A regular meeting .of the- Southold Town Planning Board
was held 7: 30 P.M. , :Wednesday, April 11, 1962 at -the Town Clerk
Office, . Main Road, . Southold, New York.
There were present: Messrs. John:.Wickham, . Chairman, Henry
*Moisa, Alfred Grebe, Archibald Youngs and William Unkelbach.
. Also_ present: Messrs. . btb`W. Van .Tuyl, .Consultant, . and
Howard M. Terry, Building Inspector.
- PUBLIC HEARING: On the question of approval of 'the following
plat: 1. flat of property owned by 'Southold Builders, Inc. ,
entitled Oakridge Hills at -Southold, consisting of 'a parcel of
land of :approximately 6. 073 acres, situated-at- Southold, in the
Town of :Southold, Suffolk County., New York, and bounded and
described .as follows:
Beginning at a point -on the southwesterly side of Horton
Lane where the same is intersected by the southeasterly side of
land now or ,formerly of Clement -W. Booth formerly Barnabus H.
Booth, which point is also distant 550.88 feet southeasterly

from the corner formed by the intersection of the southwesterly
side of Horton Lane with the southeasterly side of :Sound. View
Avenue and from said point of beginning running thence along the
southwesterly side of Horton .Lane the following courses and
distances.: (1) South 47 degrees 48 minutes 00 seconds East 202. 62
feet; .(2) South 32 degrees 30 minutes 30 seconds East 149.55 feet
to land now or formerly of Jonathan T. Overton .formerly of Johathan
B. Terry; running thence along said land South 48 degrees 25 minutes
00 seconds West 758. 64 feet to other land now or formerly of Henry
Jennings; . .running thence along said land North 35 degrees 15 minutes
30 seconds West 357. 29 feet to land now or formerly of :Clement'W.
Booth; running thence alon g said land North 48 degrees 53 minutes
40 seconds East 720. 94 feet to the southwesterly side of Horton
Lane at the point or place of beginning.
The Chairman opened the hearing by reading legal notice of
hearing and affidavit attesting to its publication in the official
newspaper.
THE CHAIRMAN: Does anyone wish to be heard in opposition to
this subdivision?
(There was no response. )
THE CHAIRMAN: Does anyone wish to be heard in favor of this
subdivision?
LEFFERTS EDSON, ESQ. , Southold,, New York: I present the map
of Oakridge Hills which has been approved by the -Suffolk -County
-Department of Health. I request that it be considered and approved
by your Board -subject to the decision of the Highway Superintendent.
(The Secretary reported that the Highway Superintendent had
indicated that he had inspected the roads and found them only
satisfactory for access for emergency and private vehicles. They
could not be accepted for dedication at this time. )
THE CHAIRMAN: The Town Highway Specifications will probably
be amended and stiffened within a relatively short time and the
- Superintendent of Highways is concerned that so many of the roads
in new developments have been breaking up this spring. I think
this has been a more severe winter than ususal on highways. In
the past in cases like this the Planning Board has waived the

provisions that highways must be dedicated within 90 days or
performance bond must be posted just because of the uncertainty
I mentioned before. Until the situation is clarified we do not
think it is fair to hold the developer up.
THE CHAIRMAN: Is there anything else?
(There was no response. )
THE CHAIRMAN: Since there is no one else present who wishes
to say anything in regard to this application fora subdivision by
Oakridge Hills I will declare the hearing closed.
On motion of Mr. Moisa: seconded by Mr. Young, it was moved:
WHEREAS Southold Builders, Inc. has petitioned the Southold
Town Planning Board for final approval of their plat known as
"Oakridge Hills" at Southold, New York, and
WHEREAS the Southold Town Superintendent of Highways has
inspected the highways and found them to be satisfactory for
private access and emergency vehicles, and his .report is hereby
approved by the Planning Board, and
WHEREAS the Southold Town Planning Board, pursuant to due
notice thereof, held a public •hearing on the matter of approval
of the plat at which time all interested persons were given an
opportunity to be heard, .and
WHEREAS the Southold Town Planning Board waives the provision
in the Rules and Regulations for the Subdivision of ,Land requiring
park and playground area or cash equivalent; and
WHEREAS the Southold Town Planning Board waives the 90 day
requirement for the dedication of highways to the Town of :Southold
and posting of a bond for same whereas the Highway :Superintendent
will only approve these highways for private and emergency access;
NOW THEREFORE BE IT RESOLVED that the subdivision to be known
as 'bakridge Hills" at Southold, New York, consisting of 6. 073 acres

and. owned by Southold Builders, Inc. , be approved.
this plat is bounded and described as follows: Beginning
at a point on the southwesterly side of Horton Lane where the
same is intersected by the southeasterly side of land now or
formerly of Clement W. Booth formerly Barnabas H. Booth, which
point is also distant 550.88 feet southeasterly from the corner
formed by the intersection of the southwesterly side of Horton
Lane with the southeasterly side of :Sound View Avenue and from said
point of beginning running thence along the southwesterly side of
Horton Lane the following courses and distances: (1) South 47
degrees 48 minutes 00 seconds East 202. 62 feet; (2) South 32 degrees
30 minutes 30 seconds East 149.55 feet to land now or formerly of
Jonathan T. .Overton formerly of Johathan B. Terry; running thence
along said land South 48 degrees 25 minutes 00 seconds West 758. 64
feet to otherland now or formerly of Henry Jennings; running thence
along said land North 35 degrees 15 minutes 30 seconds West 357. 29
feet to land now or formerly of Clement'W. Booth; running thence
along said land North 48 degrees 53 minutes 40 seconds East 720. 94
feet to the southwesterly side of Horton Lane at the. point or place
of beginning.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe, Mr.. Young, .and Mr. Unkelbach.
The Board wished Mr. van Tuyl to supply the proposed highway
dedication map and profiles of :Oakridge Hills for the file.
The Chairman repok.ted that he had discussed with Superintendent
of Highways Price the highways in Green Acres at Orient and Mr.
Price felt that the buffer strip between Greenway East and Orville
Terry's property, even though. it is landscaped and made into a
park, still is directly contrary to the requirements for dedication.
It was suggested that this buffer strip might be dedicated
to the Town along with the highways.
Mr. William J. Baxter, Jr. appeared before the' Planning Board
with a plan for a proposed subdivision on the Stewart property
adjoining the Mattituck .School on the east. After examining the
map it was decided the Board members should investigate this
proposal. Further, since this adjoins the Mattituck School District
property a letter was to be forwarded to the Trustees of the Mattituck

School District advising them of this proposal and stating that
it entails a highway running north from the Main Road, ' turning
east and for the immediate future terminating, in a turn-around.
The 'Planning Board feels eventually this road will continue out
to Mill Lane a short distance below the railroad.
The Planning Board felt the school property might benefit
by highway access to the northeast corner of the school property
at some time in the future and the 'Planning Board could require
that the developer make provision for a future highway connection
to the school property if it is their wish. This would have to
be done before the lots are sold which means provision would have.
to be made soon if the school is interested.
The Planning Board received a reply to their letter of March
9, 1962 to the Suffolk County -Department of Public Works relative
to Charlie's Lane and New Suffolk Road, .CR 26. In the letter the
Chief Engineer stated that the data submitted by the Planning .Board
did not reveal the manner 'in which- the developer plans to dispose
of water falling on Charlie's Lane and the adjoining property.
They could not permit water to be discharged' on 'to a County 'Road.
They would require 4 copies of a plan showing the proposed grade
'of Charlie's 'Lane and a drainage plan for the disposal of all water
draining or 'falling on Charlie's 'Lane. They would also want to know
the effect the development of this property will have on the box
culvert under New Suffolk Road.
On motion of Mr. Moisa, seconded by Mr. - Unkelbach, it was
RESOLVED that Mr. Van Tuyl be authorized to draw up tentative
specifications for drainage on Charlie's Road in New Suffolk.
Vote of the Board: Ayes:- Mr. .Wickham., .Mr.. Moisa, Mr.. Grebe,
Mr. Young, and Mr. Unkelbach.
Mr. Van Tuyl briefly discussed George (or Elsiels) Road in
Mr. George Grathwohl's development at New Suffolk. This road is
now 33 ft. wide and to be a Town road it should be 50 ft. Mr.
Van Tuyl stated that Highway .Superintendent Price indicated that
the 33 ft. width might be satisfactory.
The Planning Board received from the Town Board the original
petition of George K. Vloutely, East Marion, requesting a change

of zone from "A" Residential and Agricultural District to "M"
Multiple Residence District on certain real property situated
at East Marion. The Town Board requested that the -Planning Board
prepare an official report defining the conditions' described in
the petition and determine the 'area so effected with the recommenda-
tion of the::Boar_d. This property is more particularly bounded and
described as follows: Beginning at a point on the north .side of the
Main Road, Route 25, marking the southeast erly .corner of land now
or formerly of Lois Thorpe, and running thence north 1406300" west,
311. 78 feet, to- land now or -formerly of Fulton; thence north 890
56110" east, 117. 98 feet to land now or formerly of Metcalf; thence
south 14032150" east, 330. 98 feet to the northerly line of the Main
Road; running thence in a general northwesterly direction along the
northerly line of the Main Road, 126. 95 feet to the point or place
of beginning. Map of property situated in East-Marion, by Victor T.
Zurkowski, dated'April 27, 1961.
Mr. Vloutely states in his application that the premises have
been used for a multiple residence use since before zoning. He
now wishes to expand his facilities and since a non-conforming
use cannot be �expanded the .'application for a ,change of, zone is
made.
The .Chairman read letter s from J. Herbert -Fisher, Great Neck
and East Marion; Professor and Mrs. John H. Billman, Bloomington,
.Indiana and East Marion; James.-O. -Orr, Main Road, ..East Marion;
Alberta -Edwards Parker, Main Road, East Marion and Charles R.
Mosback, . Oceanside and East Marion, all in opposition to .this
proposed change of zone. Members of the 'Planning Board have
all investigated this property.
On motion of Mr. Grebe, .seconded by Mr. -Unkelbach, it was
RESOLVED that the Planning Board does not recommend to the
Town Board this change of zone from "A" Residential and Agricultural
District to "M" Multiple Residence District on the property of
George K. Vloutely.
The Planning Board feels this proposal would be spot zoning
in a strictly residential area. Further, when zoning was first
-contemplated the residential character of the Village of East
Marion was preserved and we feel it �is important that this beautiful
village remain residential.

Grebe, Mr. Young, and Mr.. Unkelbach.
On motion of -Mr. Grebe, .seconded by Mr. Young, it was
RESOLVED that the minutes of the meeting of March 7, 1962
be approved as read.
Vote of the Board: Ayes: - Mr. .Wickham, .Mr. Moisa, .Mr.
Grebe, Mr.. Young, and Mr. Unkelbach.
On motion of Mr. Unkelbach, seconded by Mr. Moisa, it was
RESOLVED that the minutes of the. meeting of March 20, 1962
be approved as read.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe, .Mr. Young, .and Mr. Unkelbach.
The next meeting of the Southold Town Planning Board will
be held 7: 30 P.M. , .Wednesday, .May 9, ,1962 .at the Town Clerk
Office, Main Road, -Southold, New York.
It was the suggestion of the Building Inspector that the
Planning Board might like to have someone from The Asphalt
Institute, College Park, Maryland come to the next Planning
Board meeting and discuss the building and maintenance of
secondary or "town" roads, the latest methods and materials,
quantities and qualities, etc. This would be very helpful
in connection with the improvement of the Town highway specifica-
tions and construction.
The Planning Board instructed the secretary to write such
a letter inviting someone from this Institute to appear at the
May 9th Planning Board meeting.
A letter was received from the Cutchogue Fire District
-relative to the installation of a fire well and approach ramp
on proposed extension of Griffing Street north of the -Post
Office in Cutchogue. The Board instructed that the letter be
placed in the file pertaining to the extension of Griffing ,Street
for future reference.

The Planning Board received for their files the legal ,
description and map of the proposed change of zone on Town
-Board=s own motion from "A" Residential and Agricultural District
-to "B" Business -District on certain property in .Arshamomaque.
The property is bounded and .descr.ibed as follows: Beginning at
the intersection of the southerly line of Main Road. with the
westerly line of Silvermere Road about 575 feet to land of Long
Island Railroad Company; thence in a general southwesterly direction
along land of .Long Island Railroad Company about 5200 feet -to Kerwin
Boulevard; thence northwesterly along Kerwin. Boulevard •to the south-
easterly line of said Main Road; thence in a general northeasterly
direction along said Main Road about 5900 feet to the point of
beginning. -Excepting two existing "B" zone areas within the above
described boundaries. Map of proposed change of zone from "A"
Residential and Agricultural District to -"B" Business District at
-A.rahamomaque by Otto 'W. Van Tuyl & Son dated April 2,. 1962.
