SOUTHOLD TOWN PLANNING BOARD
March 7, 1962
A regular meeting of the Southold Town Planning Board was
held 7: 30 P.M. , Wednesday, . March 7, -1962 at. th.e Town Clerk Office,
Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman, Henry
. Moisa and Archibald Young.
.. Absent: Messrs. Alfred Grebe, due to weather conditions,
and William Unkelbach,
PUBLIC HEARING: On the question of -approval of the ..following
plat: 1'. Pl.at of ,property owned by Greenway Realty Corporation,
entitled Green Acres 'at Orient, consisting of a parcel of land of
approximately` 33:60 acres, situated at Orient, in. the Town of
Sou thold,,. Suffolk County, New York, and bounded and described as
follows: s
Beginning at a monument on the northerly line of .State Road
at the southeasterly corner of land of Orville -Terry, running thence
along said land of, Orvil'le Terry three courses, as follows: (1)
N. 05030'10"W. 768.39 'feet; thence (2). S.82°2410011W: - 419.50 feet;
thence (3) N. 0902410011W. 1829. 00 feet to Long Island Sound; thence

along Long Island Sound two courses, as follows: (1) N. 68030120"E.
550. 00 feet; thence (2) N. 65054220"E. 193. 14 feet to land of Irving

the point of beginning.
The Chairman opened the hearing by reading legal notice of
hearing and affidavit attesting to its publication in the official
newspaper.
THE.. CHAIRMAN: Does anyone wish to be heard in opposition to
this subdivision?
(There was no response. )
THE 'CHAIRMAN: Does .anyone wish to be heard in favor of this
subdivision?
MR'. GRAMLICH: I wish to see it approved.
THE CHAIRMAN: What are your plans for dedication?
MR. GRAMLICH: I plan to dedicate the roads within three months.
THE 'CHAIRMAN: We have not yet received a report from the
Superintendent of Highways as to the condition of the highways.
If this subdivision is approved it will be pending the approval
of the Highway 'Superintendent.
THE CHAIRMAN: Since there is no one. present who wishes to
say anything else in regard to this application for a subdivision,
I will declare the hearing closed.

Lefferts Edson, Esq. appeared before the Planning Board to
discuss final approval of"Oakridge Hills at Southold` owned and
developed by Southold Builders, Inc. , 23 Wayne Drive, Plainview,
New York. This proposed subdivision is located on the west side

of Horton Lane, Southold and contains 10 lots, each containing
over 20, 000 sq. ft. Tentative approval was granted on May 10,
1961.
After. discussion layout of the roads in connection with future
development of the area, Mr. Edson was advised that a date for
public hearing would be set for the next regular meeting of the
Planning Board which will be sometime in April.
Mr. Edson next spoke informally to the Board relative to an
application to be made to the Town Board by Fay Spera, 196-28
Northern Boulevard, Flushing 58, New York, for a change of zone
from "A" Residential and Agricultural District to "B" Business
District on lots 187, 188, and 189, "Map of Peconic Bay Estates,
. Amended Map A", total size 150 ft. on Main Road and 125 ft. on
Pipes Neck Road, Arshamomaque. Mrs. Spera desires to conduct a
retail business on the premises which will consist of the sale of
marine artifacts and related items.
The Planning Board advised Mr. Edson that it is unlikely that
a change of zone would be granted on such a small area. However
the Board discussed the development of this particular area with
relation to an extension of the "B" Business zone from the golf
driving range to Kerwin Boulevard.
On motion of Mr. Moisa, seconded by Mr. Young, it was
RESOLVED that the Planning Board recommend to the Town Board,
on the Town Board's own motion, changing from "A" Residential and
Agricultural District to "B" Business District all property situated
between Kerwin Boulevard and the Golf Driving Range on the south
side of Route 25, Arshomamoque.
Between Kerwin Boulevard and Pipes Neck Road it is suggested
that the depth of this "B" Business District be to the railroad
property, and between Pipes Neck Road and the Golf Driving Range
the depth be the same as the Golf Driving Range Business District.
The entire north side of .Route 25 in this area is zoned "B"
Business and the Planning Board feels it is good planning to zone
the property on the south side of the road "B" to conform. Also,
there are several non-conforming businesses now in existence on the
south side of the road and it is believed there will be applications
made in the near future for rezoning to "B" Business by some of the
property owners.

The Planning Board discussed a possible amendment to the
Rules and Regulations for the Subdivision of Land whereby they
would require a copy of the highway layout and profile maps to
be filed with the subdivision map when highways in a subdivision
are to be dedicated to the Town. of Southold. The Board also dis-
cussed an amendment whereby it would be mandatory for a developer
of a:°subdivision with-waterfront property to provide a 100 ft. by
100 ft. area fronting on the water.
The Planning Board also discussed dead-end roads in sub-
divisions and a letter was forwarded to- Supervisor Albertson
stating that the Planning Board feels there should be some clarif-
ication on the subject. The highway specifications call for 100
ft. turn-around for all dead-end streets, however the Planning
Board has occasionally approved highway layouts in subdivisions
with what might be called a spur, namely a 5 0 ft. highway one
lot in depth which we have requested the developer to make available
at a specific location to connect up with the highway system of
another development which we felt certain would be commenced in
the near future. The real problem arises only if' the Planning
Board approves a subdivision with such spur roads and the' Town
Board refuses to accept dedication without the 100 ft. turn-
around. This means that the developer only dedicates the primary
road system and leaves the very shortspur ' to be dedicated when and
if the adjacent property is developed. It would seem more business-
like to the Planning Board for the Town to accept dedication of
these spurs even though the road is not cut through so that when
the adjacent property is developed it will be unnecessary to
reopen the whole problem and have a separate dedication for each
one of these spurs.
On motion of Mr. Young, seconded by Mr. Moisa,. it was
RESOLVED that the minutes of the meeting of February 6, 1962
be approved as read.
Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr.
Young.
On motion of Mr. Moisa, seconded by Mr. Young, it was
RESOLVED that the Planning Board forward a letter to

Mr. Henry Gallien, Jr. , Director and Mr. John F. Deming, Regional
Manager, Bureau of Industrial Development, State of New York,
Department of Commerce, Albany, New York, expressing our 'sincere
thanks and appreciation for their appearance at- Custer on February
17 th.
Mr. Young and Mr. Moisa reported that they had investigated'
the sand pit referred to in an affidavit by Leander B. Glover,
Frank J. McBride and Leander Glover, Jr. as having been in operation
continuously from the time before the Town Sand Pit and in the last
ten years the sanQd pit located in the woods. They found that this
sand pit has not been actively used in recent years.
A letter was forwarded to Mr. Glover, Mr. McBride and Mr.
Glover, Jr. stating the findings of the committee and suggesting
that they consider making application for a "C" Industrial District
on the property referred to. It is believed the Planning Board
would look favorably upon such an application.
The Planning Board received a letter from H. M. Bishop,
Commissioner of the Suffolk County Department of Public Works,
Yaphank, requesting a map showing the location of, the ,proposed
new road in relation to the culvert and New Suffolk Road, mentioned
in the Planning Board's letter of January 16th.- Mr. Van Tuyl
supplied maps of the proposed road (Charlie's Lane) and the culvert
to the Planning Board to be forwarded to the Department of Public
Works.
The Planning Board received from the Board of.Appeals map of.
property of W. Harry Lister for consideration for a possible sub-
division.
After examining this map and discussion held on same, it was
on motion of Mr. Moisa, seconded by Mr. Young that it was
RESOLVED that the Planning Board recommend to the Board of
Appeals that under the present layout of property of W. Harry
Lister if a central water supply system were used for all lots
the plan would be satisfactory and the Planning Board recommends
that variances be granted on the lots with reduced frontage.
Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, and Mr.
Young.

The Planning Board received a letter from the Board of
Appeals in reply to the Planning Board's letter regarding conform-
ing and non-conforming signs. The Board of Appeals assured the
Planning Board that they will do their best to effect a smooth
transition after the five year period of grace has expired.
The Planning Board received from the Town Board a resolution
covering proposed amendments to the Building Zone Ordinance and
requesting that the Planning Board make an official report to the
Town Board. The proposed amendments are as follows:
1. By amending the Southold Town Building Zone Ordinance as
follows:
I. By amending Article III, Section 300, by inserting therein
a new subdivision to be subdivision lA to read as follows:
lA - Two (2) family dwellings, when authorized as a
special exception by the Board of Appeals as hereinafter
provided.
II. By amending Article III, Section 300, Subdivision 7 to
read as follows:
7 - Accessory buildings, including one (1) private garage,
when such accessoryi.buildings are located in the . rear
yard, or a private garage within or attached to the dwelling.
III. By amending Article IV, Section 408, subdivision (b) ,
subsection 2 to read as follows:
2. Exceed in width one hundred (100) percent of the
horizontal measurement of such wall.
IV. By amending Article IV, Section 408, by inserting therein
a new subdivision to be subdivision (c) to read as follows:
(c) ROOF SIGNS - In lieu of a wall sign authorized
by the preceding subdivision (b) , a roof sign shall
be permitted provided that the same is attached to
or . incorporated in a roof, which sign shall advertise
only the business conducted in the building upon which
it is attached, and provided that such sign does not:

1. Exceed two (2) square feet in total area for
each lineal foot of 'such roof, and
2. Extend above the highest point of. the roof in
the. case of 'a pitched roof, and in all other cases
exceed two (2) feet six (6) inches in height above
the highest point of the roof, and
3. Project beyond the edge of the roof.
V. 'By amending Article VII, Section. 705, to read as
follows:
SECTION 705 - For each application or'Appeal to the
Board of -Appeals as hereinafter provided, there shall,
be a fee of five dollars ($5. 00) accompanying the
Application or Appeal.
On motion of Mr. Young, seconded by Mr. Moisa it was
RESD;NED that the Planning Board recommend to the Town Board
all .of. the proposed amendments as, cited in the resolution of the
Town Board dated March- 6, 1962.
The Planning Board feels that these proposed amendments to
the Building Zone Ordinance are in the best interests of the
Town of :Southold.
Vote of the Board: Ayes:- Mr. Wickham, . Mr. Moisa, and Mr.
Young.
The next meeting of the' Southold Town. Planning Board will
be a closed meeting for the- purpose of discussing planning
problems and master drainage plans, and will be held 7: 30 P.M. ,
. March 201 1962 at the Town .Clerk Office, Main Road, Southold,
New York.
GREEN ACRES: A report from the Highway Superintendent
relative to highways in Green Acres could not be obtained prior
to the March 20th meeting therefore the Board decided to take
the matter up a#ain on the 20th. See minutes of that date for
final approval of Green Acres Subdivision.
