The Chairman opened the hearing by reading the legal notice of the hearing with affidavit attesting to ,its publication in the official newspaper. The public hearing was reopened, and On motion of Mr. Young, .seconded by Mr. Unkelbach: WHEREAS Ruth F. Preston, Lda Belle Latham and Robert L. Muir have petitioned the Southold Town Planning Board for final approval of their plat known as "Fordham Acres, Section J," Maln Road, Greenport, New York, and WHEREAS the Southold Town Superintendent of Highways has Inspected the plat and found the highways In satisfactory condition for access and In compliance with the Highway specifications of the Town of Southold, and his report l.s hereby approved by the Planning Board and the roads have already been dedicated to the Town of Southold; and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval of the plat ,at which time all Interested persons were given an opportunity to be heard, and Southold Town Planning Board 3- December 5, 1961 WHEREAS the Southold Town Planning Board waives the provision In the Rules and Regulations for the Subdivlsl.on of Land requiring park and playground area or cash. equivalent; NOW THEREFORE RE IT RESOLVED that the subdivlslon to be known as "Fordham Acres, Section One", at Greenport, . Preston. re.: Fordham Acres, Section ;j: stating that I.n .view of the fact dedlcatIon of Gull Pond .Lane at Fordham Acres, Section ., as accepted by the Town of Southold did not Include the "Reserved". Lot No. I., the Planning Board hereby releases Lot No. 1, from this condition and Mr. Preston may sell It or dispose of It at his convenience. The Planning Board received .notiflcation from the Town Board stating.that the petition of Frederick Jackson, ,Administrator for the Estate of Adeline Becktold for a change of zone from "A" Residential and Agricultural District . f 4 1 Southold Town Planning Board -4- December 5, 1961 to "B" Busi_ness District was granted effective as of December 6, 1961 . The Planning Board also received. notl_ficati.on from the Town Board stating that the petition of W1.11 [am and Regina Victoria for a change of zone from "A" Residential and Agricultural District to I'M" Multiple Residence District was granted effective as of December 6, 1961 . Mr. Young reported that- he met with the Town Board relative to Cleaves Point, Section Two and the Town Attorney explained the situation to the Town Board. The Town Board stated they would require a 100 ft. access reserved on the eatt side of Gull Pond in this subdivision for possible future dedication. William Wickham, Esq. appeared before the Planning Board to discuss the property of George Grathwohl at New Suffolk. Mr. Wickham explained that Mr. Grathwohl had already sold a number of lots on Grathwohl Road which is a Town road and he understands he can continue to sell lots on the Town road on a 100 ft. front basis. It was the feeling, however, of the Planning Board and William Wickham that on the remaining area fronting on unapproved roads a subdivision map should be filed. Mr. Wickham presented two problems to the Board. One: - One of the public roads is 33 ft. in width and there are no lots sold along one side of it. The Planning Board feels that this road should be widened to 50 ft. inasmuch as 50 ft. roads arefeeding into it. Two:- There is a problem of making a connection with the County road of New Suffolk Lane through the property of Mr. Krukowski. Mr. Krukowski has tried to make a connection with the County road but was advised by the County he must have curb, gutters and drywells, etc. In conclusion Mr. Wickham stated that he would pass on the information to Mr. Grathwohl and it is expected Mr. Grathwohl will file a subdivision map. Mr.. Wickham brought up for a. brief discussion his property at- North Road, Mattituck which he wishes zoned "C" Industrial District. He feels this area which is an entire block and is prime industrial property since it has not developed residentially should be rezoned in the near future. The Planning Board stated that their idea is to. establish an industrial park, as they would have control over such a park. Mr. Wickham is completely agreeable to that. The Planning Board instructed the Secretary .to .write to the towns of Islip, Babylon, Brookhaven and Huntington requesting information as to their procedure in establishing industrial parks. Southold Town Planning Board -5- December 5, 1961 Mr. Wickham. next stated that he is a member of the Custer Institute, Inc. and he felt a good program for a Custer Institute meeting would be the possibilities of industrial development ift the Town of Southold and he would be willing to sponsor such a program. The Chairman suggested that a member of the.Department of Commerce, Industrial Development Bureau would be an ideal speaker. A letter was to be forwarded to Mr. Henry .Gallien, Jr. , Directar of the Bureau of Industrial Development requesting him to supply a speaker for an open meeting to be sponsored by a non-profit educational organization known as Custer Institute. Irving L. - Price, Jr. , Esq. appeared before the Planning Board to discuss Cleaves Point, Section II... Mr. Price had forwarded a letter to the Planning Board stating that his client believes it can agree to one of the proposals that has been made at one of the early preliminary.meetings on the subdivision. Mr. Price stated that they would be willing to reserve the 100 ft. by 100 ft. area on the water off of Snug Harbor Road and Osprey Nest Road. The Planning Board stated on that condition they would be willing to give tentative approval of the map, but they would also like a letter from Cleaves Point Corp. stating that they are reserving this 100 ft. by 100 ft. area for possible future dedication to the Town of Southold. On motion of Mr. Young, seconded by Mr. Unkelbach it was RESOLVED that the Planning Board grant Cleaves Point Corp. tentative approval of its subdivision to be known as "Cleaves Point, Section II", at East Marion, New York, map by Otto W. Van Tuyl & Son dated September 11, 1961 and revised in ink December 5, 1961. This tentative approval is granted under the condition that Cleaves Point Corp. reserve an area 100 ft. by 100 ft. on the water off of Snug Harbor Road and Osprey Nest Road for possible future dedication to the Town of Southold. Vote of the. Board: Ayes:- Mr. Wickham, Mr. Young, and Mr. Unkelbach. On motion of Mr. Unkelbach, seconded by Mr. Young, it was RESOLVED that the Planning Board set 7: 30 P.M. , Wednesday, January 10, 1962, Town Clerk Office, Main Road, Southold, New Sputhold Town Planning Board -6- December' 5, 1961 York as time and place. for hearing upon question of approval of the following plat: Plat of property owned by Cleaves Point Corp. , entitled Cleaves Point, Section II at- East-Marion, New York. Vote of the Board: Ayes:- Mr. Wickham, Mr. Young, and Mr. U nkelbach. . (After this meeting it was learned that the applicants were not completely readynfor a public •hearing and would like to again meet_`. with the Planning ,Board before having the hearing, therefore publication could not be 'made for the January 10th hearing. ) The Planning ward received a letter from Elizabeth Beebe Vail, Mrs. Herbert G. , expressing her protest to the private road that has been scraped around the small - cemetery' on the Main Road at Orient Point. Mr. Young volunteered to speak with' Mrs. Vail and Mr.. Edwin King who owns the .property relative to this matter. The Planning Board received from the Town Board the applica- tion of Henry J. Smith and.Stella. M.. Smith for the laying out and dedication to the Town of' Southold a highway to be known as Robinson Lane. On motion of Mr. Unkelbach, seconded by Mr. Young, it was RESOLVED that the Planning Board recommend to the Town Board the laying out of a highway to be known as Robinson Lane in the subdivision of-' Peconic Bay Oaks at Indian Neck,. Peconic, New York, bounded and described as follows: Beginning at a monument on the southerly Brie of- Indian Neck Road 153. 06 feet westerly along said line from land of E. W. Wood; running thence along land of Henry J. and Stella M. Smith, two courses, as follows: (1) 5.­16 degrees, 16 minutes, 30 seconds, E. 889. 28 feet to a monument; thence (2) S. 22 degrees, 02 minutes, 10 seconds E. 356.46 feet to a monument and land of Edward. On motion of Mr. Unkebach, seconded by Mr. Young, it was. RESOLVED that the Planning Board is not willing to recommend the acceptance of North- Parish Drive. Extension and Northfield Lane to the Town of' Southold until such time as a subdivision. map is filed, in view of the fact this is apparently a bonafide subdivision since there will be more than four lots. North Parish Drive Extension and Northfield Lane at Bayview, Southold, New York are bounded and described as follows: . A letter confirming this action of the Planning Board relative to the dedication of roads by F. Harold Sayre was forwarded to Mr. Sayret and further stating that some attorneys in the Town of .Southold are very concerned that purchasers of lots may sue the subdivider if the lots do not conform to the sanitary requirements of the '.'..County. and the. Planning Board would urge that Mr. Sayre take measures to avoid this problem: Southold Town Planning Board' -12- December 5, 1961 On motion of Mr. Young, seconded by Mr. Unkelbach, it was RESOLVED that the minutes of the meeting of November 1, 1961 be approved as read. Vote of the Board: Ayes: - Mr. Wickham, Mr. Young, and Mr. U nkelbach. At Mr. Unkelbach's suggestion the Planning Board discussed the unsightly condition which exists on Southold Town property at the south side of Laurel Lake, Laurel. On motion of Mr. Unkelbach, seconded by Mr. Young, itwas RESOLVED that a recommendation be forwarded to the Town Board recommending that steps be taken to correct the unsightly and dis- orderly condition which exists 'on Southold Town property at the south side of Laurel Lake, Laurel. It is the feeling of tl-e Planning Board that the Town Board might enter .into a lease.-with the Mattituck Park District to maintain this area, and a gate be placed at the entrance to close the road at night to prevent vandalism. In addition, one of the adjacent property owners is trespassing on TDwn property and the Planning Board feels that the erection of a gate would settle this problem. Further, there is a question of the Town being liable in this situation, and the property owner is building up an equity in the property by using it every day. The Planning Board considers this matter urgent and recommends , . immediate attention to correct this situation. Vote of the Board: Ayes: - Mr.. Wickham, Mr. Young, and Mr. Unkelbach.
