A regular meeting of' the- Southold Town Planning Board was
held at 7s 30' P Mo,r,, Wednesday, February 25:r; 1970r; at the Town
Officer Main Road,; Southold., New York.
There were present: Messrs: John Wickhama. Chairman; Henry
Moisa,r: Vice Chairman; Henry" Raynor..: Frank- Coyle.!, Alfred Grebe.

Howard Terry,,; Building inspector.
Mr. Dominic• Aurichio.r; Esq.,,,,! presented the Planning Board
with preliminary plan for' 'proposed subdivision- "Petty=',s Bight
Estates"..: located at" Orient!, owned by Irving & George Newman.
The map showed 33 lots : all containing ever' 20r,000sq, ft, of
area.., a total area .of approximately 18 to 19 acres of land.
The Chairman informed Mr. Aurichio of the County Board of
Health. requirement effective January 11, 1970,a, requiring

is installed. Mr. Aurichio stated that he, had plans for water
and sewerage and will take them to the' County' Board of Health
for their approval. The' Chairman advised Mr. Aurichio that the
first.- step is to present the' Board of Health with the plans for
water' and sewerage. The Board briefed him on 'the: cost of' install•
ation of water and sewerage. Mr. Aurichio stated that his clients
were aware of this. The' Chairman informed him that the operation
and management of it would be .very costly until. such time as' a
water and' sewerage district is formed in that area.
Lefferts' P. Edsona,r Esq.. and George Sfaelos. President of
Sfaelos' Realty,'Corp.& presented 'the, Board with preliminary.plan,
for' proposed subdivision of land located at north side of'Middle
Road ;.(CR27)d' Peconic:e,- N.Y." The map showed 15 lots ,. all contain
ing at least 20:a000sq, ft, of area. The, Chairman informed them
of the,, County'Board of Health requirement effective January I.*
1970.,,; requiring 40j,000sqq ft. of area per- -lot:; . -unless public
water- and sewerage is installed. Mr. Edson said that the map
was prepared in' September 1969 and was lost 'in the shuffle on
Van' Tuy18�s desk. Thee Chairman advised Mr. Edson to consult
the Board. of Health in reference to lot- size and water and
sewerage, Mr, Edson is to contact the Board of:-Health on this
matter and if necessary re-submit the application. _ Mr. Sfaelos
inquired about the• possibility .of obtaining` a "B"' zone on this
property. The Chairman informed him that :the' Master' Plan does
not call 'for "B"" zoning in that area.

Board with a revised preliminary map for proposed minor subdivision
. of property located at south side of Fanning Road., New' Suffolk, , N:-Y

Mattituck:*! N.,Y r: which was granted preliminary approval on' Nov.
17.i, 1969.,,: subject to the approval of the,Health Dept. of the
,.water situation, on lots 34144, & 5:*. Mr. Lark informed the, Board
of the, following: He, sent a letter to, the Health Dept, request-
ing approval: ' received reply stating that the -map does 'not comply
with their regulations. He then had test holes done which came
back with good results; The results of the test holes. were sent
to the .Health Dept..* they replied that they had no jurisdictions,
stating that minor subdivisions are under the Towns jurisdiction.
The Chairman stated that he would be, pleased to- see this parcel
as Residential:* as a previous application for' "b-2" business zone
was made� on 'this parcel and denied by the Town Board. Mr. Lark
presented .the Board with three (3) copies of final map and check
in the amount of' $50,00 for filing fee. Formal application has
been received.

N :Y. The Board informed Mr. Lark that this subdivision, 'is ready to
be set up for' 'final .hearing.' Frank & Nicholas'.Mandaro requested that
the, bond be,: reduced to $40'':000. They felt that the bond estimate .of
$67*000. was 'too high because .they are in tthe construction: business
and they plan to do' 'the work themselves. The, Chairman informed them
that 'the' Planning Board has� no power to reduce• _the bond:: they only
recommend' the, amount of'the bond .to the Town Board. There- was, some
discrepancy as to the amount of lineal feet , of highways in the pro-
posed subdivision. -The applicants measured. just under' 3. :0001f as
opposed tw Larry Tuthill't's estimate of 37001f, This matter to be

informed us that they are having a nitrate problems, as the test
holes were, taken in a "pocket".r this low land will have to be
pumped off' and cleared of nitrates to the point that a safe
reading can be obtained.

A lengthly discussion was held on this proposed change of zone.
This parcel- of land lies just west of Sterling Cemeteryj, on
the west side of Manhanset Avenue, The' Planning Board decided
that the Sterling Cemetery Association should be notified before
any recommendation is made on this proposed change of zone.
On motion by Mr. Coyle., seconded by Mr. Moisa.i, it was
RESOLVED that the Southold Town' Planning Board table recommendation
on the above proposed change of zone for further- deliberation of the
Board. This motion includes authorization for a ,letter to be sent to
the. Sterling Cemetery Association notifying them of this proposed change
of zone and requesting any recommendations or suggestions they may have.

The Board was presented with a revised map.r, sent down by
Alden Young, -for proposed subdivision "'Leeward Acres":a, located
at Bayviewr Southold,; N.Y. Larry Tuthill P7.2� inspected map
and stated that the drainage was inadequate. He feels there
should be more catch basins. Larry Tuthill to discuss this
subdivision with Alden Young' and come to an agreement on the
drainage: Also.a: the drainage on Mattituck Hills and Mattituck
Ridge must be resolved between Larry Tuthill and Alden Young.
In reference to proposed subdivision ofChet Orlowskir .
property located at west side of Harbor Laney Cutchoguer, N.Y
the, Chairman suggested that he have a preliminary map made up
with 40,�;000sq.ft. of area in the interior lots. The Chairman
feels that it' would be .unreasonable to look at the highway-
lots until we receive an application for the interior*-lots.
The Board was informed that Edwin H. King .has filed-. an-
application for approval of access ;(N.Y S Town' Lawt Sec.280A)
for hi s property located at south 'side of Route 25.EOrient .. N:Y:
An approval of access application must be filed for each house
built on a ,private road.

- over this matter", as the clbsest point to the Main' Road is: 800
feet. However,*. 'he Board eould •request an advisory opinion
from. the Suffolk' County' Planning Commission.

RESOLVED 'that the Southold Town Planning Board authorize
, Chairman John' Wickham 'to send to the' Suffolk County Board' of'
Health; a letter'.of transmittA;l with ' each of the subdivision
maps which the Board feels should receive special consideration
due to- the fact that the developer presented the application
and .had preliminary approval _prior to' :January 1i . '1970. Said

In reference to the number of lineal feet of highways
in the, proposed subdivision "Wheatfield Park",, located at
Griffing' Streetia. Cutchoguei,, N.'Y., : Larry Tuthill confirmed
his measurement of 3700 1f.
The Board was presented with a preliminary plan for proposed
minor subdivision of Henry John' Pavlak,, ,' property located at north
side of Grand Avenuez, Mattituckt: N.Y.; "The map showed 2 lots., the
easterly lot having frontage of -122.62ft, and an area of 24, 000
sq, ft,* the westerly lot having a" frontage of 105.5 fte and an
area of 14.,a,000sq. ft. The Board suggested that the frontage on
the easterly lot be .cut down to 100ft.,,,i, thereby''increasing the
-frontage and area of the westerly 'lots Map to 'be, revised.
Letter received from" Johri L. Crisonam,. Attorney a/c Laurel
Resources' Corp.,: requesting the Planning' Board to set forth
the- sections or subdivisions of the law which .they ar.e violating.
Letter to be sent to them informing them that they are in direct
violation of the first- section of the first page of the "Rules
and Regulations for the Subdivision of Land." .of the Town of
Southold" and :that copies of this are available at .the Town
Clerk:s Office for $1.00.

'instructs the Building Inspector not to issue any permits
on any of the, holdings of Dawn' Estates, , until they have ful-

The Board was reminded of the meeting of the Planning Boards
Board of Appeals, and' Town Board to be held at 730 PNl . ; March 10 ,
1970>a. at the Supervisors Office.&, Greenport,r, to discuss the amend-
ments to the' Zoning Ordinance.
The• Chairman reported on his meeting with the Town Board in
reference to the following: Dr. Joseph Sullivan of Southampton
. College- would like to make a study on Agriculture in the Town of
Southold. They are interested in what is happening to agriculture
on eastern- Long Island. He has made• a proposal. to the' Town to, do
the• study for $1m.000. and has submitted a possible questionaire.
The Chairman has sent the proposal and questionaire to" Cornell
University for any suggestions. that they might have. It• is. hoped
that- a proposal and questionaire can be devised that will meet
with the approval of the County.,.. Cornell University,e. and the
Town Board, The Southold-Peconic` Civic' Association has requested .
that another' study such as this be made.
Notice received from the, New York State Water Resources
Commission in regard to instructions for filing' Long Island
Well Applications was read and placed on file.

RESOLVED that the� Southold Town' Planning Board authorize
Chairman John Wickham to write a letter to the-,Riverhead Town
Board stating our objections to the proposed desulphurization
plant 'in Riverhead Town.
