Clerk Office,, Main Roads Southold,,, New York. There were presents Messrs. John Wickham,, Chairman#, .Henry Moisa* Alfred Grebe,.. Archibald Young# and William Unkelbach. Also presents Messrs. Otto W. Van Tuyl & Howard M. Terry. and Mr. George Williamsons observing. The minutes of the meeting of JLy 6-, . 1960r on motion of Mr. Unkelbach„ seconded by Mr. . Grebe, and carried,, were approved as submitted. Vote of the Board: Ayes:-- Mr.- Wickham Mr. Moisa-# Mr. Grebe,- Mr. Young,,_ and Mr.. Unkelbach. in discussing the resolution approving the subdivisions it was the .suggestion of the Chairman that in the future the word "hereby" be added to the followings " HF:RFAS the Southold Southold Town Planning Board -»2- July 26, 1960 Town Superintendent of Highways has inspected the plat and found the highways in satisfactory conditim for reasonable access and in compliance with the Highway Specifications of the Town of Southold* and his report is HEREBY approved by the Planning Board --. " The Planning Board received, letters from the Planning BoardRs of the Towns of Babylon, Huntington,, Islip and Smithtown*, in response to our letters of July 7th requesting information in regard to the allocation of parks and playgrounds or .the collection of fees in lieu thereof.. The Town of Babylon does not require fees on small develop- ments and the Rules and ReguJa tions for the Subdivision of Land state that "The Planning Board shall specify to the extent required,. the allocation of playfields,R parks and other open public spaces that may be essential to the property development of the areas or neighborhood. " The Town of Huntington states that they generally require cash which then can be used by the Town to acquire land where it deems is the best location for a park,_ playground or other recreational area. Up to 10% of the land may be designated, as a park or recreational area, if in the Planning Board's opinion It is in the interest of the general public due to topography, historical interests., natural features or unusual conditions_ The Town of Huntington has a scale which runs from V0.00 per lot for 1/3 acre plots. to $150. 00 for 1 and 2 acre lots and $500.00 per acre for multiple family. The Town of Islip requires 3/ of the areak exclusive of streets* This requirement may be modified by the Planning Board where it is,, in the opinion of the Boards advantageous to accept in lieu of actual park and playground the equitable sum of $50. 00 per building plot for recreational purposes® The Town of Smithtown states that our policy is precisely the same as theirs. If a certain subdivision contains 50 lots and the Town Assessors certify that the actual value of the land at that ldcation is $5500 per acres, the park fee: would than be determined by multiplying 50/100 times $5500 to arrive at a fee of $2750 for that plat, It was decided, since we were awaiting additional information Southold Town Planning Board -3-- July 26„k 1960 from the Town. of Huntington and a reply to our letter from the Town of Brookhaven„ that further discussion on this matter would be held at the next Planning Board meeting. Mrs_ Boken presented to the Planning Board a sample form for a "Planning Board Action}' on the matter of subdivisions. Authorization was given for a draft to be drawn of this form for the Planning Board's perusal, The Planning Board received, from the Suffolk County Plan- ning Commission,, a letter giving the specifications for the Long Island Expressway which is aligned as far- as Yaphank Avenue, Yaphank, and a draft of a Resolution on Extending the Long Islas d Expressway by the Planning Boards of Riverhead and Southold Towns. The Planning Board thoroughly discussed this resolution at some length and found it to be satisfactory with the exception of the 4th paragraph and the insertion of an additional, paragraph# which would then become the 4th paragraph. On motion of Mr. Moisa._ seconded by Mr. Young, and carriedp. it was RESOLVED that the resolution read as follows: "RESOLUTION ON EXTENDING THE LONG ISLAND EXPRESSWAY BY THE PLANNING BOARDS OF RIVERHEAD AND SOUTHOLD TOWNS WHEREAS,, good highway transportation is vital to the economic life of Suffolk County, including the Town of Southold and. the Town. of Riverhead; WHEREAS,, these towns lack adequate east-west arterial routes for the development of commerce and industry, for use by the increasing number of residents#, and to provide commun- ication with western Suffolk,E Nassau County and New York City.p WHEREAS, the Long Island Expressway is under construction as a major east west highway„ connecting the western towns of Suffolk with Nassau and New York Cityt and is being extended as far east as Riverhead„ Southold Town Planning Board - 4-- auly 26{ 1960 WHEREAS,t_ the present highway facilities in existence in the Town s of Riverhead and Southold are totally inadequate to handle the expected increase of traffic coming from and going into the proposed terminus of the bong island Expressway at Riverhead, BE IT THEREFORE RESOLVED4 that the Planning Boards of the Town of Riverhead and the Town of Southold recommend to the New York Btate Depart- ment of Public Works the extension of the song Island Expressway or a suitable arterial highway to a terminus in the Town of Southold in order to serve the entire North Fork of Long Island and Shelter Island; and BE IT FURTHER RESOLVED4 that the Planning Board of the Town of Southold and the Town of Riverhead request the support of the County of Suffolk for this extension of the Long island Expressway and ask the County of Suffolk and State of New York to jointly map a right-of-way for the Expressway extension; and That for purpose of economy and good planning, land for this right-of-way be acquired at the earliest opportunity,,. either by the County,, to be turned over later to the State of New York, or by the State itself, and That the Planning Boards of Riverhead and Southold Towns indicate their desire to cooperate fully with the County of Suffolk and the New York State Department of Public Works in mapping the route of the Expressway., and in planning service roads;,. access roads and all other matters connected with the proposed extension of the Expressway in which, action by the towns may be helpful. " Vote of the Boards Ayes:- Mr_ Wickham_ Mr. Moisa,R Mr. Grebe, Mr. Young, and Mr.. Unkelbach. On Motion of Mr. Grebe.,,. seconded by Mr. Unkelbach„_ and carried* it was RESOLVED that a letter be forwarded to Mr. William N. Leonard,' Planning Consultant$,--to the Suffolk County Planning Commission# stating that the Southold Planning .Board suggests the resolutionto read as cited above and suggest that he take it up with the Riverhead Planning Board and advise us of their decision. It was further stated to Mr. Leonard that a letter Southold Town Planning Board -5-, July 264 1960 with a copy of the resolution will be forwarded to Shelter Island as they will become involved. Vote of the Board: Ayes: Mr. Wickahm,_ Mr. Moira,,, Mr_ Grebe,, Mr. Youngs and Mr. Unkelbach_ On motion of Mr. Young,, seconded by Mr. Moisa* and carried, it was RESOLVED that Mr. Van Tuyl be delegated to discuss this matter of the Resolution with Shelter Island in the near future. Vote of the Board: Ayes:- Mr. Wickham,. Mr. Moisa,,. Mr. Grebe, Mr, Young,, and Mr. Unkelbach. The Planning Board received, from the Town Board,, the original petition of Alexander T. B1ooma relative to a change of zone from "A" Residential and Agricultural District to "B" Business District on certain real property situated at Mattituck, Town of Southold, and mpre particularly bounded, and described as follows: Beginning at a point on, the North side of Main (State) Road at a concrete monument at the southeaterly corner of the lands of one W. Konkel; and running thence the two following courses along said lands of W. Konkelz- (1) North 22 deg 55' 50" West 150 feet to a monument] (2) South 52 deg. 021 101" West 60.18 feet to a monument and land of G. Ira Tuthill; thence along said land of Tuthill,, North 22 deg_ 58: 101" West 36.41 feet to a steel axelt thence the 2 following courses along lands of Charles A. Price IZZ:- (1) North 23 deg. .03 " 00" West 258-91 feet to a monument; (2) North 58 deg. 321 00" East 213.09 feet; thence along the land now or formerly of Della H. Chew, part of the way along the Westerly side of a certain driveway., the following 2 coursesz- (1) South 23 deg. 03x 00" East 316.82 feet; (2) South 37 deg. 5V 501" East 100.00 feet to an iron pipe on the Said Northerly lane of the Main (State) Road; thence along said Northerly line of the Main (State) Road,, South 52 deg. 024 10" West 184.. 98 feet to the point or place of beginning. Applicant gives the following reasons for the requested change of zones I have contracted to sell the property to Sidney Packer,- who is the owner of ,Packer's Wholesale Candy, Paper and Syrup Distributor of 330 Nassau Road,_ Huntington Station,, New York.. The sale of said land is contingent upon my being able to have the property re zoned as business property. Mr. Packer is desirous of extending his business to the Eastern part of Long Island and would like to erect a building for his wholesale distributing business. In the event of my being unsuccessfully able to have the land rezoned, the contract is null and void and the sale of the land would not be consumated. It was the decision of the Board that they would investigate the property before making their recommendation to the 'Town Board. Since the property of Charles A. Price, III is already business, and this would be the extension of a business district, Mr. Unkelbach advised he would speak to Mr. Konkel about his feelings relative to having his propertyalso zoned "B" Business. 'Phis application for. a change of zone from "A" Residential and Agricultural District to. ?B" Business District will be further discussed at the next Planning Board meeting. The Planning Board received, from Mr. George F. Grathwohl, New Suffolk, New York three prints of the proposed layout of two highways at New Suffolk which he and his wife desire to dedicate to the Town of Southold for highway purposes_ Said highways being shown as Fishers Road and Fred Street. Map of proposed highways to be known as Fred Street and Fisher Road at New Suffolk, Town of Southold, surveyed July 134 1960 by Otto W, Van Tuyl & Song Greenport. Fred Street is the one running northerly from the end of Fisher Road to Elsie Road approximately 760 feet..,. Fisher Road is the one running easterly from Grathwohl Road. In February 1960 Mr. Grathwohl was granted, by the Planning Board,,- tentative permission to clear and grade a proposed road at. New Suffolk running easterly from Grathwhol Road approximately 345 feet and northerly toward an unnamed road approximately 760 feet. Moisa, and . carried*' it was RESOLVED that the Planning Board recommend to the Town Board that the highway layout of George F. Grathwohl at New . Suffolk. New York* be approved as shown on map of Proposed Highways to be. Known as Fred Street and Fisher Road at New Suffolk,. New York. ' Survey by Otto W. Van Tuyl & Song July 13,, 1960. It was further RESOLVED by Mr. Grebe,, seconded by Mr. Unkelbach and carried, That a copy of the above mentioned survey be forwarded to the Town Board with the recommendation* a copy be forwarded to Mr. Grathwohl,. c% Mr. Robert Dart, advising of our recom- mendation, and a copy be retained for the files of the Planning Board. On motion of Mr. Young, seconded by Mr. Grebe.,_ and carriedv, it was RESOLVED that a letter be forwarded to Robert W„ Tasker„, Esq., Town Attorney„ requesting that he be present at the next meeting of the Planning Board to discuss the Health Department ruling for 'lot sizes in subdivisions and the new State of New York Public Health Law pertaining to filing a map where the sub- division of land contains five or more lots_ The Planning Board would also like to know if the Real Property Law has ever.. been implemented by decisions or any ruling by the Court. The "Board would further like to know whether or not the Town officials are responsible for enforcing the government and State lawso.or are they just responsible- fox enforcing the laws Set up by the Town itself, Vote of the Board: Ayes:- Mr. Wickahm4 Mr. Moisa, Mr. Grebe# Mr. Youngs and Mr. Unkelbach. Southold Town Planning Board -8- July 26,. 1960 The next meeting of the Southold. Town Planning Board will be held Tuesday., August 16,,E 196041 7:30 P.M. , at the Town Clerk Office,.. Main Road, Southold, New York. The Planning Board discussed the petition of Mary E. and Margurite E. Scholtz for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain reel property situated at Laurel,#- New York. On .July 7# 1960 the Planning Board had recommended this change of zone on the Town Boards own motion to include all property from Aldrich Lane west to and including the Eastern T. V. business building owned by Edward Scholtz and also include the sand pit operation located northeasterly from the Main Road- Mr- Terry# Building Inspector# advised the Board that the Town Board wished Mr. Van Tuyl to drawup a map on this area and would like to have more specific boundaries that the Planning Board had in mind, Mr. Van Tuyl was advised that the zone should start at the western boundary line of Eastern T.V. and run easterly to Alrich Lane, thence northerly up the westerly side of Aldrich Lane to include the cemetery and the potato building and part of the sand pit operation which is located northeasterly from the Main Road. The Board briefly discussed the possibility of another commercial airport in the Town, Mr. Terry advised a party interested in such a venture had discussed it with him. The Planning Board stated they would take it up at their next meeting and consider picking out several possible locations for this airport. Meeting adjourned at 10:35 P.M.
