Middle or North Road. The Board further discussed this layout and proposed road and on motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that .this proposed layout with. 50 ft.. road be approved to a .depth of 500 feet only, and subject -to filin g a subdivision map on the entire area. Vote of the Board: ,dyes:-- Mr. Young;" Mr. Moisa,. Mr. Grebe, and Mr. Unkelbach. The Board again discussed the application for a'' change of zone from "A" Residential and Agricultural District to "M" Multiple Residence'District by Martin Charles Pfeffer, 174 S. First Street, Lindenhurst, New,York. This matter has been before the Planning Board on several other occasions but held .over. to determine the feelings of the neighbors. 'Mr. Young read a letter he recently received from Cary.:Mulford Oxley. stating that she . is in opposition 'to this change. of, zone..'. Mrs. , Oxley is an adjoining property owner. On motion . of Mr.' 'Grebe,' seconded by Mr.,, Moisa, it was RESOLVED that the Planning_ Board does not recommend favorably to the Town Board the change' of zone from "A" Residential and Agricultural District to "M"- Multiple Residence 'District on the , property of Martin Charles Pfeffer._ This property is bounded and '. described as follows: All that certain plot,,. piece or parcel of land, situate, lying and being at Greenport, Town 'of Southold, County of Suffolk .and State of New York, bounded and described as follows:- BEGINNING at- a point- on' the northerly side of North .Road (Middle Road) where'' it .is intersected by the easterly side of land now or formerly of � Carey -Sawinson; thence along said last-mentioned land the following two (2) courses and- distances:- 1. North: 23021140"West 125.87 feet; 2. Map by Otto W. Van Tuyl & Son dated July 19t 1962. The Planning Board feels this proposal would be spot zoning and would not fit in with the general character of the neighborhood. The property lies approximately 500 feet or more further east than that nearest "M" Multiple Residence District and therefore would not conform with the overall area. Vote of the Board: Ayes: - Mr. Young, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. The Planning Board received a copy of the revised Highway Specifications for the Town of Southold recently adopted by the Southold Town Board. The next ire eting of the Southold Town Planning Board will be held 7:30 P.M. , Monday, February 11, 1963 at the Town Office, Main Road, Southold, New York. Meeting adjourned at 10:10 P.M.
