Where .were present: Messrs. .John Wickham, .Chairman, Henry Mo-isa,. Archibald: Young, . and W11,liam, Uhkelbach: Mr. 'Alfred Grebe -also arrived 'from Fishers Tsland after the meeting had opened. Also presents, Messrs.,. -Otto W. Van Tdyl, -Consultant, and Lawrence,:M. Tuthill, a .Profess ional: Engineer. Mr. Howard M. Terry, Building Inspector arrived from Fishers ISlanid. after the -meeting.had. -opened. Mr. Grebe and Mr. Terry had been attending the Public Hearing on change of zone on property of A. John Gada. Mr. Stanley Sl-edzieski, Mattituck, New York, appeared -at : the Planning Board's request .to discuss the proposed dedication -of. a road "to be the: -continuation -of Ruth Road, Mattituck. Mr.. -Sledzieski:.stated to the- Foard that he has sold three lots on the. 00uth side of this proposed'.road, the last' lot.- being .25,000 sq. ft. He stated. that he has. also approached the owners of the other. lots' he had .sold .arid requested that. they take 'additional footage to increase their.:lot.: size to at .least.,20,000.. sq. . ft. He wishes the. area. to, 'develop,with large lots and attractive homes. a Southold Town Planning Board -2- January 31, 1961 The Board stated that they would be willing to recommend the acceptance of this proposed road by the Town of -Southold. if Mr. Sledzieski is agreeable to make the lots on the south .side of the road 20, 000 sq. ft. and also supply the Board with his restrictions for the north side of the . r-oad. Mr. Sledzieski -stated that he would be .willing to write a letter to. the Board to- that effect. Mr. Sledzieski brought- up the matter of a building. code for Southold Town and this was discussed briefly. Mr. William Smith, Southold, appeared before the Board for an informal discussion relative to property he proposes to sub- divide on Pine Neck Road, Southold. This proposed subdivision to be named Pine tree acres and -according to a preliminary plan would contain 27 lots. Mr. Smith stated that he and his brother Daniel Smith, desired to purchase property owned by Breitstadt adjoining this property, but the owner is unwilling to 'sell at this time. The Board discussed the layout . of the hots and roads and advised Mr. Smith to speak .with Mr. Harold Price, Highway Superintendent relative to the road layout before going any further. Mrs. Beatrice M. Wasson,, Peconic Bay Boulevard, Laurel, appeared before the Board to discuss her application for tentative approval of a -subdivision t:o be known as Rollingwood Estates. The preliminary plan for this proposed subdivision shows ten lots. Three of the lots on Peconic Bay Boulevard contain over 12,500 sq. ft. , the remaining lots average less than 20,000 sq. ft. as required by- the Suffolk County Health Department. Five of these remaining lots have less than 100 ft. frontage which is required by. the .Southold Town Building Zone Ordinance. The Board discussed with Mrs. Wasson the possibility °of cutting her lots down to three on the road and four interior lots -and therefore it would not.be necessary to file a .subdivision Map. In conclusion Mrs. Wasson stated she would think the matter over and possibly revise it. Mr. Lawrence X. Tuthill, Greenport, New York, a Professional Engineer, appeared at the Board's invitation to discuss the pos- sibility of his aiding the. Planning Board by checking estimates for the construction of roads in proposed subdivisions with relation to the posting of bonds and-other matters of interest Southold Town Planning Board -3- January 31, . 1961 to. the Board. After a thorough discussion Mr. Tuthill advised he would forward a letter to the Planning Board giving his decision in this matter. The minutes of the meeting of January 12, 1961, on motion of Mr. Moisa, seconded by Mr. Young, and carried, were approved as corrected. Vote of t1-eBoard: Ayes,- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Youngs and Mr. Unkelba.ch. The next meeting of the Southold Toi&n -Planning Board will be held 7:30 P.M..,,, Tuesday, February 21, 196.1 at. the Town Clerk Office, Main Road, Southold, New York. Mr. Van Tuyl presented the application for tentative -approval of Fordham .Acres, Section One (revised) by Ruth F. Preston, Ida Belle Latham and Robert Muir. Description of Fordham Acres.... Section One is as follows: Beginning at a point on the southerly line of North Road at the northeasterly corner of land -of :S.terling Cemetery. Planning Board -4- January 31t 1961 In September, 196-0 Mr. Robert Preston had been -Alranted -tentative approval of the. layout of Fordham Acres containing 23. 0 . acres and 25 .lots. This revised plan contains 13.61 . acres and 18 lots. On motion of Mr. Moisa, seconded by Mr. Unkelbach and. . carried, it was RESOLVED that the planning Board grant. Ruth F. Preston, , Ida Belle Latham and Robert Muir tentative approval of their proposed subdivision Fordham Acres, . Section One, Greenport, New York,dated January 10, 1961, by Otto W. Van Tiyl and Son. They may instruct their engineer or surveyor to proceed with computing .the map, preparing the finished map, submit their cloth .prints to the Health Department for approval., and proceed with other matters necessary prior to submitting them to the Planning Board for final consideration. These prints must be submitted at least 15 days prior to a re gular meeting of the Planning Board. Vote of the Board: Ayes; Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Youngs and Mr. Unkelbach. Mr. Young. brought up the matter of a joint meeting between the. Board of .Appeals, Town Board and 'Planning Board and Mr. Terry advised that this matter would be again. brought ,up in the early spring and a .meeting arranged at. that time. Mr. Young also brought up the matter of cash payment .by developers into the park and playground .fund,.when . the development does" not have -a park area. The. Board discussed an article which appeared in the New York Times -on January 19, 1961 relative to a decision handed down in White Plains, New York. The justice declared unconstitutional. a law adopted two years .ago by. the 1-egislature. The law had .enabled,communities to collect .cash payments from .real estate developers. to -erect new parks else- -- where in the town, if the new developments did not have satis- factory park areas. on motion of Mr_ Unkelbach, .seconded by Mr. Grebe, and carried it was RESOLVED to forward a letter to 'Town. Attorney Tacker request- ing his interpretation qn .whether or not this -court decision applies to the Planning Board' s Rules and. Regulations for the Subdivision of Land. They-:would also like to know whether there Southold Town Planning, Board -5- January 31, 1961 is -a .distinction made if- a subdivision is within or outside of a park district.
