SOUTHOLD TOWN PLANNING BOARD
July 27,, 1970
A regular meeting of the Southold Towri' Planning Board was
held at 7:30 P M.'a. Monday,, July 27, 1970,, at the Town office,
Main Road, Southold,, New York.
There were present: Messrs: John Wickham,, Chairman; Henry
Raynor,, Frank Coyle,
Absent: Alfred Grebe (due to unfavorable weather conditions)
Henry Moisa.
Also present: Howard Terry,, Building Inspector
Mr, Carroll Schutz a/c Doris Moeller presented the. Planning
Board with revised plan for proposed minor subdivision' of her
property located at east side of Little Neck Road,,, Cutchogue.
The map showed 3 'lots. - Lot # 1 contained 95,,000sq. ft. of area,,
lot # 2 contained 850,000sq. ft, of area, and lot # 3 contained
8Z acres and is designated on the map as, "not to be subdivided".
Almost half of the area in each of these .lots is marsh,,,.. the
Chairman sketched in the high water mark on each of 'the lots*.
On motion by Mr. :Wickhamr, seconded by Mr. Raynor,, it was

RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Doris Moeller, property
located at east side of Little Neck Road.., Cutchogue..; New York,
subject to the following conditions:
1.. Applicant must file formal application.
2. Applicant must pay fee of $10.00 per lot.
3. Applicant must present the Planning Board with three .(3)
copies of final map.
Vote. of the Board: Ayes:—Messrs: Wickham,, Raynor, Coyle.
Mr, Joseph A. Shipule presented the Planning Board with final
maps for his subdivision "Bayview Woods Estates".. located at east
side of North Road to Bayview,. Southold,, N.Y. Mr. Shipule informed
the Board that the roads are just about completed. There is a minor
dispute with Chas. Abrahams, Construction Inspector, in .reference
to water coming into this subdivision from another area. Mr. Shipule
is going to 'install 2 additional basins . on the park and playground
area to clear this up. The drainage has been completed on North
Road to Bayview. This is one of the subdivisions which has been
held up by the County Board of Health since January lstt their
approval was recently received,, so it is now ready for a final
hearing.
On motion by Mr. Raynor, seconded by Mr. Coyle, . it was

New .York, as the time and place of hearing upon the approval of the

Mr. Otto Van Tuyl and Mr. Reese°ssecretary presented the
Planning Board with preliminary plan for Harbor Li4htsD. Section
V. The map showed 70 lots.., numbered 109--178,,. containing 20z,000
sq, ft, of area each. The Board informed them that they could not
grant preliminary approval to any subdivision containing lots of
20; 000 sq. ft..,, which did not have provisions for public water
and sewerage. ' The map was dated December 31.. 1969 by Van Tuyl
& Sonsi but was not presented to the Planning Board until this ,
evening. Mr. tVan Tuyl explained that the map was set up with
lots of 20...000 sq, ft. of area4 but was done so that they could
easily be changed to 404P000 sq. ft. of arear .if necessary, with-
out altering the road layout. Mr. Reesers 'secretary informed
us that Mr. Reese would like permission to cut the roads through.
The Board questioned the 2 access roads on North Bayview Road.
Sections 3 & 4 have one access road each on North Bayview Road.

The Board is of the. Opinion that Section .V should have only one
access road on North Bayview Road. The map showed no .provis'ion
for park and playground area.. The park area previously set aside
is adequate for sections hm; 1I 1IIa & IVa. but will not: ,cover section
V. The Chairman informed them that the Board would grant permission
to cut the roads through,, but would not grant preliminary approval
to the map because of the size of the lots, The Chairman labeled
the lots numbered 177 & 178 as park and playground area. , The Board
granted permission to cut Clipper Drive through from Lot # 109
southerly to Lot # 21.t and Schooner Drive from Lot # 52 ,southerly
to Lot # 30. The Board would not allow these roads to be cut
through to North Bayview Road because they do nbt approve of the
2 access roads on North Bayview Road. The road lay-out on the
southerly end may have to be changed to provide for one access
road!, centrally=; located,, on North Bayview Road. This subdivision
map will have to be sent *to the County Board of Health for their
approval or disapproval. Harbor Lights=; Section IV was granted
preliminary approval prior to January lsta,. it is now- pending
approval or disapproval by the County Board of Health.
Alfred Dart presented the Planning Board with a revised
preliminary map for minor subdivision of his property located
at east side of Main Bayview Road,, Southold, N.Y.' Mr. Dart
originally requested to set off 2 lots for his children on the
north end of his property,. immediately west of Willow Pond
Lane, The Planning Board consulted the Town Attorney on the
legality of doing this. The Town Attorney has -informed the
Board that this cannot be done,, however an application for a
minor subdivision may be submitted. Mr. Dart advised us that
he would also like to setoff the parcel which contains his
residence and buildings. The Board suggested that he apply
for minor subdivision of four .,(4), lots. Lot #t's .1 & 2 being
the 2 lots to be set off for his children., lot # 3 containing
his residence and accessory buildings, lot # 4, the remainder
of his property on which a stipulation. must be (placed stating
that this parcel may not be divided any further .in the future,
for the purpose of creating another minor subdivision.
On motion by Mr. Raynor, seconded by Mr. Wickham, it was

The Planning Board was presented with the "Engineering Report
of the Village of Greenport,,, Inc.' in reference to the proposed,
West Greenport Water Supply District". dated June 1970x. by' Holzmachera
McLendon, & Murrellr Consulting Engineers.. Melville., New, York.
The League of Women Voters presented the Board with a copy of
their recommendations concerning the proposed Wetlands Ordinance
for the Town of Southold, The Chairman stated that he has studied
these recommendations very closely and he feels that their points
are extremely well taken and well supported, and in almost every
particular. , they have almost the same thinking as the Planning
Board in 'th:eir recommendations. The Chairman informed them that
in :view .of the fact that they so closely approximate our own
thinking on the subject, they can count on our support.
The New York State Office for Local Government is holding a
regional meeting for local officials., at the Galaxie®' in Plainview,
N 'Y ',.. on August 13,z 1970. .
Notice was received from the New York Planning Federation
announcing that the annual .,planning and zoning institute will be
held at Homowack Lodge;, Spring Glen, New York,,,, October 11-14, 1970.
Letter was -received from Richard J. Cron,,., Esq. advising us
that the Village of Greenport has notified him that -they will not
set up a seperate water district in the Bayview area :for "Leeward
Acres, ' Any extension of the water supply will be at the expense
of the subdivider.
Letter received from the New York Crop Reporting Service in
answer to our inquiry regarding -the potato acreage in Southold Town.

They informed us that there are 95 . farmers in the Town of Southold
with 70718 acres of potatoes planted this year.
At the next meeting of' the Southold Town Planning'Board to be
held on Mondays, August 10,, 1970... at 8:30 P 'M �B a preliminary report
and evaluation of .Dr. Joseph Sullivan-Is Agriculture Study will be
given. . The following.persons .have been notified to be present:

Notice received from the Tri-State Transporation' Commission
announcing that John-C. Kohl has been elected chairman for the
coming year.
Received copies of letters sent to Raymond Dean,,; Supt.- of
Highways in reference to the condition of the roads in Jackson=s
Landing:. Mattituck,, N.'Y: from, W;H. Wertenberg and Daniel D. Argentieri.
Notice received from the Suffolk County Sewer Agency- advising,
us that Town Law 277-5 has been amended, as enacted by Chapter 886
of the Laws of 1970.
Notice received 'from Aetna Insurance Company advising us that
the performance bond for Harbor .Lights Estates,, Section I has expired.
Letter 'to be sent to Mr. Reese advising him of this condition and
requesting h1m to take action to correct it.'
Received copy of letter sent to Race Point Corporation by
A. Andreoli, P.E: Suffolk County Health Dept. , advising them
that the Health Dept. has conducted a preliminary study of the
sewerage collection and disposal methods at Fishers Island and
finds them unsatisfactory. They advised them that the necessary
steps be in the immediate future to correct the existing
conditions. The Planning Board discussed their action of the

last meeting by which they approved the minor subdivision of Fishers
Island Development Corps, subject to the condition that no raw sewerage
shall enter into the area. They decided that this condition was adequate
in light of the Health Dept. findings.
The Planning Board was presented with revised maps, formal
applications, and fee for minor subdivision of Jonathan-D. Stern,
property locatedaat north side Main Roads; Orient,, New York. The
map showed 5 lots as recommended by the Board at the last- meeting,
On motion by Mr. Coylee ,seconded by Mr. Raynor,, it was
RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Jonathan D.' Sterns. located
at north side Main Roads Orients New York.
Vote of: -the Board: Ayes:- Messrs: Wickham, Raynor,, Coyle.
Letter received from the Superintendent of Highways stating
that he approves of the road lay-out of the proposed subdivision
map 6f9` Laurelwood Estates" as shown on map dated July 9, 1970.
Richard Larkt Esq. and Gus Shad appeared before the Planning
Board for an informal discussion on proposed change of zone application
of Gus Shads, property located NIS Route 25, Greenport, N.Y: A lengthly
discussion was held on the zone district boundaries. The Board made
several suggestions and recommendations as -to the location of the
proposed zones. Further action was with held on the matter until
Mr. Shad finalizes the zone district boundaries.
On motion by Mr. Wickham& seconded by Mr. Raynor,, it was
RESOLVED that the minutes of the Southold Town Planning Board
dated July 13,' 1970, be approved as submitted.
