A regular meeting of the Southold Town Planning Board was
held at 7:30 P M..$, Tuesday., March 24, 1970,i. at the Town Office.,
Main Roada, Southold,,. New York.
There were present: Messrs: John Wickham : Chairman; Henry
Moisa,$, Vice Chairman; Frank Coyle and Alfred Grebe, present at
7:50 P:M
Absent: Mr, Henry Raynor was called by the National Guard
to help out with the mail. $

VICE CHA3MAN:MOISA: I will call the meeting to order and
read the legal notice of hearing.
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the

and Frank Mandaro. I. respectfully request that the Planning Board

approve this subdivisions: as all of the requirements of the Town of
Southold have been met. The owners are in the process of acquiring
contracts to be presented to the Town Board.. so that a bond can be
approved.
Chairman Wickham suggested that this hearing be recessed until
the other members of the Board are present.
Messrs. Frank Coyle and Alfred Grebe arrived at 7:50 POM -

RESOLVED: WHEREAS: Nicholas & Frank Mandaro.9, Cutchogue, New
York;,,; •have petitioned the Southold Town Planning Board for•' final
approval of their subdivision "Wheatf'ield •Park",i located at Griffing
Streett Cutchoguei, New York,; and
WHEREAS: 'The Superintendent of Highways has approved the
lay--out of the roads, and the Planning Board accepts his reports,
and
WHEREAS: The Southold 'Town Board will accept a bond in the
amount of $67,j000 for the roads and other improvements in this
subdivisions:
NOW:, THEREFORE BE IT RESOLVED: that the Southold Town Planning
Board grant final approval to the subdivision known as "Wheatfield
Park",,j, subject to the condition that the Planning Board receive
notice from the Southold Town Board that they have received and
accepted a bond for this subdivision.
This motion shall include authorization for 'the Chairman
to sign final maps upon receipt of notice from the Town Board.

DONALD H CLARK: I am .not sure that I wish to speak against.
itj I am just interested as a property owner in -the vicinity. Just
what subdivision is involved here?
THE CHAIRMAN: `"Laurel Country Estates"& owned by Emma Enterprises•r,
Inc,,; located at Peconic Bay Blvd.,* Laurel.
RICHARD LARKj, ESQ : This subdivision is located a little north
of Peconic Bay Blvd, The owner to dates Leonard C. Emma';,, purchased
it as one of three parcels from C�T:- Young. Leonard Co . Emma is
under contract to sell to Emma Enterprises;;; Inc. They are only
taking the parcel before you on this subdivision:,i, as shown on this
map. The corporation will acquire no beach rights. The parcel.
is quite small and narrow and there would be no purpose to add
the beach area to the park and playground. Therefore they will .
not deed out any beach rights with the lots.

RICHARD LARKa, ESQ : There was a little misunderstanding
with some of the residents down therei, but no beach rights will
be deeded with the lots. '

residents of. the Mattituck Park District-,, so .they will -be .entitled

The Chairman, read telegrams of opposition to deeding beach
rights with the.' lotsr; received from the following persons: L. Kinsley
Smithy; Jane Be Corydon, Clifford H, Arthur,,: Jr.,, all surrounding
property owners.

in -the subdivision. . Suitable space for recreation.has been-.set

this zubdivisionr subject to the approval of the Town Board of -bond

of Public Works.
Up—dated letter of January 51r; 1970 from the Village of Greenport
agreeing to supply water to -this subdivision ,(original letter dated
December 11s; 1968), and letter of, August 70, 1968 from the Supt, of
Highways .disapproving of.Wild Cherry,Lane .as a dead ends; which has
since been resolved.r; were conta ted, in- file._
The Chairman read the Planning Beard's letter of February 49 1.970
in which- they forwarded copies of this subdivision map to the Dept.
of Public Works for their comments. Reply was received from Wm.` S.
Matsunayer, Jr..r; Chief Engineers; stating that -they approve of it
pursuant to Sec. 239. S of the General Municipal Law_r subject to any
comments' shown on plan in reds; and also before building •an access
road to C R.' 27,_., Middle Road_., 'a permit under Seca 136 of the Highway
Law will be required.
THE CHAIRMAN: This subdivision has been under discussion for
the past two years. The County Board of Health still has a question
on it. Therefore I would like to go through it_., then recess this
hearing.

favor of this subdivision?

of this subdivision. My name is R;'Ge Terryi, Jr.,i, Attorney., I.
appear on behalf of Valentine Ruch. He asked me "to come to
respectfully request your approval 'subject' to resolving our
differences with the Health Dept.
Mr. Van Tuyl read letter of March 16s,, 1970 received by him
from the Health Dept.ir; in which they indicated that they disapprove
of this subdivision and they are -setting up an appeal to be heard
by Mr. Andreoli.
MR VAN TUYL: I think this appeal board is something new
they are setting up to review all pending subdivisions. s
THE CHAIRMAN: I think that we should recess this hearing
until such time as it is reviewed by the Health Dept. What are
the arrangements on this subdivision in regard to a performance
bond?

HOWARD TERRYs' BUILDING INSPECTOR: The bond has been received
by the Town Board,. but they. have taken no 'action on it yet.
On motion' by Mr. Moisa,, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board recess this
hearing for final approval of the subdivision "Shorecrest"a, owned.
by Valentine Ruch, located at south side of CR278; Middle Roads;
Greenport,, N.Y.-.,, until such time as it is reviewed by- the County
Board of Health and all necessary information is received. . An
up-dated letter from the Superintendent of Highways .r; approving
the road lay-out, . must also be received.
Vote of the Board: Ayes:- Messrs: Wickham,, Moisa� Grebe,,. Coyle,
Mr, Harold Reese appeared before the Planning Board to inquire
the time limit on the preliminary approval which the Board granted
to "Harbor Lightss, Sec. IV" on June 17.,, 1,968, The Board informed
him that the preliminary approval was. granted for a .period of 6
months from date of such approval. Mr. Reese said that he spoke
with Mr. Villa of the Health Dept.i who indicated to him that it
would be automatically denied by them at. this time. Mr. Villa.
suggested that he bring. it before this Board for ,recommendationse
then the review board will take it from there, The Chairman
informed Mr. Reese that the Planning Board will .send their
recommendations to the Health Dept, if he will present us with
a final map and letter from the Superintendent of Highways:

concerning the amendments to the Rules and Regulations of the
Subdivision of Land in the Town of. Southold:
NOTICE IS .HEREBY GIVEN that the Planning Board of -the Town
of Southold will hold a public hearing at the Southold Town Clerk's
Office:, Main Streets, Southold New Yorks. on the 24th day of .March,l
1970,s, at 8:30 oy,clock in the evening of said day in the matter of
the amendments to the Rules and Regulations governI gg'--the Subdivision
of Land in the Town of Southold,; said amendments being as follows:
1. By amending Article II1:,t Section 4*. Subsection A
The subdivider shall,. within one year after the Conditional
Approval of the Preliminary Layouts. file with the Town Clerk
an application (in duplicate) for approval of all or part of
the proposed subdivisions using the approved appliccation
blank. Thus,. the subdivider may develop .the subdivision in

progressive stages instead of in its entirety. . But no subdivision
or portion thereof shall be considered unless 'it has frontage on a
public street; abuts an existing street on the Town'$s Official Map;
or an approved street for which a bond has .been. filed under Paragraph ;
Ei below. A Highway Inspection fee of 40 of bond estimate as pre
pared by- the Town Engineer for street and improvements proposed in
the subdivision shall be paid prior to final plat approval.. -
Failure to submit all or a portion of -the Subdivision Plat within,
six months shall automatically cancel the Preliminary Layout
Conditional Approval.=; unless a -request for an •extension ' of time.
is granted by the Planning Board. Such extension shall be granted
only if, the proposed subdivision fully conforms to the zoning
regulations in effect at the time such extension is applied for.

STANLEY WAIMEY: ' I. have a question. The only change I see is
in the fee 'and the wording. As I see it.a; it was 2-%i now it is being
changed to 4% Why -the- raise?
THE CHASRMAN:� These fees'* as area, actually do not cover costsd,
even for the publication of the legal notice.
STANLEY WAIMEY: Will this cover it?
THE CHAIRMAN: I hope so. We donut think that the taxpayers
should have to subsidize . it.
THE CHAIRMAN: is -there anyone else present .who wishes to bet

The Planning Board was presented with the final maps for the
minor subdivision of Philip Druhl,,r located at West & Lake Drive
Southoldi. N.Y.'
On motion by Mr. Wickhamz seconded by Mr. Moisa&, it was
RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Philip Druhl.. located at
West & Lake Drivel Southold., N.Y.'

Letter of transmittal and copy of performance bond in the amount
of $68,x000, for Sunset Knolls; Sec. IIr, to be sent-' to the Town Board
requesting a notification of acceptance of bondi, so that the final
maps can be signed.
Notice of public hearing was received from, the Town of

subdivision "Laurel Country Estates" , located off north side
of Peconic Bay Blvd..,, Laurel.", New Yorks; and
WHEREAS: The Superintendent of Highways has approved the . ' .
lay—out of the 'roads.,; and the Planning Board accepts his report, and
WHEREAS: The Southold Town Board will accept a bond in the
