Town 'Planning Board May 17, . 1960 A .regular. meeting of the;Southold-Town Planning Board was held- 7-:30 -P.M. , Tuesday, May 17, 1960 .at -the 'Town-Clerk Office, Main ..Road, Southold, New York. There were present: Messrs. John .Wickham, : Chairman, Henry Moisa�,r Alfred .Grebe, Archibald Young, and 'William .Unkelbach. Also present: Messrs. Howard 'M. Terry, _Building jaspector, and Otto W. Van Tuyl, Consultant, The Board spoke first with Mr. James A. Hewlett, 12 knollwood Road, Knollwood B-each, : Huntington, , New- York, who ,appeared as a .representative of-Walter-Uhl. Mr. Hewlett appeared fora tentative -preliminary -dis°cussion of Section of `Orient-B.y=The-Sea, --Orient, . New York. There are to- be 113. _lots in .Section. .2, each_containing ,over 20,000 sq. ft. The Chairman and members '-of the Board fully explained to- Mr. Hewlett :why it;would be impractical for Mr. Uhl to- retain the.. roads as " private as he stated he wished to do. There was also .discussion relative to the .road layout, beach facilities and lot .layout. Southold Town Planning Board -2- May 17t 1960 At the conclusion. of .the discussion the 'Chairman advised he would forward a letter to Mr. Hewlett ,summing up the Board's feelings toward Section 2. The. l-etter stated as follows: "This. is in support of. our conversation outlining the general policy of the Planning. Board of the Town of ':Southold. As you will recall., -one..of the conditions of dedication of highways is thati"a major development at least one of the highw airs shall go to tidewater with .a 100 ft.. turnaround. Contrary to what you might expect, by and large it has not .resulted in the deterioration of adjacent property and necessitated policing. After all, - this practice has been followed for many many years in this -Town so that the Town has acquired many miles of shore front in .this manner and this in .itself spreads the pressure on semi-public beaches. "As to dedication itself, we feel this is a must .from -the point of view of the developer because the sheer cost .of main- tenance of an extended highway system alone can be very burden- some and .cannot .but suffer in comparision with Town maintenance :with resulting criticism from the home owners in the development. In the long run., it has been our experience in aliiost .every case that .the home owners, many of whom were only .summer 'residents when they first .came, feel that they are under severe hardship with snow in winter and mud in spring, and in .many cases with old and sick people the hardship is very real and the Town has-been forced by public opinion to take over highways in developments. We submit that it is both reasonable and probable .for the Planning Board to face these realities now and for the developer . to weigh .the . real cost of highway maintenance against the 100 ft. of shore front. required to make dedicatinn .a possi- bility. "You understand, of. course, that the Planning Board cannot prescribe the conditions under which .highways will be' accpeted for dedication and that the discussion on this point. is .simply in regard to conditions under which we might .withhold or give approval of any proposed development. " The Board next spoke with Mr. Herbert .Rosenberg who appeared on behalf of the Board of Appeals to advise the Plann ftg ,B.oard of the request of Island's End Golf & .Country Club, Inc. , Charles A. Cornibert, President, to erect a sign in East Marion .publicizing the sitie of the proposed Golf. Club. Mr. Rosenberg stated that it is rumored that this is intended to be a commercial venture Southold Town Planning Board =3- May 17, 1960 rather than-a _private golf club as. first indicated. However, no one has approached any of the Town officials to enlighten .them of the nature of the .club and the Board of Appeals .wished the Planning Board to- be advised in advance of .the nature of .. the sign being erected. Mr. Rosenberg stated that if the Board of Appeals finds it is the intent-of the 'club to run ,a business then the sign will have to come down. Mr. Wickham-stated to Mr. Rosenberg that :the Planning Board does not want them to stand for any subterfuge - of any type. The Planning ,Board received notice from the -Town Board indicating that the change of zone from ."A" Residential and Agricultural District to "B"Business District :on the property of Grace R. Nickles. was -granted effective April 30, 1960 Notice was received from the Town Board that the change of zone from ."A" Residential andAgricultural District to "B" Business district requested by .S,tanley Sledzieski was denied. Notice was also received from the Town Board stating that .all of the property acquired from the United States of America by the Town- of- Southold was placed in -the ",B" Business District effective as of April 30, 1960. The Planning Board received a letter from the Suffolk -County Department -of Planning, Hauppauge, New York, calling attention to an excerpt .from the General Municipal Law, Chapter 24 of the -Consolidated Laws, Article 12-B, Section 239-D pertaining .to procedures for filing of plats .,where the proposed structure or proposed new streets shall have a frontage on, access to, or be otherwise directly related to any County road, existing or proposed, as shown on the county official map. The Secretary was instructed to forward a letter to the Department .of Planning asking how many prints of a subdivision must -be submitted -for approval an.d. what.other information they request .to accompany proposed subdivision maps. This letter was filed under the head- ing of 'Department of- Planning, Suffolk -County for future reference of the Planning ,Board. The minutes of the meeting of April -5, 1960, on motion .of 'Mr. . Unkelbach, seconded by Mr. Grebe and carried, were approved as submitted. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. -Southold Town...Planning Board -4- May 17, 1960 . The minutes of .the joint.°meeting of April 25, . 1960, on, motion of -Mr. Moisa, .seconded by Mr. Young, and carried, . were approved -as 'submitted. Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, .Mr. Grebe, Mr. Young, .and Mr. . Unkelbach. The Plan ning,Board .received -.a copy. of:a letter from .William. .Wickham, ,Mattituck, New York, directed to Griffing'. Smith, Tasker & Lundberg, Esgs. , Atte .W ntion Robert� . Tasker, relative to the. re- zoning. of property at Mattituck. Mr. Wickham -reported to the Planning Board on his .attendance at .a meeting -relative to migrant labor and .slum housing held under th e..a.uspice of the Suffolk County :Planning. Commission,, Mr. McGowen, Chairman. Mr. Wickham ,attended 'witYi Mr. Terry, Building InsPector and Mr. Gillispie, . Chairman of the Board of Appeals. Mr. Wickham .stated that. .a -great pe rcentage. of the time was taken up by individuals talking, about .subsidizing ,housing projects and the need, for them in Suffolk .County and. the other time was taken up with .people discussing the pros and -cons of colored migrants. Mr. Wickham •said that it .is. evident that the problems of the eastern farming towns and the . suburban .western towns are very- different -but in '-s.ome - ways related. The Board received a .letter_ from the Town Board transmitting a resolution passed by the Town Board at :a. meeting held..May 10, 1960, per taining :to .amendments to the. '.Building -Zone 'Ord.inance on the Town -Board's own motion and asking the- Planning Board to prepare an official report defining the conditions described in .the petition .and determine the . area .so affected 'with .the..'recommendation -of the Board. On motion of Mr. Moisa, . seconded by Mr. Young, and carried, it was RESOLVED that the Planning Board recommend to the Town .Board approval of the following .amendments to the Building..-Zone Ordinance of the Town,.of.Southold: I. By amending•,Article II, . Section .200, to read-.as follows: SECTION .200--USE -DISTRICT REGULATIONS --- For the. purpose of this .Ordinance, the 'Town-.of Southold, outside of the incorporated villages,._. is hereby divided into four. (Q classes ,of districts which .,shall. be designated as follows-: Southold Town Planning Board -5- May 17, 1960 "A." RESIDENTIAL ,AND AGRICULTURAL DISTRICTS I'M" MULTIPLE RESIDENCE DI$TRICTS "B" BUSINESS DISTRICTS "C" INDUSTRIAL DISTRICTS II. By .amending Article III, Section 300, . Subdivision 9, to read as follows: With reference to this amendment, on .motion of Mr. Moisa, seconded by Mr. Young, and carried, it is the recommendation .of the Planning Board that. "or grown" be inserted on .line - 2 as indicated below: 9--The sale at retail of . farm, garden or nursery products produced or drown on . the premises or of animals raised on the premises. One (1) advertising sign, either single or double faced, . not larger than, four (4) feet -by six - (6) feet in .size, advertising the sale of farm, garden .or nursery products produced or grown on the premises or of animals raised on the premises. III. By amending Article IIL,, Section . 300, -Subdivision 10, to read- as follows: 10--One (1) real estate .sign, either single or double faced, not larger than three (3) feet .by four 0) feet in .size on any one (1) or more lots, advertising . the sale or lease of only the premises on _which it- is maintained and set back not less than the. required front yard distance and not less -than ten (10) feet from each .side line. IV. By amending Article IIIA, Section 350, by. adding, thereto a new subdivision to be Subdivision lA to read as follows: l. A--Two (2) Family Dwellings. V. By amending ,Article IIIA,. Section 360, Subdivision .2,, to read as follows: (2) on premises used for hotel, motel, boarding and tourists house purposes, unless otherwise provided as a. special exception by the Board of Appeals as hereinafter provided, one (1) advertising sigi , either single or double faced, not exceeding fifty (50) square feet .in area, the lower edge of which shall be not ,less than four (4) feet above the ground, and the upper edge of which shall not . Southold Town .Planning Board --6- May 17, 1960 exceed more than thirty-five (35) feet above the ground. Such sign shall advertise only the business conducted -on .the premises, .and shall be set back . not less than five (5) feet .from -all street :and property lines. VI. By amending ,Article IV, Section 400, Subdivision 7t to read as follows: 7--Places of amusement when .approved .as a special exception by the Board -of .Appeals as hereinafter provided. VII. By amending ,Article IV, Section 400, , Subdivision 9, to read as follows: 9--Public garages, motor vehicle service stations and parking lot areas for the storage of new or used motor vehicles for sale or hire, when ,approved -as a special -exception by the Board of ..Appeals as hereinafter provided. It is further RESOLVED that the Planning Board urge the Town Board to adopt some type ,of rules and regulations for -the storage of fuel oil, gasoline, aspUaff=& etc. in- quantities exceeding 300 gal. The Planning Board is in .receipt .of information from the Town Attorney that thebest way of handling the storage of bulk fuel is by a .separate Ordinance. We would like to respectfully urge the early adoption of same. Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa, . Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board received from the Town Board the original petition .of ,Helene J. Schmidt` residing at Gardiner's Bay Estates, East -Marion relative to a change of zone .from .'"A" Residential and Agricultural District to "M" Multiple Residence District,,with instructions to prepare an .official report defining the conditions .described in the petition and determine the area .so affected with the recommendation of tle Board. The petition .is for a _change from ."A" Residential and Agricultural District to "M" Multiple Residence District on certain real property situated at .Sound Avenue or -Sound-.Road, Greenport, New York, and more particularly bounded and described as follows: Lying and being in Greenport, Township .of Southold, . Countyof Suffolk and State of New York. Beginning. at a point-on the westerly line of Sound Avenue where it intersects the northerly Southold Town' Planning Board -7- May 17, 1960 line of Sound Drive and being 2,217.60 feet, more or- less, from the northwesterly corner of the- intersection.'-of Main Road (Route 25-) and -Sound-,Avenue, .andoextending , thence along- the northerly line of :Sound Drive N. 84 0813011W. 412.64 feet to lands now or formerly of Dorothy Barstow; thence -along said lands of..Dorothy Barstow N.25.01915011W. 5-03. 0 feet to the -ordinary high water mark of 'Long Island Sound; thence along the ordinary high water mark of -Long Island .Sound, . by means of ,a tie line only, S.8000214011,E. 408. 68 feet to a point on the projected westerly line of Sound Avenue; thence along the projected and-westerly line of Sound Avenue S. 27038130"E. 481. 0 feet to the point of place of beginning, comprising in all about .3.8 acres. May of land surveyed for Helene J. Schmidt atGreenport, .April 19, 1954 by Otto W. Van Tuyl, -&Son. Applicant states that. it . is her intention that .the.;entire parcel of property, within the limits of Article .IIIA of the Building Zone -ordinance -of: the Town of Southold, Suffolk County, New York and as 'Amended, be used -as .a .location for construction of Multiple Dwellings, Hotels andyor Motels or 'such .other use as is or may be provided for in .a .Multiple Residence District. Further . reasoning. is also given in- the application. After a brief :discussion., on .motion of Mr. Grebe, seconded by Mr. Young, and carried, it-was RESOLVED that the Planning , Board inspect .the abovementioned property prior to the next -meeting and also a letter should be forwarded to Mrs. Schmi.dtt: 34-37 84th .Street, Jackson -Heights, New York,advising her that . it has 'not :been the policy of the Planning Board to grant ,a change of :zone unless the applicant has a .prospective customer or definite plans himself. From Mrs. . Schmidt's application the Planning Board is unable to determine exactly what her plans are. In addition, , the Board wishes to look -at -the property personally and.would _also like to propose, from her point. of view, that.- she might .talk with the adjoining property owners because the change of zone will require a public hearing and it might be well to find out..how the neighbors feel. about the proposed change of :zone before the hearing. Mrs. Schmidt was advised that -the Planning. Board will meet -.again -on June 7th at which. time we shall be glad to hear from her about her plans and proposals for the use of the property. The next meeting of the Southold Town Planning Board :will. be held 7: 30 'P.M. , Tuesday, June 7, 1960 at the Town Clerk Office, Main Road, Southold, New York. Southold Town Planning Board -a- May 17, 1960 Mr. Van Tuyl presented to the Board, for an informal discussion, the tentative layout of property of Ruth Young at Orient. This property is located on the north side of Main Road, Orient, on. a private road leading to Drowns Hills Estates! At present - there are 20 acres of woodland and it is proposed to develop this into 25 lots, each .-containing at least 20, 000 sq. ft. The Board discussed this layout considerably with consideration towards the proposed Soundview Avenue. On motion of Mr. Young, seconded by Mr. Grebe and carried, it was ;RESOLVED that .the Planning Board ask. Mr. Van Tuyl to prepare a layout of the proposed `Soundview Road along .the Sound in the Orient -area. Vote of the Board: Ayes: - Mr. Wickham, - Mr. Moisa, Mr. Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board discussed the results -of the joint meeting between the Town Board, Board of. Appeals and Planning, Board. Mr. Wickham stated that he feels a muntipal water system will mean the end of agriculture in the Town of Southold. He feels there are certain areas in the Town where there should be-.water districts .and there are certain areas in the Town where there should be no building permits issued without approval of the Board of Health. But to say the whole Town of Southold should have municipal .water is not goad planning and unrealistic and the Planning Board should start exploring other possibilies that 'will prevent the necessity for municipal .water. The Planning Board should look into the matter of detergents and see just how much -of a. problem they are causing. Mr. Wickham requested permission of the Planning Board to do this himself. On motion of Mr. Unkelbach, seconded by Mr. Grebe and carried, it was RESOLVED that -the Chairman and any other members of the Board should begin research into the affect :of. detergents upon the soil.
