PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U TEE S SOUTHOLD TOWN PLANNING BOARD August 6, 1962 A regular meeting of the• Southold Town Planning Board was held 7:30 P.M. , - Monday, August 6, 1962, at the Town Office, Main Road,. Southold, New York. There were present: Messrs. Archibald Young, Acting Chairman, Henry. Mois�L,, Alfred Grebe, William Unkelbach, . and John Wickham, . Chairman, who arrived .at 8: 00 P.M. Also present: Messrs. Otto W. Van Tuyl, . Consultant and Howard Terry, Building Inspector. Mr. Harold Reese and Mr. Frederick Reese of 410 Jericho Turnpike, Mineola, New York, . appeared before the- Planning Board to discuss their proposed subdivision on the 34 acres of land they have purchased from Sage at .Arshamomaque. There will be 51 lots, each containing over 20, 000 sq. ft. They have made six test holes for drainage and have received favorable reports on them. The only matters for discussion were the road ends. The easterly entrance road showed a 50 ft. dead- end at the water and the Board insisted that this be widened to a 100 ft. by 100 ft. turn around. The road which ended at the proposed canal on the west had a 50 ft. dead-end and the Board suggested that Lot No. 1 and Lot No. 18 each be increased at their southwesterly and northwesterly, respectively, boundaries by approximately 27 ft. by Southold Town Planning Board -2- August 6, 1962 25 ft. by splitting the 50 ft. road in half at that point (thereby eliminating the dead-end at the proposed canal. The Reese's agreed . to this proposal. On motion of-Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that Harold and Frederick.Reese be granted preliminary approval of their preliminary map dated March 21, 1962 with corrections by the Planning Board on August 6, 1962. Map by Otto W. Van Tuyl & Son. Vote of the Board: Ayes:- Mr. Grebe, Mr. Young, Mr. Moisa, and Mr. Unkelbach. Mr. Rene Gendron again appeared before the Planning Board to discuss his proposed subdivision on the west side of 'Bayview Road, . Southold. At the last meeting the Planning Board made suggestions as to the road ending at the, westerly end of. the property and Mr. Gendron agreed to make the suggested changes. Mr. Gendron now presented a preliminary plan showing a turn-around of 190 ft. and all lots having at least 100 ft. frontage. This subdivision will have public water therefore some of the lots will have less than 20, 000 sq. ft: of area. 'Inhere was some discussion relative to the purchase of additional land to widen . a 40 ft. road which would connect with South Harbor Road on the west- of this subdivision. This road would have to be private 'if it is not widened to 50 feet. . Mr. Gendron said he would endeavor to purchase additional land. On .motion of Mr. Unkelbach, .seconded by Mr. Grebe, it was RESOLVED that Rene Gendron be granted preliminary approval of his proposed subdivision plan dated June 23, 1962 and July 27, 1962 by Alden W. Young. This preliminary approval is granted from Bayview Road to the west boundary of the turn-around. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, . Mr. . Grebe, Mr. Young, and Mr. Unkelbach. The Board discussed the matter of:Eastwood Estates, proposed subdivision being developed by the George H. Fleet -Estate at Fleet's Southold Town Planning Board -3- August 6, 1962 Neck, Cutchogue. Everything being in order and roads almost complete, On motion of Mr. Young, seconded by Mr. Moisa it was RESOLVED that the Planning Board grant tentative approval of proposed subdivision to be known as Eastwood Estates ate Fleet's Neck, Cutchogue, New York. On motion of Mr. Unkelbach, seconded by Mr. Grebe, it was RESOLVED that the Planning Board set 7:30 P.M. , Tuesday, September 4, 1962, Town Office, Main Road, Southold, New York as time and place for hearing upon the question of approval of the following plat: Plat of property owned by George H. Fleet Estate, entitled Eastwood Estates, consisting of a parcel of land of approximately 7.87 acres, situated at Cutchogue in the Town of Southold, Suffolk , County, New York, and bounded and described as follows: Beginning at a monument on the northerly line of South Cross Road 175 feet westerly along said line from the westerly line of Fleet's Neck Road; running thence along said northerly line of. South Cross Road S. 57042100"W.-360. 0 feet; thence along land of Vanderbeck and other lands No. 32018100"W.-928. 20 feet to the southerly line of Midwood Road; thence alongsaid southerly line of Midwood Road N. 500 8312011E.-363. 24 feet to land of Besemer; thence along said land of Besemer and other lands S.32018' 00"E. -976.51 feet to the point of beginning. Containing 7.87 acres. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkd.bach. The Planning Board again discussed the application of Edwin H. King for a change of zone from "A" Residential and Agricultural District to "B" Szsiness District on Narrow River Road in Orient. At the last meeting the Board decided to investigate this property and make their recommendation at this meeting. Mr. Robert-W. Gillipsie, Jr. a neighboring property owner and Mr. Percy Douglas appeared before Southold Town. P7aining Board , -4- August 6, 1962 the Board to speak relative to the proposed change of zone. Mr. Gillispie stated that there is a question as to whether'Mr. King owns all of this land or not. George Hallock agreed to sell Mr. King the land but did not specify where the boundary was, however Mr. King started bulldozing and he went on to the George Edwards Estate property. He has done a complete job there without a change of zone, and Mr. Gillispie stated that to recommend this favorably would be- recommending spot zoning and would create a district over which there would be no restriction as to the type of business which could be conducted. Mr. Percy- Douglas concurred,fdith Mr. Gillespie. The' Planning Board members were in agreement with .Mr. Gillispie, all of them having investigated .this property. They were also in touch with the Town Trustees and found that Mr. King has violated their regulations. After considerable discussion, on motion of Mr. Grebe, secs nded by Mr. Young, it was RESOLVED that the Planning Board recommend to the Town Board that this change of zone from "A" Residential and Agricultural District to "B" Business 'District on property of Edwin King at Orient be denied. This would be spot zoning and not consistent.with the best development of : our waterfront. In the Planning Board's mind the continued operation of this marina without a permit is a flagrant violation of the Zoning Ordinance and should be discontinued. Our entire Board has studied this property and find that there are additional problems involving the Town Trustees and also adjoining property owners. This property is bounded and described as follows: BEGINNING at a point of deflection in the southeasterly line of-Natrow River Road where said line is intersected by the boundary line between land of George W. Hallock and land .of Edwards and Gillespie; running thence along said boundary line S.- 620 07 ' E. - 165 feet, more or less, to ordinary high water mark of Hallock's Bay; thence along said ordinary high water mark of Hallock's Bay southwesterly about 350 feet and then southeasterly about 260 feet to a point about 10 feet southeasterly from and old marine railway; thence along other land of George W. Hallock; two courses, : as follows: (1) S. 352 43' 00" W. - - 80 feet, more or less; thence (2) S. 410 58' 30" W.' - Southold Town Planning Board -5- August 6, 1962 221.79 feet to the easterly line of'Narrow River Road; thence along , said line of Narrow River' Road, two courses, as follows: (1) N. 390 43' 50" W. - 183.72 feet; thence (2) N. 210 481 40" E. - 465. 10 feet to the point of beginning. Containing about one and one-half acres. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. Mr. William J. Baxter, Jr. appeared before the Planning Board to request tentative approval of his proposed subdivision to be known as Village Manor, at Mattituck, New York. Mr. Baxter has received the -Health Department approval and Mr.. Van Tuyl has the cloth prints prepared. The roads have not been installed by this time but Mr. Baxter hopes to have them completed within 90 days after the subdivision is finally approved and filed and if not he will post a performance bond. On motion of Mr. Unkelbach, seconded by Mr. Young, it was. RESOLVED that- William J. Baxter, Jr. be granted tentative approval of his proposed subdivision to be known as Village Manor , at-Mattituck. Mr. Wickham stated that he had met with Governor Rockefeller at the new. university center at Stoney Brook, and also in Riverhead and he had an opportunity to express his views regarding the Bridge to Connecticut and the extension of the Expressway, as well as planned projects. He stated that he felt the matter of a highway to the end of Long Island and the Bridge to theNEw England States presents many advantages , but it would encourage industries and agriculture would decline and they should decide at an early date whether food is more important than industrial development for EasternLong Island. He discussed this personally with Governor Rockefd.ler and he was very appreciative of the points that were brought out. Mr. Wickham also talked with Speaker of the House Carlino and the Governor's secretary. The Planning Board received the application for dedication of the roads in the Oakridge Hills subdivision at Southold, owned by Southold Builders, Inc. The Planning Board had approved the road layout when this map was given final approval. On motion of 'Mr. Young, seconded by Mr. Unkelbach, it was RESOLVED that the Planning Board approves the layout of highways to be known as Jennings Road and Booth Road on property of Southold Builders, Inc. , and described as follows: Southold Town Planning Board -7- August 6, 1962 Parcel One. BEGINNING at a point on the southwesterly side of Horton Lane distant 753. 50 feet southeasterly from the corner formed by the intersection of the southwesterly side of Horton Lane with the southeasterly side of' Sound View Avenue and which point of beginning is also distant southeasterly 202. 62 feet along the said southwesterly line of Horton Lane from a point where the same is intersected by the southeasterly side of land now of Clement W. Booth and E. The above two parcels of described land comprise a road 50 feet wide at all points running from Horton Lane southwesterly to land of Henry Jennings thence from a point therein northwesterly to the south- easterly side of Sound View Avenue. The Plannin g Board approved this road layout for the filed subdivision map known as "Oakridge Hills. " Vote of' the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The- Planning Board received the file for the application to dedicate highways by F. Harold Sayre. The Planning Board previously reviewed this matter and on December 6, 1961 they did not recommend their acceptance by the Town Board. The' Planning Board again reviewed this matter and On `motion of Mr. Grebe, seconded by Mr. Unkelbach, it was RESOLVED that in the matter of the application of F. Harold Sayre to layout North Parish Drive 'Extension and Northfield Lane at Bayview, Southold, New York, th e' Planning Board has reviewed this case in light of. our letter of :December 6, 1961 . to the Town Board. The rules and regulations and the State Law allows us no latitude in this matter and it would seem to us :that the advantages of 'a filed map both . to Mr. Sayre and to the assessment rolls of the Town of Southold are both obvious and considerable and in our mind overweighted by the considerations, there- fore we are unable to recommend the acceptance of North Parish Drive Extension and Northfield Lane to the Town of Southold until such time as a subdivision map is filed. North Parish Drive Extension and Northfield .Lane are described as follows: . North Parish Drive Extension. South 58 degrees 02 minutes 30 seconds West, a distance of 64. 76 feet to a monument at the northerly end of the westerly line of said North- field Lane; thence along land of said F. On motion of Mr. Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the minutes of July 2, 1962 be approved as submitted. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach.
