SOUTHOLD TOWN PLANNING BOARD
December 6, 1960
A regular meeting of the Southold Town: Planning Board was
held 7:30 P.M. , Tuesday, December 6t 1960 at the Town Clerk
Office,. Main Road, - Southold, New York.
There were present: Messrs. John:_Wickham, Chairman,
Alfred Grebe, Henry Moisa, Archibald Young, and William
Unkelbach.
- Also present: Mr.OTto W. Van TuyleConsultant.
The minutes of the meeting of November 1, 1960, on motion
of -Mr. Moisa, seconded by Mr. Young, and carried, were approved
as corrected. The Board wished it to be noted in. the minutes
that some of the members had visited the Victoria property at
Bayview.
Vote of the Board: Ayes:- Mr., Wickham, Mr. Grebe, Mr.
Moisa, Mr. Young, and Mr. Unkelbach.
The Planning Board received application for Tentative
approval of-Subdivision plat to be known as Hickory -Acres
Southold Town Planning Board -2- December 6, 1960
(Section One) , East -Cutchogue, New York, containing 5.76 acres.
The applicant who is Flora S. Luce, and George L. Penny, III,
state that the cost of grading and required public improvements
will be $990. 00 and that they request a 'Performance Bond be waived
for the reason that all of said improvements have been completed
and paid for by applicant. The description of the entire land
under application is as follows: Premises at East Cutchogue,
Town of Southold, County of Suffolk and State of New York, bounded
and described as follows: BEGINNING at a monument on the. easterly
line of Bay- Avenue at the northwesterly corner of -land of Alden
and the southwesterly corner of land of the applicant; running
thence along the easterly line of Bay -Avenue north 12 degrees 35 '
50" east 300 feet to a monument; thence along land of �Stoutenburgh
north .-SO degrees 12 ' 50" east 566.38 feet to a monument; thence
along other land of the applicant three courses, as follows: (1)
south .17 degrees 58 ' 40" east 151.55 feet; thence (2) north 80
degrees 12 ' 50" east 52.61 feet; thence (3) south 26 degrees 46'
10" east 318.77 feet to the northerly line of-Pine Tree Road;
thence along the northerly line of -Pine Tree Road south 63
degrees 13 ' 50" west. 50 feet; thence along other land of the
applicat three courses, as follows: (1) north 26 degrees 46 '
10" west 150 feet; thence (2) south 63 degrees 13 ' 50" west
110 feet; thence (3) south 77 degrees 16 ' 10" west 309. 23 feet
to a monument at the northeasterly corner of land of Bourguignon;
thence along land of Bourguignon and land of:Alden north 84 degrees
oil 10" west 355.65 feet to the point of beginning. Containing
5.76 dcres, more or less. Three Preliminary Maps of Hickory
Acres (Section One) t at East Cutchogue, by -Otto W. Van Tuyl & Son,
dated November 4, 1960, were received.
Hickory Acres ( Section One) contains nine lots, all having
over 20, 000 sq. ft. The roads, Lupen,Drive and Billard Road,
run; . from Bay Avenue to Pine Tree Road and have already been
constructed according to the specifications of the Highway Depart-
ment.
On motion of Mr. Unkelbach, seconded by Mr. Moisat and
carried, it was
RESOLVED that the Planning Board grant Flora -S. Luce and
George L. Penny, III, Tentative approval of their Preliminary
Map of Hickory Acres ( Section One ) at East Cutchogue, New
York. Surveyed November 4, 1960 by Otto W. Van Tuyl & Son.

Itwas FURTHER RESOLVED that the Planning Board confirm
this action by letter to Flora Luce and ano. and advise that
she may now instruct her engineer or xurveyor to proceed with
computing the map, preparing the finished map, submit her cloth
prints to the Health Department for approval, and proceed with
other matters necessary prior to submitting them to the Planning
Board for final approval. These prints must be submitted at
. least 15 days prior to a. regular- meeting of the Board.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Grebe, Mr, Young, and Mr. Unkelbach.
The Planning Board discussed the denial by the Town Board
of the petition for a change of zone of*Alec in Cutchogue, and
the granting of the change of zone of Pumillo in Mattituck. The
Planning Board, on motion of 'Mr. Moisa, seconded by Mr. Young,. and
carried,
RESOLVED that a letter should be forwarded to the Town Board
stating that in view of these facts that the two cases had been
decided in opposition to what are very clearly in the best interest
of the Town of Southold, the Planning Board feels there must be
some extenuating circumstances and it would seem to the Planning
Board that it is rather important that they be made aware of what
the circumstances are so that in the future they m ay enter into
the Planning Board' s considerations. Further, the Board would
like to have the opportunity of meeting with the Town Board and
discussing these and other matters at their convenience after the
first of the year.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa,. Mr.
Grebe, :Mr. ,Young, and Mr. Unkelbach.
The Board received notification from the Town Board that
the petition of 'William Vic toria for a change of zone from "A"
Residential and Agricultural District to "M" Multiple Residence
District was denied.
The Board received notification from the Town Board that
the petition of the Jur. Order United American Mechanic, Mattituck,
. Council *34 for a change of zone from "A" Residential and Agri-
cultural District .to "B" Business District was granted effective
as of November 26, 1960.

The Planning Board members received a copy of the booklet
entitled "Suffolk -County, a .growing county,, in a growing market,
a good place to work and play., " published by the Suffolk County
Planning Commission.
Mr. Van Tuyl presented- to the Planning Board, for discussion,
the final map of Hilton Heights 'at North Parrish, Bayview,
Southold, New York. All of the lots in this subdivision are
over 12,500 sq. ft. Since the roads have not been constructed
Mr., Van Tuyl 'was advised that Mr. Epp would have to present to
the Town Board a Performance Bond sufficient to cover the full
cost of improvements estimated by the Planning Board and approved
by the Town Superintendent of Highways. Mr. Van Tuyl stated that
he would take this matter up further with Mr. Epp prior to filing
for final approval. ,
Mr. Van Tuyl brought up the matter of Section 2, Orient-By-
The-Sea. Mr. Uhl would like to construct that section of Soundview
Avenue in Section 2 which runs to the Sound and dedicate that part
to the Town. However, according to the Real Property Law and the
Subdivision- Law, when a map is filed all streets should be monumented
with two monuments at each corner. The Planning Board felt that
- that would not be practical on undeveloped land that Mr. Uhl intends
to rent as farm land, until such time as he is ready. to develop.
They suggested that he divide Section two if he wants to d-evelop
'the shore front parcel and separate it from the intended farm
land, and then proceed to install and monument his roads to
specifications in that area and to file for the balance as Section
3, if and when he- is read:,- to develop it. They suggested that
- . possibly -the Town Board would adjust the fee'.. for this subdivision
if he wished to do it that way.
It is also the Planning Board' s thought that the road nearest
the water front should continue under its present mme and -serve
only that portion of the subdivision as shown on the water front
- section of the map and the second road should be the road which
connects with the proposed Soundview or Sound Road running along
parallel to the Sound bluff from Youngs Avenue to Orient:.Point
as suggested in proposal dated June 1, 1960.
On Monday: December 5th the Planning Board met with the Town
Board at the intersection of:Cox Neck Road, Sound Avenue and Middle
Road, Mattituck, to discuss zoning the intersection atea "B"
Business. Mr. Van Tuyl presented a map to the Board dated December 6,

1960 by Otto W. Van Tuyl. After considerable discussion relative
to the area to be zoned, on motion of Mr. Grebe. seconded by Mr.
Unkelbach and carried, it was
RESOLVED that the Planning Board recommend to the Town Board
that on the Town Board' s own motion, the following area be zoned
"B" Business District at the intersection of *Sound Avenue, Cox
Neck Road, and Middle Road: On the Bullock- property, north side
Middle Road, from -Cox Neck Road east to the easterly line of the
Long Island Lighting Company Easement, 300 ft. ind--pth. On the
property of Norris, north side Sound Avenue and west side Cox Neck
Road, the line will run north approximately 500 ft. on .Cox Neck
Road and approximately 400 ft. west on Sound Avenue, projected to
an intersection at -right angles to each street. On the south side
of- Sound Avenue the district will run along the southerly and east-
erly line of the Long Island Lighting' Company Easkement to the
westerly line of the Sacks property. The triangle bounded on the
north by Middle Road and south by Sound Avenue shall extend east
to the easterly side of the Long Island Lighting Company Easement
and substation. All of the aforementioned are shown on map prepared
by Mr. Otto W. Van Tuyl and set forth in a legal description of same.
Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. Grebe,
Mr. Young, and Mr. Unkelbach.
The Planning Board received the original petition of Procan
Inc. .and William J. Baxter,, from the Town Board with instructions
to prepare an official report defining the conditions described
in the petition. and determine the area so effected with the
recommendation of the Board. Procan, Inc., a domestic corporation
with office at 28 Park Avenue, Bay Shore and William JT Baxter,
residing at Nassau Point, join in a petition for a change of zone
from "A" Residential and Agricultural District to "B" Business
District on certain real property situated at Main Road, Mattituck,
New York, and more particularly bounded and described as follows:
All that plot, piece or parcel of land, with the buildings and
impoovements thereon, situate, lying and being in the Hamlet of
Mattituck,, in the Town of Southold,, County of Suffolk and State
of New York, bounded and described as follows: BEGINNING at a
monument set in the ground at the intersection of the northerly
:-line of Main Road, with the westerly line of Elijah's Lanes
running thence along the said northerly line of Main State Road
N.8.4°45140"W. 395.38 feet to a monument- set in the ground at an
.angle in said line of Main State Roadl thence mill along said

Applicants state they/to erectZ!, building to house a
multigraphing and mailing business, which Mr. Baxter now operates
at 73 Pearl Street-, New York,. New York. They plan to hire from
twenty to twenty-five persons and if the operation is successful
more people will undoubtedly be hired..
All of the members of the Planning Board are familiar with
this property, each having visited the site. After considerable
discussion, on motion of Mr. Grebe, seconded by Mr. Unkelbach,
and carried, it was
. RESOLVED that the Planning Board recommend to the. Town Board
this change of zone from "A" Residential and Agricultural District
to "B" Business District on the abovedescribed property,
The Planning Board is of the opinion that a project of this
type will greatly benefit the community* as it will provide jobs
for the local residents_ Fir then, it is felt that there is
sufficient area in the plot to warrant this change of zone.
It should be noted that this property was formerly a non-
conforming businessl the non conforming use expired by time
limitation.

a resolution relative to amendment of the Zoning Ordinance, with
instructions to prepare an official report thereon pursuant to
the provisions of Articb IX of the Building Zone Ordinance of the
T own of Southold:

I- By amending Article I, .Section 100 by adding thereto a
new paragraph, to be Paragraph 23B, to read as follows:
23B-*-*TOURIST CAMP--TAZy lot, piece or parcel of ground
where two or more tents, tent houses, ramp cottages,_ house
cars or- house trailers used as living or sleeping quarters
are or may be located, said camp being operated for or with-
out compensation.
II. By amending Article IIIA, Section 350,, by adding thereto
a new paragraph, to.be Paragraph 4A, to readas follows:
4A. . Tourist camps, when approved as a special exception
by the Board of Appeals as hereinafter provided.
After considerable discussion, on motion of Mr. Grebe, seconded
by Mr. Young* and carried it was
RESOLVED that the Planning Board recommend this amendment to
the Building Zone Ordinance..
The Planning Board feels that this would be the practical
manner in 'which trailer parks should be handled in the Town of
Southold.
Vote of the Board: Ayes: Mr. Wickham,, Mr. Moisa,, Mr.
Grebe# Mr. Young, and Mr. Unkelbach.
Mr., Grebe presented to the planning Board a letter from
Paul V. Daley,. Supervising Principal of Fishers Island Union Free
School, District No. 42 Fishers Islands stating that the Board of
Education requests that Faculty Housing Property owned. by the
School District at Fort Wright be zoned as residential property.
A map of the property by-Chandler & Palmera Engineers,, Norwich,
Connecticut dated February 1956 was enclosed.
On motion..of Mr.. Grebe,, seconded by Mr. Moisa and carded,
it was
RESOLVED that the Planning Board recommend that the Town
Board on its own motion place in the "A" Residential and Agri-
cultural District the Faculty Housing property owned by the School
District at Fort H. G. Wright, Fishers Island, New York.

The Board also instructed that a letter be forwarded to
Chandler & Palmer, Engineers, stating that the Planning Board
has maps in their files prepared by Chandler & Palmer,, and
requesting that they advise if one or more member of their
staff has New York State Professional Engineer licenses or
is their company licensed to do professional engineering in
the State of New York..
The Board discussed meeting with the Board of Assessors
in the near future to discuss problems of mutual concern. It '
was decided that they would forward a letter of invitation to
the Board of Assessors after the first of the new year.
The Board discussed the advisability of notifying real
estate agents,, lawyers and surveyors relative to procedure set
up by the Planning Board for requiring a filed map when subdivid-
ing .five or more lots,, and if there are four or less approval of
access should be secured from the Board of Appeals, Mr. Wickham
stated that he had spoken with the Town Attorney and was advised
that if an occasional lot is sold from a going farm concern that
this is not with the intent to subdivide and the approval of a
filed map should hot be required, however if it is obvious that
a n individual is breaking up a farm a map should be filed_ THe
Board members were to consider this matter of issuing information
sheets and will discuss it again at the next meeting
The next meeting of the Southold Town Planning Board will
be held 7:30 P.M. , Wednesday, December 14, 1960 at the Town
Clerk office, Main Road, Southold, New York.
