A regular meeting,of-the Southold.Town-Planning.Board was
held .7:30 :P.M., Monday, January 11, .1960 -at..the Town Clerk- Office,
Main Road, Southold, New-'York.
There Were present: Messrs. JohnWickham, Chairman, Henry
. Moisa,, Alfred Grebe, Archibald Young, and- William Unkelbach.
,Also.,present: Messrs. Howard M. Terry, Building.Inspector,
Otto- W. Van .Tuyl, Consultant, and -Harold.Price, Highway- Superin-
tendent.
Mr...Joseph Deerkoski, North Road, Mattituck, New_ York,
appeared .before. the Planning .Board requesting-preliminary
. approval-of.:his,map dated December 29, 1959, initialed. by, Otto
,W. pan Tiyl. This map .covers.-his property on the south.side of
..Westphalia Road, Mattituck, New York, bounded north. by_Westphalia
Road, east-by--land now or formerly.,of Edith Young, south_.by Gilles,
and west.:by, C.. R. •Bennett. The property contains approximately
,,.11.18-acres and 19. 1ots are proposed, each containing, about. 20,000
- sq. .ft. . The proposed .roads as. shown on the map are to be, 50.,ft. Mr.
Deerkoski-requests permission to cut trees ,and-push out..the stumps
as-soon as,:the weather permits :in order that he.may start.on the
roads. Mr. Price advised .that_ it will -only.be necessary, to clear
30 ,ft.. in..the center-of-the road and leave a tree-line-on-. the

sides-where the light and telephone poles.will. go. so- that the
development--will look attractive.
- On •motion of Mr..Unkelbach, :seconded by, Mr..Moisa and carried, '
it was
RESOLVED that Mr. Joseph Deerkoski.be granted tentative per
mission to-cut trees -and clear.-'roads on his. land on the south side
of -Westphalia. Road, ,Mattituck, .New York, as .shown on-.tentative plan
for Joseph 'Deerkoski, Mattituck, New York, dated December 29, 1959
and initialed by Otto Van.Tuy1., This permission is granted subject
to:Mr. Deerkoskizs filing .a map in: the Suffolk County_Clerk;s office
in.-accordance--with the Rules :and Regulations . for the Subdivision of
Land for the Town of .Southold, revised August 26, -1959.
It-was further RESOLVED that a letter be forwarded .to Mr.
Deerkoski confirming,;the Board's action.

Mr.- Walter C., Grabie, Mattituck, New York, telephoned:at-the
-start .of the meeting and spoke-with Mr.: Terry; and Mr., Young.., Mr.
Terry, and Mr. Young.reported that Mr., Grabie had advised, with
respect.-to .his application for an-Open Development-Area.-at-Luptonts
-Point, that :he had only obtained one more signature on. his:petition
from .the. property owners ;at Lupton's Point. requesting that the 20 ft.,
road remain private and in its present size. $e had contacted .the
remaining three individuals. from whom he:had..not received .signatures,
but had .only, heard. from one of. them. Mro. Terry stated that 'Mr.
' Grabie has-a prospect -.to.buy lot No., 20 and the buyer is anxious
. to. start. building.by, the end of February. -At present a building
_permit cannot be' issued until the lot4f owreceives recognition. of
_access,:fromthe Board of Appeals and also a variance on the lots
-because the frontage on the private road .is.:only 75 fto rather than
the 100 ft.. minimum frontage required under-the Building Zone
Ordinance.
On motion of Mr. Moisa, .,seconded by. Mr. Grebe and carried, it

RESOLVED that a letter be .fo'rwarded to the Southold Town. Board
.of Appeals.:recommeuding,that. they grant.variances .on .lots .owned by
. Walter'C., Grabie on-the south -side of private right-of-way., at Luptonis
Point, Mattituck, New Yorl, and numbered 20, 21,- 22, 23 and 24 on map
. of property surveyed for Edmund R.s Lupton situate at -Mattituck, New
York, .surveyed by Otto W® Van Tuyl & :Ron on March 24, 1952.. The date
this: Layout-was originally planned was April 1, 1952 as.:indicated on
the aforementioned map.

The Planning.Board.makes_this;recommendation in view of the
fact, although .these are.only, 75 .ft.- lots -on the rightGofway,
they, are ,100 ft.-on :the.water and contain more :than- the minimum
:area. required.under.:the ,Southold Town Build ing ,'Zone Ordinance,.) Any
-, attempt.-to- change -the right-of way at -this ;time- would. result -iu
excessive• hardship,:to- Mr. -Grabie.

approval.of subdivision applications :and,the steps.,that. ,could.be
taken:to speed up_-their, approval. ,

Mr.- Moisa, seconded..by.;'Mr. ,Young., -and carried, were approved; as-
submitted.

lots. l.through .22 and:,continuing the road north -from -that point but
tapering.it: to.. 35 ft.,•when it-reaches .,lo4s :2,7 and_30.; -There are
33 lots,:in .all; running .from the.Main Road north to!,the ,property- of
Hellman on. the east -side, of:the private.-road,--and,the private road:=off

The Planning,Board has studied .this problem carefully.'and .has
assents from ,all..concerned .except Mr. Dominick-Pardo and Cecilia
Aycardie Mrs,- Pardols property is ..minor .and has..no.road :frontage.
,. The Aycardi property. fronts �on Naugles.Drive.
,We further suggest-that --the Town'Board adver-tise this whole
parcel. in the interest of saving.time; . and that the.-decision as to
whether:-or not-to,include the Pardo and-Aycardi property-,be held
.until the time of the hearing.. . This.:matter is :urgent and should
be heard as.:soon as possible as-it is :delaying-;the use and

development of the property in question.
. As .stated previously, the Planning Board is -of -the opinion
that. by Zoning.these properties.:"C" Industrial would be the best
, use of this_. land with -the future development .of the area in mind.

:The petition of Wilson Tuthill, Cutchogue, New York, for
tentative approval of a subdivision plat -in accordance with Article
.16 of-the Town Law:and the Rules .�and.Regulations of the'Southo-ld
Town'Planning, Board, was.. received. . Mr. Tuthill has a parcel of
land on the west side of Little Neck 4oad, Cutchogue, New. -York
containing., 21.5 -acres, 5z -of"which are meadow land® At present
-Mr... Tuthill wishes .tentative approval -of the proposed subdivision
suryeyed .by. Otto-We Van Tuyl &:S.on on December 24, 1956, map.of
Wilson Tuthill atLittle Neck, dated- September 1, 1959 -and- December
22, 1959, so that he may go ahead and cut. through -.the. roads .named
Wilson. Road and Emory Court.

RESOLVED—that-tentative approval be granted Mr.,,Wilson Tuthill,
to clear roads '-on his property on the west side of Little Neck'Road,
Cutchogue, New York, ,tentative.map by Otto W.,.Van Tuyl &.:Son dated
September I., 1959 and December 22., 1959,); . This permission is.. granted
- subject:-to..Mr.:Tuthill's filing .a.map- in. the Suffolk County.-Clerk's
Office .in accordance with .the Rules -.and-Regulations :forthe Sub-
division of Land for 'the Town of Southold, revised August' 26, 1959.

The Board discussed the matter of a proposed amendment -to..the
Southold Town'Building Zone Ordinance under Article V. Section 503
.which'reads as-follows:
. IC" INDUSTRIAL DISTRICT: ' Section 503-"C" FRONT -YARD in the" "C" Industrial District, the required front-yard
shall be at:least -thirty_ (30) feet, provided -further
that:where property, is .bounded on any side. by a railroad"
right-of-way, or on a rear-line by a-railroad right-of-
way, there shall be a setback along,the entire length
of such railroad right-of-way or private right-of-way
of at least`thirty. (30) feet."

.It-is :the feeling of -the Board .that this -requirement-causes
a hardship on adjacent property,-ownerse— One property under discussion
was ;that of Goldsmith and Tuthill which is:located..directly.-opposite
the Southold passenger depot. :This :30 ft. requirement has,.:partic-
ularly -caused.them a hardship.
On motion proposed by the Chairman, moved by,-Mr. Young, seconded
by, Mr* Moisa and. carried, it was
RESOLVED that the Planning,Board forward .a letter -to the Chief
-Engineer, Long .Island Railroad, Jamaica Station, New- York, asking
:for his ;comments, suggestions and recommendations in:'this matter
of maintaining building setbacks.;from railroad right-of-ways.

Mr. Young, and Mr. Unkelbach. .
The Planning .Board .briefly-discussed the future development of
. . the intersection of Middle Road; Sound Avenue and Cox Neck Road,
Mattituck, New York.,
.The next meeting of.-the Southold Town Planning.:Board will. be
held 7:30 P.M., Monday, February 1, 1960 at :the Town`Clerk"Office,
Main-.Road,: Southold, New York..
. It was 'suggested that notification be sent to Robert-W..Tasker,
Esq.., Town Attorney., inviting him to. attend the next meeting .of. the
Planning:Board.
On.motion•of Mr..: Grebe, seconded by Mr., Moisa and unanimously
, carried, it-was
RESOLVED that:the Planning .Board recommend to• the -Town'Board
that-Mr. Otto-We Van Tuyl be appointed as.:Consultant to, the Southold
Town Planning Board effective January 1, 1960.
Vote, of_ the Board: Ayes Mr.. Wickham, Mr,.: Moisa, Mr.. Grebe,
Mr.:Young, and Mr.. Unk6lbach.
: The Planning- Board discussed the matter ,of personal liability
insurance. Mr. Unkelbach .brough out several points which-were
discussed at -the Zoning .Convention held in' December.
-On emotion of Mr.. Grebe, seconded by Mr. Moisa:and carried, it
was
:RESOLVED .that a letter be forwarded .to. the Southold Town Board
requesting„them to look -into personal. liability, insurance coverage
for those. employees of the Town of Southold concerned with Zoning
and Planning.
