SOUTHOLD TOWN 'PLANNING BOARD
August 10s. 1970
A regular meeting of the Southold Town Planning Board was
held at 7:30 P.M ', Mondays August 10., 1970,; at the Town Offices'
Main' Road". Southold.. New York.
, There .were present: Messrs: John Wickham., Chairman; Henry
Moisas, Vice-Chairman; Henry Raynor; Frank Coyle; Alfred Grebe.
-THE CHAIRMAN: I will call the meeting to order and read the
legal notice of hearing.
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the
Town Laws public hearing will be held by .the Southold Town Planning
Board at, the Town Office._ Main Roads, Southoldz, New Yorks; tin said
Town on the loth day of August. 1970s, at 7:30 o=clock in the
evening,. of- said days, on the question of approval of the following
plat:
Plat of property owned by Joseph, A. Shi.pule & others.., entitled

An amendment was made to the above- legal description by changing
property said to be owned by Gendron'. 'to GV _ Cook. This correction
was made .upon request of Mrs, .G�V.- Cook.
The Chairman read the affidavits attesting to its.-publication
in the Long Island Traveler-Mattituck Watchman' and .the Suffolk
Weekly Times,
The Chairman inspected the file and read letter from the Supt.
of Highways approving the road lay-out.,v.' bond estimate in the amount
of $23,�000. by Lawrence Tuthill PO'E.',, recommendation to reduce bond

to $5a600 because majority of work was completed before a bond was
issued.., and contract from Corrazzinl in the amount of $5,0,600, to
complete roads. A performance bond was never posted on this sub-
division because the owner completed most of the work and presented
a passbook to the Supervisor for- the remaining work to be completed
in the amount of $5,600.
The Chairman inspected final maps showing approval of the County
Health Dept. and signature of Herbert Davids.
THE CHAIRMAN: Is there anyone present who wishes to be heard
in opposition to this subdivision?
.(There was no response. )
THE CHAIRMAN: Hearing none. I will now open this hearing to
anyone wishing to speak in favor of this subdivision.
MR.' JOSEPH A: SHIPULE: I wish to speak in .favor of this subdivision.
THE CHAIRMAN: , Mr. Shipule �has come before this Board many times
and has met all of our requirements. Is there a letter of satisfaction
from the Town Board in the file?
Upon inspecting the file further., no such letter from. the Town
Board was found.
THE CHAIRMAN: I am afraid that I will not be able to sign the
finals maps until such time as we have a letter of satisfaction from
the Town Board.
THE CHAIRMAN: Is there anyone else present who wishes to speak
in. favor of .this subdivision?
(There was no response.
THE CHAIRMAN: Hearing noner: I will declare this hearing closed
at this timei decision will be made later in the evening.
Mr. Kurt Hambschr. President of the South Fork Development
Corporation appeared before the Planning Board in- reference to
"Corey Creek. Estates",,; located at south side of Bayview Road,,
Southold,' New York. Mr. Hambsch presented the Board with recent
correspondence which he received from the Suffolk County Clerkzs
Office stating that a correction or amendment cannot be made to
this map, . This map must be abandoned and a new map must be filed.
Mr. Hambsch told the Board that he would be willing to back fill
the canal and dredge it in the proper place to make the subdivision
conform with the map as filed,: rather than to file a new map.

The Planning Board received. from the Town Board the original
,petition of .Jack Driscoll, North Oakwood Driven Laurel,; New .York
and Rene Gendron's, Golden Lane,; South Jamesport, New York, relative
to a change of zone from "A" Residential and Agricultural District
to "B" Business Districts; on certain real property, together with
the instructions to prepare an official report defining the conditions
contained therein.
This property is situated at Mattitucka, in the Town of Southold,_
County of Suffolk and State of New Yorks and more particularly
bounded and described as follows:
PARCEL I - BEGINNING at a monument on .-the westerly line of
Factory Avenue at its intersection with the northerly line of land
of the Long Island Railroad;
RUNNING THENCE South 47 degrees West- along the northerly line
of land of -said railroad 224.32 feet;

dated November 12s. 1943 and recorded August 23,, 1944 in `Liber 2383
cp 405.. and through death of Francais Haupt on June 211 1945
A lengthly discussion was held on this proposed change of. zone.
THE CHAIRmA.N: I will declare this discussion closed at this
time, the Board will make a recommendation later in the evening.
R.'G Terry? Esq. and Mrs. Valentine Ruch appeared before the
Planning Board in reference to the subdivision "Shorecrest". Mr,
Van -Tuyl presented the Board with a copy of letter from the Health
Dept, stating the Board of Review determination on this subdivisions
being that the lot sizes be increased so that the subdivision
contains atotal of 18 lots. Mr, Van Tuyl presented a revised
map showing 19 lots sad requested that it be approved subject to
being accepted by the Health Dept. The Chairman informed them that
the Board will require a letter of approval from the Health Depte
before granting final approval and signing maps.

Massimo F. Yezzie. owner and developer of Mattituck Shopping
Centers, to be located at northeast corner of Main Road ,(Route 25)
and Factory Avenues. Mattitucks:: New Yorks, appeared before the
Planning Board to request approval for alteration of site plan.
The Chairman was reluctant to grant- approval to the alteration
of this site plan w ithout :the approval of the Building Inspectors;
Howard Terry,; who was unable to attend this meeting. '
On motion by Mr. Moisa seconded by Mr. Coyle.; it was
RESOLVED that -the Southold Town Planning Board grant approval
to the site plan of Mattituck Shopping Center as altered by moving
the Post Office on Factory Avenue and eliminating the side road on
Factory Avenues, subject to the approval of ,the Building Inspector.
This motion includes authorization for the Chairman to sign
map at such time when approval is received from the Building Inspector.

Coyle.. Grebe.
William Esseks,. Esq. appeared before the Planning Board -to
request final approval of :the minor subdivision of. Fishers Island
Development- Corp. Mr. Esseks informed the Board that the. Health
Dept, has no objections of -the sale of these lots provided that
a time schedule for -corrective action is agreed to in -reference
to the sewerage disposal. The Health Dept. reported that there
are 35 houses in the area which are pumping raw sewerages 5 of
which belong to Fishers Island Development Corp. Mr. Esseks
said that anyone building commercially on the property will be
required to have cesspools. The Chairman informed him that as
stated at the last meeting this minor subdivision could be approved
subject to the requirements of the Division of Environmental
Health Services,, this statement must be written on .the final maps.
Mr. Esseks stated that he realized .that they must conform with
the Health Dept. Standards and agreed to this condition.
On motion by Mr. Grebes. seconded by Mr. Raynors, it was
RESOLVED that the South old Town Planning Board grant final
approval to the minor subdivision of Fishers Island Development
Corp. ,. subject to the condition that .the applicants conform to
all the requirements of the Health Dept:'

Andrew Cyprus,. President of Nick & Nicki Hair Stylists. Inc.
presented .the Planning Board with a preliminary plan for minor
subdivision of property located at Summit Drive &- Sound Beach
Drive,, Mattituck. The map showed 2 lots,: each containing 20,000
sq. ft. of area. The Chairman infformed Mr. Cyprus of the Health
Dept. requirement of 40,,-000 sq. ft. of area per lot. The regular
meeting was recessed at this time for special meeting scheduled
at 8:30. Mr. Cyprus was asked to appear at the next regular
meeting of the Planning Board.
R 'G: Terry,. Esq. presented the Planning Board.with a preliminary
map of proposed subdivision of Theodore Dowd., property located at
S/S Soundview Avenue and E/S Lighthouse Road, Southold,: New York.
The map showed 8 lots, all containing over 20.,000 sq, ft. of area,.
but less than 40,,.000 sq. ft. The Chairman informed him that the
Board might accept a minor subdivision of 5 lots'. but would not
accept 8 lots as presented. This matter also to be taken up at
the next meeting.
The Board discussed again the proposed change of zone from
"A" to "B" on property of Driscoll & Gendron,. located at west side
of Factory Avenue. Mattituck. The following recommendation was
passed:
On motion by Mr. Moisa,. seconded by Mr. Raynor.,. it was
RESOLVED that the Southold Town Planning Board does not
recommend to the Southold Town Board the change of zone from
"A" Residential and Agricultural District to "B" Business
District on the above described property.
It is the opinion of the Southold Town Planning Board that
the proposed density per acre is too high. '

On motion by Mr. Wickham,. seconded by Mr. Moisa,,' it was
RESOLVED that the minutes of the Southold Town Planning Board
dated Jinn 27,. 1970, be approved as submitted.
