The Chairman reported that the Superintendent. of aighways
had approved of the highway layout at the last. meeting. There
was a brief discussion relative to reserving lot No. 3 to tie-in
with a possible future road from the west. Mr. Smith agreed that
he would hold. lot. No. 3 for two years and if he. r-eceives an .offer
to sell he will contact the Board before selling it.

RESOLVED that the Planning Board grant Henry J. Smith tentative
approval of his proposed. subdivision to be known as "Peconic Bay
Oaks" at. Indian Neck, Peconic, New York, map by Otto W. Van Tuyl
& Son dated April 3, 1961.
,A letter. was to be forwarded -to Mr. Rdson with a copy to Mr.
Smith stating that he may now instruct .his engineer or. surveyor to
proceed with . computing the map, preparing the finished map, submit
their cloth prints to the Health Department for approval, and proceed
with other matters necessary prior to submitting them to the Plan-
ning Board for final consideration. These prints must be submitted
at least ,15 days prior to a regular meeting of the Planning Board.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. .Grebe',
and Mr. Young.
Mr. Stanley Case, Chairman of the Board of Fire Commissioners,
Cutchogue, appeared before the Planning. Board for a brief .discussion
with reference to having Griffing ,Street, Cutchogue, put into
-existence. The question of availability of water for another
fire well 800 ft. nearer the school and -also nearer the village
was discussed. A map of said Griffing ,$treet appears in the Mehl
change of zone file along with pertinent correspondence. The
outcome of this discussion was that the Board of Fire Commissioners
would forward a recommendation and request to the. Southold Town
Board with- a =copy of same to the Planning Board.
Mr. Edson next spoke to the Board with Mr. A. F. Martin and
.Mr. H. E. Worley relative to property theX own on Morton Lane,
Southold. Mr. Martin and Mr'. Worley wished to have, the B,oard's
comments on .a pre-preliminary plan showing a connection with the
road in the C. W. Booth property to the north. The Planning Board
.stated that they have no objection to the layout. Mr. Edson stated
that .his next step would be to submit a preliminary plan to the
Board.
Mr. Martin Graemlich and Mr. Henry Graemlich appeared before
the Planning Board with their attorney to discuss their proposed
subdivision •at Orient to be known as Green Acres. Their main
point of discussion was the Town's requirement -pf public access
to the water. In their plans they intended. to provide 170 ft.
by 200 ft. on the .water for the residents of the subdivision,
but they did not wish to give access to- the public. This was
thoroughly discussed and the Board advised that- a road to the

water would be a requirement -of approval of. the subdivision.
It -.was finally agreed by all concerned that a parcel of. land
50 ft. on the road and 100 ft. on the water would be setaside
for dedication to the Town and a parcel 120 ft. on the road and
85 ft. on the. water would be reserved for use by- the residents
of the subdivision.
Mr. Van .Tuyl was to contact .Mr. Harold Price relative to
the approval of . drainage in Green-Acres and. report back to the
Planning Board at :their next meeting.
Mr. William Smith .of the ,S,outhold Dev.elopment :Corporation
appeared before the Board to discuss tentative approval of
"Fairview Park at Southold, " south side Pine Neck Road. This
proposed subdivision. has 23. acres, with .36 lots, each containing
over 20, 000 sq. ft. The Southold Development Corporation now
has obtained a 50 ft. road running from Bayview Road to Gardiner's
Lane. in the. Subdivision through the B.reitstadt .Estate property.
There was a brief discussion. relative to obtaining public water.
On motion . of Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that -the Planning Board -grant Southold Development
Corporation tentative approval of proposed subdivision to be known
as "Fairview Park at Southold", at Pine Neck .Poad, Southold, New
York. Map by Otto W. Van Tuyl & Son dated April 5, 1961.
A letter was to be forwarded to the Southold Development
Corporation stating that they may now instruct -their engineer
or surveyor to proceed -with computing the- map, preparing the
finished map,_ submit their cloth prints to the Health Depart-
ment for approval, and proceed with other matters necessary prior
to submitting them to the Planning Board for finalcDnsideration.
Tiese prints must be submitted at least 15 .days prior to a regular
meeting of the Planning Board.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe,
and Mr. Young.
Mr. Ernest .Wilsberg and Mr. Harold Wilsberg appeared before
the -Board fr.o . a preliminary discussion relative to highway location
in a proposed subdivision on Main Bayview Road, Southold.
The Wilsbergs propose dredging a canal in this subdivision
and there was considerable discussion on the subject.

On motion .of. Mr. Young, seconded by Mr. Moisa, it,Was '
RESOLVED that_ a letter be forwarded to the- Southold Town
Trustees calling their attention to the fact. that in the near
future ther_e .will ,frequently be requests by subdividers for .','.
permission to have dredged canals or dredging for shoreline.
improvements in their new subdivisions. These subdivisions,
will. in many instances have considerable frontage on existing
.highwater line or highwater mark along our creeks and other
tide water inlets of our inland water systems which. comes .under
the jurisdiction of the Town Trustees. The planning Board
requested any suggestions, outline or statement. of policy which
the Trustees might like to submit, or procedures they would
like to have followed in relation to permission . or approval of
such dredging as may proposed.
Vote -of the Board: Ayes:- fir. Wickham, Mr. Moisa, Mr.
Grebe, Mr. Young.
The Chairman.brought up the . subject .of new construction
less than the prescribed area of high water mark. The Planning
Board felt that. they should be very rigid about the rear yard
provision of the Zoning Ordinance as applied to water frontage,
and particularly in business zones. A thorough discussion was
held on this subject.
On motion of Mr. Grebe, seconded by Mr. Moisa, it was
RESOLVED that the Planning Board. extends their sincere
congratulations to Mr. and .Mrs. Archibald N. Young on their
5.1st Wedding -Anniversary.

The petition of Herbert-L. Kalin ,& .Lloyd C. Kalin, Greenport
and .Orient, . New York, for a change of zone from -"All Residential
and .Agricultural District to "B" Business District was received
from the Southold Town Board .with instructions to prepare an
official report ,defining the conditions described in the petition
. and. determine the area so affected with the recommendation of
the Board. Property located in Greenport, New York, . and more
particularly bounded and described as follows: Beginning at :a
point. on the easterly line of Moores Lane distant 150 feet -in
a northerly direction from the intersection - formed by the said

. easterly line of Moore' s Lane with the northerly line of Front
Street; running thence north 2042140" east, 150.33 feet to the
southwesterly corner of land of the Village of Greenport; thence

. of land now or formerly of Sledje.ski, south. 2005100" west, 103.60
feet to a point;. thence along the westerly line of .land of' Herzog,

In reading the reason for the requested change .of: zone on
the petition the Board found that petitioners stated that they
own a retail florist business and are presently restricted by
the provisions of Section 300 of.- the Southold Town Building
Zone Ordinance and precluded from the commercial cultivation
of flowers, shrubs, etc. for the wholesale market. It is the
Planning Board's interpretation .-of the Building Zone- Ordinance
that: Eection .300 does not preclude the commercial cultivation
of flowers and. shrubs, etc.
On motion of Mr. Grebe, seconded by Mr., Young, it was
RESOLVED that the Planning Board return petition for a
-change -of zone by Herbert .L. Kalin. and Lloyd. C. Kalin to the
Southold Town Board stating that the Planning Board has no
objection to granting a "B" Business District on the Kadin
property but feel the reason for request on page 2 is a
definite mis-statement - of fact as regarding Section 300.
Further, the Planning Board would . like to recommend that
the Board on its own motion consider rezoning the entire - area
"B" Business including the property of Albert Herzog, Jr.

Grebe, and. Mr. Young.

Population and Housing CharacteristicsReport from the Suffolk
County Planning Department.

-The planning Board discussed the matter of a performance
bond for completion of roads in Hilton Heights at North Bayview
Road, .Southold.
.On motion of Mr. Grebe, seconded by Mr. Young, it was
RESOLVED to forward a letter to Harold Price, Superintendent
of Highways, . enclosing a copy of Lawrence Tuthill ' s report on
sufficiency of the proposed bond and stating that the Planning
Board is contemplating .asking for a performance bond in an amount
- of the estimate by Lawrence Tuthill plus 10%, .for a total of
$10, 000. 00, and .requesting Mr. Price's reaction or approval of it.
It is presented to Mr.. price in accordance with the Rules ;and
Regulations for the Subdivision of Land. If he has any questions
the Planning Board would be happy to discuss it .with him at the
next meeting or personally.
A carbon .-copy of this letter was to be forwarded to Mr. Epp.

Grebe, and Mr. Young.
The Beard discussed with Mr. Van Tuyl the extension -of North
Sea Drive to the east in Section One of Orient by the Sea, Orient,
New York, also a westerly extension of Park View Lane through
Lot 63 and drainagoroblems that -exist.
on motion of Mr. Young, "seconded by Mr. Moisa, it .was
RESOLVED .that Mr. Van Tuyl forward a letter to Mr. Uhl
stating that the Planning Board discussed and considered the
westerly extension of Park View Lane through Lot 63 and an
extension near the easterly end of..North Sea Drive to the. east.
Also Mr. Price stated that the Town should have two areas of
drainage basins, each side of Park, View Drive either east or west
of the easterly line of lots 142 and 5.1, each of which should be
about 75 ft. in width by 100 or 125 ft. deep. There is -also the
matter of a performance bond for work not . to be done this year.
It was suggested that .the -questions involved -could best be Settled
by a conference with Mr. Uhl' s representative, the Planning Board
and the Town Superintendent of Highways.

Grebe, and Mr. Young.

On motion of 'Mr. Young, seconded by Mr. Grebe, it.'was
RESOLVED -that Howard -Terry be complimented on his report
of attendance at,-the 1.2th annual School -of:Eastern States Build-
ing -Officials Federation held-.at New York on February :23 and. 24,
1961. This report ,and his -ob;servations were found ,to be very
informative.

RESOLVED- that,' the minutes -of .the meeting. 'of March 15, 1961,

the Planning Board discussed the necessity of . strengthening
the highway specifications with ,reference to subdivisions.
On: motion of Mr. You ng, .seconded by,Mr. Grebe, it was
RESOLVED that ,a letter be forwarded to Mr. Harold Price
stating ,that the Planning-'B,oard has discussed .strengthening'
, the highway specifications as. regards subdivisions and feel
that it ,would perhaps be advisable to amend the specifications
as soon as possible to take,: care -of highways built-or being
built..on heavy clay land and 8uggest. as ,=6 possibility that
when.highways in "subdivisions ,are proposed on heavy soils that
.-the base of such highways be subject to approval, of,, the . Super-
intendent of Highways.
This is. only a suggestion but the Planning Board feels,
that . it is necessary to put something in if only for a stop-gap '
so ' that .they may require -adequate. construction. Mr.. Price'.s
comments or suggestions were requested.
