Tuesday, September 4, 1962 at the Town Office, .Main Road,. . Southold, New York. There were present: Messrs. John Wickham, Chairman, Henry Moisas Alfred Grebe, ,.Archibald Young, and William Unkelbach. Also present: Mr. Otto W. Van Tuyl, Consultant, .and Mr. Howard Terry, Building Inspector. PUBLIC HEARING: On the question of approval of the following plat: 1. Plat of property owned by George H. . Fleet :Estate,. entitled Eastwood Estates,. consisting of a parcel of land of approx- imately ,7.87, acres, .situated at Cutchogue, in the Town of Southold, Suffolk -County, New York, and bounded and described .as follows: Beginning at a monument on the northerly line of South .Cross Road 175 feet .westerly along said line from the westerly line of Fleet's Neck -Road; thence along said northerly line of South Cross Road S.57042100"W. . - 360. 0 feet; thence along land of Vanderbeck and other lands N.32018100"W. - 928/20 feet to the southerly line of Midwood Road; thence along said southerly .line of'Midwood Road N.50003120"E. . - 363.24 feet to land of Besemer; thence along said land of Besemer • and other lands S.32°18100"E. - 976.51 feet to the point of beginning. Southold Town Planning Board -2- September 4, 1962 Mr. Wickham did not participate in this hearing as he is interested in this property. Mr. Young, Acting Chairman, opened the hearing by reading legal notice of hearing, affidavit attesting to its publication in the official newspaper and letter from the Superintendent of Highways stating that he has inspected the roads and at- this stage find that they are being constructed in compliance with the Highway Specifications of the Town of Southold. ACTING CHAIRMAN: Is there anyone present who would like to speak in favor of this subdivision? JOHN O8KEEFFE, ESQ. , Riverhead: I appear for the Fleet Estate in support of this subdivision and say we wish you would see fit to approve it. ACTING CHAIRMAN: Does anyone wish to speak in opposition to this proposed subdivision? (There was no response. ) MR. JOHN WICKHAM: I have talked with Superintendent of Highways Price on this and he says that in order to have the Town accept dedication of the highway it would be necessary to have .some arrange- ments made for drainage. ACTING CHAIRMAN: I think we can grant this and stipulate that adequate drainage will be required by the Superi tendent of Highways. MR. OtKEEFFE: That will be agreeable to us. ACTING CHAIRMAN: Is there anything else? (There was no response. ) ACTING CHAIRMAN: Since there is no one else who wishes to say anything regarding this subdivision I will declare the hearing closed. On motion of 'Mr. Unkelbach,. seconded by Mr. Grebe, it was moved: WHEREAS George H. Fleet -Estate has petitioned the Southold Town Planning Board for final approval of their plat known as "Eastwood r Southold Town- Planning Board -3-. September 4., . 1962 Estates" at Cutchogue, .New York, and WHEREAS the Superintendent of Highways of the Town of :Southold. has inspected the highways and found at this stage they are being constructed .in compliance with, the Highway--Specifications of the Town of Southold, and his report is hereby approved by the 'Planning Board, and WHEREAS the Southold Town Planning Boardr. pursuant to due -notice thereof, held a public hearing on the matter of approval of the plat .. at which time all interested persons were given an opportunity to be heard, and . WHEREAS the Southold Town Planning Board waives the provisions in the Rules. and Regulations for the' Subdivision of Land requiring park and playground area or cash equivalent; NOW THEREFORE BE 'IT .RESOLVED that the subdivision- to be known as"Eastwood Estates" at:Cutchogue, New York, consisting of 7.87 acres and owned by the George H. .Fleet- Estate be approved. The highways in this subdivision must meet the specifications of the Highway' Superintendent before being approved for dedication by the Planning Board. WILLIAM BAXTER," SR. : I am appearing for my son. I talked to Price about putting in the roads and he suggested that the layout is satisfactory. I,mentioned Wells of Mattituck to do the job and Mr. Price stated he would be satisfactory, and I told .Wells to get Mr. Price's approval about the construction of the roads,-:. Planning Southold Town/Board -5- September 4e., 1962 i There was discussion relative to easements for drainage and Mr. Baxter' stated he would agree to giving deeds to the town for easements. There was a suggestion that the pond should be dredged so there wild be constant water level 'in it` THE' CHAIRMAN: Are there 'any other questions? Does anyone wish to say anything- further? (There was no response. ) THE CHAIRMAN: Since there is nothing further I will close the hearing. . On motion of Mr.. Moisat,. seconded by Mr. Grebe,. it was RESOLVED: WHEREAS William J. Baxtere . Jr. and Jane P. Goeller have petitioned the Southold Town. Planning Board for final approval o.f their plat known as ' "Village .Manor" at Mattituck, New York, and WHEREAS the superintendent- of Highways of the Town of Southold has inspected the map and approves the highway layout of. roads to ,be constructed, . and his report is hereby approved by the Planning Board, and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard, . and WHEREAS the Southold Town 'Planning Board waives the .provisions in the Rules and Regulatiors for the' Subdivision of Land requiring park and playground area or cash equivalent; NOW THEREFORE BE IT RESOLVED that the subdivision to be known as "Village Manor" at Mattituck, New York: consisting of 16.345 acres and owned by William .J. Vote of the Board: Ayes: Mr.-. Wickham,. Mr. Moisa, Mr. Grebe, .Mr. Young, .and Mr. Unkelbach. Mr. Walter =Luce appeared before. the Board on behalf .of Nathaniel 0. Abelson to discuss the preliminary. plan of proposed subdivision to be knownas. "Arrowhead Cove" at Indian Neck, Peconic, New York. This proposed subdivision would contain 31.1 acres and have approximately 40 lots. Mrs. -Agnetta -Ewer 'also appeared before the Board with reference to this matter. She owns property at the point where Campfire Lane ends. at- a 'turn-around at �Peconic Bay. .She does not approve of this location for. the road end as it abutts her property. This problem was discussed and the Board stated that Mr. -.Luce should discuss this matter with Mr. Abelson and see if he has an alternative idea. He has indicated a .desire to keep the roads private. Mr. Van Tuyl presented for 'the Boardb review a preliminary .map of property of .'Christ- Stratakis on the west side of Rocky.-Point Road, East Marion. The man shows six lots on Rocky Point Road and four interior lots. According to the 'subdivision rules there must be over four lots off of .a public highway to be. considered a subdivision. However,. the Board is always favorable toward -an individual filing a subdivision map because it is easier for mapping and tax purposes. On motion of Mr. Hoisa, seconded by Mr. Youngs. it was RESOLVED that Christ' Stratakis be granted preliminary approval of his map of 'property at Rocky.Point Road, :East Marion. Map by Southold Town Planning Board -7- September 4, 1962 Otto W. Van Tuyl & Son dated August 10; 1962. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board received from the Town Clerk the petition of Alec Zuhoski, Bertha Harris, Frank J. McBride, Leander B. Glover, Albin Pietrewicz, Jennie S. Golembeski, as administratix of Frank Szawinski Estate, Jennie S. Golembeski, as Executrix of 'Katie Szawinski Estate for a change of zone from "A" Residential andAGricultural to "C" Industrial District on certain real property situated at Cutchogue, New York, and more particularly bounded and described as follows: Beginning at the intersection of the southeasterly line of Oregon Road with the southwesterly line of Cox Lane; running thence southeasterly along said line of Cox Lane about 3, 000 feet to a point on the direct extension northeasterly of the northwesterly line of land of Wickham Estate; thence southwesterly across land of Pietrewicz on said extension and then along said northwesterly line of Wickham Estate and land of Harris and then across land of Szawinsk i Estate; a total distance of about 1400 feet, to land of Leander Glover; thence southeasterly along said land of Glover about 300 feet to, the north- westerly line of Middle Road; thence southwesterly along said line of Middle Road about 50 feet to land of First Baptist Church of Cutchogue; thence northwesterly along the last described land and other lands about 500 feet to land of Town of _Southold; thence along land of the Town of Southold, three courses, as follows: (1) southwesterly about 250 feet; thence (2) southeasterly about 100 feet; thence (3) south- westerly about 350 feet to land of McBride; thence southeasterly along land ofMcBride about 350 feet to said northwesterly line of Middle Road; thence southwesterly along said line of Middle Road about 400 feet to land of .Zuhoski; thence northwesterly along land of Zuhoski. about 1950 feet to land of J. P. Krupski; thence along land of J. P. Krupski, four courses as follows: (1) northeasterly about 350 feet; thence (2) northwesterly about 1700 feet; thence (3) northeasterly about 450 feet; thence (4) northwesterly about 150 feet to the south- easterly line of said Oregon Road; thence in a general northeasterly direction along said line of Oregon Road about 1300 feet to the point of beginning. Excepting therefrom however all the lands within the above described parcel now owned by the Town of 'Southold, as delineated on a survey attached hereto. Containing about 130 acres. The land described has present uses consistent with future industrial uses: a sand pit, a town dump, a cooperative labor camp. The future use of the land will be the same : :as the present. Southold TownPlanning Board -8- September 4.0' .' 1962 The Board discussed the matter 'of the Town property being excluded and it was determined that according to the Town Attorney i it would not be legal to zone town property. It -was also pointed out that on ,page 3 of' the petition it states the parcel contains 130 acres, . and the Planning Board wished it noted that the petition should read 130 acres excluding the Town of =Sou thold Property. On motion of Mr. Grebef seconded by Mr. Unkelbach,, it was RESOLVED that the Planning Board recommend, to the Town Board this change' .of zone from "A" Residential and Agricultural District to' "C" Industrial District. 'Map of 'proposed "C" 'industrial zone at Cutchogue by Otto W.. Van Tuyl dated August 8, 1962. The _yPlanning Board feels that this is the best possible use for the property in question as the area is unsuitable for residences. There are no adequate undeveloped industrial areas in the Town and the Planning Board feels this area is ideal and of sufficient size to admit a great deal of industrial activity. The Planning Board does feel,. however, that since it is the policy of the Town to abolish, wherever possible,, nonconforming uses the Town property should be included in this "C" Industrial District if it is proper;. to do so. Vote of the Board. Ayes:- Mr..-Wickhamv, Mr. Moisa, Mr. Grebe,, Mr. 'Young,. ' and Mr. Unkelbach. -, Mr. Moisa, Mr. Young,. Mr. Grebe and Mr. Unkelbach,.. along with Mr. Howard Terry, Mr. Harold .Price and County- Executive Dennison,. . met with Henry-Zabahonski on Fishers Island on August 21st during the annual visit. Mr. . Zabahonski discussed subdivision procedures with those present. . He had a blueprint of the property he is interested ' in developing. They advised him that- for any further information he should contact the Planning Board. Mr. Young brought up the problem of the highway specifications. lie feels, along -with the other members of the Board, that the Highway Specifications. of the Town of Southold should be tightened up. Everyone agreed that Mr. Price should be consulted and advised of 'the Board's plans. On motion of Mr. Wickham, seconded by Mr. Moisar.. it was Southold Town Planning Board . -9- September' 4, 1962 RESOLVED that Mr. Young be appointed to prepare a .resumell of the highway .regulations. of the ,Townsin this 'County and propose standards for the Town of Southold. - Mr. Young requested that Mr. Terry and Mrs—Boken aid him in this project. Vote of the Board: Ayes: Mr. Wickham, Mr. Moisa, .Mr. ' Grebe,, : Mr. Young?.• and Mr. Unkelbach. On motion of'Mr. Unkelbachi,, . seconded by.-Mr. Grebe., it was RESOLVED that the minutes of August 6,. 1962 be approved as submitted. Vote of the Board: Ayes:- Mr.. Wickham, . Mr. Moisa, Mr. Grebe Mr.' Young,, and Mr. Unkelbach. The next meeting of the Southold Town Planning Board will. be a brief meeting to approve , the 1963 Budget and will be held 7_ 00 P.M. ,.'
