Southold Town Planning Board
February 1, 1960
A regular meeting of the Southold Town Planning Board
was held Monday, February 1, 1960 at the Tovm Clerk Office,
Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman,
Henry Moisa' Alfred Grebe, Archibald Young, and William
Unkelbach.
Also present: Messrs. Howard M. Terry, Building
Inspector, Robert W. Tasker, Tovm Attorney, Otto W. Van Tuyl,
Consultant, and Harold Price, Highway Superintendent.
William Wickham, Esq, appeared before the Planning
Board by request of Edgar Hills, Esq. , who asked that he
speak to the Board on behalf' of Arnold Sacks. It has been
rumored that the Planning Board would be in favor of the
entire area at the intersection of Middle Road, Sound Avaue,
and Cox Neck Road, Mattituck, New York, being zoned "B"
Businesse Mr. Hills would like to make an application on
behalf of Mr. Sacks and possibly Mr. Pappish joining in
and also some of the other property owners in the area.
However, he does not want to do it unless there is some
indication from the Planning Board that it would be
feasible, The Chairman advised Mr. Wickham that there
had been some discussion at the last meeting about this

situation and the Board had been aware of the fact for some
time that there had been people in that neighborhood who are
interested in having the area zoned commercial, and the Planning
Board thought they might correspond with the other interested
people to see if they would like to join with Papish and the
Town Board on its own motion. Mr. Wickham stated that he
was bringing the matter upat this time as a move to get the
situation under way. The Chairman stated that the Planning
Board is definitely of the opinion this area should be zoned
"B11 Business and the only thing left to resolve is how it
may be done most satisfactorily.
William Wickham alsospoke to the Planning Board with
reference to the application of William M. Beebe and Harry
E. Mason for tentative approval of a subdivision to be known.

Tentative approval had been granted by -the Planning Board on
December 15, 1959• He asked the Board just where the dividing
line is for developers that do not have to file maps, and what
about the new Health Depaftment requirements? The Chairman
advised that the Planning Board is primarily interested in
highways and that is the basic reason for insisting on a
filed map. The primary reason for revising the Rules and
Regulations for the Subdivision of Land was that the Planning
Board found they are getting no where ,there is a problem with
the developments. As far as the Zoning Ordinance of the Town
of Southold is concerned, the minimum lot must be 129500 sq. ft.
and the thing that confuses everyone is that the Board of Health
will not o.k. a filed map unless the lots are 20,000 sq. ft.
However, if someone were to present for dedication a highway
to the Town of Southold and it were approved by the Town,then
the Planning Board would not insist on a map being filed if
there were a reasonable number of lots. Possibly 6 to 10 lots.
Mr. Harold Price, Highway Superintendent, stated that they
are adding a paragraph to the highway specifications that "where
a road has been completed according to the specifications to
the satisfaction of the Town Board and himself, then they will
give tentative approval, but the road will not be accepted
as a To-vm highway until one year from that date." Mr. Price
further stated that he thought another sentence should be
added to that stating that a third coat of oil. should be
applied before the Town takes over at the end of the year.
Mr. William Wickham stated th4t as far as he is concerned
the question in his mind is who shall file a map, who shall
have 20,000 sq. ft. and will you allow 127500 sq. ft. on a
public road. Is the Planning Board going to penalize the
man with the subdivision? The Chairman advised that the Plan-
ning Board cannot say someone is o.k. with less than 20,000
sq. ft. because the Health Department will say you are not.

If everyone files a map here and it requires the Board of
Health approval than the applicant must go to the Board of
Health. What is in the best interests of the Town of ,Southold
is . the Planning Boardts main- concern. The Chairman advised
he feels it will. not be long before everything is 20,000 sq.
ft. Right now the V.A. and F.H.A. will not give mortgages on
less than 20,000 sq. ft. Mr. William Wickham stated that he
feels that whereas Suffolk County is so long that many problems
applying to Islip and Babylon do not apply out here in our
farming communities. Mr. Unkelbach suggested the possibility
of the Planning Board petitioning the Board of Health to ease
up on the regulations since there is no comparison between
Southold and villages further west.
On motion of Mr. Young, seconded by Mr. Moisa, and
carried, It was
RESOLVED, that Mr. Wickham, Chairman of the Planning
Board, accompanied by Mr. Van Tuyl, visit with Dr. David-'-
Overton, Commissioner of Health of Suffolk County relative
to the possibility of easing up or_ lot size regulations ,
water supply and other regulations with relation to the Town
of Southold.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa,
Mr. Grebe, Mr. Young, and Mr. Unkelbach.
The Board went on to discuss with Mr. William Wickham
and Mr. Walter Luce, Cutchogue, New York, the m tter of the
affect of detergents on the soil, storm sewers and water
districts.
Mf. Walter Luce then spoke to the Board with reference
to lots he owns on Bay Avenue and Pine Tree Road, Cutchogue.
The Chairman advised that as far as the rules and regulations
for the subdivision of land are concerned, if the highway
is accepted by the Tovm then lots may be sold. If someone
desired to open other roads he would have to go through the
preliminary proceedings of putting the roads into shape and
filing a map ,if someone wished to build on the roads before
the year is up when they are accepted by the Town. Mr. Luce
was advised that Bay Avenue and Pine Tree Road are established
Town highways and he can sell lots with 12,500 sq. ft. The
question now is lots on unapproved roads off Bay Avenue and
Pine Tree Road. Mrp ,Luce was told that there are only two
alternatives. Either seek approval of the access or file a
map of the entire parcel and have it approved and the problem
will be solved.
On motion of Mr. Moisa, seconded by Mr. Grebe and carried,
it was

RESOLVED that the Southold Town Planning Board retain
Mr. Otto W. Van Tuyl as Consultant. Appointment to be effective
as of January 1, 1960.
Vote of the Bpard: Ayes:- Mr. Wickham, Mr. Moisa,
Mr. Grebe, Nir. Young, and Mr. Unkelbach.
The matter of the application of Walter Grabie for an
Open Developer nt Area was ordered held in abeyance until the
Planning Board hears from the Health Department.
A letter was received from the Southold Town Board of
Appeals stating that they understand that the Board of Health
now requires 20,000 sq. ft. minimum lot sizes in subdivisions.
It is also their understanding that the Planning Board and board
of Health regard property coming under the subdivision regulations
as being any property which zs divided into five or more lots.
Actually if these assumptions are correct the Board of Appeals
will continue to function on property which are divided into
four or fewer lots, A reply to their letter was requested.
The Planning Board replied that it is the feeling of the
Planning Board that the dividing point for lots to be handled
as a subdivision should be between four and five. The Planning
Board suggested that the Board. of Appeals handle cases of access
involving four cr less lots and the Planning Board handle cases
involving five or more lots where access is concerned.
The a.-pplication of Ralph Glover and Una Belle Glover
for an Open Development Area was received. Location of the
property, North Sea Drive, Southold , New York. After study-
ing the application it was the feeling of the Planning Board
that the aforementioned ruling of access involving four or
less lots being referred to the Board. of Appeals would apply
in this case,
The Planning Board received the application of George G.
Bailey, Broad-waters Drive, Nassau Point, for a change of zone
from "A" Residential and Agricultural District to "B" Business
Districton certain real property situated at south side Main
Road, Cutchogue, New York, approximately 400 ft. west of Bay
Avenue , with a frontage of 66 feet and depth of 165 feet. ,
bounded easterly and southerly by land of William Midgley,
westerly by Walter Silleck and northerly by Main Road, but
more particularly bounded and described as follows: (Deed
description) Beginning at a point marking the northwesterly
corner of the tract hereby conveyed, and the northeasterly
corner of the lands now or formerly of Oscar Silleck, on the
southerly margin of the Main highway running through Peconic;
thence running southerly by and with said lands now or formerly
of Oscar Silleck ten (10) rods to land now or formerly of Daniel

V. Howell; thence easterly, by andwith the said land now or
formerly of Daniel ' V. Howell four (4) rods; thence northerly
by and with the lands now or formerly of Daniel V. Hair ell ten
(10) rods to southerly margin of said highway, and thence
westerly along the southern margin of said highway four (4)
rods to the point or place of beginning; being bounded north-
erly by said highway; easterly and southerly by lands now or
formerly of Daniel V. Howell; and westerly by lands now or
formerly of Oscar Sill_eck, containing about one quarter of an
acre.
Mr. Bailey stated in his application that he wishes to
use the land to have a ceramic shop for lessons and to sell_
ceramic supplies.
On motion of Mr. Unkelbach, seconded by Mr. Moisa, and
carried it was
RESOLVED, that the Planning Board recommend to the Town
Board that the change of zone be made from "A" Residential
and Agricultural District to "B" Business District on the
aforementioned described property.
The Planning Board is thoroughly familiar with this
property, and wish to point out that this change will fill
out a "B" Business District, because this property has been
a jog in . the existing district. The request seems completely
reasonable to the Plan ping Board.
Vote of the Board: Ayes:- 1x1r. Wiclfham, Mr. Mois a, Mr.
Grebe,. Mr. Young , and Mr. Unkelbach.
The Planning Board discussed the matter of amendments to
the Southold Town Building Zone Ordinance as proposed by the
Board of Appeals on May 19 1959•
On motion of Mr. Young, seconded by Mr. Unkelback and
carried, it was
RESOLVED, that the Planning Board recommend to the Town
Board the first three amendments proposed in the letter of
the Southold Tovm Board. of Appeals on May 11 1959:
1. Sign sizes:
Article III
subsection 8 to read "1 Foot by 2 feet."
subsection 9 to read 4 feet by 6 feet. "
subsection 10 to read !'3 feet by 4 feet.Q
These clarificati ns would elimin.at the possibility
of odd shaped elongated advertising sign.

2. Under Section 360 (2) of Article III A, the I'M"
District allows a 50 sq. ft. double face sign without - any
restrictions. We believe an additional sentence should be
added to (2) as follows:
"Height of signs in the 111411 District, advertising
_the business conducted on the premises , should
not exceed 35 feet and the bottom edge of the
sign shall not be less than four feet from the
ground level. "
It is believed that most motel signs are electrical in
nature and it has been recommended that a four foot clear-
ance be required. Any unnecessary hardship could be
corrected by variance.
We do not suggest altering the superficial area of
the Signs. The purpose is to cohfine the maximum dimensions
to the sign area intended when the present amendments were
adopted.
3 . It is recommended that the following addition be
made to the Ordinance under Article III A, Section 350, to
read:
111. a. Two family dwellings. "
This oversight was called to our attention by the Town
Attorney.
A further amendment on motion of Mr. Grebe, seconded by
Mr. Moisa and carried was recommended to the Town Board by the
Planning Board. The Planning Board is in receipt of a letter
from Frank Aikman, Jr. , Chief Engineer, Long Island Rail Road
concurring in the Planning Board's proposal and- stating that as
the Ordinance now reads such a zone would place a restriction
on future industrial development in which the railroad would
naturally be interested.
Article V, Section 503 to be altered as follows:
"Section 503a--"C" FRONT YARD--In the "C" Industrial
_District, the required front yard shall be at
least thirty (30) feet, provided further that
where property is bounded on any side by a
private right-of-way, other than a railroad
right-of-way, there shall be a setback along
the entire length of such private right-of-way
df at least 15 feet. "
Vote of the Board: Ayes :- Mr. Wickham, Mr. Moisa,
Mr. Grebe, Mr. Young, and Mr. Unkelbach.

The Planning Board discussed with the Town Attorney the
matter of liability insurance. Mr. Tasker advised that
certain employees in the Town are covered, however the Plan-
ning Board, Board of Appeals, etc. , are not. He stated that
the policies of the Town are being gone over and steps will
be taken to include the Planning Board and Board of Appeals.
The annual meeting of the Association of Towns to be
held in New York City February 87 9, and loth was brought
up for discussion. On motion of Mr. Moisa, seconded by Mr.
Unkelbach and carried, it was
RMSOLVED that Mrs. Judith T. Bokazbe designated to
attend the meetings as a representative of the Southold
town Planning Board.
Mr. Wickham advised the Planning Board that on January
269 1960 he had appeared before the Southold Town Board to
discuss the seriousness of Golden Nematode on Eastern Long
Island and requested that some financial assistance by the
Town of Southold toward eradication of Golden Nematode would
be of great help in this program.. He went on to explain to
the Planning Board the affect of Golden Nematode upon the
crops, how it spreads, and what has been done at the present
time toward seeking legislation for its eradication and control.
On motion of Mr. Young , seconded by Mr. Unkelbach and carried,
it was
RESOLV.�D, that a letter be forwarded to the Southold
Town Board recommending that the Town Board of the Town of
Southold take immediate steps to make available funds for
the eradication and control of the Golden Nematode. The
Planning Board believes that the positive approach to this
problem offers more hope, but also at the present time we
appear to have an unique opportunity of cooperating with state
and federal agencies in a new plan, namely treatment by
fumigation of land not now infeated9 but "operationally
exposed."
It was further R SOLITED upon motion of �1Ir. Moisa,
seconded by Mr. Grebe and carried, that a letter be
forwarded to the Southampton Town Planning Board outlining
the Southold Town Planning Board's recommendation to the
Town Board and the importance of-prompt action in this
matter and suggesting that the Southampton Board consider
this problem and if they see fit recommend to their Tovm
Board cooperative action.

Southold Town Planning Board February 1, 1960
The Elam-iing Board received a map of property of George
F. Grathwohl at New Suffolk, New York by Otto W. Van Tuyl &
Son dated July 25, 1957. After considerable discussion and
consideration, on motion of Mr . Moisa, seconded by Mr. Young,
and carried, it was
RESOLVED that the Planning Board grant tentative permission
to Mr. George F. Grathwohl to clear and grade proposed road
running easterly from Grathwohl Road approximately 345 ft.
then northerly toward unnamed private road approximately 7,60
ft. , on his property on the easterly side of Grathwohl Road,
New Suffolk, New York, as shown on Preliminary Plan for George
F. and Elsie Grathwohl, New Suffolk, New York dated July 25;
1957 by Otto W. Van Tuyl & Son.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe, Mr. Young, and Mr. Unkelbach.
The next meeting of the Southold Town Planning Board
will be held 7:30 P.M. , Wednesday, February 17, 1990 at the
Town Clerk Off ice, Main Road, Southold, New York.
The minutes of the meeting of January 117 1960, on motion
of Mr. Moisa, seconded by Mr. Grebe and carried, were approved
as submitted to the members by mail.

Grebe, Mr. Young, and Mr. Unkelbach.
