A regular meeting .of the Southold Town Planning Board
was held 7:30 P.M. , Tuesday, October 4,,. 1960., at the Town
Clerk Office, Main Road,. Southold New York..
• There were presents Messrs_ John Wickham, . Chairman,
Henry Moisa, Alfred GrebeR Archibald Young, and William
Unkelbach.
Also presents Mr_ Otto W, Van Tuyl„ Consultant.
Mr. James A. Hewlett, representing Mr- Walter'Uhl of
Woodhollow Properties, Inc...,, 3 Glen Laney Glenwood Landing,
New York, appeared before the Planning Board to discuss the
acceptance of the roads in Section 1 of orient-By-The-Sea.
On September 14 Mr.. Uhl corresponded with the Chairman
requesting that an inspection be made of the completed roads
and sections of roads within Section 1, Orient-By-The-Sea',
Orient Point since they are now ready to dedicate the roads
to the Town of Southold. However, before preparing the nec-
essary instrument they wished to know whether or not the Town

would accept such dedication. The roads named werezPlum Lane,
Parkview Lane,: Three Waters Lane and Soundview Road..
Upon receipt of the abovementioned letter a copy was forwarded
to the Superintendent of Highways, Harold Price, referring the
matter to him. His reply, dated September 28,E 1960... was that the
Town of Southold will not accept roads as Town highways on water
front property which do not terminate at the water. Upon inspection
of the. roads, after the last rain, he found that all bains were
full and running over and the Town is not satisfied with the basins
taking care of the roads adequately.
Mr.. Uhl sent a reply to Mr.. Pricexs letter on .September 30th
to the Planning Board Chairman stating that he does not understand
.one paragraph. He was of the opinion the matter of a road terminating
at .the water would be resolved upon the filing of Section 2- Of
Orient--By-The-Sea which would provide for a road terminating at
the water and such a preliminary plat was approved by the Planning
Board on August 22* 1960. On the matter of the road basins over-
flowingr .Mr. Uhl recalled that there had been unusually severe rain
storms with 4 inches of rain within 24 hours. However a few days
later he inspected the drains and found they were draining satis-
factorily and also there had been no washouts or road repairs
necessary.
Mr, Van'Tuyl stated that he had spoken with Harold Price and
Mr. Price had advised that the construction of the roads in Section
1 were very good .and if they followed that in Section 2 it will be
very good. However, he did not think the drainage would be adequate.
There are two basins, one at each side of the entrance road to
Orient-by--The--Sea which were supposed to take care of the flow
so that it will not go on to the State road. Mr. Price indicated
to Mr. . Van Tuyl that 'if he had some wind of statement from the
State Department of Public Works that they will be satisfied with .
the drains he will be willing to accept them. However,# the Chair-
man stated he is not sure that the Town will accept dedication of
the roads in Section 1 without an iron-clad agreement about the
roads in Section 2.
it is the opinion of the Planning Board that Mr. Uhl has three
alternatives which are as followsz (1. ) Give a performance bond for
that section of road to the beach which lies in Section 2. (This
would have to have the approval of the Town Attorney. ) 2x(2.) Either
this fall or next spring construct that section of Soundview Avenue

in Section 2 which runs to the Sound and dedicate that part to
the Town. (3. ) File the map of Section 2 and at that time take
out a performance bond on some of the highways. (That will also
require approval of the Town Attorney, )
The Board forwarded a letter to Mr. Uhl confirming the
proceedings of the meeting and citing the three alternatives.
It was suggested that Mr. Uhl consider these alternatives and
indicate which looks most realistic to him at this time and if
he will let the Planning Board know his decision we will be glad
to pursue it further with Mr. Price and the Town Attorney who in
the last analysis have to passon all dedications. It was stated
to Mr. Uhl that there is nothing fixed about the Planning Boardl*s
ideas on the matter and it is .entirely possible there may be some
other combination or method by thich the Town Board can be assured
that access to the water would be guaranteed.
Mr.. Hewlett next discussed with' the Planning Board the matter
of the Edwin H. King property at Orient Point_ Mr- Hewlett had
forwarded a letter to the Planning Board dated September 30, 1960
requesting a brief statement in regard to the reasons for the
Boards disapproval of the layout and asking if a different layout
might be acceptable or commercial zoning is possible,. Mr. Hewlett
said there were several thoughts for the use of the property, such
as a motel site, or property for houses, or dredging a safe canal
for the use of the property owners at Orient Hy9The--Sea.
Mr. Hewlett was advised by the Board that after an investiga-
tion by the Planning Board''s team it was felt this is a piece of
: property which, if someone wants to develops either the federal
government or State Park Commission will immediately step in and
say it cannot be done. it certainly is not a choice residential.
location. It was suggested that Mr. Hewlett get in touch with the
federal government and State Park .Commission before making any
further plans.
The Planning Board received the original petition of William
A. Davis from the. Town Board instructing the Planning Board to
prepare 'an official report defining the conditions described in
the petition and determine the area so effected with ,the recommen-
dat2on of the Board. Mr. Davis requests a change of zone from "A"
Residential and Agricultural District to "M" Multiple Residence
District on the following described propertys Located at the
southwest corner of Fourth Street and Main Street, New Suffolk,.

New Yorks Beginning at the northeasterly corner of land of the
applicant ,an the southerly line of Main Street and westerly line .
of Fourth Street* and running thence along the westerly .line of
Fourth Street. S.5o00'W- 151. 97 feet to the northeasterly corner
of land now or formerly of Ackery thence N. 8504213011W. 100_0
feet to the southeasterly corner of land now or formerly of
Roaches thence N.50001E. 152.03 g feet to the southerly line of
Main Streety thence S.85040130"E.. 100..0 feet along the southerly
line of Main Street to the-point or place of beginning,
As his reason for requesting this change of zone Mr. Davis
states that the property is already in use as a boarding house
with a two family cottage. He would like to -change the property
as follows: leave the two family cottage as is, Oet .rid of
restaurant type kitchen and dining room. Put in new bathrooms
and kitchenette units to make efficiency apartments with quarters
for my own familLy. The third floor is to be closed off at this
time which has been used as a dormitory. They feel it is a are
hazard and should not be used until fire escape or some other
arrangements can be made.
Mr. Young and Mr. Unkelbach .volunteered to investigate the
.property and make a report at the next meeting,
The Planning Board received an Information Bulletin from
the Conservation Department and State Council of Parks of the
State of New York relative to the $75, 000,,000 Park and Recreation
Land Acquisition Bond Act. .This bulletin was ordered filed.
The Planning Board received a letter from the Town of
Riverhead Planning Board transmitting a copy of a resolution
passed by. them relative to the proposed Long Island Expressway
Extension.,
M,r. Walter Luce., Cutchoguex. New Yorkx appeared before the
Planning Board and presented a map of property he desires to
develop on Bay Avenuef, Cutchogue. The area he is irderested in
developing at the present time is outlined in red and dated
October 4A 1960 on map by Otto W. Van Tuyl & Son- There will
be a total of 9 lots, two fronting on Bay Avenue. Each lot will
contain in excess of ,20R 000 sq. ft. and a 50 ft* . road, to be
known as "Alden Lane" will connect with the Town concrete road
of Bay Avenue. 'This 50 ft. road .already has two coats of oil
and Mr. Luce advised he intends to develop it further and dedicate
it to the Town..

After further discussion,, on motion of Mr, Moisa, seconded
by Mr. Grebe*. and carried, it was
RESOLVED that the Planning Board give Walter Luce preliminary
approval of his plan containing nine lots located on the east side
of Bay_Avenue, . Cutchogue,t New York. Area marked in red on map
dated October 4,, 1960 by Otto W. Van Tuyl & Son,.

the Planning Board received a letter. from the Town Clerk
transmitting the original petition of the Jr, Order United
American Mechanics-& Mattituck Council 34, Mattituck, New Yorkt
and instructing the Planning Board to prepare an official report
defining the conditions described in the petition .and determine
the area- so affected with the recommendation of the Board. This
petition requests a change of zone from "A" Residential and Agri-
District to "B" Business District on certain real property
situated at Mattituck, New York, and more particularly bounded and
described as follows:
Parcel I. Northerly by the highway, eatterly by the burying
,grounds southerly by land formerly owned by the Fi.rst.Methodist
Episcopal Church of Mattituck, westerly by land now or formerly
owned by Mrs_ Martha Hazard being fifty feet more or less in front
and rear and 75 feet deeps and being the same premises conveyed
to The First Methodist Episcopal Church of Mattituck by deed
recorded:'.-in the Office of the Clerk of Suffolk County in Liber 78
of deeds page 330 and also in Liber 456 of deeds at page 393,
Parcel- ll, Northerly by land formerly owned by the First
Methodist Episcopal Church of Mattituck 54 feet, easterly by the
Mattituck Free Cemetery grounds 55 feet, southerly by the Mattituck
Free Cemetery Grounds 54 feet, and westerly by the roadway leading
into the cemetery grounds 55 feet, being the same premises conveyed
to the First Methodist Episcopal Church of Mattituck by deed dated

The reason this change of zcne from "A" Residential and
Agricultural District to "B" Business District is requested
is to use the premises as a summer theatre.
After further discussion, on motion of Mr- Grebe,
seconded by Mr. Young, and carried; it was

to the Southold Town Board that this change of zonef rom "A"

The Planning Board believes that the cultural value of such
a project would be of considerable value to the Town of Southold&
and although there is not adequate parking, at the same tame we
feel the streets are wider than normal and they accomodate the
members of the two churches without difficulty.

The Planning Board received a letter from the Town Clerk
transmitting the original petition ofFRank Pumillo& Cutchogue&
New York, asking for a change of zonefrom _"A" Residential and
Agricultural District to "B" Business District on certain real
property situated at Mattituck, New York,. and more particularly
bounded and described as follows:
Beginning on the boundary line dividing said Premises and
land of Skuro 200 feet southerly from the monument on the south,
erly side of Main Road marking the boundary line between said
landsy running thence southerly along said land of Skuro 'and
along land now or formerly of Abitz 242.32 feet to .a.monument
and land of Shewell_;, running thence in an easterly-direction
along said land of Shewell 266.3 feet to a monumnt and land
of Biliunasy running thence in a northerly direction along said
land of Shewell 75. 0 feet to a munument and land of Jacksony

zn ,his petition Mr. Pumillo stated that the southerly
part of his property which he is asking zoned "A" is an irregularly
shaped parcel with which he can do nothing under an "A" Residential
Zone. It is impossible to subdivide or put one residence ;on due to
the northerly part being zoned "B" and since it has no frontage on
any roadway. If permission is granted to rezone to "B" Busin.ess it.
is his intention to erect an attractive motel which will not only
improve the location but be a needed asset to the village.
After a thorough .discussion, on motion of Mr. Moisay seconded
by Mr. Unkelbach, and carried, it was
RESOLVED, that the Planning Hoard does not recommend the
change of ,zone from "A" Residential and Agricultural District
to "B" Business District as shown on map of property made for
Frank Pumillo at Mattituck, New York, compiled from several
surveys July 28, 1959 by 'Otto W. Van Tuyl & Son_
The Planning Board does not believe it is in the best
interest of the Town pf Southold to have a motel in connection
with a bar and grill. In addition., this would be out of
character with the existing immediate adjacent residential
area,

Grebe, Mr, Young., and Mr. Unkelbach.
Each member of the Planning Board received a copy of minutes
submitted by Howard Terry„ Building-lnspector* of the meeting of
all highway superintendents, supervisors, town planning boards.#
Mr. H- L. Bishop,, Commissioner# D.P.W. and all members of County
Planning Board on August 22* 1960 at the County Centers Riverhead_
The purpose of the abovementioned meeting was called by
County Executive H_ Lee Dennison to consider highway matters.
The minutes of the meeting .of September 6*, 1960,. on motion
of Mr. Grebes sea)nded by Mr. Young.. and carriedg were approved
as submitted,

Mr. Terry referred to the Planning Board, for their
perusal- a copy of the "Detailed Proposal for the Preparation
of a Comprehensive Plan for the Town of Southold, " prepared by
Edwin S. Voorhis & Son, Inc., Consulting Engineers and City
Planners.,, 243 Main Street, Huntington., dated September 19,r 1960.
Mr. Van Tuyl presented to the Planning Board the preliminary
plat ofFordham Acres which receivedpreliminary approval on
September 6* 1960. 'He stated that Mr. Raynor who owns the
property south of Fordham Acres would like to extend Gull Pond
Lane into his property to jointhe road to the south known as
Anglers Road which extends to Manhanset Avenue to the south. Mr_
Raynor intends in the future to develop his property into lots_
The question posed by Mr. Preston is whether the Planning
Board will require the 1.00 ft. to the water to be dedicated to
the. Town as it is shown on the preliminary plan of Fordhaim.Acres
if that loop road is established. The Planning Board expressed
the opinion that they would not insist that they have the road
there- It was stressed howevere that Mr. Van Tuyl advise Mr.
Preston that the Planning Board is going to insist that the roads
be dedicated to the Town of Southold and advise that it be taken
up with the Town Board, but feel it would not be necessary for
the Planning Board's approval of the subdivid.on as such.
The next meeting of the Southold Town Planning Board will
be held 7:30 P.M. .. Tuesday, November I-r. 1960, at the Town Clerk
Office, Main Road,,, Southold, New York.
