The Chairman opened the hearing by reading legal notice
of hearing with affidavit attesting to- its publication in the
official newspaper.
THg CHAIRMAN: In view of the fact Mr. Luce is not here
yet, I will ask if there is anyone who wishes to be heard in
opposition to this proposed .subdivision?
(There .was no response. )
THE CHAIRMAN: Hearing none we will recess this hearing
until Mr. Luce appears.
THE CHAIRMAN: Now that Mr. Luce is present I will ask if
there is anyone present who wishes to speak for this application?
MR. LUCE: I have nothing to add.
THE CHAIRMAN: We do not have the Superintendent . of
Highways' report, but. Mr. Price is present .and I will ask for
his report -at .this time.
MR. HAROLD 'PRICE, Superintendent .of Highways: The roads
are in good shape and acceptable.
THE CHAIRMAN: If the roads are to be dedicated to the Town
and the dedication will ,be completed within the next 90 .days, a

performance bond will not be required.
MR. LUCE: We plan .to dedicate immediately. Mr. Dart
-will begin preparing for dedication tomorrow.
THE CHAIRMAN: Is there anyone else present who wishes
to speak formor against this proposed subdivision Hickory
Acres?
-(There was no response. )
The Chairman declared the hearing closed.
On motion of Mr. Moisa, seconded by Mr. Grebe;
WHEREAS Flora S. Luce and George L. Penny, III have
petitioned the Southold Town Planning Board for final approval
of their plat .known as "Hickory Acres, . Section One" at Bay
Avenue Cutchogudr New York, and
WHEREAS the' Southold Town Superintendent of Highways has
inspected the plat and found the highways in satisfactory con-
dition for reasonable access and in compliance with the High-
way specifications of the Town . of 'Southold,and his report is,
hereby approved by the Planning Board; and
WHEREAS the Southold' Town Planning Board, pursuant to due
-notice thereof, held a public- hearing on the matter of approval
of the plat .at which time all interested persons were given an
opportunity to be heard, and
WHEREAS the Southold Town Planning, Board waives the
provision in the Rules and Regulations for the Subdivision
of Land requiring park .and playground area or cash equivalent
NOW THEREFORE BE IT RESOLVED that the subdivision known
as "Hickory Acres, Section One" at Bay Avenue, '(rutchogue, New
York, consisting of 5.76 acres and owned by Flora -S. Luce and
George L. Penny, III, be approved on the basis that if . dedication
of the highways to the Town of Southold is not completed within
_ 90 days from this date per formance bond for their completion
will be required.

Vote of the .Board: Ayes.-. Mr. Wickham, Mr. Moisa, Mr.
Grebe, Mr. Young, and Mr. Unkelbach.
A letter. was forwarded to- the Southold Town Board notifying
them of the .approval of "Hickory Acres, Section one. ". A letter
was also forwarded to Flora S. Luce and George IL. Penny, III,
notifying them of the approval -of their subdivision.
Mr. Lefferts Edson appeared before the Planning Board to
discuss the parcel of . land owned by Mr. Albert F. Martin and
Harold E. Worley, Horton Lane, Southold. At the last Planning
Board meeting Mr. Edson had presented a pre-preliminary sketch
which showed the plat divided into 11 lots' with a' road down
the center ending in a .100 ft. turn-around. It .was the. feeling
of the Planning Board that -this turn-around would not be satis-
factory to the Highway superintendent and suggested that -the
road might possibly tie in with a road -on the land being
developed by Clement Booth to the north. Mr. Edson presented
.at this meeting a revised pre-preliminary sketch .showing- the
suggested tie-in with the Booth property. Mr. Clement -Booth
. appeared and -expressed his agreement to this road. The Planning

Board stated to Mr. Edson that the layout. looked satisfactory
to them. Pencil markings on layout dated 'March 7, 1961, bly Otto
W. Van Tuyl.
Mr. Edson and Mr. Henry Smith .of Pe-conic, next spoke to,
the Board with reference to a parcel of land .Mr. Smith owns -on
the south side of Indian Neck Road... Peconic. The preliminary
layout. by Otto W. Van Tuyl & Son, dated November. 14, 196.:0 and
revised March. 10, 1961, named Robinson Homes, shows 24 lots, each
containing at least 20, 000 sq. ft. -The lots. would be divided
by a 50 ft. road ending in a 100 ft. turn-around .and then contin-
uing as .a 50 ft. private road for approximately 500 ft. ,. ending
75 ft. in .width .at Little Peconic Bay. Mr. .Smith stated that
he. intends to dedicate Robinson Lane to the Town of Southold
but -not the private road.
The Board discussed with Mr. Price the -advisability of
having 100 ft. strips. ending at the water and Mr. Price stated
that he would like to see larger water front .areas rather than
.the small 100 ft. strip, since they are becoming .too many and
too close together. However, at the present time he feels the
only way to handle the situation -is to judge each case -as it
comes before the Board rather than have a .set .regulation.
With-.reference to the proposed ."Robinson Homes" Mr. Edson
stated he .would take steps toward making a. formal tentative
application to the Planning Board.
Mr. Joseph Snellenberg appeared before the Planning Board
with .reference to property owned by Julius. Z,ebroski on south
side of Main Bayview Road, Southold. Mr. Zebroski 'has approx-
imately 18 acres of land, approximately 12 acres of which he
developed prior to Zoning with private roads. He now wishes
to sell lots on a parcel of about -six to eight acres which .he
has layed -out .tentatively in four or five lots, plus some
meadow land which he expects to sell to lot owners adjoining
the meadow land. At the present .time -he .wished to put in a 50
ft.. road for dedication to the Town, thereby giving access to
the four or five lots. The Planning Board advised that .a-s far
as they are concerned the highway layout is satisfactory, how .
ever if he is going to -sell five or more lots he must file for
a subdivision. With four -or less they would be .willing to
recommend preliminary approval of the highway layout.

-Mr. Daniel Smith, Southold, New York, appeared before
the Planning Board for further discussion of proposed sub-
division of Pinetree Acres at south .side Pine Neck Road,
Southold, owned by the Southold Development-.Corporation. On
January 31, 1961 William Smith had appeared with a .preliminary
plan of Pinetree Acres and that plan has now been .revised to
a plan dated March 9,, 1961. -The Board thoroughly discussed
the layout -of lots, all of.which contain at .least .2.0,000 sq.
ft. and the road layout. The Planning Board advised Mr. Smith
that they are agreeable to the .entire layout -and stated he may
now proceed .with . formal application for tentative approval.
The Planning Board received a letter from the Suffolk
Cbunty Department. of Health.. transmitting the Department's standards
for. sewage and wakte disposal systems. These standardswere
-approved by David B. Overton, M.D. , Commissioner, Suffolk -County
Department .of Health on January l., 1961 and it is their intent
to commence. -enforcement as of .April 1, 1961.
The Board received a letter from .Town Attorney Tasker with
reference to a previous letter to the Planning Board concerning
the decision in Orange:::County declaring invalid the provisions
of Section 277 _of the Town Law which authorized a planning board
to require a, .developer to contribute money to the park fund.
Mr. Tasker stated that there is pending in the legislature a
bill amending ,Section 277 of the Town Law to circumvent the
abovementioned decision. A. copy of the bill was enclosed in
his letter. The bill attempts to set forth a formula in
ascertaining the amount of money to be contributed and„also
requires that the money so contributed be deposited in- a'
capital reserve fund and used only for the acquisition of
land for parks so located that they will serve primarily the
general- neighborhood in which the subdivision is located.
The Planning Board .received_ a .list of County Roads for
their files.
The Secretary was instructed to forward a letter to 'the.
Department of Commerce, State .of. New York, requesting, the
1960.-edition of "Local Planning. and Zoning" which .-contains
new Section 239-1 and -Section 239-m,of the .General Municipal
Law of the State of 'New York:.which became effective January- 1,
1961.

The report of the Building. Inspectors attendance at the
12th annual school -of the Eastern States Building ;Officials
Federation held at New York, February 23 and 24, 1961 was
accepted. The 'Secretary is to make .a copy for each. member.
The Planning Board discussedthe possibility of purchasing
a Photocopy machine. Literature had been received from Apeco.
Mr. Terry-advised he would contact, the company and .r.equest. a
demonstration.
The minutes of the meeting 'of February 21, 1961, on motion
. of Mr. Moisa, seconded by Mr. Grebe, and .carried, were approved
as read.
Vote of the` Board: ,Ayes;- Mr. Wickham, Mr. Moisa, Mr.
Grebe, . Mr. Young', and Mr. Unkelbach.
.. Mr. Van Tuyl brought up Orient-By-The-Bea, Section 2. He
indicated that , at the present time there is no provision for a
road. to the east -of Suction One. The Board thoroughly discussed
the layout of -Orient-,By-The-Sea, Section One and Section Two. It
was the feeling of the Planning Board that .in Section One there
should be some provision for a highway running east, and this
might possibly be an extension of Sound View Road. In Section
Two it is felt that Park View Lane should be extended toward the
west to the Moisa property. -Consideration was given to the
possibility of waiving. all walkways on .Ryder Farm Lane in -exchange
for having ..a road continue through to the west.
Mr. Van Tuyl brought iri a map of Green .Acres zt .Orient which
is being,devel-oped by Greenway Realty. This map had contours- of
the land and the proposed lot .layout. A. brief informal discussion
was held.
The Planning Board received a -reply to their letter' of
February 23.rd to the New York State Department of Commerce,
Albany, relative to an'airport .for Southold Town. This letter
stated that the State would be pleased to assist in locating a
suitable .site for- an airport if the Planning -Board would advise
as to the location of the sites under -consideration. They--would
then make a study in their office 'to determine the one .which ,would
best meet the Towns requirements. Following that study; they
would make a reconnaissance survey to ascertain the conditions
in the field. If the Town .or 'County is interested in developing
one of the sites they could also make a rough preliminary field
survey to determine the probable cost of the development.

A letter was' also received from the Fishers Island _Ferry
District transmitting an excerpt from the minutes of the Board
of. Commissioners meeting of the Fishers Island Ferry District
.held March 2, 1961, and the resolution , read as follows:
"WHEREAS Suffolk --County has proposed .a .development program for
'the airports and air terminals in Suffolk :County, including
Elizabeth Airfield, Fishers Island,
AND WHEREAS the Board of Commissioners note that -the- comprehensive
plan and development program for airports and .air terminals in
Suffolk County as prepared by Malcolm S. Spellman Associates,
Consulting ,Engineers dated December 1960 recommends for Elizabeth
Airfield a 5000 foot runway, shore line erosion control, field
lighting, automobile parking area and, a paved .area for the load-
ing and unloading of. aircraft,
THEREFORE. BE IT RESOLVED that:-the .Board -of' Commissioners of the
Fishers Island Ferry District hereby approve of this proposal
and thereby request that .Elizabeth Airfield, Fishers Island,
Ndw York be given full consideration in this program. "
The Board discussed the Fishers Island airport and the
three proposed. locations in Southold Town, which are as follows:
1. West side Duck Pond Road, between .Long Island. Sound and Oregon
Road, Cutchogue', New York.. 2. North of Bergen Avenue, and west
.of Luthers" Road, Mattituck. 3. The original location suggested
by the County in their aviatiinn .report, which is North of Main
Road (Route 25) , west.,of -Alvah`s Lane, .south -af Long Island Rail-
Road, and "east .of Elijah's Lane, -Mattituck.
It was agr-eed by all members present .that the location on
the west side of Duck Pond Road .would be the most practical
and best approach. Mr. Terry stated that he had.-spoken to J.
Parker Wickham :of the Mattituck .Airport and he feels that .this
would be.,the best location.
On motion of Mr. Young, seconded by Mr. Grebe, it was
RESOLVED that the Planning Board forward a letter - to the.
State citing the three possible locations and request .that they
begin their study, as well as the Elizabeth Field Airport :at
Fishers Island. The Planning Board understands there is no
obligation involved for this service by the State.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe, Mr. Young,aNd Mr. Unkelbach.
Southold Town Flanning,Board -9- March 15, 1961
Mr. Lawrence Tuthill, P.E. appeared before the Planning
Board and submitted his estimates for the construction of- roads
in Hilton Heights, Southold. Mr. Dillenbeck, engineer for Mr.
Hilton Epp- has submitted two -estimates, one of $3,8.00. 00 on a
detailed take-off of the quantities for the construction of. the
roads and the other a very general figure based .on a balance of
cut .and fills in the grading of the 'roads at .an estimated -cost
-.of $2,400. 00. Mr. Tuthill feels there should also be four leach-
ing basins, two at .the junction of Hilton Road and North Bayview
Road and two at the junction .-of- Hilton Road and the right-of-way
at. Mallgraf's property, each leaching basin is estimated to cost
$.800. 00. He also feels the bonds should be based on _an increase
of 20/ over present day costs for the general rise in construction
costs and an additional 10% should be added for adminstraticn
expenses if there . should be a .default. Mr. Tuthill submitted
the following: Bond without leaching basins: Estimate $3,80.0. 00
plus 30/ - $1, 140. 00, total. - $4, 940. 00. B:ond.with leaching
basins: Estimate $7, 000. 00, plus 30/ - $2,100. 00, total -
$9, 100. 00.
On mot gn .of Mr. Grebe, seconded by Mr. Moisa, it.was
RESOLVED that Mr. Tuthill's report be approved and submitted
to the Town Board for approval of the sufficiency -of the bond.
Vote of the Board: Ayes:- Mr. Wickham., Mr. Moisa, ,Mr.
Grebe,- Mr. Young, and Mr.. Unkelbach.
Mr. Tuthill also was requested to submit, to the Planning
Board his working figures with r-oad,length, size -of .leaching
basins, etc. These would also be submitted to the Town Board.
.The next .meeting of the .S.outhold Town Planning Board will
be held 7:30 P.M. , Tuesday, April 11, 1961 at the Town Clerk
Office, Main Road, ,Southold; New York.
Mr. Unkelbach requested. that .someone accompany him to Laurel
Lake to investigate the possibility of fencing the Town owned
property because of disturbances occuring. there. Mr. Young
offered to go with Mr. 'Unkelbach.
