PLANNING BOARD MEMBERS John Wickham, Chairman Henry Moisa Alfred Grebe Archibald Young William Unkelbach M I N U T E S SOUTHOLD TOWN PLANNING BOARD June 20,. 1961 A re gu]a r meeting of the Southold Town' Planning Board was held 7:30 P.M. , Tuesday, June 20, 1961 'at -the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. John Wickham, Chairman, Henry. Moisa, Alfred Grebe and William Unkelbach. . Absent: Mr... Archibald Young, due to a death in the family. Also present: Messrs. Otto W. Van Tuyl, . Consultant- and Howard M. Terry, Building Inspector. . The minutes of the meeting of June 6, 1961, on motion of Mr. Moisa, seconded by Mr. Grebe,, were approved as read. Vote of the. Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, .and Mr. Unkelbach. The Planning Board received notification from the Town Board of the change of zone from "A" Residential and Agricultural District to "M" Multiple Residence District on the property of Frederick C. Bernhardt, and from- "A" Residential and Agricultural' District -to "B" Bubiness 'District. on the property of Herbert-L. and Lloyd, C. Kalin effective May 29, 1961. Southold Town Planning Board -2- June 20, 1961 Notification also was received from the Town Board on the change of zone from "A" Residential and Agricultural District to "B" Busin ess District on the property of-Wilson and Ralph Glover effective June 30, 1961. The Planning Board received a copy of the Action of the Board of-Appeals inihe matter of the application of Julius Zebroski, a/c Leslie Gazzola for recognition of access in accordance,,%ith .State of New York Town Law, Section 280A. This application was denied and reasons therefore were setforth in the Action of the Board. It was also noted that a similar- application by Mr. Zebroski on behalf of Mr. Prosper Clust requesting access over a .50 ft. road was withdrawiby Mr.. Snellenberg, ' Mr.- Zebroski's attorneys the night of the hearing, June 11 1961. The Planning Board wished ,a letter forwarded to the Board of Appeals acknowledging receipt of the Action and thanking them for the information, along with a copy of the minutes of " the Planning Board' s meeting of June 6, 1961 pertaining to the appearance of Mr. Snellenberg and .Mr.. Zebrosk i. The Planning Board received a copy of a resolution passed by the Southold Town Board at .a meeting held June 6, 1961, and instructions to prepare an official report thereon pursuant to the provisions of'Article IX of the Building Zone' Ordinance of the Town of Southold. It has been brought to the attention of the Town Board that the Building Zone Ordinance of the Town of Southold makes no provision for the use of land for cemetery purposes except in the "C" Industrial District and the Board believes that cemeteries should be a permitted use in the "A" Residential and Agricultural District -as well as the other use districts as a special exception by the Board of Appeals, there- fore the Town Board wishes to amend the Building Zone Ordinance Article III, Section 300 by inserting therein a new paragraph to be paragraph 6B 'to read as follows: 116B .—Cemeteries and the necessary incidental structures when authorized as a special exceptinn by the Board of 'Appeals as Hereinafter provided:" On motion of Mr. Moisa, seconded by Mr. Grebe, it was RESOLVED that the Planning Board recommend to the Town Board the amendment to the Southold Town Building Zone Ordinance "placing cemeteries in the "A" Residential and Agricultural District Southold Town Planning Board -3- June 20, 1961 when authorized as a special exception by the Board of Appeals. The Board is sure that it was the original intention of the authors of the proposed .Ordinance that cemeteries should be in the "A" Residential and Agricultural District. Further, all work sheets and the Zoning Map bears this out. It is believed this was an oversight in the printing or -proof reading of the Ordinance. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, and Mr. Unkelbach. The Secretary was instructed to forward a letter' to the Suffolk County- Planning Commission advising them of the proposed amdndment and requesting their recommendation and report in accord- ance with Section 239-m of the General Municipal Law. The Chairman of the Planning Board received a copy of the Street Index issued by the Suffolk County Planning Board. The Planning Board received from the Town Board the petition of Woodhollow Properties, Inc. for a change of zone from "A" Residential and Agricultural District to "B" Business 'District on certain real property situated at Orient and mpre particularly bounded and described as follows: Beginning at a point on the southerly side of the Main Road which point marks the northwesterly corner of premises herein described and the northeasterly corner of land of `the State of New York; thence running along the southerly side Main Road,, North 87 degrees 09 minutes 20 seconds -East 151. 72 feet to land of the United States Government; thence running by last mentioned land, South 11 degrees 43 minutes 20 seconds 'East 752 feet, to the ordinary highwater mark of Gardi.ner's Bay; thence running southwesterly along the ordinary highwater mark of Gardiner's Bay the tie. line of which bears South 39 degrees 44 minutes 40 seconds 'West 348.41 feet to land of the State of New York; thence running by last mentioned land, North 4 degrees 40 minutes 45 seconds West 1000 feet to the southerly side of the Mairi Road, at the point or place of beginning. Grebe, it was Southold Town Planning Board -4- June 20, 1961 RESOLVED that .the Planning Board forward letters with copies of the application and map to the County of Suffolk Planning Board, Long Island State Park Commission, New York- State Department of Public Works, and -U. S. Department of' Agriculture, requesting their approval and comments on this change of zone in accordance with the General Municipal Law Section 239-m.. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, Mr. G rebe, Mr. Unkelbach. The Planning Board received a letter from George A. McMann, Jr. on behalf of Woodhollow Properties, Inc. informing the Planning Board that they have obtained an estimate for the completion of the remaining roads in Section 2 of Orient-By-The-Sea, Orient, from Roberts & Fink, Inc. in the sum of $12,805. 00. Thy for the completion of 9,850 linear feet of road at $1.30 per linear foot. They wished to be informed whether the bond in that amount would be sufficient for the Town of Southold to insure the completion of the aforementioned roads. On motion of Mr. .Moisa, seconded by Mr. Unkelbach, it was RESOLVED that the Planning Board turn this estimate over to Lawrence Tuthill to check and prepare a report for the Planning Board on the accuracy of this proposed bond. Also a letter was to be forwarded to Mr. George A. McMann, Jr. advising him the Planning Board has turned this over to their engineer to check and advising that in view of the drainage problems on this particular farm, the Planning Board feels -the amount of the bond may be conceivably several times greater than the figure mentioned in his letter. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe and Mr. Unkelbach. The next meeting of the Southold Town Planning Board will be held 7: 30 P.M. , Tuesday, July 18, 1961 at the Town Clerk Office, Main Road, Southold, New York. The Planning Board, on motion of Mr. Grebe, seconded by Mr. Moisa, RESOLVED that a letter be forwarded to the Town Board suggesting that a joint meeting be held between the Board of Appeals, Town Board and Planning Board sometime in the near future to complete unfinished business, such as proposed changes t Southold Town Planning Board -5- June 20, 1961 in the Zoning Ordinance, Highway�' Specifications, etc. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr,. Grebe, and Mr. Unkelbach. . Supervisor 'Albertson appeared before the Planning Board to discuss the proposed Southold Town Airport. On motion of-Mr.,, Grebe, seconded by.Mr. Unkelbach, it was RESOLVED that . a letter of confirmation be forwarded to the Southold Town Board confirming the, ,Planning. Boardbconversation with Supervisor:Albertson held this date. The Planning Board feels that the proposed location for - the- Southold Town Airpott at west side Duck Pond Road and north side Oregon ,Road is the best .possible location in the Town of Southold. Vote of the Board: Ayes.: - Mr.' Wickham, Mr. Moisq., Mr. Grebe, . and Mr. Unkelbach., The Planning Board received the application for dedication of a highway to the Town of -Southold by"L. Barron Hill and Adelaide H. Hill. Road to be known as Calves Neck Road. ..After reviewing the dedication .and release, copy -of proposed deed and general map of land of-L. Barron Hill, on motion .of :Mr.. Moisa, seconded by Mr. Grebe, it :was "RESOLVED that the Planning Board return to the Town Board this file advising that the Planning Board finds this application incomplete and faulty. In accordance with the Highway.-Specifications of the Town of -Southold the following information must be filed with the' Plannin g Board: threeprints of the proposed .layout of such highway -showing courses and distances and monuments on the map. Also a map giving profiles and drainage if any. Upon receipt of the proper maps , and information the .Planning Board will make a prompt investigation and report. Vote of the Board: Ayes:- Mr. Wickham, . Mr_ Moisa,..Mr. Grebe and Mr. Unkelbach. Southold Town .Planning Board -6- June 20, 1961 Mr. Van Tuyl brought up for a brief discussion the proposed Cleaves Point, Section 2. This area has Village water, therefore 12, 500 sq: ft. lots are proposed. The proposed plan shows 29 lots which is expected to be revised. Meeting adjourned at 9: 30 P.M.
