A reguIx meeting of the Southold Town Planning Board was
held 7:30 P.M. , Wednesday, . September 13, 1961 at the Town Clerk
Office,. Main Road,. Southold, New York.
There were present: Messrs. John Wickham, Chairman, Henry
Moisa,. Alfred Grebe and Archibald Young.
Absent: Mr. William Unkelbach
Also present: Messrs. Otto W— Van Tuyl, Consultant and
Howard M. Terry, Building Inspector.
The Planning Board received- from the Town Board the original
petition of Edward L. Donahue, . Clement B.-Donahue, Edward ;D. Meyer,
Raymond W.- Donahue, and Reginald S. Donahue for change of zone from
"A" Residential and Agricultural District to "B" Business District
on certain real property situated at- Southold, and more particularly
bounded and described as follows: Beginning at a point marked by a
granite monument set at the point of inP-rsection of the northwesterly
line of.Middle Road with the northeasterly line of Kenney`s Road;
and running theAPe along said line of Kenney's Road, North 41 degrees

57 minutes 50 seconds West a distance of 220.62 feet to an iron
pipe; thence on a line at right angles to said line of Kenney's
Road, North 48 degrees 02 minutes 10 seconds East a distance of
131.30 feet- to an iron pipe; thence along land of the party of the
first part and along land of' Edward Donahue, South 42 degrees 05
minutes 50 seconds East a distance of 200. 0 feet to an. iron pipe
set on said northwesterly line of 'Middle Road; thence along said
line of Middle Road,. South 39 degrees 08 minutes 40 seconds West a
distance of 133.38. feet to the point of beginning. Map of land

The Donahue Brothers, Edward, Clement, Raymond and Reginald
and Edward D. Meyer appeared before the Board to answer questions.
Mr. Meyer stated that he intends to build a block and brick building
100 ft. by. 35 ft. facing on Route 2.7A. The sotback -.on Route 27A
will be 50 feet and on Kenney's Road it will be 35 ft.' Mr. Meyer
intends to produce and assemble electronic instruments and will
eventually hire 10 to 15 employees.
On the opposite corner is the property of: -Conway which is
zoned "B" Business and is used for' the repair of farm machinery,
trucks, tractors, etc. . Diagonally across Route 27A is the property.
of Kae-l-in which is zoned "B" Business and is used for the sale and
service of Farm machinery.
On motion of Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that the Planning Board recommend to the Town Board
the change of zone from "A" IResidential • and Agricultural District
to "B" Business District on the property of Edward L. Donahue,
Raymond W. Donahue, Reginald S. Donahue, Clement B. Donahue and
Edward D. Meyer, , Southold,. New York.
Diagonally across from the property in question, on the south
side of Route 27A, is the property of Kaelin Farm Machinery which is
zoned "B" Business and opposite this property on the west side of
the corner of Kenney's Road and Route 27A is the property of Conway
which is zoned "B" Business and used for a similar purpose.
The Planning Board feels this property is particularly suitable
for "B" Business and would be advantageous to the economy of :Southold
Town.

Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe and Mr. Young.
Mr. Walter Uhl appeared before the Planning Board with Mr.
Frank :McMann to discuss 'Orient-By-The-Sea, Section Two. : The
Chairman stated that Mr. Price,. Superintendent of Highways, was
not in agreement. with the Board's suggestion of 10 ft. by 200 ft.
flush drainage area along the highway in the vicinity of lot 48,
but he will 'go along with double catch basins, there must .be 100/
vertical drainage in the heretofore approved leaching area -locations.
Mr. Uhlvas in agreement with this. He said he would do every-
thing possible to put the property in order for final approval and
'approval of the highways. Mr. Uhl stated that he has received
approval of the Health Department.
The Chairman stated that a letter would be forwarded to Super-
intendent- Price requesting that he send to either. Mr. Uhl or the
Planning Board the specifications or 'name of the manufacturer with
relation to the double catch basins. He would also request that Mr.
Price go along with.Mr. Van Tuyl to locate the position of these
catch basins. ..The Board also requested that .some sort of formula
or reasonable practice be set up of- so many feet of area per lot or
100 feet of road frontage or at least some basis that the' Planning
Board could use in future cases.
The Board finding that everything seemed to be order agreed to
.set a date for the public hearing on approval of- orient-By-The-Sea,
, Section Two.
On motion of Mr. Grebe, seconded by Mr.. Moisa it was
RESOLVED that the' Planning Board set 7: 30 P.M. , Tuesday,
October 3, 1961, Town .Clerk: Office, Main Road, Southold, New York,
as time and place for' hearing upon the question of. approval of the
following plat:
Plat of property owned by Woodhollow Properties, Inc. , entitled
Orient-By-The-Sea, Section Two, consisting of �a .parcel of land of
approximately 68. 00 acres, situated at .Orient, . in the Town of: Southold,
Suffolk .County, New York, bounded and described as follows:
Beginning at a point on the westerly line of land .of the appli-
cant and the easterly line of land of Joseph Moisa at a point about .

Mr. Terry advised the Board that the Suffolk County Planning
-.Commission would be holding a public hearing on September. 20th on
the application for a change of-' zone on the property of:Woodhollow
Properties, Inc. at orient. The Southold Town Board recently approved
this change of zone from "A" .Residential and.Agricultural to "B"
Business.
Irving L. Price, Jr. ,. Esq. appeared before the' Planning Board
to present the application for: approval of 'Section Two of :Cleaves

Cleaves ' Point at--East Marion by Otto W. Van Tuyl & Son dated
September ll, . 1961., This proposed .subdivision. will contain 22
lots,. each -having over 12, 500 sq. ft. of 'area and having public
water, Cleaves ' Point,: Section Two is described as follows:
Beginning at the intersection of� th.e westerly line of -Maple
Lane with the northerly line of Osprey Nest-Road .as shown on "Map
of Section One- Cleaves ' Point" filed in Suffolk -.County-Clerk's; Office
as Map No. 2752; running thence along the northerly line of said

The Chairman brought up the question of' a 100 ft. turnaround
. at the water. - It was pointed out that in the Planning Board' s
minutes of:March 11, 1957 there was mention made that- Osprey Nest
Road should be made a 50 ft. right-of-way and extended to the water
with a 100 ft. by 100 ft. turnaround.
Mr..- Price asked the Planning Board under-whkt regulations or
section of the! State Law the Planning Board is requesting that this
be done? He stated that the' Planning. Board has no authority other
than the regulations approved by the Town of Southold and the State
Law. He stated that his client has instructed him not. to agree to
anything other than what is shown on the preliminary plan. These
roads are to be kept -private.
On motion of Mr. Young.- seconded by Mr. Grebe, it was
RESOLEED that this matter be "tabled until the Board has .an
opportunity to consult with the Town Attorney with regard 'to the
legal position of the Board.
Vote of ' the Board: Ayes:- Mr. . Wickham, Mr. Moisa, . Mr. Grebe,
. and Mr. Young.
The Chairman dictated a letter to Town. Attorney Tasker' requesting
his opinion on the above matter.

The Planning Board received from the Town Board the original
petition of William Victoria and Regina G. Victoria for a change
of zone from "A" Residential and Agricultural District to "M"
Multiple Residence District. Thomas ' Stark, Esq. appeared before
the Planning Board with Mrs. Victoria to answer questions relative
to this application for a change of zone on certain property situated
at Bayview,_ Southold, and bounded and described as follows: bounded
on the west by lands now or formerly of.Koke' Estate 740 feet, more
or less, on the north by other lands of Willian Victoria and Regina
G. Victoria 850 feet, more or less, and on the south and. east by the
waters of Corey -Creek and the shore line thereof as the same winds
and turns and by the meadow land now or formerly of Howard M. Terry
and others; all as shown and outlined on plot plan prepared by Alden
W. Young, Licensed Land Surveyor of Riverhead, New York, dated July
7, 1961. -- Mr. Stark promised to forward to the Board a complete
metes and bounds :description of. this property- and same will be recorded
in the next minutes of the Planning Board.
Mr; r:and'iMrs. Victoria wish their property rezoned from "A" To "M"
so 'that they may expand their present non-conforming operation ,
which is used for the location of cottages for summer rental.
On motion of Mr. Moisa, seconded by Mr. Grebe it was
RESOLVED that the Planning Board recommend to the Town Board
this change of' zone from . %'I Residential and Agricultural District
to "M" Multiple Residence District.
This property has been non-conforming since 13rior to the enact-
ment of Zoning and an enlargement of the use will in no way harm the
character of the area. Mr. and Mrs. Victoria wish to maintain the
front of the property facing on Main Bayview Road in "A" Residential
and Agricultural District -as a buffer. The Planning Board feels a
change to "M" would be' the most reasonable use for the property.
Vote of the Board: Ayes:- Mr.. Wickham, Mr. Moisa, . Mr. Grebe,
and Mr. Young.
The Planning Board received from the Town Board the original
petition of Frederick L. Jackson, administrator of Estate of Adeline
J. Becktold, . Southold, requesting a change of zone from "A" Resi-
dential and Agricultural District -to "B" Business District on
certain property situated at Southold, .and more particularly bounded
and described as follows: Beginning at a point on the eatterly side

of Wells Avenue 200 -feet southerly from its intersection with the
southerly line of Main Road, said point of b eginning being the
southwesterly corner of the premises late of Adeline J. Becktold
zoned "B" Commercial-, running thence along the easterly side of-Wells
Avenue' S. 15045 ' 10"E. . 471.78 feet to the northerly line of Wells Avenue;
running thence N.70022120"E. 149.89 feet to land. .now or formerly of
Suffolk County Trust Co; running thence along said land now or formerly
of- Suffolk-Couty Trust- Co. and a right of way N. 15055 '50"W. 464. 12
feet to said other land bf the Estate of=Adeline J. Becktold zoned
"B" Commercial and running thence S.7301712011W. 148 feet more or less

This change of zone is requested becauxe it is intended to
put this property on the market as a single parcel- and it iiB,,:believed
better planning for the village if:` the property would be zoned
"B" for its entire length. It is presently "B" for 200 ft. back
from Main Road.
:On motion of Mr. Young, seconded by Mr. Grebe, it was
' RESOLVED that the Planning Board recommend to the Town Board
this change of zone from "A" Residential and Agricultural District
to "B" Business' Distric.t.
This property is presently zoned "B" Business for 200 ft. in
depth. Applicant intends to sell the parcel for commercial use and
it is believed good planning and will better serve the nedds of the
coiununity if the entire parcel is zoned "B". On the opposite corner
the property is Business, across the street is Business and to the
east of this property for the balance of the business section the
zone is "B" Business.
Vote of the Board: Ayes-.- Mr. Wickham, Mr. Moisa, Mr. Grebe,
and Mr. Young.
The Planning Board .received notification from the Town Board
that the application for change of a)ne by Guido Ciacia, from "A"
Residential and Agricultural District to "B" Business`District was
. approved effective as of September 23, 1961.
Notification was also received that the application for a
change of zone from "A" Residential and Agricultural_ District to

"M" Multiple Residence District on property of Southold Develop-
ment Corp. & George W. Smith & Sons, Inc. was denied.
The Board reviewed the file of the proposed subdivision of
Peconic Bay Oaks at Indian Neck Lane, Peconic. Everything was found
to be order to publication for hearing upon the approval of this plat.
On motion of Mr. Young, seconded by Mr. Moisa, it was
RESOLVED that the Planning Board set 7:30 P.M. , Tuesday,
October 3, 1961, Town Clerk Office, Main Road, Southold, New York,
as time and place for hearing upon application for approval of the
following plat:
Plat of property owned by Stella M. Smith and Henry J. Smith,
entitled Peconic Bay Oaks, consisting of a parcel of land of approx-
imately 16. 23 acres, situated at Peconic, in the Town of Southold,
Suffolk County: New York, and bounded and described as follows:
Beginning- at a point on the southerly side of Indian Neck -Road
where the same is intersected by the easterly line of land now or
formerly of L. A. Messenger; running thence North 78 degrees 44

The Planning Board received a letter from Richard J. Cron,
Esq. who, since the retirement from law practice of RobertF. Dart,
hasbeen handling the matter ' of dedication of the extension of Ruth
Road, Mattituck, by -Stanley- J. and Helen Sledzieski to the Town of
Southold. In reviewing the file Mr. CRon did not find a written
letter of approval of the dedication of the proposed road and would
like to know if ' such a letter was ever forwarded. This clients are
prepared to put in the new road as soon as approval of the proposal
previously filed .with the Planning Board is received.
In reviewing the minutes of the Planning Board it was found that
a resolution recommending approval of the continuation of Ruth Road
was made at the meeting ofFEbruary 21, 1961. The file was then
returned to the Town Board with the resolution and a notation that
it is understood by-Mr. and Mrs. Sledzieski that all lots on the
south side of the proposed road which they may hereafter sell or
convey will have a minimum area of 20, 000 sq. ft. A letter to this
effect was to be forwarded to Mr. Cron.
The minutes of the meeting of-August 1, 1961, on motion of' Mr.
Moisa, seconded by Mr. Grebe, were approved as read.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe,
and Mr. Young.
the Planning Board received from the Town Board application to
layout Town Highway for the dedication of Gull Pond Lane at Greenport
by Ruth F. Preston, Ida Belle Latham and Robert L. Muir.

This road is in a proposed subdivision to be known as Fordham
Acres, Section One. This proposed subdivision received preliminary
approval in September 1960 and the applicant has paid the filing fee
for final approval. The preliminary map shows a 100 ft. turnaround
at water.
On motion of Mr. Young, seconded by Mr. Moisa, it was
RESOLVED that the Planning Board finds this application to be
a departure from town policy in that this proposed road on the map
for dedication does not have the required turnaround at the water,
and the Planning Board is not willing to approve this highway at
this time.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe,
and Mr. Young.
A letter covering this matter was to be forwarded to the Town Board.
The Planning Board discussed the budget for the fiscal year
beginning January 1, 1962 and the following was agreed upon: -
(This constituted a $200. 00 increase from the 1961 budget. )

The next meeting of the Southold Town Planning Board will be
held 7:30 P.M. , Tuesday, , October 3, 1961 at the Town Clerk office,
Main Road, Southold, New York.
