PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T E' S SOUTHOLD TOWN PLANNING BOARD March 20, 1962 A meeting of the Southold Town Planning Board was held 7: 30 P.M. , Tuesday, March 20, 1962 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. John ,Wickham, Chairman, Henry Moisa,_ Alfred Grebe, Archibald Young, and William Unkelbach. Also present: Messrs. Howard Terry, Building Inspector and Otto W. Van Tuyl, Consultant. The Planning Board received from the Town Board the original petition of- Kenneth D. Case, Peconic, New York for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Peconic and more particularly bounded and described as follows: Beginning atwa monument set on the southerly line of North Road at the northeasterly -corner of land 'of Kenneth Case,. being the northwesterly corner of land of .F. F. Overton Estate; running thence along said land of F. F. Overton Estate and land of J. Trombetta, South 37 degrees 04 minutes 50 seconds East a distance of 384.39 feet, more or less, to the existing "B" Business District; running thence South 55 degrees 05 minutes 20 seconds West along the northerly line of said existing "B" 'a, Southold Town Planning. Board. -2- March 20r 1962 Business District a distance of 250 feet, more or less, to land of Harold Paul; running thence along said land of Harold Paul, North 38 degrees 21 minutes 50 seconds West 232feet, more or less, to land reserved by Kenneth D. . Case; running thence along said land reserved by Kenneth D. Case, two courses as follows: (1) North 54 degrees 57 minutes 10 seconds East a distance of 211. 65 feet; thence (2) North 37 degrees 04 minutes 50 seconds West a distance of 150. 0 feet to the southerly line of North Road; running thence along said southerly line of North Road, North 53 degrees. 47 minutes 20 seconds East. a distance of 45. 0 feet to the point or place of beginning. Map by Otto W. Van Tuyl & Son dated January 13, 1943r, revised August 4, 1953 and January 30s 1962. This change of zone is requested because the premises are contracted to be sold to Steve W. Stepnoski who proposes to use said premises for the purpose of operating a general trucking business. 100 ft. in depth at the rear of this property is already zoned "B" Business. In examining the map the Planning Board found that the frontage of the Stepnoski property on the North Road would be 45 feet. They advised Mr. Rensselaer Terry, Jr. who represents Mr. Kenneth Case that they would recommend this change .of' zone favorably as long as the frontage on the North Road is widened to 50 ft. as this is the only frontage of this property and in a "B" , Business District a lot must have 50 ft. frontage. On motion of Mr, Moisar seconded by. Mr. Grebe, it -was RESOLVED that the Planning Board recommend to the Town Board this change of zone from "A" Residential and Agricultural District to "B" Business District on the property of Kenneth Case, south side North Road, Peconic, New York. This would be an extension of an existing "B" Business District and would be in harmony with the character of the area. It is specifically pointed out that .the frontage of this parcel on North Road should be .extended to 50 ft. to conform with the requirements of the Zoning Ordinance. This Board has discussed this change of zone with .Mr. Harold Paul and he has no objections in fact he is also Southold Town Planning Board -3- March 20, 1962 considering a change of zone on his property. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. . It was called to the Planning Board3s attention that nothing further has been done relative to submitting a performance bond for roads in Orient-By-The-Sea, Section II. It was the decision of the Planning Board to write to the attorney for Orient-By-Thel-'7Sea, Section II, George A. McMann, Jr. , stating that a performance bond has not been submitted for the completion in compliance with specifications for dedication of roads in Orient-By-The-Sea, Section II. Also, enclose a copy of the estimate submitted to the Planning Board by Lawrence Tuthill, P.E. concerning the final estimated cost of construction of the highways. The normal procedure for Mr. McMann would be to submit a proposal for a performance bond to the Town Board for their approval as to the amount, form and sufficiency. The Planning Board discussed the necessity of revising the Highway Specifications, and on motion of Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that a letter be forwarded to the Town Board stating that the Planning Board feels that it is extremely important that the specifications for construction of new highways be modified and strengthened. It is felt that the existing specifications have worked a hardship on some develop- ers and proven to be wholly inadequate in other cases and has put the Planning Board, Superintendent of Highways and Town Board in an embarrassing position, besides being a source of very real and unnecessary cost to the Town Highway Department. In addition to strengthening the specifications the Planning Board feels that it is vitally important that someone, presumably the Super- intendent of Highways or some qualified person designated by him, should inspect all new highways during the process of their construction to make sure that the minimum requirements of the specifications are being met. Vote of the Planning Board: Ores:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. Southold Town Planning Board -4- March 20, 1962 The Planning Board received a letter from the Town Board relative to certain property on the south side of Route 25 at ' Arshamomaque. The Town Board feels a change of zone in this area might be considered from "A" Residential and Agricultural District to "B" Business 'District on the following area: From the present "B" Business District which ends at the easterly side of Silvermere Road, continuing westerly to the southerly side of Kerwin Boulevard. The property east of Silvermere Road to the Fleet property, and north of Kerwin Boulevard to the railroad over- pass is presently zoned "B". They propose the depth of this "B" district to be from Route 25 to the railroad property. The Town Board requested a report and recommendation on this proposal. On motion of Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED that the Planning Board recommends to the Town Board this change of zone from "A" Residential and Agricultural District to "B" Business District in Arshamomaque. The entire north side of Route 25 in this area is zoned "B" Business and the Planning Board feels it is good planning to zone the property on the south side of the road "B" Business to conform. Also, there are several non-conforming businesses now in existence on the south side of the road and it is believed there will be applications made in the near future for rezoning to "B" By some of the property owners. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The next meeting of the Southold Town Planning Board will be held 7: 30 P.M. (E.S. T. ) , at the Town Clerk Office, Main Road, Southold, New York on Wednesday, April 11, 1962. On motion of Mr. Grebe, seconded by Mr. Young, it was RESOLVED that the Planning Board set 7: 30 P.M. , Wednesday, April 11, 1962, Town Clerk Office, Main Road, Southold, New York as time and place for hearing upon the question of approval of the following plat: Plat of property owned by Southold Builders, Inc. , entitled Oakridge Hills at Southold, consisting of .a parcel of land of Southold Town Planning Board -5- March 20, 1962 approximately 6. 073 acres, situated at Southold, in the Town of .Southold, Suffolk County, New York, and bounded and described as follows: Beginning at a point( the southwesterly side of Horton Lane where the same is intersected by the southeasterly side of lard now or formerly of Clement W. Booth formerly Barnabas H. Booth, which point is also distant 550.88 feet southeasterly from the corner formed by the intersection of the southwesterly side of Horton Lane with the southeasterly side of Sound View Avenue and from said point of beginning running thence along the south- westerly side of Horton Lane the following courses and distances: (1) South 47 degrees 48 minutes 00 seconds East 202.62 feet; (2) South 32 degrees 30 minutes 30 seconds East 149.55 feet to land now or formerly of Jonathan T. Overton formerly of Johathan B. Terry; running thence along said land South 48 degrees 25 minutes 00 seconds West 758.64 feet to other land now or formerly of Henry . Jennings; running thence along said land North 35 degreed. 15 minutes 30 seconds West 357. 29 feet to land now or formerly of Clement-W. Booth; running thence along said land North 48 degrees 53 minutes 40 seconds East 720. 94 feet to the southwesterly side of Horton Lane at the point or place of beginning. Voteof the Board: Ayes: - Mr. Wickhamt Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board discussed--Proposed subdivision Green Acres at Orient and the Chairman report/that Superintendent of Highways Price stated that he approves the highways in Green Acres for private access and recommends that heavy traffic be prohibited during the spring thaw. He feels the Town of •Southold will eventually accept these highways. On motion of.Mr. Grebe, seconded by Mr. Moisa, it was moved: WHEREAS Greenway Realty Corporation has petition the Southold Town Planning Board for final approval of their plat known as "Green Acres" at Orient, New York, and WHEREAS the Southold Town Superintendent of Highways has inspected the highways and found them to be satisfactory for private access, and his report is hereby approved by the Planning Board, and WHEREAS the Southold Town Planning Board, pursuant to due Southold Town Planning Board -6- March 20, 1962 notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard, and WHEREAS the Southold Town Planning Board waives the provision in the Rules and Regulations for the Subdivision of 'Land requiring park and playground area or cash equivalent; NOW THEREFORE BE IT RESOLVED that the subdivision to be known as "Green Acres" at Orient, New York consisting of 33.60 acres and owned by Greenway Realty Corporation, be approved. This plat is bounded and described as follows: Beginning at a monument on the northerly line of State Road at the south- easterly corner of land of Orville Terry, running thence along said land of Orville Terry three courses, as follows: (1) N. 05030=1011W. 768. 39 feet; thence (2) S.82'24' 00"W. 419.50 feet; thence (3) N. 09024100"W. 1829. 00 feet to Long Island Sound; thence along Long Island Sound two courses, as follows: (1) N.68- 3012011E. 550. 00 feet; thence (2) N.65054120"E. 193. 14 feet to land of Irving C. Latham; thence along said land of- Irving C. Latham S. 0604811011E. 2726.57 feet to the northerly line of said State Road; thence along the northerly line of said State Road S.6804215011W. 239. 16 feet to the point .of beginning. BE IT FURTHER RESOLVED that the Planning Board waives the 90 day requirement for the dedicatiop of highways to the Town of 'Southold whereas the Highway -Superintendent- will only approve these highways for private access. Mr. Vote of the Board: Ayes:- Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board held discussions relative to recreational areas in subdivisions, location of junk yards and dumps in the "C" Industrial District, handling of industrial parks by other townships, development of waterfront property and agricultural prospects on Long Island. A letter was to be forwarded to the Town of Hempstead and Village of Garden City requesting information relative to the estab- lishment of industrial parks in their area. Southold Town Planning Board -7- March 20, 1962 The Board wished a letter forwarded to Town Attorney Tasker stating that at the Association of Towns meeting it was stated it is now possible under some circumstances to obtain money from developers for use for recreational purposes in the Town.
