SOUTHOLD TOWN PLANNING BOARD
December 20, 1960
A regular meeting of the Southold Town Planning Board was.
held 7:30 P.M. , Tuesday, December 20-, 1960 at the Town Clerk
Office, Main Road, Southold, New York..
There were present; Messrs.. John Wickham, Chairman,. Henry
Moisa, Archibald Young, and William Unkelbach.
Absents Mr. Alfred Grebe {Mr.. Grebe' s absence was caused by

The Planning Board received notification from the Town Board
that the petition of Frank Pumillo for a change of zone from "A"
Residential and Agricultural District to "B" Business District
was granted effective as of December 17, 1960.
NotifJc atlon was also received that the petition of Williak
A. Davis for a change of zone from "A" Residential and Agricultural
District to "M" Multiple Residence District was granted effective
December, 17, 1960.
The Planning Board received a copy of a letter forwarded to
the Southold Town Board with reference to the petition-of-William,
Southold Town Planning Board -2r- December 20, 1960
J. Baxter and Procan, Inc. from William Wickham. Mr. Wickham
stated that his office is in the process of making another appli-
cation on behalf of Martin Filla for premises adjoining the Procan,
Inc.--Baxter parcel on the north and west and since it is not ready
for presentation to the Town Board he asked that the Town Board and
Planning Board withhold final. considerat ion until the new appli-
cation is received.
The Planning Board received a letter from the Town Board
enclosing a resolution relative to the proposed rezoning from
."A" Residential and Agricultural District to "B" Business
District the property in the vicinity of the intersection of
Sound Avenue, Middle Road, and Cox Neck Road at Mattituck and
requesting an official report from the Planning Board relative
to this change of zone.
On motion of Mr. Moisa, seconded by Mr. Young, and carried,
it was
RESOLVED that the Planning Board recommend to the Town Board
the change of zone from "A" Residential and agricultural District
to "B" Business District on certain property situated at Mattituck
and described as follows:
All those certain tracts or parcels of land, situate, lying
and being at Mattituck, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
PARCEL 1. Beginning at the intersection of the northerly
line .of Sound Avenue with the westerly line of Cox Neck Road
and running thence westerly along the northerly line of Sound
Avenue 450 feet; thence northerly at right angles to said line
of Sound Avenue 350 feet, more or lessf thence easterly at right
angles to said westerly line of Cox Neck Road 275 feet, more or
less, to said westerly line of Cox Neck Road; thence southerly
.along said westerly line of Cox Neck Road 500 feet to the point
of beginning. Containing about three and one-half acres.
PARCEL 2.' Beginning at a point on the easterly line of Cox
Neck Road 300 feet northerly from the northerly line of Middle
Road, measured at right angles to said line of Middle Road, and
running thence easterly parallel to said line of Middle Road, about
970 feet to. the easterly boundary line of land now or formerly of
Bullockf 'thence southerly along said line of Bullock about 323

feet to said northerly line of Middle Road; thence westerly along
said line of Middle Road about 950 feet to an angle in said Line;
: thence northwesterly along the northerly line of said Middle
Road about 50 feet to the easterly line of said Cox Neck Road;
thence northerly along said easterly line of Cox Neck Road
about 290 feet to the point of beginning. Containing about
Seven Acres.
PARCEL 3.. Beginning at a point on the southerly line of
Middle Road at the northeasterly cornier of land now or formerly
of Kousourous and running thence southerly along the easterly
boundary linIe of said land of Kousourous and then along the east--
erly boundary line of land of the Long Island Lighting Company,
about 425 feet to the northerly line of Sound Avenue.; thence
northwesterly along said northerly line of Sound Avenue about
900 feet to a points thence- northerly along the westerly line
of land of said Kousourous 57 feet to the southerly line of said
Middle Road; thence easterly along said southerly line of Middle
Road about 703 feet to the point of beginning. Containing about
four and one-quarter acres.
PARCEL 4. Beginning at a point on the southerly line of
Sound Avenue at the southeasterly line of the easement of the
Long Island Lighting Company; running thence along said south--
easterly line of the easement last described in a south westerly
direction about 440 feet; thence a long said line of said easement,
westerly about 880 feet to the westerly boundary line of land now
or formerly of Sacks; thence northerly along said westerly lineof
Sacks about 1170 feet to the southerly line of said Sound Avenue;
thence easterly and southeasterly along said line of Sound Avenue
about- 1700 feet to the point of beginning. Containing about
twenty--three acres..

The entire Planning Board has visited this property we have
discussed it thoroughly. We believe that although the total.
acreage is greater than we like to recommend, never the less
the acreage in individual ownership are reasonable and it seemed
advisable to extend the zone on the southside of the highway to
the Long Island Lighting Company easement because it has been
proposed that additional storages be erected on some of this
property extending to the south, It would seem to us that this
would be the most practical use of this land and, further., that
if Southold Town is to remain in the potato business it is
advisable that additional storage facilities, either public or

private be provided.
it should also be noted that the Lcn g Island Lighting Company
substation constitutes a non--conforming use and it should be
included in this "B" Business District as outlined in the map
dated December 6, 1960 by Otto W_ Van Tuyl. The pylko property
approximately opposte the substation on the south side of the road
is also a non,--conforming use to the extent that three families
occupy the house and the barn has been used as a carpenter shop
for a considerable period.

The Planning Board received a letter from Woodhollow Prop-
erties, Inc.. , George E. Buschmann, regarding Section Two of
Or iez t-By-The-•Sea. In the le tter it is stated that while they
intend filing the remaining property as Section Two they contemplate
renting the greater portion for farming. They will continue the
paving of Sound View Road from where it ends at Section ONe to
Ryder Farm Lane, along Ryder Farm Lane to Kings Farm Road, along
Kings Farm Road to Three Waters Lane connecting up with Section ONe_
They are now negotiating for the installation of this section of
road, in accordance with Town specifications, including six dry-
wells at a cost of $7, 100, 00 and the work will be completed before
plat of Section Two is filed. This will take care of giving access
to the public beach as previously discussed with the Board. It
is stated in the letter that the cost to install the remaining
roads and twelve drywells as shown on plat based on an estimate
will be approximately $19,800000. They would like to have the
approval of the Town Board to permit them to defer the installation
until a latex date and they can furnish a Performance Bond for
one year with any renewals of same. They will install all the
necessary road monuments and protect same so they are not abused
by the farming operations.
The Board wished a letter forwarded to Woodhollow acknowledging
their letter and stating that the Board is taking the matter of
Performance Bond up with the Town Board, Superintendent of Highways
and Town Counsel.
A letter was forwarded to the Town Counsel, requesting a sample
of a Performance Band, knowing if it is usual procedure to add a

certain percentage for possible rise in price of future con-
struction, if it is customary to have performance bonds for a
single year renewable annually thereafter for a longer period,
and any other suggestions on this matter he may have,
A letter was forwarded tolhe Southold Town Board calling
attention to WoodholloWs plans because the performance bond
must be handled by the Town of Southold, and stating that the
Planning Board is looking into the matter of footage of highway
to be constructed, the cost per foot, and the adequacy of the
amount..
A letter was forwarded to the Town of Huntington, Depart-
ment of Planning requesting that the Southold Town Planning
Board be supplied with information pertaining to their general
procedure in performance bond cases.
The Planning Board received a ,letter from the Town Board
transmitting the original petition of A. John Gada, Fishers
Island, requesting that the following described property be
placed in the "C" Industrial Districts A, John Gada, having
an interest in certain real property as contract vendee, situated
at Fishers Island, and more particularly bounded and described as
follows: Beginning at a brass plate on the Westerly side of the
roadway extending Northerly from Whistler Avenue, said point being
on the dividing line between the herein conveyed tract and land of
the United Stated Coast Guard known as the family quarters tract.
and thence running along the Westerly line of said roadway North
370 06 ' West 82.20 feet; thence along said road line North 160
141 West 80.11 feet; thence along said- road line North 10 29
East 125.3 feet; thence Northeasterly along said road line to
land of the United States Coast Guard known as the communications
antenna site; thence Northwesterly in a straight line to the shore
of Fishers Island Sound, abutting Northeasterly on said Coast Guard
land; thence in a general Southwesterly direction along said shore
line about 450 feet to the entrance of Silver Eel Cove; thence
along said Cove line in a Southeasterly, Northeasterly and South-
easterly direction about 700 feet to said land known as the family
quarters; thence North 540 East, about 125 feet to the point of
beginning. Containing 2.2 acres, more or less. plan of property
to be -conveyed by Race Point Corporation to A. John Gada, Fishers
Island, New York, dated, December 1960 by Chandler & Palmer Engineer.
In accordance With the Town Attorneys request to Mr. Gada,

he forwarded a letter to the Southold Town Board amdnding his
petition by changing paragraph two (2) thereof to read as follows:
"that by changing from quote A unquote residential and agricultural
district, the premises described in paragraph one (1) hereof".
The Board thoroughly discussed this petition. It was the
feeling that members of the Board should visit the site in the
near future, but since they are all familiar with it, motion: was
offered by Mr. Unkelbach, seconded by Mr. Young, and carried
RESOLVING that the Planning Board forward a recommendation
to the Town Board stating that the Planning Board would respect-
fully suggest that instead of changing the zone on this property
alone, that the Town Board on its own motion change to "C" Industrial
District all of this immediate area and, in addition, it would seem
logical to the Planning Board that the warehouse area west of the
Ferry District might well be changed to "B" Business District.
Vote of the Board.: Ayes: Mr. Wickham, Mr. Moisa, Mr-
You ng, and Mr. Unla lbach.
Mr. Howard Terry was requested to contact Chandler & Palmer,
Norwich, Connecticut, to determine if they have engineers status
in Ndw York State, and also if they have any maps of the Fort area
which would be useful to the Planning Board in determining areas to
be zoned.
Mr. Van Tuyl was requested to prepare a description of the
areas in question recommended by the Planning Board.
The minutes of the meeting of December 6, 1960, on motion of
Mr. Unkelbach, seconded by Mr. Young, and carried, were approved
as read.

Young, and Mr. Unkelbach_
The Board received the report of the Building Inspector on
the Anhual Zoning Convention held in Huntington on December 10,
1960-
The Secretary was instructed to prepard the Annual Report
of the Planning Board for submission to the Town Board.

The next meeting of the Southold Town Planning Board will be
held 7:30 P.M. , Tuesday, January 17, 1961 at the Town Clerk Offices
Main Roads Southold , New York.
