HomeMy WebLinkAboutPB-05/12/1969 M I N U T E S SOUTHOLD T0WN PLANNING BOARD May 12, 1969 A regular meeting of the Southold Town Planning Board was held at 7:30 P.M, , Tuesday, May 12, 1969, at the Town Office, 14ain Road, Southold, New York There were present : Messrs: John Wickham., Chairman; Henry Moisa, Vice Chairman; Alfred Grebe, Frank Coyle,Henry Raynox. Also present: Rod Van Tuyl, Consultant; Howard Terry, Building Inspector. PUBLIC HEARING: Upon the question eE approval of the following plat: 1. Plat of property owned by Mary J. Grigonis, entitled Harvest Homes Estates, Section I, consisting of a parcel of land of 17.071 acres, situated in Southold, in the Town of Southold, Suffolk County, New York, and bounded and described as follows : BEGINNING at a monument on the easterly line of Oaklawn Ave. , 767.05 feet northerly along said easterly line from Well's Avenue; from said point of beginning running along said easterly line of Oaklawn Avenue, N. 230 93' 50" IN.- 175.0 feet; thence the following 9 courses : (1) N. 660 36' 10" ,E,.- 208.0 feet; thence (2) X. 23° 23' 50" W-- 526.39 feet; thence ,(3) S. 730 , 06' 40" W.- 1.34 feet; thence (4) N. .23° 23' 50" W o- 99.98 feet; thence . (5) S. 73° 06' 40" W.- 800 feet; thence .(6) N.23 ° 23' 50" W,- 174.95 feet; thence (7) N. 73' 06' 40" E.- 380.93 feet; thence (8) N. 15° 45' 10" W.- 117.79 feet; thence (9) N, 69° 04' 00" E.- 200.82 feet to -said Wells A-venue; thence along said Wells .Avenue, .the following five courses: (1) N, 700 22' 2041 E,- 76.30 feet; thence (2) southeasterly on a curve to the fight _having a radius of 80.0 feet, a distance of 123,84 feet; thence (34 S. 200 56' 00" E.- 650.24 feet; thence (4) S. 190 09' 10" E.- 169®20 feet; thence (5) southerly on a curve to the right having a radius of 199.59 feet, a distance of 10.80 feet; thence the following three courses: (1) S.690 04' 00" W.- 244.10 feet; thence (2) S. 200 56' 00" E.- 100.0 feet; thence (3) N. 840 27' 30".E,- 170.95 feet to said Wells Avenue; thence along said Wells Avenue, two courses: (1) S. 241 30" 50" W,- 55.38 feet; thence (2) Southwesterly on a curve to the left _having a radius of 189,38 feet„ a distance of 44.62 feet; thence the following four courses: (1) S. 870 47' 00" W.- 129.31 feet; thence (2) S. 660 36' 10" W.- 293.0 feet; thence (3) N. 230 23' 5011 W.- 41.03.feet; thence (4) .S. 66° 36' 10" W.- 333.28 feet to the point of beginning. Southold Town Planning rd r' Page -2- May 12, 1969 The Chairman stated that the legalnotice of hearing was published in the Long Island Truveler-Mattituck Watchman, and the Suffolk Weekly Times, and read the affidavits in the file indicating that publication was actually made. THE CHAIRMAN: At this time is there anyone present who wishes to speak in opposition tb this subdivision' (There was no response. ) TIM, CHAIRMAN: Is there anyone present who wishes to speak in favor of this subdivision? BILL GRIGONIS: Our attorney is confined to home. I am here and can answer any questions on this, THE CHAIRMPIV: Anyone else wish to speak on this subdivision? (There was no responseR ) The estimate for the performance bond was discussed as to whether or not the estimate on the watermains was for Section I and Section II or for just one section. The Chairman read a letter of intent from Mary.Grigonis, concerning park and .playground area for Section II of this subdivision, THE CHAIRMAN: We will recess this hearing at this time in order to obtain further information concerning the performance band. The Chairman read a letter from Robert J. Douglas, concerning Willow Terrace, Orient, requesting postponement on the hearing for this subdivision, Such request granted; hearing set for June meeting. Mr. Jack Driscoll appeared before the Board in regard to property of Martin Weglicki, located on Pedcmzic Bay. Blvd, The Chairman read a letter of approval of the roads for this proposed subdivision, The topography of the property was discussed It was agreed this property should be filed in two sections, Mr% Driscoll requested permission to sell one lot out of this property. Said lot being located on the existing highway. It was agreed that Mr. Driscoll be granted permission to sell one lot on .the existing highway, subject to the subdivider filing an application for Section I of this subdivision; and paying the required fee for the filing of said subdivision, Southold Town Planning Board Page -3-- May 12, 1969 Mr. H. R. Reeve, et al, appeared before the Board for a preliminary discussion on a subdivision, Bennets Pond. Said. subdivision showed 10 lots. It was pointed out that two of the lots were too small and that lot Y 6.does not have sufficient frontage.. A discussion was held on the turnaround,. The entrance to this property will be 100 feet wide and the road will be 50 feet wide. No action was taken on this subdivision. Mr. Lark and Pairs Finger appeared beofre the Board in regard to the roads in Birch Properties, Inc. They requested that the Southold Town release Birch Properties from the.perf ormance bond on the road. Messrs Lark and. Finger advised the Board of the traffic problem on this road which they wished to keep as_ a private road, and stop speeding cars from using it as a through-fare, The Chaim.an advised that this road has not met the requirements of the Superintendent of Highways and that the bond could not be released until he granted the approval. It was agreed that Mr. Lark should approach Mr. Dean, Superintendent of Highways and see what he would required in order for the bond to be released on these roads in Birch Properties, Inc. Mr. Ed Meyer appeared before the Board in regard to lots no. 158, 159, and 160 in Nassau Points Mr, Meyer wishes to divide these three lots into six lots and sell theme. Mr. Meyer was advised that under five lots would be considered a minor subdivision. No action was taken on this matter and it was decided to hold it for the next regular meeting., Mrs. Saland appeared before the Board in regard to dividnig property and selling lots. She was advised if she wish to sell only one lot than she should file a plan showing the one lot she wish to sell, If however, she intended to continue selling lots she would have to file a.map for a subdivision. Mr. Lee appeared before the Board in regard to his property located at Laurel Lake, Laurel. The Chairman advised Mr. Lee that the planning Board has received a letter from the State Department of Transportation advising where the expressway and service roads will be located in relation to this property; and at this time it may be feasible for Mr. Lee to develope his property and have suitable access. A. discussion was held on obtaing access through the property of Jazombek, however it was reported this property is in the process of being sold. Mr. Lee was advised that he should file fog a minor subdivision on this property and make the necessary application to the Planning Boardw Southold Town Planning .__rd Page -4- . May 12, 1969 Mr. George Ahlers appeared before the Board in regard to his subdivision located at Southold. Mr, Ahlers reported that he has obtained prices for the bulkheading of the canal, Said Canal will be 50 feet wide . The subdivision will have city water. Mr, Ahlers was advised to file a new map showing the 50 foot canal. A letter from the superintendent of highways will be required. It was reported that the roads are roughed in. Mrs Ahlers was advised he would have to complete the roads or post a performance bond. The Planning Board received from the Town Board the motion to change the following property: By Chainging from "B!T Business District to "A" Residential-Agricultural District, the following described property: All that certain tract of land situated at the south side Main Road, east of Beixedon, Southold, in the Town of Southold, County of Suffolk, and State of New York, and more particularly bounded and described as follows: BEGINNING at a point on the southerly line of the Main Road, 230.97 feet- easterly along said southerly line from a private roadknown as "Arshamomaque Avenue", from said point of beginning being the north- easterly corner of lot 2, block 2, as shown on "Map of Beixedon Estates", filed in the Suffolk County Clerk's QEf ice as Map #1472; from said point of beginning running along said southerly line of the Main Road, N. 570 12' OOrr E.- 100.0 feet to land of Lang; thence along said land of Long; S. _44° 11' 4011 R.- 1600 feet, more or less, to ordinary high water mark of Town Harbor; thence southwetterly along said high water mark 950 feet more or less, to the shore of the "inner basin" as shown on said "Map of Beixedon Estates"; thence northwesterly and the northeasterly and then .again northwesterly an then northerly along said shore about 1600 feet to the easterly corner of lot 8., block 21 as shown on said map; thence along said lot 8, and along lots 7, 6, and 5, N. 70 36' 4011 E.- 260 feet, mslre or less, thence along said lot 5 and along lots 4, 3, and said .lot 22 N,, 250 23' 40" W.- 366.21 feet to the point of beginning. Being and intended to be the .same parcel shown as a "B" zone on the zoning. map of the Town of Southold, as adopted April 91 1957 . Mr. R.G. Terry, Esq. , and Mrs.Grace Nickles Lewis appeared before the Board in. regard to the above, Mrs. Lewis is the owner of the parcel in question. A very lenghty discussion was held on the history of the property and Mrs. Lewis stated her reasons for not wanting the property to change zone. A proposal was made to split the zone of the property between rrArr Zone and "Id" Zone. On motion by Mr. Cd)yle, seconded by Mr. Grebe, it was RESOLVED that the above application be tabled for further investigation by the Planning Bard, Vote of the Board : FLyes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mt.. May 122 1969 Board The Planning Board received from the Town/the motion to change the following property: By chainging from "C" Industrial District to "APl Residential-Agrialtur&l. District the following .described property: _ All that certain tract of land situated at Bayview, Southold, in the Town of Southold, County of Suffolk, and State of New York, and more particularly bounded and described as follows: BEGINNING at a point on the ordinary high water mark of Shelter Island Sound, where said high water mark is intersected by the boundary line between land of Plock and land of Reydon Shores", from said point of begirini ng running easterly along said high water mark 800 feet, more or less; thence through said d)and of Plock, two courses: (1) southerly 1200 feet, more or less, thence westerly 800 feet, more or less, to said Reydon Shores; thence northerly along said Reydon Shores", 1200 feet, more or less, to the point of beginning. Being and intended to be the same parcel shown as a "C" zone onn the zoning map of the Town of Southold, as adppted April 9, 1957. It was agreed that the Planning Board recommend that nothing be done with.this proposal in the immediate future because the Planning Board believes it is in the best interest of the Town of Southold to zone this for light Industry, and that this application should be held until such time as there is a light industry classification in the Towne It is reported that a great deal of money has been invested in. this property for oyster research. Cassella Builders appeared before the planning Board requetting a further reduction in the landscaped area for the property shopping senter to be located at 14ain Road and Factory Avenue, Mattitucko On motion by Mr, Moisa, seconded by Mr. Coyle,=it was RESOLVED that the Southold Town Planning Board recommend that the application .for futher reduction in land scaped area for the Mattituck Shopping Center be denied. Vote of the Board : Ayes:- All On motion by Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED that theminutes of the Southold Town Planning Board dated April 14, 1969, be approved as submitted. Vote of the Board : Ayes :- ALL Southold Town I'laxnzing avc.rd Page -6- May 12, 1969 The Planning Board authorized Mr. Henry Moisa to sign the map on Harvest Homes when the Bond estimate has be taken care of. The next regular meeting of the Southold Town PlanningBoard will be held. at 7:30 P.M. , Tuesday, June , 1969, at the Town Osf ice, MainRoad, Southold, New York. .
