Road, ;Southold, New York. There .were presents Messtp. . :John.Wickham, Chairman', Henry,Mois , Alfred Grebe, Archibald Young, and'William. Unkelbadh. Also presenttz Mr. Otto W. Van Tuyl, -Consultant ,Mr. and Mrs. :Cha'rles Witherspoon._and Mr. Robert Witherspoon -appeared before the Planning;Board for a.. discusson .relative to- billboard signs. They stated the Board of. Appeals had `denied thempermissian ,to 'replace -a billboard -sign- they had:lost. approx— imately one-- year and.a half' 'ago- and .they were before the `Planning" Board to 'seek their support `should they-again .go to the '�owzi Board to discuss the. 'sign .situa.ti9p. Messrs. Witherspoon wish Section 1002 .-o,f`Articl-e X. of the Zoning.-Ordinance abolished becau:Se that. .section.of .the,Ordinance,' they-state, will put i them.out. of; business. They,went._ into detail about .their- life histories and problems. j Southold Town Planning Board -2- January 12, 1:961 The Manning Board advised the Witherspoons that if they questioned the Board of Appeals' decision they should take the matter up with their attorney and they may go to the higher courts. Also, it was suggested that before they return to the Town Board they should consult .with their attorney and have a clear case to, present-to the Town Board. The Manning Board received a letter from _Town Attorney Tasker giving his opinion .concerning the . application .of the various provisions of .the Education Law -of the State of New 'York as they may effect. the Southold Town Planning Board. It ' is his -opinion that the prohibition against public officials accepting and approving plans and specifications applies only when. .such .plans and .specifications are -related to "Construction or alteration of buildings and structures"and in this instance only when such plans and specifications involve buildings and structures not,: specifically excluded by Sections 1208 and 7307 of the Education Law. It -is his -opinion, that -the Education Law does not .proh.ibit the Planning Board from accepting and approving any maps, plats, plot plans., plans or specifications without the seal and facsimile signature of- a licensed :engineer, surveyor or architect unless the same relate to the construction or alteration .of buildings.' or structures and in the. latter case, the provisions do .not apply - (a) to alterations to any building or structure costing $1.0, 000 or less .wh.ich. do not involve changes affecting the structural safety and/or public safety thereof, (b) to farm buildings, including barns, sheds, poultry houses and other buildings used directly and solely for agricultural purposes, (c) to residence buildings of gross area of 1500 square feet or less, not including garages, car ports, porches, cellars, uninhabitable basements -or uninhabitable attics_. 'The-,.;Planning Board also received a letter from Town Attorney Tasker relative to per f ormance bonds in connection ,with -Orient by-the-sea. He stated that the most . important factor When requir- ing a performance 'bo'nd is that. the Planning Board specify in detail all of the matters which must be performed by. the developer. He called'-attention to the fact that .any performance bonds to be given should be issued by a bonding `or surety. company approved by. the Town Board or by the owner with security acceptable to the Town Board and shall also be approved by, the Town Board as to form, sufficiency and manner -of execution. The performance bond shall run for a term to be fixed by the,- Planning Board but in .no case for. a. .loncjer term than three years and may be extended by the Manning Board with the consent of the parties thereto. Southold Town Planning Board -3- january 12, 1961 Mr. Tasker 'also pointed out that Section 277. , Subdivision 4 makes it mandatory that the Planning Board can waive the installation_,of fire alarm .signal. devices only with. the approval of the Board of Supervisors if the fire alarm .dev ces are in an area included. in a .centr-al fire alarm system .or by, the Town Board in any other -case, unless the installation is made in a fire district -in which case approval of the Board of Fire -Commissioners is necessary. The Planning Board discussed the matter of hiring an engineer for the purpose of checking estimates for the cost of .construction -of roads, etc. in subdivisions, and other matters of interest:to the Planning Board. A letter was forwarded to Mr. Lawrence M. Tuthill, Greenport, a Professional Engineer, inviting him to the next. meeting -of the Planning Board. The minutes of the meeting of December 20, 196,0, on motion of Mr. Moira, seconded by Mr. Unkelbach, and. carried, were approved -as -corrected. The Board wished it to be noted that Mr. -Grebe was absent due to weather conditions which .prevented him from coming over from Fishers Island. Vote -of the Board: Ayes:- Mr. Wickham, , Mr. Moisa, . Mr. Grebe, Mr. Young, and Mr. Unkelbach. Mr. Howard Terry, advised the Planning Board that the Town Attorney had stated that an application to place the -Faculty Housing property owned by the School District at Fort H. -G. Wright,, Fishers Island, would not be necessary because it is his inter- preation that all property in Fort H. G. Wright is "A" Residential and Agricultural District when it. reverts back to the Town of Southold. On motion of Mr. Moira, seconded by Mr. Young, and carried, it -was RESOLVED that this Board hereby recognizes the inter- pretation by Counsel for the Town of 'Southold that all lands in the Town which either are or have been under the jurisdiction of the Federal government .shall revert -to the highest zoning classification at ,any time that they are released to the jurisdiction .of the Town of Southold. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelba-ch. Mr. Young, seconded by_ Mr. Moira, and .carried, it was RESOLVED- that:the Planning, Board forward a letter to- Mr. Harold R. Reeve, Sr. congratulating him and :Mrs. Reeve .on the celebration .of their -50th .Wedding Anniversary, January_ 5, 1961, The Planning, Board has enjoyed .mt.. Reeve's fellowship and feel that the, Town of Southold, is indebted to him for his. services. on the Zoning-Commiss ion f . as well as "the-. Planning ,Board. It. . is hoped that -the institution of Zonirig ; in this Town will continue to be something he .can .take pleasure in. Vote of _the Board: Ayes;'- Mr. Wickham,, Mr. Moisa,: Mr. Grebe, . The' Planning Board discus-s-ed the - rezoning of:property.at Fort H. -0. _'Wright, at Fishers, asland with relation to property located between the existing :"B"' Bu.sine'ss District, whistler ,Avenue, Fishers Island Sound and Silver -Eel Cove. Prior to mak.ing. a .recommendation to .-he Town Board a letter .had been forwarded to Race.- Point Corporation asking their comments and ideas 'on _this rezoning. A. reply was received from ,,7ans.en Woyes, jr. , Vice-?President-:of .Rase Poin,t..Corpora tiOn Stating , that. they did not want any of the acreage owned by. their 'corporation, -other than that presently under application, to be- zoned Industrial. On motion- of- Mr.. Moira, seconded by Mr. Unkelbach., ..and -carried, it .was RESOLVED tha the Planning Board recommend to- the Town Boards on -the Town' Board's own motion, the change - of zone from 1120 Resi- de4tial. and, Agricultural District. to '`B" Business District.,all Southold Town Planning .Board- -5- January 12, 1961 that portion .of Fort H.. G. Wright property, Fishers Island, New York, , located between existing ; "B" Business District, .Whistler Avenue, Fishers Island Sound and Silver Eel Cove, and more particularly bounded and described as follows: Beginning at .the southwesterly corner of land of .Race Point Corporation at. the shore of Fishers Island .S.ound and being the northwesterly corner of the existing "B" Business Zone; running thence along said. Race Point. Corporation .and,.said existing "B" Business Zone, four courses:,. as follows: (1)' N.670131B. 78.5 feet, more or less; thence (2) S.2'20471E. . 125. feet.; thence (3) N.67013 'E. 329. 2 feet; thence (4) N.220471W. 125 .feet to the northerly line of "Whisaler. Containing about :27 acres. The members of. the Planning,B.oard have inspected this property. It is practically all occupied by warehouses, shops and barracks and business type installations, .some presently in use by the Coast Guard and U. S. Navy. The property contains practically .no sites suitable for residential buildings and..we feel that if it -were rezoned "B" Business some use woul.d, be made of many of these existing buildings. Mr. Grebe, Mr. Young, and Mr. Unkelbach. . 2qie 'Planning Board received a letter from ;Chandler & Palmer, _ Civil Engineers, Norwich, Connecticut in reply. to. their . letter of December 12, 1960 concerning New York State licenses. Chandler and Palmer- advised that the two partners in the firm, Benjamin .H. Palmer and Shepard 'B. Palmer each have Professional Engineer and Land Surveyor licenses for- the State of Connecticut and they -have applied for licenses in. New York and their applications are now being. processed. Mr. Van Tuyl spoke informally to the Board relative to Fordham .Acres. Mr. Robert Preston, owner of this proposed i r _Southold Town .Planning Board -6 January 12, 1961 subdivision has changed the layout by --cutting the acreage from .:2.3. 0 to 13.61 acres, .with .18 lots rather than. 25.. Mr. Van Tuyl, -had .a .Revised. Preliminary. Plat of Fordham ,Acres, Section -One, .. dated January 10, 1961 for '.the Boards' perusal. The Board .discussed the park area .which _had been eliminated in this revised plan .and felt:.that. they would be inclinedto waive the park -requirements, in Section One in view of the fact 1-00. ft. on Gull Pond.will be -dedicated to- the, Town. of Southold. The Planning Board'receiyed a .l.etter from Robert F. Dart, Esq. . on behalf. Of 'Stanley: J. Sledzieski and Holen Sledziesk,i, his wife, .-of.Mattituck; making application for approval- o:f a proposed Town. highway'to be the continuation of Ruth Road' Mattituck. Mr. and Mrs. Sledzieski own.. preniis.es near Mattituck, bounded on the.north' and west by -Capt. Kidd estates and' on t ie :east by ,Luther's Road (now known as Breakwater ,Road) . There is in.Capt. Kidd Estates .a public highway' known . as Ruth Road-which .dead-ends at the, westerly.boundary--of Mr. Dart's clients' lands. They are desirous -of dedicating to the Town of :Southold land for the Town Highway, g y. to -connect',i,Ruth Road with Luther Is ,Road. Mr. Dart included a survey by Alden ,W. Young,.. dated May 17, 1:95.6 showing the. proposed layout.'of 'the, road. A. 1-engtYy dis°cussion was '.held .considering. the pros.,and. cons of' thlis proposed road with. relation to, the future development of . the. land on either side- of- the: road. On motion -of Mr. Grebe, . seconded. by Mr. Young, and carried, it was RESOLVED- to forward a Letter to Mr.. Dart., with .a- carbon, copy to Mr. Sledzieski,. requesting;'Mr. Sledzieski's presence at the ne:t .'Planning. B�oard meeting, to discuss this matter. Vote of-the, Board: Ayes, Mr. Wickham, Mr. Moisa,, Mr,, Grebe, Mr. Young, . and. Mr. Unkelbach. The next-meeting of .the- :Southold Town Planning Board will be held .7':30 P.M. , .January 31, 1-961.
