Re: Set off for John and

Dear Mr. Shirvell:
Please let this confirm that the Planning Board reviewed
the above mentioned proposal at the Monday, March 24, 1986 meeting.
It was the consensus of the Board to set this proposal for
a field inspection prior to any further review or action.
Also, since the lots proposed are less than 2 acres,
an application will also need to be made to the Board of
Appeals.
If you have any questions, please don' t hesitate to contact
our office.

REASON FOR APPEAL Continued
NA
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties o¢runneces=,' "s(
sory HARDSHIP because
As noted in my letter of February 28,. 1986 to the Planning Board requesting
a setoff, I was forced due to a physical disability,. to retire prematurely from the
Suffolk County Police Department. This, disability makes it virtually. impossible for
me to properly care for or fully utilize my .entire lot. Asa consequence, the
westerly half remains unkempt in a neighborhood of fairly well tended lots. Although
I cannot make use of or enjoy a major part of my property, 1• must continue to pay
taxes on the entire plot. Because my pension is fixed at a level considerably below
what I earned before my forced retirement,' this has and continues to cause consider-
able. and increasing financial hardship'.
Strict, application of the Ordinances would likely force me to relocate, preclude
the possibility of any of my children (who "were educated in local schools and have
established many personal ties to the community). returning to Southold due to the
high cost of housing and permit a lot to remain in an unattractive condition not in
keeping with the. rest of the neighborhood.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate"'
vicinity of this property and in this use district because
The westerly section of the: lot is undeveloped. It 'is situated on a corner
with substantial frontage on both Pine Tree Road and Billard Road. It is -easily .
accessible from either street. Because the westerly-:half of the: lot.lie's slightly
lower than the eastern half of the- property, the- lot lends itself naturally-to .
subdivision. To deny the subdivision,: in addition -to causing consider6l5le..fin-
ancial and personal hardship, would leave intact a lot which does not comport
with other properties in the- vincinity in appearance, size, configuration or
situation.
3. The Variance would observe the spirit of the Ordinance and WOULD,. NOT CHANGE THE
CHARACTER OF THE DISTRICT because
As noted .above, the segment to be subdivided is a corner lot with easy access
and substantial' frontage on two streets. After subdivision both lots would approx-
imate or exceed the- size of most other parcels in the area. Subdivision 'would per-
mit the- lot to be fully' -used and maintained in a manner which would improve the
appearance of the- neighborhood rather than detract from it.
