NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the

There was a discreptancy in the legal description as to the
distance from South Oakwood Road westerly to land of Burns. The
Legal description read 233.;271',, but the map showed no definite
distance,; it was calculated ;to be approximately 228.27t, Gary
Olsens. At a/c Martin Weglicki to resolve this difference
with van Tuyl,. land surveyor.

VICE-CHAIRMAN MOISA: Upon inspecting this file,, I find
everything in order,, I will now open this meeting to anyone
wishing to speak in opposition to -this subdivision.''
MR:' BARNEY SIDOR: According-to the description you reads,
the lots in the subdivision will have water rights to the .area
described as Parcel 1I1.1, is that correct?
MR MOISA: Yesi thatals right.
MR-01 SIDOR: Do the water rights apply to just .this parcel
or to others?
MR. MOISA: For the time being,; just this one.
MR-,' SIDOR: But it .could be extended?
MR.' MOISA: Yes.,
CHAIRMAN.i; WTI: The Planning Board requires the developer
to provide a specific amount of park and playground area for a
certain number of lots. If the developer creates another subdivision
additional park and playground area must be provided for it
MR. MOISA: This park and playground areai described as Parcel II,
covers only this particular subdivisioni described as Parcel I.
M S' SIDOR: He 'owns more land to the north,,' he. will develop
that and deed them beach rights too.
THE CHAIRMAN: if he develops additional land,, the 'Planning
Board will insist that he provide more park and playground area.
MRS; CARPENTER: How many lots' are there in this subdivision?•
MR., Mom: There are 26 lots.
The Chairman read the certification on map made by the engineer
stating that each lot contains at 3e ast 400000 sq. _ ft, of area,
MRS., CARPENTER: With this development and the existing one,`
is it possible that it will affect our- natural supply of water?
(The existing development referred to is "Laurel Country Estates")
THE CHAIRMAN: The County Board of Health says no. They
contend that with 40,000 sq, ft. of area per building lot there
is adequate provision for water and sewerage disposal. I am sure

that the Planning Board in this Town feels that this is a realistic
amount of area,, particularly when you get away from the shorefront.
MRS: CARPENTER: But these 2 new subdivisions will add 80
families to the area.
THE CHAIRMAN: Yes, but the lots have enough area �so as to be
self sufficient as to water and sewerage according to the Health
Dept,.
MR:' SIDOR: These two developments are just the beginning of
further development.
THE CHAIRMAN: Yes, but if they are developed 'in one acre
lots= the County Board of Health feels that there will be no
problems. This goes back to the findings .made .by our study
which were presented at our information meeting. There is
water enough in our Town to double our present poptilation 'and
continue agriculture. if agriculture goes out,*, it will provide
even more water for residential developme nt. .
M I HAMMEL: I think the beach is entirely inadequate in
regard to area. There is only 200 feet of shorefront for the
26 families in the subdivisions. plus he gave beach rightsto
Burns and Groch.lwski. They will be spilling over onto the
adjoining beaches, which are private.
THE CHAIRMAN: A property owners association could be
developed to prevent this.
MR-o HAMMEL: Why is there a connecting road to his
undeveloped. property to the north?
THE CHAIRMAN: The Planning Board insists on these connecting
- roads to provide ' for any future development.
MR HAMMEL: So .when he develops that property=, the people
in there will .come down. and use the beach too.
THE CHAIRMAN: How are you going -to stop them. This is .a
very real problem for anyone who owns beach near the highway.
if the walkway is narrow you have better protection.
MR ' HAMMEL: But they will try to force their way down with
an automobile.
THE CHAIRMAN: We advocate that a property owners association
be formed. This would be a way of stopping them.
MR HAMMEL: Yes, that='= true.

THE CHAIRMAN: If the walkway is narrowt; ,.they are in a better
position to protect their rights than if. they have a road. . 'In view
of the planning Board and protecting their raghtst -they'are in a.
fairly strong position because the 'Planning Board is prepared to
make sure that any further subdivisions don.1t have beach rights to
this particular beach. '
MR01 HAMMEL: How will you prevent other lot owners in: the
area from using it?
THE CHAIRMAN: when the lot .owners in "Laurel-wood Estates"
see it -coming -they could bring suit against them,; it would be a
dilution of their rights. They could take legal action.
MR:'. HAMMEL: Couldn't you specify on the map that these beach
rights are for these lots only?
THE CHAIRMAN: Yesi this cD uld be added on the map.
MR:' MOISA: Is there. anyone else present who wishes to speak;
in opposition to this subdivision?
ARTHUR GATEHOUSE: Yes.s. I wish to speak against this subdivision
plan.. Would the Planning Board consider placing a permanent restriction
on each lot stating that there will be no further subdivision allowed?
THE CHAIRMAN; This -is a case where the lots are roughly. .3001

deeps there is no possible way under existing Board of Health rules
to reduce -these lots any further. Alsos the Town Board has in their
plans for the immediate. futures, an amendment to the Zoning Ordinance
which will support the, Board of Health one acre zoning requirement. ,
MR.' GATEHOUSE: Why were % acre lots allowed?
THE CHAIRMAN: The County Board of Health will not allow
anything less than 1 acre unless they have both water and sewerage
disposal and the Town -Board is going to bring the Ordinance up to
date accordingly.
MR:' GATEHOUSE: What would prevent someone from buying :a lot
and dividing it further?
THE CHAIRMAN: The Board of Health would not give them a permit
for a well and cesspoolst' and the Building Inspector would not give
ahem a permit for construction.
MR' ' GATEHOUSE: Wells' it has been dones, I know several
instances.
THE CHAIRMAN: Not it has not.

MR � GATEHOUSE: Well,,, I want something placed on the map in
writing stating that under no circumstances may any of these lots
be further subdivided.
THE CHAIRMAN: Well.,,ji this could be done, . For example we .
could state that- none of the lots may be further subdivided under
any condition; with .the exception of the installation of public
water and sewerage, 'If at some future date public water and
sewerage should be installedi then the lots could be split as
provided for in the Zoning Ordinance in effect at that time,
GARY OLSENZ ES.Q.': I don't think such a restriction is necessary.
The covenants and restrictions to placed on file, in the County Clerk,"s
Office will cover this. If at any time anyone contemplated re--subdivid» .

THE CHAIRMAN: This property cannot be sold except by lot
numbers. If we heard that one of these lots has been divided
we would immediately notify the County Clerk that the map is in.

MR GATEHOUSE : Yesj but this may happen in five or ten years,:
and the original developer may not .be around.
THE CHAIRMAN: Now you are talking about second owners. In
the Town of Southolda� some of the gravest problems arise -because
of second and third owners,' and we have. a way of preventing them.
Under Common Law anyone has -the right to try to change things ar but
we have placed restrictions on second and third owners.
bM.11 GATEHOUSE: I am asking that a restriction be placed on
this for infinity,
THE CHAIRMAN: I suspect that somewhere the County Board of
Health rules state "one house per lot".
M .11GATEHOUSE: Well..; I am against this subdivision unless this
statement is put into the minutes of this meetings; or unless it is
written in on the map,
THE CHAIRMAN: This statement will be put into the minutes.'
GARY OLSEN'iESQ.: it seems to me that he is opposed to zoning
in the Town of Southold in general! l not only to this particular
subdivision.
MR ' 'GATEHOUSE: I want this on record tonight that it can be
only one acrglots.

MR.'- HAMMF.L: The lot on the corner now owned by Griffith does
not have 40t;000 sq. ft. of area.
THE CHAIRMAN: They received permission to set that lot off
before the County Board of Health regulation went into effect.
MR:. HAMMEL: Well.,,; now you say that each lot in this subdivision
contains 40i,1,000 sq, ft.- of area? Lot # 20 does not have 40.,.000 sq,
ft. of area.'
The Chairman checked the area of lot # 20 and found that it has
only 38,.'000 'sq, ft. of area.'
MR... GATEHOUSE: I would also like on record that only the people -
in ' this subdivision may. use the beach.
THE CHAIRMAN: We could possibly add a statement such as:
Park and playground restricted to .use by lot owners in "Laurelwood'
Estates" only.
MR-O HAMMEL: But he has already given beach rights to Burns and
Gorchowski.
THE CHAIRMAN: This is a trivial matter now. The fact that lot
# 20 does not have 40...000 sq. 'ft: of area puts a different light on
this hearing. We will not accept a map which certifies to something
which is not true. This map is void.
MR""GATEHOUSE: Also, I would like to ask if it Is the policy of
the Planning Board to accept dead--end roads without circular turn-
arounds? Woodside Lane has no turn around on -the end. Why?
THE CHAIRMAN: Woodside Lane is what we call a. connecting.. road
to provide for future possible development of the adjoining properties.
We don=t require turn arounds. on such roads.
MR:' GATEHOUSE: You stated that all subdivisions must contain
at least 400.000 sq, ft. of area per lot?
THE CHAIRMAN: Yes,. that's rights; unless they have public water
and sewerage,' With adequate provision for water and sewerage disposal
202.000 sq, ft, of area is acceptable.
MRS:1 CARPENTER: Does this apply to all subdivisions in the Town
of Southold?
THE CHAIRMAN: This applies to all subdivisions approved after
January 10 1970.

MR: GATEHOUSE: Will there .be adequate screening provided for
adjacent property owners on the beach?
THE CHAIRMAN: Ordinarily., 'no.
MR GATEHOUSE: I think the adjoining property owners are
entitled to screening.
MR: MOISA: It has never been requested prior to now. This is
something.wO. will have to look into.
MR , GATEHOUSE: The developer should be required to put up the
screening.., not the adjacent property owners. Also.t this right—of--way,
is now being used by out siders2 I hope it will not.' be construed as .a
public right-of--way.
MRS7 CARPENTER: Is there any ordinance against the construction..
of mobile homes on these lots?
THE CHAIRMAN: There is no Town ordinance against them. They
are allowed as long as they contain at least 850 sq, ft, of area,
which is the .minimum requirement for a house.
MR: MOISA: Is there anyone else present who wishes to speak
-in opposition to this subdivision?
(There' was no response.1)
MR:' MOISA: Is there anyone, else present who wishes to speak
in favor •of -this subdivision?

Mattituck7, appearing on behalf of, Martin Weglicki. The preliminary
and final; laywout has been approved by the Planning Board and the
County Board of Health,, I oppose any restrictions being placed on it.
MR:, MOISA: is there anyone else present wishing to speak
in regard to this subdivision?
(There was no response.)
THE CHAIRMAN: This hearing will be recessed until such time
as the map is amended or corrected because it is .in error and' it is
unacceptable.

of this subdivision. I would like to speak in favor of this subdivision.
With respect to the fact that the Planning Board..has approved the plans
up to dater and the County Board of Health has granted their approval...
I request .that final approval be granted to this. subdivision at this
time,
VICE-CHAIRMAN: Is there anyone else present who wishes to speak
in favor of this subdivision?

THE CHAIRMAN: I will offer a resolution that this subdivision
under question be granted final approval subject to receipt from the
Town Board of-acceptance of performance bond= which will be set- in an

appearing on behalf of Valentine Ruch. We request approval of this
subdivision map by this Board as approved by the County Board of
Health.
HENRY RAYNOR: It says here on the map .that ingress and egress for
lots 1m,2.D3.j'4� & 16 shall be restricted to the interior street system.
What will stop the owners of these lots from .cutting a driveway through
off CR 27?
HOWARD TERRY: The State Highway Dept, would not give them 'a permit.
THE CHAIRMAN: This subdivision has been discussed many times by
this Board and it now meets all of our requirements.. I will offer a
resolution that this subdivision map be approved as ..submitted with the
approval of the Health Dept.;a dated. September 25a, 1970. An officer of
this Board shall be empowered to sign the map upon receipt of notice
from the Town Board that they have accepted the bond.'

The Planning Board was presented with final maps for the
minor subdivision 'of Southold Development Corp.j� property located
at south side• of North Road to Bayviewt, Southoldi New York. . The
map showed 3 lots containing from 22.,800 to '23,,000 sq. ft.' ' of area
a 50 ft. right-of-way.., a reserved section at the westerly end of
the property*z , and a large parcel on the easterly end which was
labeled "Southold Development Corp. "t, being the area on which they
could not secure good water. The Chairman questioned the reserved
area on the westerly end of the property. Mr. Smith stated that it
was part of Oakwood Developments, he did not give them rights to itz,
but he told them he had property on which they could put a boat.

The Chairman asked Mr. Smith-ss permission to label this as "reserved
for boat moorings",, Mr. Smith agreed 'to this. The Chairman informed
Mr. Smith that the easterly section should have lot-numbers-'' the .
Planning' Board does not like to leave anything unlabeled.; they accept
the fact that someday it might be developed. Mr. Smith asked if it
could be developed if they ever run public water down there, The
Chairman told him that it could be developed if they ever got public
water and suggested that he draw lot lines on the map. . Mr. Smith
drew ,a line in the middle of this section and labeled the lots 4 & 5.

RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision map of Southold Develgpment
Corp., property located at south side of North Road to Bayview.�

Planning Board with final maps -for the -minor subdivision of Kodros
Spyropoulos & Nick Theophilos.' property located at east side of
Kenny's Roadr'. Southold.: New York. 'The map showed 5 lots containing
from 37. 810 to 39,;168 sq, ft.' of area. all lots fronting on Kenny's
Road with .107 to 109 ft.' of -frontage. This minor subdivision will
require no .roads as the property -fronts on Kenny"s Road., 'an existing
Town Highway*

RESOLVED that the Southold Town Planning Board grant final
approval to the minor subdivision of Kodros Spyropoulos & Nick
Theophilos, property located at east side of Kennys's Road.'

New York. Mr. Matthews stated that Mr. Guest doesn's`t want to sub-

Mr. Grebe said that he spoke with Mr. Guest who told him that Mr.
Russell does not plan to build another houses The Board informed
Mr. Matthews that they would approve this minor subdivision with
the understanding that no building permit shall be issued until
such time as the right-of-way meets the minimm requirements for
a Town Highway. Formal application and. fee yet to be submitted.

Richard Lark... Esq, appeared before the Planning Board in
reference to the subdivision "Bennett'-s Pond",, located off
Westphalia Road,:'Mattituck,- -New Yorks. owned and developed by
HR:� Reeve & Sons. The owners are in the process of building
the road to dedicate it to. the Town Board who says that they
will not accept the tree in the cul-de-sac at the south end
of. the road. Mr. Lark requested that the Planning Board send
a letter to the Town Board recommending their acceptance of
this road as presented& on the basis of the fact that the lay-
out has already been approved by the Supt. of Highways and
final approval was granted to this subdivision by the Planning
Board with the understanding that they leave as many trees as
possible.

Chairman John Wickham to send- a letter of transmittal to the
Town Board recommending their approval of the acceptance of
Bennett=s Pond Roadr; located at Mattituck.; New York.

Richard Lark., Esq, appeared before the Planning Board to
request an extension of time of the performance bond for the
subdivision "Sunset Knolls...: Section I"& located at Mattituck.
Mr. Lark informed the Board that the final application of oil
and the bluestone has not yet been applied. Mr. Corazzini
informed Mr. Sledjeski that he will not be able to complete
the .owrk until next spring. Therefore., Mr, Sledjeski is
requesting that the performance bond be extended until June
30z. 1971 to allow for the completion of the remaining work.
On motion by Mr. Raynor., seconded.by Mr. Moisa:l! it was
RESOLVED that the Southold Town Planning Board grant an
extension of the performance bond for the subdivision "Sunset
Knolls..: Section I" until June 30 1971. This bond is covered
by a passbook on file in the Supervisors Office.; not by a
bonding company contract.

Richard Lark.. Esq. informed the Planning Board that the
Health Dept, has granted approval to the proposed subdivisions
"Mattituck Hills" & &'Mattituck Ridge"$: subject to the installation
of a public water system. The next step is for them to obtain
the approval of the plans for the water system from the New York
State Water Resources Commission and the Conservation Dept,' If
this is not accomplished by the time .that the New Zoning Ordinance
is -put .into effect.. they will either have to provide for both a
water and sewerage system_ or increase the
one acre. The Board suggested that one or both of the developers
come before the Board and discuss plans for their water system. _
Richard Lark., Esq. presented the Planning Board with sketch
of proposed minor subdivision of John Scheel.; property located
at Bay Avenue. Cutchogue - New York. The sketch showed 4 lots
ranging in area from 120.,000 to 20..000 sqe ft. of area. The
Planning Board stated -that they will not accept a lot contain-
ing 120.,000 sq. ft. of areal, they suggested that the lot lines O
be re-arranged to increase the area of lots 1 & 3. Preliminary

meeting.
Richard Larkr Esq, brought up for discussion the proposed
division of property owned by George R. Clary property 'located
at north side of Sterling Road. west side of Horton RoadiJ and
south side of Lilac Lanei. Nassau Farmsi Cutchogue& New York.
Mr. Lark presented the Board with survey of the property and
stated that this is the only lot in the area which is owned
by Mr. Clary. Possible division lines for this lot were, discussed
by Mr. Lark and the Board. The Board advised him to have pre—
liminary maps made up and presented at the next meeting.
An informal discussion of the proposed change of zone
application of Gus Schadi; property located at north side of
Route 25,'i Greenporti. New York,, was held by .the Planning Boardi
Dick Lark,: and Gus Schad, Mr. Schad has finalized the district
boundary lines and is ready to, present the application to the
Town Board. The Planning Board informed him that the public
hearing required on the scenic easement can be held at the same time
the hearing is held for the change of zone.
The Planning Board was presented with final maps and formal
application for the minor subdivision of Theodore Dowd-i, property
located at S/S Soundview Avenue and E/S Lighthouse Roadp' Southoldi-
New York. The map was revised as previously requested by the
Planning Board. Arnold Larsen to present Board with 3rd copy of
final map and filing fee of $60.

RESOLVED that the Southold .Town Planning Board grant final
approval to the minor subdivision of Theodore Dowd i Southoldii, New
Yorks subject to receipt of 3rd copy of 'final map and filing fee
of $60.

Henry Raynor was opposed to the approval of this' minor subdivision.
