a regular meeting of the -Southold Town Planning Board
was held 7:.30 P.M. , Tuesday, , February 6, 1962 at the Town
Clerk "Office, . Main Road, Southold, New York.
There were present: 'Messrs. John .Wickham, Chairman,
Henry Moisa, . Archibald Young, and William .Unkelbach.
.,Absent: Mr— Alfred Grebe due to illness.

and Howard Terry, Building Inspector.
PUBLIC HEARING: On the question of approval of the follow-
ing plat: 1. Plat of property owned by 'Cleaves Point Corporation,
entitled-.Cleaves, Point, .Section II, at ".East .Marion, consisting of
a parcel of land of approximately 98-40 acres, , situated at "East
Marion, in the Town of :Southold, ,Suffolk -County, New York; and
bounded and described as follows:. Beginning at the intersection
of the westerly line of Maple Lane with the northerly line of
:Osprey. Nest Road as shown on Map of-: Section One Cleaves Point"
filed in Suffolk.-County Clerks Office as Map No. 2752; running

thence along the northerly line of said Osprey Nest Road S.560

The -Chairman opened the hearing by reading legal notice of
hearing and affidavit attesting to its publication -in the official
newspaper.
THE CHAIRMAN: Is there anyone present who wishes to be
heard in opposition to the approval of 'this subdivision?
(There was no response. )
THE CHAIRMAN: Is there anyone present who wishes to speak
in favor of the subdivision to be known as Cleaves Point, . Section II?
IRVING L. PRICE, JR:.' -ESQ. , Greenpott, New York: I just appear
on behalf of the applicant and urge approval of this subdivision.
THE CHAIRMAN: I have here a letter from Charles A. Cornibert,
President of:Cleaves . Point.Corp. which I will read:
"Southold Town Planning Board,, Southold; . L.I. , N.Y. ,. Re:
Cleaves Point Corp{ Gentlemen; This will confirm the agree-
ment of this corporation to reserve an area 100 feet by 100 feet
on the water off Snug Harbor Road and Osprey Nest Road for a
period of 12 years for possible dedication to the Town of :Southold
for highway purposes.
"This condition will be incorporated as an amendment in the
declaration of covenants and restrictions filed in the Office of
the County Clerk.
"This letter is given in connection with application for
approval of 'subdivision map entitled,. "Cleaves Point- Section IIZ
. Southold" Town Planning Board -3- February '6, 1962
at East Marion, Ne w York," and is in reply to your letter of
January 16, .1962.

THE .CHAIRMAN: . Hearing none I will declare the hearing
closed.
On motion of.Mr. Young, seconded by Mr. Unkelbach:
Plannin REAS Cleaves Point Corporation has petitioned the Southold
Town/Board for final approval of their plat known as "Cleaves
Point, . Section II", at .East Marion, New York, and
WHEREAS the Southold Town Superintendent ' of Highways has
inspected the map and found the proposed highway- layout to be
satisfactory for reasonable access, and his report is hereby
approved by the Planning. Board; and
WHEREAS the Southold Town Planning Board, pursuant to due
notice thereof, held a public hearing on the matter of approval
of the plat at which time all' interested persons were given an
opportunity, to be heardt and.
WHEREAS the Southold Town- Planning Board waives the provision
in the Rules and Regulations for the- Subdivision of Land requiring
park and playground area or cash equivalent;
NOW THEREFORE BE IT:RESOLVED that' the subdivision to be known
as "Cleaves Point, Section Two", at .East Marion, New York consisting
of 9.40 acres and owned by. Cleaves Point Corporation, be approved.
This plat is. bounded and described as follows: Beginning
at the intersection of the westerly line of Maple =Lane with the
northerly line of Osprey Nest .Road as shown on "Map of Section
One, . Cleaves Point" filed in Suffolk :County Clerk's 'Office as

Map No. 2752; running thence along the northerly line of said
Osprey Nest Road. S. 56037310"W. 450 feet; thence N. 33022=50"W.
25 feet; thence S.56°37=10"W. 160 feet, more or less, to Gull Pond;
thence northerly along Gull Pond 500 feet, more or less; thence
along other land of the applicant four courses, as follows: (1)
N.56037=10"E. 162feet, more or .less; thence- (2) N. 33022850"W. 10.69
feet; thence (3) N. 19'30100"E. 437.95 feet; thence (4) N.56°37310"E.
102.53 feet to the westerly line of said Maple' Lane; thence along
said line of 'Maple Lane two courses, as follows: (1) S.31°23320"
E. 50. 03 feet; thence (2) S. 33022'50"E. 750 feet to the point of
beginning.
Cleaves ' Point Corporation has agreed in writing and it
has been indicated on the final map approved by the Southold
Town .Planning Board on February 6, 1962 that the corporation
will reserve an area 100 feet by 100 feet on the water off .Snug
Harbor Road and Osprey Nest-Road for a period of 12 years for
possible dedication to the Town of Southold. for highway purposes.
This condition will be incorporated as an amendment in the declaration
of covenants and restrictions filed in the Office of the' County
Clerk.
Vote of the Board: Ayes:- Mr. Wickham, . Mr. Moisa, Mr.
Young, and Mr. Unkelbach.
Mr. Van Tuyl brought to the .attention of the Planning Board
that Hilton Epp has done nothing with the proposed subdivision
Hilton Heights towards securing final approval. The final hearing
has not been held and at the present time the Boa�d is awaiting
a reply from Mr. Epp relative to furnishing a performance bond.
The last correspondence with Mr. Epp was in May of 1961.
Mr. Ernest .Wilsberg appeared before the Planning Board request-
ing -preliminary approval of -a proposed subdivision containing
approximately 52 lots, which he and his brother Harold wish to
file on the east side of Main Bayview Road, Southold. Mr. Alfred
Dart, owner of property which bounds the Wilsberg property on the
north also appeared before the -Planning Board in connection with
the discussion relative to this proposed subdivision.
The northerly line of this proposed subdivision forms a sharp
corner at one point. This is the approximate point where the
Planning Board feels there should be land reserved for a road

connecting the'Wilsberg and Dart property with roads in Fairview
Park to the north. The Planning Board thought that possibly the
Wilsbergs and Mr. Dart could reach some agreement relative to an
exchange of property to straighten this corner out. However, no
settlement could be agreed upon at this time between the two
parties:. Mr. Wilsberg agreed, however, . 'to reserve 50 ft. at,
the point in question for possible future dedication to the Town
for highwaypurposes.
After _a thorough discussion and examination of the map,
On motion of Mr. Moisa, . seconded by Mr. Young, it was
RESOLVED that the Planning Board grant Ernest and Harold
Wilsberg preliminary approval' of their proposed subdivision on
the east side Main Bayview Road, Southold, New York, with the
condition that a 50 ft. strip be reserved between lots 32 and
33 for a possible future road connection. Map by Otto W. Van
Tuyl & Son dated February 6, 1962.

Young„ and Mr. -Unkelbach.
ijr. Edwin King appeared before the Planning Board for an
informal discussion. Mr. King first discussed property he owns
on the north side of Route 25 at East .Marion. There is only an
8z ft. access road to this property. The Board advised Mr. .King
that it would be up to him to widen this road before he could begin
to develop the property.
Mr. King next spoke informally relative to a marina he
is building on property he owns in Orient. He also spoke about
property he owns on the south side of,.Route 25 beside and in back ,
of the' Latham Cemetery at Orient Point.
The' Secretary advised the Board that final .arrangements
have been made for Mr. Henry Gallien, Jr. , . Director of the
Bureau of industrial Development of the New York State Department
of :Commerce and Mr. John F. Deming, . Reginal Managerr Nassau-
Suffolk Reginal Office of the Bureaaof Industrial Development of
the New York State' Department of Commerce to speak at the Custer
Institute, Inc. , -8:30 P.M. ,_ Saturdayr February 17, 1962. The
topic of this lecture will be industrial development in the Nassau-
Southold Town Planning Board -6- February 6,, 1962
Suffolk area with some remarks on .the development . of industrial
parks. This will be an open meeting and there will .be publicity
in the local neTaspapers.
The new proposed subdivisions "Eastwood Estates",, was presented
to the Planning Board. This subdivision is located .at Fleet's
Neck, .Cutchogue, contains 7.87 ,acres, 14 lots, and is owned by
the Estate of George H. Fleet.
After. a thorough review of the map, on motion of Mr. Moisa,
seconded by Mr. Unkelbach, it was
RESOLVED that Estate of George H. Fleet, . LeRoy,,S. Reeves
Trustees be granted Preliminary approval of the map of "Eastwood
Estates" at Fleet's Neck, . Cutchogue, New York. ' Map by Otto W.

Youngs . and Mr. Unkelbach.
The Planning Board next received new proposed subdivision,
. "Hill Crest Colony" at Orient, New York. This property is owned
by Ruth L. Young and contains 24 acres and there will be 40 lots. .
Some of' the lots in this proposed subdivision will contain less
than 20,000 sq. . ft. because there will be public water, a well
to be installed on the east side of the property outside .of the

On motion of Mr. Young, seconded by. Mr. Unkelbach, it was
RESOLVED that this plan be tabled for further information
from the developer, including ,locations of. water mains, location-
of access to water, contours and profiles.

Young, . and Mr. Unkelbach.
The Planning. Board received a. letter from .Leander B.
Glover, Frank J. McBride and Leander Glover, Jr. attesting to
the fact that they have operated .a sand pit on the west side of
:C oxjs 'Lane, continuously from the time before the Town Sand Pit,
and in the last ten years the -sand pit located in the woods. . Map
was attached to this letter.

The purpose of filing this letter with the Planning Board
is to gain recognition from the Planning Board that this sand
pit was operated prior to the time the Zoning Ordinance went
into effect.
On motion of .Mr. Unkelbach, seconded by Mr. Wickham, it was
RESOLVED that a committee of Mr. Young. and Mr. Moisa investigate
this sand pit and report at the next- Planning Board meeting.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Young,
and Mr. Unkelbach.
A joint meeting between the Town Board, Board of Appeals and
Planning Board will be held 7:30 P.M. , Monday, February 26, 1962
at the Town Clerk Office, Main Road, Southold, New York.
Mr. Wickham suggested that at the time of the joint meeting
the Planning Board could bring up the subject of an amendment to
the Rules and Regulations for the Subdivision of'Land. The amend-
ment would be in the Preamble, adding to Item 6 so that it will
read as follows:
116., To provide for the orderly development of waterfront
property, including highway access to water on all waterfront
subdivisions. "
Also, since there may be some discussion relative to
Industrial Parks at the joint meeting, each member of the Plan-
ning Board is to review the procedures of other townships as
to industrial parks., This information will be available at the
Planning Board office.
The Planning Board received a letter from the Nassau-Suffolk
Civil Engineers, Inc. requesting the sup1port of all Planning
Boards in the proposed amendment of Section 335 of the Real
Property Laws amended. The following resolution was adopted
by the Nassau-Suffolk Civil Engineers, Inc. : "WHEREAS the
laws governing the filing of subdiv is ions in Suffolk County_
provide for a certification by the surveyor that two monuments
have been set on each street intersection prior to filing of said
subdivision in the office of the Clerk of Suffolk County, and
under present customs of building developments the above is a
duplication of work and the Planning Boards have the authority

to include the cost of setting said monuments in the improvement
bonds, "
On motion of Mr. Young, seconded by Mr. Unkelbach,; ,it was
RESOLVED that a letter be forwarded to the New York' State
Civil. Engineers, Inc. stating that the Southold Town Planning
Board is very much in favor of the proposed amendment to Section
335 of the Real Property Law whereby the certification placed on
the map to be filed would read "Permanent .Markers will be set. "
It is the feeling of the Planning Board that the present
requirement is an unnecessary duplication of effort and everything
should be done to expedite this amendment.

and Mr. Unkelbach.
On motion of Mr. Young, seconded by Mr. Unkelbach, it was
RESOLVED that the minutes of the meeting of January 10, 1962
be approved as read.

and Mr. Unkelbach.
The next meeting of the Southold Town Planning Board will
be held 7:30 P.M. ,. Wednesday, . March 7, 1962 at the Town, Clerk
Office, Main Road, Southold, New York.
On motion of Mr. Young, seconded by Mr. Moisa, it was
RESOLVED that the' Planning Board set 7:30 P.M. , Wednesday
March 7, 1962 as time and Town Clerk Office, . Main Road,- Southold,
. New York, . as place for hearing upon the question of approval of
the following plat: Plat .of property owned by Greenway Realty
Corp. , entitled Green Acres at Orient, consisting of a parcel
of land of approximately 33.60 acres, situated at Orient, in
the Town of- Southold, - Suffolk -County, New York, and bounded and
described as follows:
Beginning at a monument on the northerly line of-State
Road at the southeasterly corner of land of Orville Terry, running
thence along said land of Orville Terry three courses, as follows:
