A regular meeting of. the Southold Town Planning Board was
held at 7:30 PMec. Monday., September 26�, 1970 at -the Town--.Offices,
Main Roads. Southold., New York.
There were present: Messrs: _John Wickhami!-Chairman; Henry

the Planning Board with a preliminary map for proposed minor
subdivision . of Kodros Sypropoulos & Nick 'Theophilosa, property
located .at east- side of Kenny's Road.: Southol&I X-0Y. (J:J:r Donahue
Estate,) Preliminary map showed 5 lotsil containing from 37t!000
to 39,p 000 sq. ft.' of areaa. .a total of 4.3-84 acres' all lots
fronting on Kenny's Road with 1072 to 10.98 road frontage- on each.
This minor subdivision will require no .road.s,' as the property
fronts on Kenny's Road., A Town Highway. . The.Board advised Mr.
Baker that- final maps may be drawn up for this manor subdivision

RESOLVED- that the Southold Town Planning Board grant preliminary
approval to the proposed minor subdivision of Kodros Sypropoulos &
Nick Theophilos, property located at east side of Kennyss Road
Donahue Estate) .. Southold,, New York.

Gary Olsen,; Esq. presented the Planning Board with final
maps for propposed subdivision "Laurelwood Estates",, owned by
Martin Weglickia; located at. north side of Peconic Bay Blvd. ,,
Laurel,, NY:' The Board inspected map and found all revisions
to be as previously requested by them. The map has been
•approved by the County Health Dept., and contained the signature
of Herbert W. Davids,,, Director of the Division of Environmental
Health Services,; on date of September 25, 19700 Mr. Olsen
advised the Board that he will submit formal application and
fee upon notification of amount of bond estimate. Mr. Olsen
requested the Board to set a date for the 'final .hearing on this
subdivision. The Board agreed to set the date for final hearing
on this subdivision for the next meeting of .the Planning Board.,
and advised Mr. Olsen to submit 4 copies .of final map at- that
time.

Rensselaer G. Terry , Esq. presented the Planning' Board with
final maps for the subdivision "Shorecrest",, owned by' Valentine
Ruch*,; located at south side of North Road `(CR27) ' Greenport,,' N.�Y:
The map has been revised at the request of' the Health Dept. The
original lay-out was for 22 lots, which the Health Dept. disapproved,,
the final map now shows 18 lots. ' The subdivision has received the
approval of the Health Dept.,: and the map. contains the signature of

Herbert W. Davids,,, Director of Environmental Health Services,.' on
date of September 25,, 1970. Due to the fact that the division of
lots and road lay-out has been revised, this subdivision map must
be re-submitted to the County Highway Dept, and to the County
Planning Commission for their approval. Supt. of Highways Raymond
Dean, has inspected the revised road lay-out and will forward a
letter of approval. R 'G,' Terry requested that the public hearing
be re-convened on this subdivision upon receipt of approval of the
revised lot divisions and road lay-out from the State Highway Dept.
and the County Planning' Commission.

The Planning Board reviewed again the original petition of
Dri-Gen Realty,_ Cotp. ,. Inc.r. North Oakwood Road.. Laureli New York,
relative to a change of zone from "A" Residential and Agricultural
District to "B-211' Business District=; on certain real property,,
together with the instructions to prepare an official report
defining the conditions contained therein.
This property is situated at Greenport,, in the Town of Southoldt'
County of Suffolk,, and State of New York a and more particularly

The Planning Board discussed this proposed change of zone
at some length.
It is the opinion of the Planning Board that this will be
an improvement over -the existing condition of the property. Any
of the uses allowed in the "B-2" Business District will not harm
the character of the area, it will be an expansion of the business
area to the west and across the street on the north side of the
Main' Road.
On motion by Mr. Coyle, seconded by'Mr. Grebe,, it was
RESOLVED that the Southold Town Planning Board recommend
favorably to the Southold Town Board the .change of zone from
"A" Residential and Agricultural District to "B-2" Business
District, . on the "above described property.

The Southold Town Planning Board received from the Town
Board the original amended petition of Andrew Cassidy, Albertson
Lanes. Greenport, New York . relative to a change of zone from
"A" Residential and Agricultural District to "B-2" Business
District,. on certain real property,. together with the instruct-
ions to prepare an official report defining the conditions
contained therein.
This property is situated at Greenporte in the Town of
Southold,, County of Suffolkt, and State of New York. and more
particularly bounded and described as follows:
Bounded northerly by the Main Road running between Greenport
and Southold;- Easterly by the land and buildings of Dri-Gen Realty
Corp. ; southerly by the land of Long Island Railroad Company;
westsrly by land and buildings of Fleet Lumber' Company; Containing
an area of 4.26 acres.
The Planning Board discussed this proposed change of zone
at some length.
it is the opinion of -the Planning Board that this will be

east and it will be a continuation of the present business
district to the west and across the street on the north side

Richard Cron',, Esq, and Frank Borne appeared before the
Planning Board in reference -to proposed subdivision "Leeward
Acres' ,, located at S/S Bayview Road and EIS Jacob's Lane,,.
Bayview,,' Southold., N.Y.' Mr. Cron .presented the Board with
revised preliminary map dated Sept, 21,; 1970. The total area
of the subdivision is 57 acres. The map showed a total of
53 lots,,, all containing over 40,.000 sq. ft. of area. Mr, Cron
stated that- they-had received an estimate from the Village of
Greenport to install public water.. but the cost was so high
that they abandoned the idea and enlarged the lots to 40,.000
sq. ft, instead. Mr. Cron stated that they had trouble with
the Health Dept. , the map has been revised 2 times since the
last presentation to the Planning Board, Mr. BorneL_said that
it was his thought to have cluster zoning which the Health
Dept. said that they would cnnsider and advised him to have
, maps made for, but after the maps were made up,,, they disapproved
it. This map as presented,,, is as revised at -the request of the
_Health Dept. The Board inspected the map. Park and playground
area is approximately 3 acres*, the Chairman questioned if they
planned to -excavate the drainage pond. Mr. Borne said that it
will be excavated. The Board noted that the road lay-out is a
little different from the original plan and advised them that
a new letter of approval will have to be obtained from the Supt.
of Highways,,; and also the bond estimate will have to be revised
by Larry Tuthill. Mr. Cron requested preliminary approval of
the revised preliminary map.
On motion by Mr. Wickham„ seconded by Mr. Grebe,, it was
RESOLVED that the Southold Town Planning Board grant
preliminary approval to the revised map for proposed subdivision
to be known as "Leeward Acres" r, located at S/S North Bayview
Road and E/S Jacob's Lane,, Bayviews Southold,,. N.Y. subject to
the approval of the road lay-out by the SuperintenAent of
Highways.

Charles Digregorio presented the' Planning Board with
preliminary map for proposed minor subdivision of his property
located at N/S Leslie Road.. Peconic.., N 'Y-' The map showed 5
lots and proposed 50ft. highway. Lot # 1 contained 1754,000
sq. ft. of areas' lot # 2 - 80,000sf.,,, lot-- # 3 -- 80s,000 sf. r.
lot # 4 - 40,a,000sf. s. lot'# 5 - 80r,000sf. Mr. Digregorio
stated .that it is his intention to reside on lot # 1 himself,.
and sell the rest of the lots for building plots. The Board
informed Mr. Digregorio that they would. accept this minor
subdivision with the provision .that none of the lots can be
re-subdivided in the future. Mr. Digregorio agreed to this
condition. The Board requested Mr. Digregorio to .present
3 copies of final map: formal application..: and fee of $50.
($10. per lot) The Board will also require that Mr. Digregorio
have his name printed on the final .map.
On motion by Mr. Raynors, seconded by Mr. Coyle] it was
RESOLVED that the' Southold Town Planning Board grant
preliminary approval to the proposed minor subdivision of
Charles Digregorio., located at N/S Leslie Road,,; Peconic,
subject to the following conditions:
1. None of the lots may be re-subdivided in -the future.
2. Applicant presenting 3 copies of final map with owner,is
name printed on theme formal applications, and fee of $50.

George .Ahlers presented the Planning Board with final maps
for his proposed subdivision "Calves Neck%, located at Southoldr,
N._Y, The final maps contained the signature of Herbert W. Davids,
Director of the Division of Environmental Health Services. Mr.
Ahlers requested .that the Board set a date for the final hearing

on this subdivision. Mr. Ahlers informed the Board that the water
mains have been installed,, the drainage is in the process of being
installed,,i the monuments are being set .for the curbing.* et.c,,. and
that they will be ready to start- paving as soon as the drainage is
completed.. work on the bulkheading will start .on October lst. In
reference''to the drainage problem on the N/W 'end of Hill Road,;
which was causing a pond on Babcock's property,. Mr. Ahlers stated
.that they will either install a grating in the curb.' or' build up
the property to overcome it. . Estimate for performance bond has
been submitted by Larry Tuthill as follows: $15.00O.roads,, $270000.
bulkheading. The Town Board stated that they will accept a bond
in the amount of $15..000. for the roads., with the understanding
that the bulkheading will be completed, and will not have to be
bonded. Mr. Ahlers stated that the bulkheading will .be completed
before the hearing,; and the roads should be near completion also.
The Chairman informed him that the bond will be set at the time
of the- hearing for the amount of -the remaining work .to be completed
at that time.

Southold Town Planr 4 Board -9- ptember 26,, 1970
Mr. Arnold Larsen presented .the Planning Board with revised
map for proposed minor subdivision of Theodore Dowd,, property
located at S/S Soundview Avenue and EIS Lighthouse Road,;. Southold,;
New York. The map showed 6 lots,: instead of 5 as originally
presented. The Chairman read the minutes of the last meeting
pertaining to this matter. The Chairman stated that he felt
that the Board should accept 6 lots in view of the fact that
this is about the best lay-out that can be drawn up because
of the excessive road frontage. The 'Board informed Mr. Larsen
that final action will be taken on the matter later in the
evening.
On motion by Mr. Moisa, seconded by Mr. Wickham,,,. it was
RESOLVED that the Southold Town Planning Board table the
above matter., for further deliberation of the Board,,. until
later in the evening.

Mr. Otto Uhl, Jr. ,. President of Cove Beach Estates,. Inc. ,,
presented -the Planning Board with revised map for proposed
minor subdivision of Cove Beach Estates,, Inc., property located
at north side of Main Roads' East" Marion,, New York. The' map was
revised as requested by the Board at the last meetings, the ad-
jacent property was labeled as tennants in common and listed
the names of the owners. Mr. Uhl presented the Board with
formal application, fee,, and letter ofintent agreeing not to
request another minor subdivision on ac6jagent properties in
which the principles of Cove Beach Estates have in interest.
Vice Chairman Moisa read the letter of intent to the Board:. ,
The Board stated that they would approve this minor subdivision
as of the day that this tenancy in common becomes effective.
The Board requested Mr. Uhl to notify them of the dissolution
of the corporation. The Chairman signed the maps and recorded
the following statement on each: Approval to become effective
on the day and as of the time that the tenancy in common is
established.
On motion by Mr. Wickham,, seconded by Mr. Raynor,: it was
RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Cove Beach Estates, Inc.,;
property located at north side of Main Roadn; East Marion,; New
York,subject to applicants notifying the Board of the dissolution
of the corporation. This approval not to become effective until
the day -that the tenancy in common ; legally established.

Mr. Rudolph Melk- a/c Southold Associates presented the Planning
Board with a preliminary site plan for proposed shopping center to
be known as "Bohack Village",,; to be located at N/S Main''Roadi` across
from Frank Murphy Garden Center., Mattituckt, New York, The Bohack
store will contain 20,,.000,sq. ft. of sales areas; and there will be
several small satellite stores with a total of 5.a,000sq, ft, of sales
area, The plan -showed 411 parking stalls., the minimum requirement
for the area would be 250. All drainage will be taken care of on
the premises by means of 2 ring pools.,,; there will be one (1) leach-
ing pool for each 5,,000sq, ft, of roof area. The minimum setback
from the Main Road at any point is 294 feet. the Board was agree-
able to granting preliminary approval to the lay-out of this site
plan. The Board advised Mr. Melk that .he will now have to present
the plan to the Labor Dept. ,,, the Health Dept.:,,, and the State High-
way Dept, for their approval.'

RESOLVED that the Southold Town Planning Board grant
preliminary approval to the lay-out of the site plan for
proposed shopping center to be known as "Bohack Village"..,
located at north side of Main Roadi' Mattituckt; New York.

David Horton & Robert Horton presented the Planning Board
with preliminary map of heir proposed subdivision to be known
as "Peconic Homes'?"'rtXAec�.- at south side of Main Roads: Mattituck$
New York. The map showed 8 lots', all containing at least 40t,000
sq. ft, of area,, and proposed 50 ft. road with 100ft. turn-around
at southerly end. Howard Terry informed -the Board ghat the Supt.
of Highways has inspected the map and will send a letter of
approval on it. David Horton requested that the Board grant
preliminary approval to the lay-out of this subdivision as
presented. The Board advised Mr. Horton that the next step is
to contact the State Highway Dept.., in reference to the grader
and the curb & gutter requirements at the entrance on the Main
Road,,, before they cut the road through*

Mr. Henry Raynor registered his opposition to the approval of
this minor subdivision.'
The Planning Board reviewed again,,, the request of Harry &
Margaret Guest for a minor subdivision of their property,,, Socated
at North Hill.. Fishers Island, New York. The Board disapproved
of a minor subdivision on thisproperty because it contains an
area of 15 acres, The Board authorized a letter to be sent to
. Phillip B. Matthews, Attorney a/c Harry & Margaret Guest.
notifying them of this Boards disapproval and suggesting that
they file for a major subdivision with provisions for adequate
highways to meet the existing Town Highway.

RESOLVED that the- Southold Town Planning Board disapproves
of the minor subdivision plan of Harry & Margaret Guest.; North
Hill.; Fishers Island.., New York.
This motion includes authorization .for a letter to be sent
advising the applicants of the Board's disapproval and advising
that they file for a major subdivision w ith .provisions for
adequate highways to meet the existing Town Highway.

Howard Terry informed the Planning Board of-.the inquiry
made by Doris Moeller in reference to her minor subdivision,
located at east side of Little Neck Roadr� Cutchoguea; New. York.
The final map as approved showed a 50 ft. road "res'erved for
possible future dedication for- Town Highway purposes" on the
adjacent minor subdivision of property of Wm. Beebe & others,
which adjoins her property on the south. Mrs. Moeller planned
to use this road as access for the S/E lot in her subdivision.
WM. Beebe informed her that he deeded this area as part of the
lot which he sold to J.W. Smith out of his miihor subdivision.
The Chairman suggested that the Board send a letter to Wm.
Beebe stating that it appears that this piece of property has
been sold contrary to the minor subdivision map which he filed.
A copy of this letter to be sent to J:W.' Smith.
A letter was received .from William Wickham in reference to
the approved minor subdivision of Richard Babcock, located at
Calves Neck Road,' Southold,, N:Y.' Mr. Wickham advised the Board
that a re-survey of �the property has revealed that the barn was
not located properly in the first survey and as a consequence
the lower lines of lot number 2 had to be revised to a small
extent. : Mr.; Wickham returned the original map as signed by
the' Chairmanr' and sent 2 copies of the corrected maps to be
signed,' one for our file,, and one to. be returned to him.

RESOLVED that the Southold Town' Planning Board authorize
Chairman John Wickham' to sign revised approved minor subdivision
map of Richard Babcock,, with corrected survey as amended
September 8r 1970.

The Planning Board was presented with three .(3) copies of
final map for proposed minor subdivision of the Samuel E. Darby
Estates located at SIN end of Vanston' Road, Nassau Point,- Cutchoguea,
NY The final map showed property divided into 3 lots and right-
of-way has re-located as requested by the Board at the September
1... .1970 meeting.

Received xequest from Harry Schroeder demanding a copy of
the wetlands ordinance and a copy of the Master Plan. Letter
was sent to Mr. Schroeder advising him that neither the wetlands
ordinance or the Master Plan has been adopted.
Howard Terry presented the Planning Board with corrected
pages to insert into their copies of the proposed amendments
to the Zoning Ordinances.' received from the Town Attorney.
_ Letter received from Jean Schneider in reference to preserving
farm land. Said letter placed on file to be answered by the Chairman..
The. Planning Board discussed the procedure of presentation
to be followed at the "Information Meeting on Master Plan" to be
Y}eld on October 2 ' 1970a, at the Southold High School, The Chairman
suggested that all members bxing their Book 11 of the Raymond&
May Master Plan Study. The' Chairman will present the opening
statement defending Dr. Sullivants Agriculture Report.: and then
call on each of the Board members to read a section from Book II.
One of the Board members presented an interesting question which
he felt will be asked by many people at the meeting: How many
residential lots are there available to be built uponi in the Town
of Southold=; and how many people will they serve in reference to
the projected population? This is a very difficult question to
answer precisely. The Chairman stated that- there are- about 400
to 500 vacant 1-2acre subdivision lots in the .Town of Southold.; but
there are several % acre subdivisions.:and 1 acre subdivisions in
the process of requesting approval. The Chairman was of the
opinion that we have enough residential area to double our present
population.
