There were present; Messrs: Johri Wickhami, Chairman; Henry Moisaz. Vice Chairman,,(; Henry Raynor; Frank Coyle. Absent: Mr, Alfred Grebe:,Cdue to unfavorable weather conditions). Also present: Howard Terrya Building Inspector Gary Olsen; Esq. appeared before the -Planning Board in reference to lot # 28 of Martin Weglicki'ss proposed subdivisions. located on north side of Peconic Bay Blvd:..- Laurel' New York, Mr. Olsen requests. The Board to authorize the Building Inspector to -Issue a building permit on this lot* or as an alternatives, permission to remove this lot from the subdivision map. Mr. Olsen informed the Board-that a contract of sale on Lot # .28 was entered into between Mr. Weglicki and Richard P.-Griffith on November 24i 1969i a mortgage commitment was obtained to build upon the lot*. a title search was donea; and both ' ( Southold Town Plann,' ' Board -2- -ipril 21.,* 1970 parties are ready to close title. Mr, Olsen presented the Board with a copy of the minutes of the Planning Board meeting of May 12s. 1969. Mr, Weglicki and Mr. Jack Driscoll .(the real estate broker) appeared at this meeting and requested permission to sell Lot # 28. The Board granted permission to sell this lot ;(which is. on an existing highway) subject to the subdivider filing an application for Sec, I of this subdivision and paying the required fee for the filing of said subdivision. This subdivision has been granted preliminary approval by the Planning Board,: but no approval has been received from the Board of Health, Mr, Olsen stated that the Board of Health may disapprove of the present.'lay-out and a new map will have to be drawn upT, so he suggested that -this lot could just be left the map. The filing fee for a subdivision- consists of 4/ of the bond estimates. since this subdivision has not been approved` by the Board of Health., a bond. estimate cannot be done. Therefore the Chairman suggested that the condition previously set on the approvals. which was that the filing fee be paid.: be waivered. On motion by Mr, Raynors seconded by Mr. Moisaj it was RESOLVED Martin Weglicki be granted permission to remove Lot # 28 from his proposed subdivision map of property located at north side of Peconic Bay Blvd.s Laurels New York. The condition previously set,, being that the applicant pay the subdivision filing fee:" is here- by waivered due to the fact that the Board of Health has not yet approved the subdivision and no bond estimate can be calculated. Vote of the Board: Ayes:- Messrs: Wickham:", Moisa", Raynor."; Coyle. Mr. William Schriever of Orient and Mr. George Penny". Jr. of Penny Lumber Co. appeared before the Board in reference to Greenport Homes". Inc, This property is scheduled for auction sometime late in May. Mr. Wm. Schriever.", a prospective bidder,, appeared before the Board to inquire what possible plans the Board would consider for the removal of the present buildings and construction of new home sites, Mr. Schriever felt that he must have some idea of what the Board would approve of, in order to submit a suitable bid. The present construction consists of 28 buildings with 50 living units on a tract of 7 acres. Mr. Schriever informed us that if he is able to purchase Greenport Homes.", Inc, he would also purchase part of the Cassidy property:" adjoining it on the' west.-, making a total area of about 11 acres." He estimated his cost of purchase at about $1041;000, per acres, and stated that in" order to make the plan work.", he would have to divide it into 50 14 acre lots." to be sold at $4,,000, eachs on which Penny Lumber Co. proposed to construct homes at a cost of about $15s000. Mr. Penny stated that in order for the prospective home builders to receive a low Southold Town Planx, j Board April 21i; 1970 interest rate from the Federal Farm & Home Programs; the total price of the lot and house must be under $214000. Mr Schriever presented the Board with a proposed plan for the lay�out. of the. proposed .sub— division. The total area of land would be 480.-000sq. ft.,,a 100.,p000 sq. ft . would be used for roads,,. and 15 .000sq. 'ft, for park areai. the remaining 380 ,000sq. ft, would be the total lot area. The plan showed 50ft. roads. With a total of 380*000sq, ft. of lot areal. each of the fifty :(50) lots would contain 7.,;300sq, ft, of areE.. The Board was of the opinion that 50 lots with 7300sq, ft, of area each would be too great a density. The Chairman -suggested. that 40 lots with 12:iOOOsq. ft. of area each might possibly be acceptable to the 'Planning Board. Mr. Schriever informed the Board that he had confered with Mr. Koppelman on this plan and he agreed with it.a he also spoke with Mr. Villa of .the Health Dept.-,v, whose position. was that as long as there is public water and sewerage available., Ley will go along with any lot size that the Town will Approve .of. Mr. Schriever stated that he is trying to offer an d1.ternative to rental. There are several other prospective bidders proposing rental. The buildings as area now pay under $5,000. in taxes. He estimated that the taxes would double 5 or 6 times , if his proposition is carried out. The Board agreed that this would be a much better land use than the existingt but again stated that the density which he proposed was too great. The Chairman informed Mr. Schriever that .the Planning Board will have to confer with the Town Attorney . the Board of Health.- the Planning Commissions and the State Dept. of Transportation. ' The Chairman asked Mr. Schriever to appear at the next meeting., by which time they will try to have an answer for him. Mr`. Jack Driscoll and Mr. Rene Gendron presented the Planning Board with a preliminary sketch for proposed "Senior Citizens Rental Apartments' ,i' property located on Factory' Avenue,, about 200z from Sound Avenue.,i Mattitucka New York,. Total area is about '7 acres.* on which the developer wants to put 100 apartments. He intends -to have his own sewerage disposal plant and water system.'. The property is preseht-1y zoned "A",,, and it is proposed to be rep-zoned for industrial use in the proposed Master. Plan. The Chairman informed him that the Planning Board would not- recommend any such density as 100 units on 7 acres of land. The Chairman stated that this will require a change of zone D: which will have to be submitted to the Town'Board. Mr. Driscoll asked what objection the Town would have to such a project as this. The Chairman stated that there is a water problem right 'in the village of Mattituck and he is proposing to' put one hundred living units right in where the water problem is. The Chairman, stated there would be no guarantee to the Town Board that he would make a senior citizens development out of it. If a change of zone were granted permitting him to have an apartment complex,,.. no condition could be set that would restrict the occupancy to seniorcitizens. 'Southold Town Planni; Board . -4- 'pril 21,,, 1970 The Town could not bond him for anything that he may say that he will do. The Chairman informed him .that as soon as he submits the change of zone to the Town Board,. it will be forwarded to the Planning Board for their recommendation. The Chairman once again said that 14 units per acre was too great a density. Mr. Driscoll stated that he could drop it to 12 unitsi but no less',„ he stated his opinion that this density would be better,, in . regard to waters: than having 100 families on 1 acre lots. ' The Chairman said that this was not true because on 1 acre lots one family would only be using -3-2 of the water.. the rest of it is available for flushin4 action. which means that the water supply would be safe for at least 100 years. The Chairman informed them that their first step is to petition the Town Board for a change of zone. - Mr. Driscoll inquired what zoning would be in their favor .to petition the Town Board for a proposition such as this. The Chairman stated that at the present time B-2 would be the most favorable.s, but said that there is no assurance that the Town Board will not change the density in this zone in the near future. Mr. John J. Jones presented the Planning Board with a preliminary site plan for proposed Cutchogue Shopping Center to. be located on 'north side of Main Road (immediately east of Sterling Nursery) ,, Cutchoguer New York. The total land area is 236,s288sq.. ft, (5.2acres),., total building area is 44a,364sq. ft. The plan showed 361 parking stalls (Town requirement being 202) . The Board questioned the loading area on the east side of the building as to its efficiency. Mr. Joseph Martiranoi Real Estate Manager for Hills Supermarkets=, explained the dock- method of loading to be used; which the Board felt was efficient. The property is presently zoned "B" Business, so no change of' zone will be required. Mr. Jones stated that they own half of the right- of-way ,(Sterling$s) adjoining the property on the west and north, and would be willing to pave the entire surface if this would be - satisfactory with the Sterlings. The architecture of the buildings will be colonial. The proposed plan showed plantings and landscape. The pri.nci,pal ' tenant will be Hills Supermarket., there will be several smaller satelite stores;, and a movie theatre. The Chairman suggested that there may be a problem in regard, to drainage. Mr. Jones stated that this will be no problem as the drainage will be all built in. Artie Melusino stated -that .the entire area .will be self drained according .to the Town of Southold specificationss and that their engineer will work in conjunction with the Town engineer. _ Mr. Jones requested the Planning Board to grant preliminary approval of the site plan as submitted. The Chairman informed Mr. Jones that a decision will possibly be' reached later in the evening by the Board. Southold Town Plana j Board -5- April 24 1970 Eugene Francolini,, Attorney and Kurt Hambacha; Vice President of. the South Fork Development Corp. appeared before the Planning Board' in reference to Corey Creek..Estatesr,' subdivision located at south side of Bayview Roadp Southold, New York. Mr. ; Francolin,i informed the Board that the canal was dredged subsequent to. the .filing of the subdivision map. The Chairman told them that- the.y have officially filed a subdivision-map and then altered ita, a correction will have -to be made with the County Clerk. ', The Chairman voiced his opinion that the development of the waterfront in the ' Town of Southold is solely as important as the devel_pment of the road frontage. Mr. Francolini stated that eight (8) .of .the lots , in the subdivision have already been conveyed. Previously there '. was some discretion with the Supt. of Highways 'in reference to3 the turn in Corey Creek Lane on Lot # 25,r. Mr. Francolini advised the Board .that an arc will be made. on the turn, and deeded to the Town. Howard Terry informed them that the bond will expire on June 222, 1970 and must be renewed.. Mr. Francolini requested a . one year extension of the bond to complete the roads and other . improvements. This extension shall be granted subject to . the developer presenting the Planhing. Board with a copy of the renewed bond coverage. The Chairman once again informed Mr. Francolini and Mr. Hambach that a corrected map will have to be filed with the County Clerk. on motion by Mr. Mois&�. seconded by Mr. Raynor , it was RESOLVED that the Southold Town Planning Board grant a one year extension of time to complete the roads and other improvements in the subdivision "Corey Creek Estates," located at south side of Bayview Roadz, Southold,. New Yorke, subject to .the developer presenting the Board with a copy of the renewed bond coverage from the insurance company. Vote of the Board: Ayes:- Messrs: Wickham,, Moisaa, Raynor, Coyle. William Essex* Attorney appeared before the Planning Board on behalf of Fishers island Development Corp.$; he presented -the Board with a map of the Fort HG: Wright property located on the north- westerly- end of Fishers Island. . The approximate acreage of the property is from 8-10 acres. There are now 6 deterioated buildings on the property at present. The Corporation wishes to sell the property off in sections -to persons interested in restoring the area. Mr. Essex requested the Board to grant the Fishers Island Development Corp. an open area development on the property as shown within -the red lines on the map as submitted. The Chairman reviewed the fact that the Town has not granted any open area developments in the past 9 yearsk he suggested that they file for a minor subdivision of five (5) lots. Howard Terry informed them -that .they will .have to make application to the Board of Appeals under Section 280A for approval. of- access' in order for him 'to' issue building permits for the interior property,, Whistler Avenues, although not' a Town road,, is suitable .access and. is -maintained by the Towna, building permits could be issued on this road. Minor subdivision regulations were presented to Mr. Essex. upon• his request. The Chairman informed him that once .thi.s i.s approved .as a minor sub" divisions it cannot be divided again. Mr. Essex to .confer with the Fishers Island Development Corp. in regard to filing minor subdivision ' application. Richard Larks. Esq presented the Board with a copy of .the conveyance between Leonard Emma and Emma Enterprises,,i Inc.., as requested ., for Laurel Country Estates. This subdivision was granted final approval at the last meeting subject to, receipt of copy- of the conveyance, Mr, Lark stated that' the' description ' of the property given in the deed. is .the exact same as Schedule "A" of the application. Copy of covenants and restrictions to be placed on lots yet to be 'received. Richard Lark..., Esq, presented the Board with a copy of the deed in which Birch Properties,s Inc. conveyed to the Birch Hills Property Owners Association, ; Inc.,& the roads and park and play-- ground area -in the subdivision "Birch Hill Estates". ;' The roads will be 'private and will not,be ,dedicated to the Town. Letter ' of approval was recexved �from the Supt, of Highways stating that. he has inspected the 'roads.,and recommends that they be turned over to the Birch Hills Property Owners Association,,. Inc. Mr. Lark .-requested the Planning Board to send a--recommendation to 'the Town Board recommending that .the bond be released in his care, On motion by Mr. Coyles. seconded by Mr. Moisa,D- it'was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board the release of the bond for the. roads in the subdivision "Birch Hill Estates. " Vote of the Board: Ayes:- Messrs: Wickhama, Moisa , Raynor:a; Coyle, Richard Larks; Esq, presented the Planning Board with a revised preliminary map for proposed minor subdivision of Richard Babcock•Z., property located at west side of Calves Neck 'Southold Town Planninc card -7- April 21a, 1970 Roada; Southolda N.-Y.- There is public water in the entire proposed minor` subdivision* ' The map showed' 4 lots., all containing consider-- ably'over . the minimum square' footage requirement. , The map showed a parcel of land of 5.a'.200sq. ft. of area 'on the east side of Calves Neck. Road., opposite Lot # l.a which was .labeled 1 A., The Board, did not favor 'thisa- they questioned whether or not .there was a property owners association._ Mr. Lark said that there was no property owners associations and the chances of dedicating it to the Town .were slight. The Board agreed to leaving 1 A as part of Lot # 1-subject ,to .the conditions that it may never be built upon - and it must be legally conveyed as part of Lot # 119 Mr. Lark to prepare formal application for minor subdivision to be presented at next meeting. In reference to Mattituck Hills and Mattituck Ridge. Mr. Lark informed the Board that everything has been submitted to the Board of Healthi but no answer has been received yet. Correspondence was received from the New York State Department of Transportation in' answer to our inquiry if they have any plans to widen the North Road :i(Route 25) easterly of the Greenport ,Traffic Circle. The state informed us .that .they have no plans to widen the road in this area. However, in regard to the proposed subdivision , . of Gus Shad.: the developer will have to apply for a State Highway- Permit for any work performed within the State Highway boundary. . The Board informed Mr. Lark that the first step for this proposed development will be to file application for a' change of zone from "A" to "M" & 11B-211,a; then file application for a subdivision. The Southold Town Planning Board received from the Southold Town Board the original amended petition of Case Bros.,*. Cutchoguei New Yorka. relative to a chances of zone from "A" Residential and Agricultural District to "M-1" Multiple Residence District on certain real property together with the instructions to prepare an official report defining the conditions contained therein. Coyle informed the Board that he had spoken with several members of the Sterling Cemetery Association in reference to the proposed change of zone. and they are to send another letter: which we have not yet received. On motion by Mr. Coyle& seconded by Mr. Moisaa. . it was RESOLVED that the Southold Town Planning Board table recommendation on the above proposed change of zone for further deliberation of the Boardi due -to the fact that the Board has not yet received the letter from the Sterling Cemetery Association. Vote of the Board: Ayes:- Messrs: Wickham,, Moisa., Raynor&, Coyle. in -reference to proposed subdivision of Andrew Dzenkowskit located at East Marion., NsY I it was reported that negoiations are being carried on with Edna Brown to purchase her 50 ft, right-of- way adjoining the proposed subdivision on the north. Southold Town Plan ,ig- Board -10- April 21.0 1970 Letter was received from .the Riverhead Town Planning Board in reference to the proposed fuel desulphdrization. plant. Upon taking into consideration our views and concern for.,the futures they recommended denial of the petition.: and the petition was withdrawn by the applicant. Letter was received from George G. Semerjian expressing his personal thanks for the manner in which he was treated in connection with his recent zoning application. ' The .Chairman reported that he and Henry Raynor met with a committee of the Southold-Peconic Civic Association in reference to the proposed Agriculture Study. , They presented the committee with the preliminary questionaire to be used by Dr. Sullivan of South- ampton College. The Town Board has acted favorably on the agriculture, study and by resulution they authorized Dr. Sullivan to proceed. The Town Board suggested that Justice Demarest sit in on the final draft of -the questionaire, The Chairman.. Dr. Sullivan .a„ and Justice Demarest met and drew up the final draft of the questionaire. Dr. Sullivan expects to begin work on the study early in .May.'_ Dr. .Sullivan - suggested that we get in touch with the newspapers and radio stations to inform .the farmers of the study being done.' The Southold-Peconic. Civic Association advised us that they would Iike' to be included in the conference after .the facts have been collected to assist in the interpretation of the study. The Chairman advised the Board that no date will be set for another public information meeting on the Master Plan until Dr. Sullivan completes the agriculture study. Notice was received from the New York State Planning Federation .advising pre-registration for the annual meeting to be held on October ll.. . 12 r, 13. & 14.. 1970,& at Spring Glen,,, New York. Request for progress report for the roads in Harbor Lightsa. Section IZ, was received from the Aetna bonding company.- The bond has expired& ,,and the roads are not ready to be taken over. The roads are under 1956 specifications. The Chairman is to contact the Supt. of Highways for a report. ' Southold Town' Plan .g Board -11- April 21t 1970 Request for information on the Master Plan was received from Southampton College.. Said request placed in file. Notice was received from PLI News (Practicing Law Institute) in reference to interstate land sales.,, Howard Terry reported on his inquiry to Easthampton and Southampton Towns in .reference to steps they have taken for "scenic easements". They have not actually entered into any contract agreements. The _Chairman reported that he had spoken with Mr. Newman of -the County Planning Commissiont;.who 'thinks `that Brookhaven Town .may have contracts., Mr. -Newman is going to try to get a copy of the contracts for us. The Town Board is favorable towards contracts for "scenic easements" and feels that we should move ahead on this. t The Board discussed again the proposed Cutchogue Shopping Center, On motion by Mr. Coyle., seconded by Mr'. Moisa ,. it was RESOLVED -that the Southold Town Planning Board grant preliminary approval to the site plan for - the proposed Cutchogue.- shopping' Center:., to be located at north side of Maim Roads; Cutchogue.*: New York.
